GEGENSTAND: Art. 60 EPGÜ, R. 194 (d), 196, 197, 199 VerfO – Antrag auf Inspektion und Beweissi-cherung
ZUSAMMENFASSUNG DES SACHVERHALTS:
Am 25. März 2025 hat die Antragstellerin im Vorfeld einer Hauptsacheklage einen Antrag auf An-ordnung einer Inspektion und Beweissicherung auf Messeständen der Antragsgegnerinnen ge-stellt.
Die Antragstellerin ist alleinige Inhaberin des Europäischen Patents 2 983 864 B1 (Anlage HRM 2; nachfolgend Antragspatent), das am 26. März 2014 unter Inanspruchnahme der Priorität zweier deutscher Patentanmeldungen (DE 102013006010 sowie DE 102013016053) vom 9. April 2013 bzw. vom 27. September 2013 in deutscher Verfahrenssprache angemeldet wurde. Die Veröffent-lichung der Erteilung des Antragspatents erfolgte am 26. April 2017. Das Antragspatent ist aktuell in Österreich, Belgien, der Schweiz und Liechtenstein, der Tschechischen Republik, Deutschland, Spanien, Frankreich, Großbritannien, Irland, Italien, Luxemburg, Polen und der Türkei in Kraft. Der zunächst erklärte Opt-Out wurde mit Antrag vom 24. März 2025 zurückgenommen (App_14363/2025).
Gegen die Erteilung des Antragspatents wurde kein Einspruch eingelegt. Ferner ist nach Ablauf der Einspruchsfrist kein Nichtigkeitsverfahren angestrengt worden.
Das Antragspatent trägt die Bezeichnung „Verfahren und Vorrichtung zur Oberflächenbehandlung von Werkstücken“. Sein Patentanspruch 1 ist wie folgt formuliert:
„Verfahren zur Oberflächenbearbeitung von Werkstücken, indem das Werkstück relativ zu einer Schüttung aus einem Schleif- und/oder Poliergranulat bewegt wird, wobei das Werk-stück in Bezug auf die Schüttung aus dem Schleif- und/oder Poliergranulat um zumindest eine Achse rotiert (P4) wird, wobei das Werkstück in Bezug auf die Schüttung aus dem Schleif- und/oder Poliergranulat auf verschiedene Rotationsgeschwindigkeiten (R1, R2) be-schleunigt wird, dadurch gekennzeichnet, dass das Werkstück und/oder ein die Schüttung aus dem Schleif- und/oder Poliergranulat aufnehmender Behälter (11) unter fortwährender Beschleunigung mit fortwährend unterschiedlichen Rotationsgeschwindigkeiten rotiert wird bzw. werden.“
Die Antragsgegnerin zu 1) entwickelt, fertigt und vertreibt Maschinen und Technologien für das Gleitschleifen und Elektropolieren. Ihr Leistungsspektrum umfasst das präzise Glätten, Polieren, Verrunden und Entgraten von Werkstücken.
Bei der Antragsgegnerin zu 1) handelt es sich um die Muttergesellschaft der GPAINNOVA-Gruppe. Die Antragsgegnerin zu 2) ist eine Fachhändlerin und Kundin der Antragsgegnerin zu 1), die unter anderem die Produkte der Antragsgegnerin zu 1) anbietet und verkauft.

Zum Produktportfolio der Antragsgegnerin zu 1) gehören Elektropoliermaschinen für verschiedene Anwendungsbereiche, unter anderem für den Dentalmarkt. Sie bietet diese Maschinen auf ihrer Internetseite https://www.dlyte.com/de/produkte/ unter anderem auch in Deutschland an. Zu den von der Antragsgegnerin zu 1) unter der Marke „DLyte“ für den Dentalmarkt angebotenen Produkten gehören unter anderem die Produkte „DLyte 1D“, DLyte 10D“ und „DLyte 100D“, wobei diese Produkte alle zur „Compact Series“ der Antragsgegnerin zu 1) gehören. Die Antragsgegnerin zu 2) bietet diese Maschinen ebenfalls auf ihrer Internetseite an. Hinsichtlich des Inhalts dieser Internetseiten wird auf die Anlagen HRM 7 bis HRM 9 Bezug genommen.
Derzeit stellen die Antragsgegnerinnen auf der Messe „Interdentalschau 2025“ (nachfolgend: IDS 2025) aus, die vom 25. März 2025 bis zum 29. März 2025 in Köln stattfindet.
Die Antragstellerin trägt vor, alle vorgenannten Produkte der „Compact Series“ würden derzeit auf der Messe „IDS 2025“ ausgestellt. Der Antragstellerin sei es kaum möglich, Zugang zu diesen Ma-schinen zu erhalten. Zum einen seien die Preise zwischen 30.000,- EUR und 50.000,- EUR zu hoch, um sie nur wegen eines Tests zu erwerben. Zum anderen handele es sich um ein personalisiertes Geschäft. In der Branche der Parteien würden Maschinen nur über „bekannte“ Vertriebswege, ein exklusives Händlernetz, verkauft. Pro Land gebe es meist nur einen und in größeren Ländern zwei feste Wiederverkäufer von Maschinen der Antragsgegnerin zu 1). Die Wiederverkäufer hätten eine sehr enge Beziehung zum jeweiligen Hersteller der Maschinen, so dass die Antragstellerin nicht beliefert werden würde. Ein anonymer Kauf der in Rede stehenden Maschinen sei auch deshalb nicht möglich, weil die Käufer dieser Maschinen wegen der enormen finanziellen Belastung durch einen Kauf sicherstellen wollen, dass die Maschinen den erwünschten Mehrwert in ihrem Geschäft mit sich bringen. Normalerweise finde eine Probebearbeitung in den Räumlichkeiten des Herstel-lers statt oder die Kunden würden zunächst eine Testmaschine erhalten. Durch die Testphase er-hielten der Testkäufer oder seine exklusiven Wiederverkäufer einen engen Kontakt. Es würde da-her auffallen, wenn dieser enge Kontakt im Einzelfall fehlen würde, wenn etwa die Antragstellerin die Maschine nur zu Testzwecken erwerben möchte. Es würde vermutlich der Verkauf gestoppt werden.
