VORTRAG DER PARTEIEN:
Mit Schriftsatz vom 10.04.2025 haben die Beklagten beantragt, die Ausführungen der Klägerin zur Patentfähigkeit ausgewählter Hilfsanträge in ihrer Replik auf den Antrag auf Änderung des Patents vom 10. März 2025, dort in Abschnitt 15, gemäß Regel 9.2 VerfO unberücksichtigt zu lassen.
Die Beklagten meinen, dass dieser Vortrag nicht innerhalb der Frist für die Nichtigkeitswiderklage eingereicht worden sei. Vielmehr habe die Klägerin erstmalig in der Replik auf den Antrag auf Änderung des Patents zur angeblichen Rechtsbestandsfähigkeit der Hilfsanträge 19/19A und 22/22A vorgetragen, was nach Regel 30(b) VerfO aber bereits im Antrag auf Änderung des Patents hätte erfolgen müssen. Durch den Vortrag zur Patentfähigkeit der Hilfsanträge 19/19A und 22/22A in der Replik auf den Antrag auf Änderung des Patents habe sich die Klägerin entgegen Regel 32.3 VerfO auch nicht auf das in der Erwiderung auf den Antrag auf Änderung des Patents enthaltene Vorbringen beschränkt.
Die Beklagten beantragen,
alle Verfahrensschritte, Fakten, Beweismittel oder Argumente, die durch die Klägerin in ihrer Duplik auf die Widerklage auf Nichtigerklärung des Patents und Replik auf den Antrag auf Änderung des Patents vom 10. März 2025 beigebracht wurden und die nicht auf den Vortrag aus der Erwiderung auf den Antrag auf Änderung des Patents erwidern, nämlich den Abschnitt 15 Ausführungen zur Patentfähigkeit ausgewählter Hilfsanträge, unberücksichtigt zu lassen.
Die Klägerin beantragt,
den Antrag der Widerklägerinnen auf Zurückweisung von Vortrag zurückzuweisen.
Sie macht geltend, mit dem Antrag auf Änderung des Patents vom 07.11.2024 habe sie die Hilfsanträge 1/1A bis 33/33A vorgelegt und die Erfordernisse der R. 30.1 VerfO in diesem Zusammenhang unter Rz. 246 ff erläutert. Sie meint, dasselbe treffe auf die Hilfsanträge 14/14A bis 33/33A zu. Denn unter Rz. 376 des Änderungsantrags sei neben den eingereichten Anspruchsfassungen eine Tabelle zu finden, anhand welcher die Merkmalskombination des

jeweiligen Hilfsantrags nachvollzogen werden könne. Beispielsweise sei daraus ersichtlich, dass der Hilfsantrag 19/19A die Merkmalskombination der Hilfsanträge 4, 7 und 8 und der Hilfsantrag 22/22A die Merkmalskombination der Hilfsanträge 4, 5, 12 und 13 beinhalteten. Folglich kombinierten diese Hilfsanträge lediglich die Merkmale der zuvor genannten Hilfsanträge. Unter Rz. 377 sei ausgeführt worden, dass für diese Hilfsanträge das zuvor Gesagte ebenfalls gelte und auf die Ausführungen zu den vorhergehenden Hilfsanträgen somit für die Anträge 14/14A – 33/33A verwiesen worden sei.
GRÜNDE DER ANORDNUNG:
Der nach Regel 9.1. und 9.2 VerfO zulässige Antrag der Beklagten vom 10.04.2025 auf Zurückweisung von Vortrag in Bezug auf die Ausführungen unter Ziffer 15. der klägerischen Replik vom 10.03.2025 ist unbegründet.

Eine Klagepartei hat nach Regel 29 (a) VerfO innerhalb von zwei Monaten nach Zustellung einer Klageerwiderung, die eine Widerklage auf Nichtigerklärung enthält, eine Erwiderung auf die Widerklage auf Nichtigerklärung zusammen mit einer Replik auf die Klageerwiderung und gegebenenfalls einem Antrag auf Änderung des Patents gemäß Regel 30 einzureichen. Auch muss, wenn die Erwiderung auf die Widerklage auf Nichtigerklärung einen Antrag des Patentinhabers auf Änderung des Patents enthält, nach Regel 30.1 (b) VerfO eine Erläuterung enthalten, warum die Änderungen den Anforderungen der Artikel 84 und 123 Absätze 2 und 3 EPÜ genügen und warum die vorgeschlagenen geänderten Patentansprüche gültig und gegebenenfalls verletzt sind.

