1. gemäß R. 265.1 S. 1 und S. 2 VerfO die Rücknahme der Verletzungsklage zuzulassen;
2. gemäß R. 265.2 S. 1 lit. (a) VerfO durch Entscheidung das Verfahren für beendet zu erklären;
3. von einer Kostenentscheidung im Hinblick auf die Kosten der Vertretung (R. 152 VerfO) wegen des Vergleichs zwischen den Parteien abzusehen;
(b) (i) oder (c) (i), lit. (d) VerfO an die Klägerin zurückzuerstatten sind.
Die Beklagte beantragt,
1. gemäß R. 265.1 S. 1 und S. 2 VerfO die Rücknahme der Widerklage zuzulassen;
2. gemäß R. 265.2 S. 1 lit. (a) VerfO durch Entscheidung das Verfahren für beendet zu erklären;
3. von einer Kostenentscheidung im Hinblick auf die Kosten der Vertretung (R. 152 VerfO) wegen des Vergleichs zwischen den Parteien abzusehen;
(b) (i) oder (c) (i), lit.

DECISION-MAKING PANEL/CHAMBER:

JUDGES INVOLVED:
This order was issued by legally qualified judge Dr Thom, representing presiding judge Thomas, legally qualified judge Dr Schumacher as rapporteur and legally qualified judge Mlakar.

LANGUAGE OF THE PROCEEDINGS: German

SUBJECT: R. 265.1 sentence 2 RoP – Requests for withdrawal of the action and the counterclaim
R. 370.9, R. 370.11 RoP – Requests for reimbursement of court fees

BRIEF STATEMENT OF THE FACTS:
In a written submission dated 4 September 2024, the plaintiff filed a patent infringement action against the defendant. The counterclaim for annulment subsequently filed by the defendant is dated 16 December 2024.

Even before the conclusion of the written proceedings, the plaintiff and the defendant, each by written submission dated 14 July 2025, declared the withdrawal of the action and the counterclaim against the background of an out-of-court settlement.

The plaintiff requests
1. that the infringement action be allowed to be withdrawn pursuant to R. 265.1, sentences 1 and 2, RoP;
2. that the proceedings be declared closed by decision pursuant to R. 265.2, sentence 1(a), RoP;
3. to refrain from making a decision on costs with regard to the costs of representation (R. 152 RoP) due to the settlement between the parties;
4. to decide that unused court costs are to be reimbursed to the plaintiff in accordance with R. 370.9 lit. (b) (i) or (c) (i), lit. (d) RoP.

The defendant requests that
1. pursuant to R. 265.1, sentences 1 and 2, VerfO, the counterclaim be allowed to be withdrawn;

2. to declare the proceedings closed by decision pursuant to R. 265.2 sentence 1 (a) VerfO;
3. to refrain from making a decision on costs with regard to the costs of representation (R. 152 VerfO) due to the settlement between the parties;

4. to decide that unused court costs are to be reimbursed to the plaintiff in accordance with R. 370.9 lit. (b) (i) or (c) (i), lit. (d) RoP.

The parties have agreed to the withdrawal declared by the other party and to the respective request for partial reimbursement of court costs.
They have declared by mutual agreement that they have reached a final agreement on the bearing of the costs of the proceedings (costs of representation and court costs) in the settlement concluded.
No reimbursement of costs shall take place between them. A decision by the court on the costs is therefore not necessary.

REASONS FOR THE DECISION:

The decision follows the mutually agreed will of the parties.

Although Rule 265(2)(c) RoP requires a decision on costs in accordance with Part 1, Chapter 5 RoP, such a decision was dispensable in view of the parties' unanimous statement that no decision on costs was necessary (see UPC_CFI_505/2024, order of 24 January 2025, para. 13 – DexCom v. Abbott).
The order for the proportionate reimbursement of court costs is based on R. 370.9 (b) (i), 370.11 RoP.

DECISION:
1. The withdrawal of the action is granted at the request of the plaintiff and with the consent of the defendant.

2. The withdrawal of the counterclaim for annulment is granted at the request of the defendant and with the consent of the plaintiff.
3. The proceedings referred to in points 1 and 2 are declared closed.

4. This decision shall be entered in the register.
5. No decision on the costs of the parties is necessary.
6. The Registrar is instructed to reimburse the plaintiff as soon as possible 60% of the court fees paid by it in these proceedings in relation to the action, amounting to EUR 6,600.

7. The Registrar is ordered to reimburse the defendant as soon as possible 60% of the court fees paid by it in these proceedings in relation to the counterclaim for annulment, amounting to EUR 6,600.

8. The value in dispute for the action and the counterclaim for annulment is set at EUR 500,000 in each case.