Zugang zu Maschinen der Antragsgegnerinnen zu Testzwecken erhalte die Antragstellerin nur in Einzelfällen über unzufriedene Kunden. Eine vollständige Verifizierung der in Rede stehenden Ver-letzungshandlungen sei so nicht möglich. Unter anderem habe die Antragstellerin die „DLyte 10D“ zu Testzwecken von einer gemeinsamen Kundin gebraucht erworben. Dies sei jedoch zufällig und zu dem Zeitpunkt noch nicht mit Blick auf das Antragspatent erfolgt. Darüber hinaus sei es der Antragstellerin gelungen, die „DLyte 100D“ bei einer gemeinsamen Kundin in der Türkei zu unter-suchen, wobei offen sei, ob die in der Türkei vorgefundene Maschine mit entsprechenden Maschi-nen, die in den EPG-Vertragsstaaten vertrieben würden, identisch sei. Die Untersuchungen hätten unter anderem ergeben, dass die „DLyte 10D“ und die in der Türkei aufgefundene „DLyte 100D“ - wenn sie den in den EPG-Vertragsstaaten identisch ausgestaltet wäre, das Antragspatent verletze. Hinsichtlich der Untersuchungsergebnisse im Einzelnen wird auf die Anlage HRM 14 verwiesen.
Die Bemühungen der Antragstellerin, auch das dritte Mitglied der „Compact Series“, die „DLyte 1D“, zu untersuchen, sei indes erfolglos geblieben. Das Gleiche gelte für eine Untersuchung der „DLyte 100D“ in einer in den EPG-Vertragsmitgliedsstaaten vertriebenen Version. Informationen auf der Internetseite sowie Produktvideos der Antragsgegnerseite würden nahelegen, dass die „DLyte 1D“ und die „DLyte 100D“, soweit für die Verletzung des Antragspatents relevant, baugleich zur „DLyte 10D“ seien.

Am 25. März 2025 habe einer der rechtlichen Vertreter der Antragstellerin die „DLyte 1D“ und die „DLyte 100D“ am Ausstellungsstand der Antragsgegnerin zu 1) äußerlich in Augenschein nehmen können. Die Inaugenscheinnahme habe die Vermutung bestätigt, dass die „DLyte 1D“ und die „DLyte 100D“ baugleich zur „DLyte 10D“ seien, soweit dies für die Verletzung des Antragspatents relevant sei. Zudem hätten die „DLyte 1D“ und die „DLyte 100D“ geleuchtet und seien eingeschal-tet gewesen. Schließlich sei auf dem Stand der Antragsgegnerin zu 2) eine „DLyte“-Maschine aus-gestellt gewesen, die vermutlich aus der „Compact Series“ stamme. Ergänzend wird auf die als Anlagen HRM 16 bis HRM 17 vorgelegten Fotografien sowie auf eine eidesstattliche Versicherung Bezug genommen.
ANTRÄGE DER ANTRAGSTELLERIN:
I. Der Antragstellerin zu gewähren:
1. eine sich in einem funktionsfähigen Zustand befindliche DLyte 1D und DLyte 100D vor Ort auf der Messe IDS, die vom 25. bis einschließlich 29. März 2025 in Köln Messe, Messeplatz 1, 50679 Köln, Deutschland stattfindet, am Messestand der Antragsgegnerin zu 1), durch einen Sachverständigen und einen Gerichtsvollzie-her zu inspizieren, insbesondere
a. die DLyte 1D und die DLyte 100D in Betrieb zu nehmen, wobei der Antrags-gegnerin aufgegeben wird, etwa erforderlich Passwörter einzugeben,
b. zum Zwecke und für die Dauer der Messungen des Bewegungsablaufs und der Rotationsgeschwindigkeit des Werkstückhalters der DLyte 1D bzw. der DLyte 100D, ein Smartphone am Werkstückhalter zu befestigen,
c. geeignete Einstellungen an der Maschine vorzunehmen, um Verfälschun-gen des Messergebnisses zu vermeiden, insbesondere die Deaktivierung der Vibrationseinheit des Behälters,
d. ein Programm an der DLyte 1D bzw. der DLyte 100D auszuwählen und ein-zuschalten, das den Werkstückhalter zum Zwecke der Messung in Bewe-gung setzt,
e. sofern von der DLyte 1D bzw. der DLyte 100D vorgesehen, ein Programm selbst zu konfigurieren und einzuschalten, das den Werkstückhalter zum wecke der Messung in Bewegung setzt,
f. die Messung während des Betriebs der DLyte 1D bzw. der DLyte 100D durchzuführen,
g. den Messvorgang so häufig zu wiederholen, bis eine hinreichende Messung der Rotationsgeschwindigkeit und des Bewegungsablaufs des Werkstücks-halters der DLyte 1D bzw. der DLyte 100D erfolgte,
2. oder eine vergleichsweise Messmethode anzuwenden;
3. hilfsweise, im Falle einer Unmöglichkeit von Antrag I.1 und I.2.