Entgegen der Ansicht der Beklagten war die Klägerin jedoch mit ihrer Erwiderung auf die Widerklage und Antrag auf Änderung des Patents vom 07.11.2024 diesen Anforderungen gerecht geworden, weshalb die ergänzenden Erläuterungen in der klägerischen Replik vom 10.03.2025 nicht als verspätet zurückzuweisen sind. Es handelt sich bei den Hilfsanträgen 19/19A und 22/22A daher nicht um neue Hilfsanträge, die nach Regel 30.2 VerfO der Zulassung durch das Gericht bedürften.
a)
Die Klägerin hatte unter Randnummer 246 ff. ihrer Erwiderung auf die Widerklage zu den Zulässigkeitsvoraussetzungen der Hilfsanträge Ausführungen gemacht und erklärt, dass diese Anträge rein vorsorglich gestellt werden würden. Sie hat die Hilfsanträge 1/1A bis 33/33A eingeführt. Zwar hat sie keine spezifischen Ausführungen zu den Hilfsanträgen 19/19A und 22/22A gemacht. Allerdings hatte sie in Randnummer 376 klargestellt, dass die Hilfsanträge 14/14A bis 33/33A jeweils Merkmale der bereits besprochenen Hilfsanträge kombinieren würden. Sie hat eine Tabelle mit einer entsprechenden Übersicht eingeblendet und ausgeführt, dass diese Hilfsanträge die Voraussetzungen von R. 30.1 VerfO erfüllen würden und für diese Hilfsanträge ebenso das zuvor Gesagte gelte. Damit ist den Beklagten hinreichend vor Augen geführt, dass die Hilfsanträge HA19/19A aus einer Kombination der Hilfsanträge 15/15A + 8/8A, mithin aus den Hilfsanträgen 4/4A mit 7/7a und 8/8A bestehen sollten. Ausführungen zu diesen Hilfsanträgen waren wiederum in der Erwiderung auf die Widerklage gemacht (vgl. zu den Hilfsanträgen 4/4A mit 7/7a und 8/8A in Rn. 274 ff., 303ff. und 321ff.); dasselbe gilt für die Hilfsanträge 22/22A, die auf einer Kombination der Hilfsanträge 4/4A, 5/5A, 12/12A und 13/13A beruhen sollen. Eine solche Bezugnahme genügt grundsätzlich den Anforderungen der Regel 30.1. (b) VerfO.

b)
Zwar enthält die Duplik der Klägerin vom 10.03.2025 weitere, ergänzende Ausführungen zur Patentfähigkeit der Hilfsanträge 19/19A. Da die Hilfsanträge 4/4A mit 7/7a und 8/8A, die in Kombination den Hilfsantrag 19/19A ergeben sollen, nach Vortrag der Klägerin auf Offenbarungsstellen in der Patentschrift beruhen sollen, erweist es sich als nicht zu beanstanden, dass erst mit der Duplik ergänzende Ausführungen dazu, welche technische Aufgabe zu lösen sei und dass zwischen den Merkmalen dieses Hilfsantrags eine Wechselwirkung vorliege, gemacht worden sind. Denn die Aufgabe, eine gestapelte Anordnung und dünnere Ausgestaltung zu realisieren, findet sich bereits in den Ausführungen zu den zu kombinierenden Hilfsanträgen.
Die Möglichkeit, den bereits geleisteten eigenen Vortrag in Abhängigkeit der Erwiderung der Gegenseite weiter zu vertiefen, erkennt die Verfahrensordnung in Regel 32.3 VerfO aus gutem Grund an, weil die Verteidigung der Gegenseite auf die unterbreiteten Hilfsanträge bei Einreichung der hilfsweisen Änderungsanträge ebenfalls nicht in Gänze vorhersehbar ist (vgl. allgemein CoA, 18.09.2024 - UPC_CoA_265/2024, APL_30169/2024, Ls. 2). Der Grundsatz der Verfahrensökonomie erlaubt den Parteien – und gebietet es sogar zuweilen – insoweit Wiederholungen zu vermeiden und eine Bezugnahme auf bereits angestellte Erwägungen zu anderen Hilfsanträgen vorzunehmen, die kombiniert werden sollen, jedenfalls wenn und soweit diese, wie hier, eine hinreichende inhaltliche Tiefe aufweisen. Solange diese Voraussetzungen erfüllt sind, handelt es nicht um neue Hilfsanträge, die nach Regel 30.2 VerfO der Zulassung durch das Gericht bedürften.
c)
Entsprechendes gilt in Bezug auf die Hilfsanträge 22/22A.

