DARSTELLUNG UND ANTRAG
1. Am 24. Februar 2025 legte ILME Berufung gegen der Anordnung der Lokalkammer München vom
10. Februar 2025 (beanstandete Anordnung, ORD_68781/2024) ein, mit dem der von ILME gemäß
R. 19 VerfO eingereichte Einspruch zurückgewiesen wurde.
2. Die Berufung wurde Phoenix am 18. März 2025 zugestellt.
3. Am 26. März 2025 beantragte Phoenix, ihr eine Fristverlängerung von drei Wochen für die Einreichung
seiner Berufungserwiderung zu gewähren, wobei zur Begründung unter anderem auf die Anzahl und
Komplexität der in der Berufungsbegründung vorgebrachten Argumente sowie auf die Vielzahl der
anderen Fälle verwiesen wurde, mit denen sich der Vertreter von Phoenix parallel zu dieser Berufung
befassen muss.
4. Am 27. März 2025 reichte ILME eine Stellungnahme ein und beantragte, den von Phoenix
eingereichten Antrag abzulehnen.
GRÜNDE DER VERFAHRENSANORDNUNG
5. Gemäß R. 235.2 VerfO ist die Erwiderung innerhalb von 15 Tagen nach Zustellung der
Berufungsbegründung gemäß R. 224.2 (b) VerfO einzureichen.
6. Das Gericht kann auf einen mit einer Begründung versehenen Antrag einer Partei eine in der VerfO
genannte Frist verlängern (R. 9.3 VerfO, vorbehaltlich des Absatzes 4).
7. Dabei hat das Gericht die im EPGÜ und in der Verfahrensordnung festgelegten Grundsätze,
einschließlich ihrer Präambel, sowie die Sachlage des jeweiligen Falls zu berücksichtigen. Während es
die Verfahrensordnung flexibel und ausgewogen anwendet, soll es das Verfahren so effizient und
kostensparend wie möglich gestalten (VerfO, Präambel Abs. 4).
8. Im vorliegenden Fall hatten die Berufungskläger nach der Zustellung der beanstandeten Anordnung
zwar nicht mehr als zwei Wochen Zeit, um ihre Berufungsbegründung vorzubereiten und einzureichen,
doch ist das Gericht nicht davon überzeugt, dass dem Berufungsbeklagten eine Fristverlängerung von
drei Wochen gewährt werden sollte, die Phoenix eine erhebliche zusätzliche Zeit für die Vorbereitung
seiner Berufungserwiderung einräumen würde, was im Widerspruch zum Grundsatz der
Waffengleichheit stünde.

9. Im vorliegenden Fall ist es zudem im Hinblick auf das in erster Instanz anhängige Hauptsacheverfahren
geboten, dass die in diesem Antrag aufgeworfene Frage der Kompetenz des Einheitlichen
Patentgerichts bald entschieden wird.
10. Phoenix kann daher nur eine Fristverlängerung von drei (3) Tagen für die Einreichung seiner
Berufungserwiderung zum 7. April 2025 gewährt werden.

STATEMENT AND REQUEST
1. On 24 February 2025, ILME lodged an appeal against the order of the Local Chamber Munich of
10 February 2025 (order under appeal, ORD_68781/2024), dismissing the opposition filed by ILME pursuant to
R. 19 VerfO.
2. The appeal was served on Phoenix on 18 March 2025.
3. On 26 March 2025, Phoenix requested that it be granted an extension of three weeks for the submission of
its response to the appeal, citing, among other things, the number and
complexity of the arguments put forward in the appeal statement and the large number of
other cases with which Phoenix's representative has to deal in parallel with this appeal.
4. On 27 March 2025, ILME submitted a statement of case and requested that the request submitted by Phoenix be rejected
.
REASONS FOR THE ORDER
5. Pursuant to Rule 235.2 of the Rules of Procedure, the reply must be filed within 15 days of service of the
appeal statement of grounds pursuant to Rule 224.2(b) of the Rules of Procedure.
6. The Court may, upon a reasoned request by a party, extend the time limit specified in the Rules of Procedure
(R. 9.3 VerfO, subject to paragraph 4).
7. In doing so, the Court must take into account the principles laid down in the EPGÜ and in the Rules of Procedure,
including their preamble, as well as the facts of the case. While applying the Rules of Procedure flexibly and in a balanced manner, it should make the proceedings as efficient and
cost-effective as possible (Rules of Procedure, preamble, paragraph 4).
8. In the present case, although the appellants did not have more than two weeks after service of the contested order
to prepare and submit their grounds of appeal,
the Court is not convinced that granting the respondent an extension of
three weeks, which would give Phoenix considerable additional time to prepare
its response to the appeal, which would be contrary to the principle of
equality of arms.

9. In the present case, it is also necessary, in view of the main proceedings pending at first instance,
that the question raised in this application concerning the competence of the Unified
is decided soon.
10. Phoenix can therefore only be granted an extension of three (3) days for the submission of its
appeal response by 7 April 2025.
ORDER
Phoenix is granted an extension until 7 April 2025 for the submission of its
appeal response.