a. in Bezug auf die DLyte 1D, die beantragten Maßnahmen nach Antrag Ziff.
I. 1 und I. 2 während der IDS, die vom 25. bis einschließlich 29. März 2025
in Köln Messe, Messeplatz 1, 50679 Köln, Deutschland stattfindet, auf dem
Messestand der Antragsgegnerin zu 2) zu gewähren,
b. und in Bezug auf die DLyte 100D, eine DLyte 100D und alle technischen,
werblichen und kommerziellen Unterlagen in jeweils einer Kopie in Bezug
auf die DLyte 100D während der IDS, die vom 25. bis einschließlich 29. März
2025 in Köln Messe, Messeplatz 1, 50679 Köln, Deutschland stattfindet,
durch einen Gerichtsvollzieher physisch zu beschlagnahmen oder die DLyte
100D an jedem anderen Ort in Deutschland physisch zu beschlagnahmen;
c. eine ausführliche Beschreibung der der DLyte 100D zu erstellen, die eine
detaillierte Beschreibung der Merkmale der DLyte 100D sowie der relevan-ten
technischen, werblichen und kommerziellen Dokumentation über die
DLyte 100D, an allen unter Ziff. I.1. genannten Orten;
4. äußerst hilfsweise, im Falle einer Unmöglichkeit von Antrag I.1., I.2. und I.3. je
eine DLyte 1D und 100D und alle technischen, werblichen und kommerziellen
Unterlagen in jeweils einer Kopie in Bezug auf die DLyte 1D und die DLyte 100D
während der IDS, die vom 25. bis einschließlich 29. März 2025 in Köln Messe,
Messeplatz 1, 50679 Köln, Deutschland stattfindet, durch einen Gerichtsvollzie-her
physisch zu beschlagnahmen oder die DLyte 1D und die DLyte 100D an jedem
anderen Ort in Deutschland physisch zu beschlagnahmen;
5. eine ausführliche Beschreibung der DLyte 1D und der DLyte 100D zu erstellen,
die eine detaillierte Beschreibung der Merkmale der DLyte 1D und die DLyte
100D sowie der relevanten technischen, werblichen und kommerziellen Doku-mentation
über die DLyte 1D und die DLyte 100D, an allen unter Ziff. I.1. genann-ten
Orten;
II. Herrn Patentanwalt Stephan Freischem, Salierring 47-53, 50677 Köln, als Sachverstän-digen
zu benennen und zu bestimmen, dass er durch einen europäischen Patentanwalt
ersetzt werden kann, der in derselben Kanzlei wie Stephan Freischem arbeitet;
III. der Gerichtsvollzieherin Frau Köln, zu ge-statten,
dass sie bei der Durchführung der Beweissicherungsmaßnahmen gemäß dem
in dieser Sache zu erlassenden Beschluss von dem Sachverständigen unterstützt wer-den
kann, und zu bestimmen, dass sie im Fall ihrer Nichtverfügbarkeit, durch jeden
anderen zuständigen Sachverständigen ersetzt werden kann;
IV. dass Herr Rechtsanwalt Joscha Torweihe, EPG Vertreter und in dieser Sache benannter
rechtlicher Vertreter der Antragstellerin von der Kanzlei Hoyng ROKH Monegier, Stein-straße
20, 40212 Düsseldorf, bei den nach Ziff. I beantragten Maßnahmen anwesend
sein darf, oder ein anderer Rechtsanwalt der Kanzlei Hoyng ROKH Monegier, falls Herr
Torweihe nicht verfügbar sein sollte;

V. dass Herr Patentanwalt Steffen Lenz, EPG Vertreter und in dieser Sache mitwirkender Patentanwalt der Patentanwaltskanzlei Lichti, Bergwaldstraße 1, 76227 Karlsruhe, bei den nach Ziff. I beantragten Maßnahmen anwesend sein darf, oder ein anderer Patent-anwalt der Patentanwaltskanzlei Lichti, falls Herr Lenz nicht verfügbar sein sollte;
VI. anzuordnen, dass die Angestellten und Geschäftsführer der Antragsgegnerin nicht bei der Vollstreckung des in dieser Sache zu erteilenden Beschlusses anwesend sein dürfen und dass der Gerichtsvollzieher nicht berechtigt ist, hiervon gemäß dem anwendbaren nationalen Recht eine Ausnahme zu machen;
VII. anzuordnen, dass die an der Durchführung der Maßnahmen zur Beweissicherung ge-mäß der zu erlassenden Anordnung beteiligten Personen, wie der Gerichtsvollzieher, der Sachverständige und/oder der Parteivertreter, der Antragsgegnerin oder Dritten keine Informationen über diese Maßnahmen erteilen dürfen und keine Gelegenheit bieten dürfen, Einblick in die DLyte 1D und die DLyte 100D oder die jeweiligen detail-lierten Berichte zu gewähren oder diese zu prüfen, es sei denn, die Antragsgegnerin stimmt zu oder auf der Grundlage einer weiteren Anordnung des EPG;
VIII. die Antragsgegnerinnen zu verpflichten, bei der Durchführung der Maßnahmen zur In-spektion und Beweissicherung gemäß dem in dieser Angelegenheit zu erlassenden Be-schluss mitzuwirken und dem Gerichtsvollzieher und dem Sachverständigen auf deren Anforderung hin,
- uneingeschränkten Zugang zur DLyte 1D und zur DLyte 100D zu gewähren, ein-schließlich der Eingabe von Passwörtern,
- Zugang zu einem Teil der DLyte 1D und der DLyte 100D zu gewähren, und/oder