Da bereits ausreichender Vortrag zu den Hilfsanträgen 19/19A und 22/22A in der Erwiderung auf die Widerklage enthalten waren, liegt auch kein Verstoß gegen R. 30 (b) und R. 32.2 VerfO vor. Lediglich vertiefender Vortrag auf die Verteidigung der Beklagten durch die Klägerin in der Replik ist nicht verspätet.

Ob diese Hilfsanträge in der Sache die Anforderungen der Regel 30.1. (b) VerfO erfüllen und ob es auf diese Hilfsanträge überhaupt ankommt, bleibt der Entscheidung des Spruchkörpers anlässlich der mündlichen Verhandlung vorbehalten. Wie bereits in der Anordnung vom 30.12.2024 (App_62431/2024) ausgeführt, ist die Entscheidung darüber, ob die Änderungsanträge (insgesamt) den Anforderungen an Regel 30.1 lit. (b) VerfO genügen, eine Sachfrage, die der Berichterstatter dem Panel und zwar der Endentscheidung überlässt. Auf diese Sachfrage kommt es dabei im Rahmen der Endentscheidung ersichtlich nur dann an, wenn der Spruchkörper die Angriffe der Nichtigkeitswiderklage auf das Klagepatent ganz oder teilweise für erfolgreich ansieht.
ANORDNUNG:
Der Antrag der Beklagten vom 10.04.2025 auf Zurückweisung von Vortrag in Bezug auf die Ausführungen unter Ziffer 15. der klägerischen Replik vom 10.03.2025 wird zurückgewiesen.

STATEMENTS OF THE PARTIES
In their written statement of 10 April 2025, the defendants requested that the plaintiff's comments on the patentability of selected auxiliary requests in its reply to the request for amendment of the patent dated 10 March 2025, in section 15 thereof, be disregarded pursuant to Rule 9.2 of the Rules of Procedure.
The defendants argue that this submission was not filed within the time limit for the counterclaim for annulment. Rather, the plaintiff first argued the alleged legal validity of auxiliary requests 19/19A and 22/22A in its reply to the request for amendment of the patent, which, according to Rule 30(b) VerfO, should have been done in the request for amendment of the patent. By arguing the patentability of auxiliary requests 19/19A and 22/22A in its reply to the request for amendment of the patent, the plaintiff also failed to limit itself to the arguments contained in its response to the request for amendment of the patent, contrary to Rule 32.3 of the Rules of Procedure.
The defendants request that
all procedural steps, facts, evidence or arguments submitted by the plaintiff in its rejoinder to the counterclaim for annulment of the patent and reply to the request for amendment of the patent dated 10 March 2025 which do not respond to the submissions in the response to the request for amendment of the patent namely section 15, comments on the patentability of selected auxiliary requests, be disregarded.
The plaintiff requests that
the counterclaimants' request for dismissal of the submission be rejected.
It asserts that, with the application for amendment of the patent dated 7 November 2024, it submitted auxiliary requests 1/1A to 33/33A and explained the requirements of Rule 30.1 VerfO in this context in paragraphs 246 et seq. It considers that the same applies to auxiliary requests 14/14A to 33/33A. This is because, under marginal number 376 of the request for amendment, a table can be found alongside the submitted versions of the claims, which allows the combination of features of the

can be traced. For example, it can be seen that auxiliary request 19/19A contains the combination of features of auxiliary requests 4, 7 and 8, and auxiliary request 22/22A contains the combination of features of auxiliary requests 4, 5, 12 and 13. Consequently, these auxiliary requests merely combined the features of the aforementioned auxiliary requests. In paragraph 377, it was stated that the above also applied to these auxiliary requests and reference was therefore made to the comments on the previous auxiliary requests for requests 14/14A – 33/33A.
REASONS FOR THE ORDER:
The defendant's application of 10 April 2025, which is admissible under Rules 9.1 and 9.2 of the Rules of Procedure, for the rejection of the submissions relating to the statements in point 15 of the plaintiff's reply of 10 March 2025 is unfounded.