- die DLyte 1D und die DLyte 100D in Betrieb zu setzen und in verschiedenen Be-triebszustände zu bringen;
IX. die Antragsgegnerinnen zu verpflichten, ihre Geschäftsführer und Mitarbeiter anzu-weisen, den Aufforderungen des Gerichtsvollziehers und/oder des Sachverständigen entsprechend Ziff. VII. nachzukommen;
X. ein Zwangsgeld in Höhe von EUR 2.500 Euro pro 15-minütigem Zeitraum, der zwischen der Aufforderung des Gerichtsvollziehers oder des Sachverständigen Zugang zur In-spektion gemäß Ziff. I zu gewähren, und der tatsächlichen Gewährung des angeforder-ten Zugangs verstreicht, festzusetzen;
XI. anzuordnen, dass der Gerichtsvollzieher der Antragsgegnerinnen eine Kopie des in die-ser Angelegenheit zu erlassenden Beschlusses zusammen mit einer Kopie des Antrags vorlegen muss, zumindest einem Vertreter der Antragsgegnerinnen, der an dem Ort anwesend ist, an dem die jeweiligen Maßnahmen durchgeführt werden;
XII. anzuordnen, dass die auf diese Weise zu erlassende Anordnung sofort vollstreckbar ist;
XIII. anzuordnen, dass die auf diese Weise zu erlassende Anordnung an allen Tagen und zu allen Stunden vollstreckbar ist;

XIV. anzuordnen, dass die Zustellung durch den Gerichtsvollzieher im Zusammenwirken mit Herrn Rechtsanwalt Joscha Torweihe, wie unter Ziff. IV., erfolgt, oder einem anderen Rechtsanwalt der Kanzlei Hoyng ROKH Monegier, falls Herr Torweihe nicht verfügbar sein sollte;
XV. alle Kostenentscheidungen vorerst auszusetzen.
GRÜNDE DER ANORDNUNG:
Der Antrag auf Anordnung einer Inspektion und Beweissicherung (R. 192, 199 VerfO) hat im teno-rierten Umfang Erfolg.
I. Die Lokalkammer Düsseldorf ist gemäß Art. 32 (1) c), 33 (1) b), 60 EPGÜ zuständig. Der Antrag ist gemäß R. 192 VerfO in zulässiger Art und Weise gestellt worden. Insbesondere hat die Antragstel-lerin vorgetragen, dass sie beabsichtigt, gegen die Antragsgegnerinnen bei der Lokalkammer Düs-seldorf Hauptsacheklage zu erheben.
II. Ferner hat die Antragstellerin glaubhaft dargelegt, dass das Antragspatent durch die Antragsgeg-nerinnen möglicherweise verletzt wird (Art. 60 (1) EPGÜ).
Angesichts der geschilderten Umstände des Falles ist es möglich, dass die Produkte „DLyte 1D“ und „DLyte 100D“, wie sie auf der IDS in Köln ausgestellt sind, von der technischen Lehre des Antrags-patents Gebrauch machen.
Die als Inhaberin des Antragspatents aktivlegitimierte Antragstellerin hat anhand einer Produkt-broschüre (Anlage HRM 21), einem auf Youtube abrufbaren Produktvideo, der Beschreibung der Produkte der Dental Series (Anlage HRM 23) sowie auf der Grundlage der Untersuchung der Com-pact-Serien-Schwester „DLyte 10D“ (Anlage HRM 14) nachvollziehbar dargelegt, weshalb sie von einer Verwirklichung sämtlicher Merkmale des Antragspatents bei dem Produkt „DLyte 1D“ aus-geht.
Darüber hinaus hat sie das Modell „DLyte 100D“ bereits bei einer ihrer Kundinnen in der Türkei analysiert und als Anlage HRM 14 einen entsprechenden Untersuchungsbericht vorgelegt. Auf der Grundlage dieser Analyse hat die Antragstellerin nachvollziehbar dargelegt, weshalb sie auch bei dieser Ausführungsform von einer Verwirklichung der durch das Antragspatent unter Schutz ge-stellten technischen Lehre ausgeht.
III. Die Antragstellerin hat ferner dargelegt, dass der Antrag dringlich ist (R. 194.2 a) VerfO). Zudem hat sie Gründe für den Erlass einer Anordnung ex parte aufgezeigt (R. 194. 2 b), c), 197 VerfO).
1. Die Inspektion bzw. Beweissicherungsmaßnahme ist dringlich.
a)
Dass das auf der Messe „IDS 2025“ in Köln ausgestellten Produkt „DLyte 1D“ möglicherweise von

der technischen Lehre von Patentanspruch 1 des Antragspatents Gebrauch macht, hat die Antrag-stellerin nachvollziehbar dargelegt. Jedoch kann eine hinreichende Substantiierung nur über eine Untersuchung des auf der vorgenannten Messe ausgestellten Produktes erfolgen, im Rahmen de-rer Messungen über Bewegungsabläufe der Maschine und insbesondere zur Rotationsgeschwin-digkeit und zum Beschleunigungsverhalten durchgeführt werden. Maschinen wie die „DLyte 1D“ sind nach dem Vortrag der Antragstellerin nicht leicht erhältlich und Unternehmen, die solche Ma-schinen gekauft haben und benutzen, sind im Allgemeinen nicht bereit, „Unternehmensfremden“ (Patentinhabern) Zugang zu ihren Räumlichkeiten oder Maschinen zu gewähren. Die Messe „IDS 2025“ bietet der Antragstellerin daher Gelegenheit, Beweise für die durch sie vermutete Verlet-zung des Antragspatents zu sammeln.
In Bezug auf das Produkt „DLyte 100D“ hat die Antragstellerin bereits eine Maschine bei einer ihrer Kundinnen in der Türkei untersucht. Auf der Grundlage dieses Untersuchungsberichts hat sie nach-vollziehbar dargelegt, weshalb sie davon ausgeht, dass auch diese Ausführungsform von der tech-nischen Lehre von Patentanspruch 1 Gebrauch macht. Da die Antragstellerin jedoch eine Patent-verletzung innerhalb der Vertragsmitgliedsstaaten des EPG nachweisen muss, kann ihr eine Unter-suchung des auf der Messe „IDS 2025“ ausgestellten Produktes Gewissheit darüber verschaffen, ob dieses mit dem in der Türkei untersuchten Produktes in den für eine mögliche Verletzung des Antragspatents relevanten Merkmalen übereinstimmt. Wie die Antragstellerin nachvollziehbar er-läutert hat, bleibt ihr durch die extrem schwierige Möglichkeit der Beschaffung solcher Maschinen aufgrund der fehlenden Verfügbarkeit der Maschinen auf dem freien Markt keine andere Option als die Inspektion auf der Messe „IDS 2025“ in Köln durchzuführen.
b) Die Anordnung war nach R. 192.3, 197 VerfO ex-parte zu erlassen. Andernfalls bestünde die nach-weisliche Gefahr, dass Beweismittel vernichtet oder aus anderen Gründen nicht mehr verfügbar sein werden (R. 197.1 Alt. 2 VerfO).
Wie die Antragstellerin nachvollziehbar erläutert hat, besteht die ernsthafte Gefahr, dass die „DLyte 1D“ und die „DLyte 100D“ kurzfristig vom Ausstellungsgelände entfernt oder mittels eines Software-Updates einzelne, von der Antragsgegnerin zu 1) vorprogrammierte Polierprozesse de-aktiviert werden. Dadurch können Beweise, anhand derer ggf. die Verletzung bestätigt werden könnte, verloren gehen. Für die Antragstellerin wäre es aufgrund der bereits im Einzelnen geschil-deten besonderen Marktverhältnisse nahezu unmöglich, Beweise für die aus ihrer Sicht gegebene Verletzung des Antragspatents durch die vorgenannten Produkte zu beschaffen.
IV. Im Rahmen der Ermessensentscheidung überwiegen die Interessen der Antragstellerin.
Die Antragstellerin hat anhand der ihr bisher zur Verfügung stehenden Informationen nachvoll-ziehbar dargelegt, weshalb sie von einer Verwirklichung sämtlicher Merkmale von Patentanspruch 1 des Antragspatents bei den auf der Messe „IDS 2025“ in Köln ausgestellten Produkten ausgeht. Auch hat sie nachvollziehbar erläutert, aus welchen Gründen ihr aufgrund der gegebenen beson-deren Verhältnisse im relevanten Markt keine anderen Möglichkeiten offenstehen, Beweise für die aus ihrer Sicht vorliegende Verletzung des Antragspatents durch die Produkte „DLyte 1D“ und die „DLyte 100D“ zu sammeln, weshalb sie zur Beweissicherung auf eine Untersuchung der auf der Messe „IDS 2025“ ausgestellten Produkte angewiesen ist.

Vor diesem Hintergrund bedarf es der vorliegenden Anordnung, um den insoweit überwiegenden Interessen der Patentinhaberin gerecht zu werden. Die Antragsgegnerinnen werden durch die an-geordneten Maßnahmen nicht unzumutbar belastet. Ihren Geheimhaltungsinteressen tragen die in die Anordnung aufgenommenen Geheimnisschutzanordnungen hinreichend Rechnung.
V. Die Antragstellerin hat die Gerichtsgebühr für den Antrag auf Inspektion/Beweissicherung entrich-tet, R. 192.5 VerfO.
VI. Die Anordnung sieht nach R. 196.4, .5 VerfO vor, dass ein Sachverständiger bestellt wird, der die Maßnahmen ausführt. Zur Unterstützung des Sachverständigen bei der Durchführung der Beweis-sicherung hat die Kammer von der durch R. 196.5 S. 2 VerfO eingeräumten Möglichkeit Gebrauch gemacht, die Unterstützung durch einen Gerichtsvollzieher anzuordnen. Dessen Hinzuziehung war insbesondere für die hilfsweise beantragte dingliche Beschlagnahme notwendig, die nach dem na-tionalen Recht in die Zuständigkeit der Gerichtsvollzieher fällt (UPC_CFI_539/2024 (LK Düsseldorf), Anordnung v. 18.10.2024 – Bekaert Binjiang Steel v. Siltronic).
Nach R. 196.5 VerfO waren Mitglieder oder Vertreter der Antragstellerin selbst von der Inspektion und Beweissicherung auszuschließen. Im Hinblick auf die Verhältnismäßigkeit und den Schutz ver-traulicher Informationen war auch die Personenanzahl der Prozessbevollmächtigten bei der In-spektion zu beschränken (Art. 60 (1) EPGÜ, R. 196.1 VerfO). Die ferner gegenüber den Prozessbe-vollmächtigten, dem Sachverständigen und dem Gerichtsvollzieher angeordneten Geheimnis-schutzmaßnahmen tragen den Geheimhaltungsinteressen der Antragsgegnerinnen ebenso wie das geschilderte Prozedere nach Erhalt der ausführlichen Beschreibung Rechnung.