Under Rule 29(a) of the Rules of Procedure, a party to an action must, within two months of service of a statement of defence containing a counterclaim for revocation, file a reply to the counterclaim for revocation together with a rejoinder to the statement of defence and, where appropriate, a request for amendment of the patent in accordance with Rule 30. Furthermore, if the response to the counterclaim for revocation contains a request by the patent proprietor to amend the patent, it must, pursuant to Rule 30.1(b) of the Rules of Procedure, contain an explanation of why the amendments satisfy the requirements of Articles 84 and 123(2) and (3) EPC and why the proposed amended patent claims are valid and, where applicable, infringed.

Contrary to the defendant's view, however, the plaintiff had satisfied these requirements in its response to the counterclaim and request for amendment of the patent dated 7 November 2024, which is why the supplementary explanations in the plaintiff's reply dated 10 March 2025 cannot be rejected as late. The auxiliary requests 19/19A and 22/22A are therefore not new auxiliary requests which would require the court's approval pursuant to Rule 30.2 VerfO.
a)
In paragraph 246 et seq. of its response to the counterclaim, the plaintiff had commented on the admissibility requirements for the alternative claims and stated that these claims were being made purely as a precautionary measure. It introduced alternative claims 1/1A to 33/33A. It did not make any specific comments on auxiliary claims 19/19A and 22/22A. However, it had clarified in marginal number 376 that the alternative claims 14/14A to 33/33A would each combine features of the alternative claims already discussed. It inserted a table with a corresponding overview and stated that these alternative claims would fulfil the requirements of R. 30.1 VerfO and that the above statements would also apply to these alternative claims. This sufficiently demonstrates to the defendants that the auxiliary claims HA19/19A should consist of a combination of the auxiliary claims 15/15A + 8/8A, i.e. of the auxiliary claims 4/4A with 7/7a and 8/8A. Comments on these auxiliary claims were again made in the response to the counterclaim (see auxiliary claims 4/4A with 7/7a and 8/8A in para. 274 et seq., 303 et seq. and 321 et seq.); the same applies to auxiliary requests 22/22A, which are to be based on a combination of auxiliary requests 4/4A, 5/5A, 12/12A and 13/13A. Such a reference generally satisfies the requirements of Rule 30.1(b) of the Rules of Procedure.

b)
The plaintiff's rejoinder of 10 March 2025 does contain further, supplementary statements on the patentability of auxiliary requests 19/19A. However, since auxiliary requests 4/4A with 7/7a and 8/8A, which in combination are supposed to result in auxiliary request 19/19A, are based on disclosure passages in the patent specification according to the plaintiff's submission, it is not objectionable that supplementary statements on the technical problem to be solved and on the interaction between the features of this auxiliary request were only made in the rejoinder. This is because the task of realising a stacked arrangement and a thinner design is already found in the statements on the auxiliary requests to be combined.
The possibility of further elaborating on one's own submissions in response to the other party's reply is recognised by the Rules of Procedure in Rule 32.3 VerfO for good reason, because the other party's defence against the auxiliary requests submitted when the auxiliary amendments were filed is also not entirely foreseeable (see CoA, 18 September 2024 – UPC_CoA_265/2024, APL_30169/2024, para. 2). The principle of procedural economy allows the parties – and sometimes even requires them – to avoid repetition in this respect and to refer to considerations already made in relation to other auxiliary requests that are to be combined, at least if and to the extent that these, as in the present case, are sufficiently detailed. As long as these requirements are met, these are not new auxiliary claims that would require approval by the court pursuant to Rule 30.2 VerfO.
c)
The same applies to auxiliary claims 22/22A.

Since sufficient arguments on auxiliary claims 19/19A and 22/22A were already contained in the response to the counterclaim, there is also no violation of R. 30 (b) and R. 32.2 VerfO. Only the plaintiff's more detailed arguments in support of the defendant's defence in the reply are not late.

Whether these alternative claims satisfy the requirements of Rule 30.1(b) VerfO on the merits and whether these alternative claims are even relevant is reserved for the decision of the panel at the oral hearing. As already stated in the order of 30 December 2024 (App_62431/2024), the decision as to whether the amendments (as a whole) satisfy the requirements of Rule 30.1(b) VerfO is a question of fact which the rapporteur leaves to the panel and, in particular, to the final decision. This question of fact is clearly only relevant in the final decision if the panel considers the counterclaim for annulment of the patent to be wholly or partially successful.
ORDER:
The defendant's application of 10 April 2025 for dismissal of the submissions relating to the statements in point 15 of the plaintiff's reply of 10 March 2025 is dismissed.