Ferner war anzuordnen, dass die durch den Sachverständigen zu erstellende ausführliche Beschrei-bung nur in einem Hauptsacheverfahren gegen die Antragsgegnerinnen verwendet werden darf (R. 196.2 VerfO).
Die Kosten der durch den Sachverständigen durchzuführenden Inspektion und Beweissicherung einschließlich der durch den Sachverständigen zu erstellenden ausführlichen Beschreibung hat die Antragstellerin jedenfalls bis auf Weiteres zu zahlen, da sie die Inspektion begehrt. Soweit der Sachverständige nicht auf die Zahlung eines Vorschusses für seine Kosten verzichtet, hat die An-tragstellerin an den Sachverständigen vor Beginn der Inspektion eine durch diesen zu bestimmen-den, angemessenen Vorschuss zu zahlen.
Diese Anordnung ist zusammen mit den in Ziffer XVI. genannten Schriftstücken durch den Gerichts-vollzieher im Zusammenwirken mit dem gemäß Ziffer IX.1 an der Inspektion und Beweissicherung anwesenden rechtsanwaltlichen Vertreter der Antragstellerin gemäß R. 197.2 VerfO zuzustellen.
VII.
Die in die Anordnung aufgenommene allgemeine Androhung von Zwangsmitteln gibt der Kammer die notwendige Flexibilität, um auf eventuelle Verstöße gegen diese Anordnung unter Berücksich-tigung der Interessen beider Parteien sowie der Schwere des Verstoßes reagieren zu können.
Im konkreten Fall konnte von der Anordnung einer Sicherheitsleistung abgesehen werden. Die da-für bei einer ex-parte Anordnung notwendigen besonderen Umstände (R. 196.6 VerfO) liegen vor. Anders als bei einer Unterlassungsanordnung droht den Antragsgegnerinnen durch die Inspektion

und Beweissicherung allenfalls ein geringfügiger Schaden. Sie sind auch weiterhin zum Angebot und Vertrieb der zu untersuchenden Produkte berechtigt (Abgrenzung zu: UPC_CFI_177/2023 (LK Düsseldorf), Anordnung v. 22.06.2023 – myStromer v. Revolt). Davon ausgehend und unter Be-rücksichtigung der kurzen Dauer der Messe würde die Anordnung einer Sicherheitsleistung die Be-weissicherung und Inspektion unangemessen verzögern, was es rechtfertigt, vorliegend von der Anordnung einer Sicherheitsleistung abzusehen.
VIII.
Soweit die Antragstellerin hilfsweise die Gestattung einer Beschlagnahme der zu untersuchenden Produkte „an jedem anderen Ort“ begehrt hat, konnte dem weder unter Bestimmtheits- noch un-ter Verhältnismäßigkeitsgesichtspunkten entsprochen werden. Diese Aspekte stehen auch einer Gestattung der Vollstreckbarkeit dieser Anordnung an „allen Tagen und Stunden“ entgegen. Die Beschreibung der zulässigen Maßnahmen in der Anordnung trägt ebenfalls dem Bestimmtheitsge-bot Rechnung.
Gründe für einen Ausschluss von Vertretern und Mitarbeitern der Antragsgegnerinnen von der Teilnahme an der Inspektion sind nicht ersichtlich. Einem solchen, durch die Antragstellerin be-gehrten Ausschluss steht bereits entgegen, dass die Mitarbeiter und Geschäftsführer der Antrags-gegnerinnen, dem Begehren der Antragstellerin folgend, den Aufforderungen des Gerichtsvollzie-hers und/oder des Sachverständigen zu folgen haben.

ANORDNUNG:
Es wird ohne vorherige Anhörung der Antragsgegnerinnen folgende Inspektions- und Beweissiche-rungsanordnung erlassen:
I. Der Antragstellerin wird gestattet, eine sich in einem funktionsfähigen Zustand befind-liche „DLyte 1D“ und „DLyte 100D“ vor Ort auf der Messe IDS, die vom 25. bis ein-schließlich 29. März 2025 in Köln Messe, Messeplatz 1, 50679 Köln, Deutschland statt-findet, am Messestand der Antragsgegnerin zu 1) durch einen Sachverständigen und einen Gerichtsvollzieher zu inspizieren und dabei
1. die „DLyte 1D“ und die „DLyte 100D“ in Betrieb zu nehmen, wobei der Antrags-gegnerin aufgegeben wird, etwa erforderlich Passwörter einzugeben;
2. zum Zwecke und für die Dauer der Messungen des Bewegungsablaufs und der Rotationsgeschwindigkeit des Werkstückhalters der „DLyte 1D“ bzw. der „DLyte 100D“, ein Smartphone am Werkstückhalter zu befestigen;
3. geeignete Einstellungen an der Maschine vorzunehmen, um Verfälschungen des Messergebnisses zu vermeiden, insbesondere die Deaktivierung der Vibrations-einheit des Behälters;
4. ein Programm an der „DLyte 1D“ bzw. der „DLyte 100D“ auszuwählen und einzu-schalten, das den Werkstückhalter zum Zwecke der Messung in Bewegung setzt;
5. sofern von der „DLyte 1D“ bzw. der „DLyte 100D“ vorgesehen, ein Programm selbst zu konfigurieren und einzuschalten, das den Werkstückhalter zum Zwecke der Messung in Bewegung setzt;
6. die Messung während des Betriebs der „DLyte 1D“ bzw. der „DLyte 100D“ durch-zuführen;
7. den Messvorgang so häufig zu wiederholen, bis eine hinreichende Messung der Rotationsgeschwindigkeit und des Bewegungsablaufs des Werkstückshalters der „DLyte 1D“ bzw. der „DLyte 100D“ erfolgte.
II. Sollte eine Inspektion vor Ort gemäß Ziffer I. nicht möglich sein, wird der Antragstelle-rin gestattet,
1. in Bezug auf die „DLyte 1D“, die unter Ziff. I.1. beschriebenen Maßnahmen wäh-rend der IDS, die vom 25. bis einschließlich 29. März 2025 in Köln Messe, Messe-platz 1, 50679 Köln, Deutschland stattfindet, auf dem Messestand der Antrags-gegnerin zu 2) durchzuführen
und
2. in Bezug auf die „DLyte 100D“ eine Solche und alle technischen, werblichen und kommerziellen Unterlagen in jeweils einer Kopie in Bezug auf die „DLyte 100D“ während der IDS, die vom 25. bis einschließlich 29. März 2025 in Köln

Messe, Messeplatz 1, 50679 Köln, Deutschland stattfindet, durch einen Gerichts-vollzieher
physisch zu beschlagnahmen und sodann durch einen Sachverständi-gen
wie in Ziffer I. beschrieben inspizieren zu lassen.
III. Sollte die unter Ziffern I. und II.1. genannte Inspektion nicht möglich sein, wird
der Antragstellerin äußerst hilfsweise gestattet, zusätzlich zu der Beschlagnahme
der „DLyte 100D“ gemäß Ziffer II.1. auch eine „DLyte 1D“ und alle technischen,
werblichen und kommerziellen Unterlagen in jeweils einer Kopie in Bezug auf die
„DLyte 1D“ während der IDS, die vom 25. bis einschließlich 29. März 2025 in Köln
Messe, Messeplatz 1, 50679 Köln, Deutschland stattfindet, durch einen Gerichts-vollzieher
physisch zu beschlagnahmen und sodann durch einen Sachverständi-gen
wie in Ziffer I. beschrieben inspizieren zu lassen.
IV. Der Sachverständige soll innerhalb einer Frist von 2 Wochen nach Abschluss der
unter Ziffern I. bis III. genannten Maßnahmen eine ausführliche Beschreibung der
„DLyte 1D“ und der „DLyte 100D“ erstellen und der Kammer vorlegen, die eine
detaillierte Beschreibung der für eine Beurteilung einer Verletzung des Antrags-
patents relevanten Merkmale der „DLyte 1D“ und der „DLyte 100D“ enthält.
V. Die gemäß Ziffer IV. gefertigte Beschreibung und alle anderen Ergebnisse der In-spektion
und Beweissicherung dürfen nur in einem Hauptsacheverfahren gegen
die Antragsgegnerinnen verwendet werden.
VI. Als Person, welche die vorgenannten Maßnahmen ausführt, wird als Sachver-ständiger
ernannt:
Patentanwalt Stephan Freischem, Salierring 47-53, 50677 Köln.
Dieser kann durch einen in derselben Kanzlei arbeitenden europäischen Patent-anwalt
ersetzt werden.
VII. Zur Unterstützung des Sachverständigen wird als Hilfsperson des Sachverständi-gen
die Gerichtsvollzieherin
Köln.
bestellt.
Für den Fall, dass diese bei Durchführung der Inspektion und der Beweissiche-rungsmaßnahmen
verhindert ist, kann sie durch einen örtlich zuständigen, durch
die Antragstellerin zu beauftragenden Gerichtsvollzieher ersetzt werden.
VIII. Dem Sachverständigen sowie dem Gerichtsvollzieher wird im Interesse der Wah-rung
von Geschäftsgeheimnissen der Antragsgegnerinnen, die bei der Inspektion
und Beweissicherung zutage treten könnten, aufgegeben, sowohl gegenüber der
Antragstellerin persönlich als auch gegenüber Dritten Verschwiegenheit zu wah-ren.

IX. Während der Vollziehung der vorliegenden Anordnung ist neben dem Sachver-ständigen und dem Gerichtsvollzieher die Anwesenheit folgender Vertreter der Antragstellerin gestattet:
1. Herr Rechtsanwalt Joscha Torweihe, EPG Vertreter und in dieser Sache be-nannter rechtlicher Vertreter der Antragstellerin von der Kanzlei Hoyng ROKH Monegier, Steinstraße 20, 40212 Düsseldorf, oder ein anderer Rechtsanwalt der Kanzlei Hoyng ROKH Monegier, falls Herr Torweihe nicht verfügbar sein sollte;
2. Herr Patentanwalt Steffen Lenz, EPG Vertreter und in dieser Sache mitwir-kender Patentanwalt der Patentanwaltskanzlei Lichti, Bergwaldstraße 1, 76227 Karlsruhe, bei den nach Ziff. I beantragten Maßnahmen anwesend sein darf, oder ein anderer Patentanwalt der Patentanwaltskanzlei Lichti, falls Herr Lenz nicht verfügbar sein sollte.
Vertretungsorgane, Angestellte oder sonstige Mitarbeiter der Antragstellerin dürfen bei der Ausführung dieser Anordnung im Hinblick auf die Inspektion und Beweissicherung nicht anwesend sein.
X. Den Antragsgegnerinnen wird aufgegeben, bei der Durchführung der Maßnah-men zur Inspektion und Beweissicherung gemäß dieser Anordnung mitzuwirken und der Gerichtsvollzieherin und dem Sachverständigen auf deren Anforderung hin
1. diesen sowie den gemäß Ziffer IX. anwesenheitsberechtigten Personen zu gestatten, die Messestände der Antragsgegnerinnen auf der Messe IDS, die vom 25. bis einschließlich 29. März 2025 in Köln Messe, Messeplatz 1, 50679 Köln, Deutschland stattfindet, zu betreten, um die Inspektion und Beweissicherung gemäß dieser Anordnung durchzuführen;
2. uneingeschränkten Zugang zur „DLyte 1D“ und zur „DLyte 100D“ zu gewäh-ren, einschließlich der Eingabe von Passwörtern;
3. Zugang zu einem Teil der „DLyte 1D und der „DLyte 100D“ zu gewähren;
4. die „DLyte 1D“ und die „DLyte 100D“ in Betrieb zu setzen und in verschie-dene Betriebszustände zu bringen
und ihre Geschäftsführer und Mitarbeiter anzuweisen, den Aufforderungen der Gerichtsvollzieherin oder des Sachverständigen nachzukommen.
XI. Die an der Durchführung der Inspektion und der Beweissicherung beteiligten Per-sonen und insbesondere der Gerichtsvollzieher, der Sachverständige und die Par-teivertreter der Antragstellerin sind verpflichtet, Tatsachen, die ihnen im Rah-men der Ausführung der gesamten Anordnung zur Kenntnis gelangen, sowohl gegenüber Dritten als auch gegenüber der Antragstellerin geheim zu halten.

Zudem dürfen die vorgenannten Personen bis zu einer Freigabeanordnung des Einheitlichen Patentgerichts keine Gelegenheit bieten, der Antragstellerin oder Dritten Einblick in die „DLyte 1D“ und die „DLyte 100D“, die ggf. beschlagnahm-ten Unterlagen und Produkte sowie die durch den Sachverständigen zu ferti-gende ausführliche Beschreibung zu gewähren.
XII. Die Antragsgegnerinnen sollen aufgefordert werden, sich nach Vorlage der ge-mäß Ziffer IV. zu fertigenden ausführlichen Beschreibung durch den mit der Durchführung dieser Anordnung beauftragten Sachverständigen zu ihren etwai-gen Geheimhaltungsinteressen zu äußern. Die oben genannten Vertreter der An-tragstellerin, die bei der Inspektion und Beweissicherung anwesend sein durften, sind zu hören. Erst danach entscheidet das Gericht, ob und inwieweit die aus-führliche Beschreibung der Antragstellerin persönlich zur Kenntnis gebracht wer-den und ob die Schweigepflicht für die Vertreter der Antragstellerin aufgehoben wird.
XIII. Die Antragstellerin ist verpflichtet, die Kosten der Inspektion und Beweissiche-rung einschließlich der Fertigung der ausführlichen Beschreibung zu tragen. Der Antragstellerin wird aufgegeben, vor Beginn der Inspektion dem Sachverständi-gen einen angemessenen, von diesem zu bestimmenden Kostenvorschuss zu zah-len, soweit dieser nicht auf einen solchen Kostenvorschuss verzichtet.
XIV. Bei schuldhafter Zuwiderhandlung gegen diese Anordnung kann das Gericht für jeden Verstoß jeder Partei ein Zwangsgeld festsetzen, dessen Höhe das Gericht unter Berücksichtigung der Umstände des Einzelfalls bestimmen kann.
XV. Die Maßnahmen zur Inspektion und zur Beweissicherung werden auf Antrag der Antragsgegnerinnen aufgehoben oder treten anderweitig außer Kraft, wenn die Antragstellerin nicht innerhalb einer Frist von höchstens 31 Kalendertagen oder 20 Arbeitstagen, je nachdem, welcher Zeitraum länger ist, nachdem die nach Zif-fer IV. zu fertigende schriftliche Beschreibung der Antragstellerin offengelegt wurde oder das Gericht durch eine endgültige Entscheidung entschieden hat, kei-nen Zugang zu dieser Beschreibung zu gewähren, eine Klage gegen die Antrags-gegnerinnen erhoben hat.
XVI. Diese Anordnung soll persönlich von einem der unter Ziffer IX. genannten Ver-treter der Antragstellerin zusammen mit einer Kopie des Antrags auf Erlass dieser Anordnung einschließlich der Beweisstücke und sonstigen Unterlagen, auf die sich der Antrag vor oder bei der Vollziehung dieser Anordnung stützt, sowie der Mitteilung über vorläufige Maßnahmen und Anweisungen für den Zugang zum Verfahren (wird durch das CMS bereitgestellt) unverzüglich im Zeitpunkt der Voll-ziehung der Maßnahmen zugestellt werden.
Die Zustellung dieser erfolgt durch den Gerichtsvollzieher im Zusammenwirken mit dem gemäß Ziffer IX.1. an der Inspektion und Beweissicherung anwesenden rechtsanwaltlichen Vertreter der Antragstellerin.
XVII. Im Übrigen wird der Antrag auf Inspektion und Beweissicherung zurückgewiesen.

INFORMATIONEN ZUR ÜBERPRÜFUNG UND BERUFUNG:
Die Antragsgegnerinnen können innerhalb von 30 Tagen nach der Vollziehung der Maßnahmen eine Überprüfung der vorliegenden Anordnung beantragen (Art. 60 (6) EPGÜ, R. 197.3 VerfO).
Die nachteilig betroffene Partei kann gegen diese Anordnung innerhalb von 15 Tagen nach ihrer Zustellung Berufung einlegen (Art. 73 (2) a) EPGÜ, R. 220.1 c) VerfO).

On 25 March 2025, the applicant filed an application for an order for inspection and preservation of evidence at the defendants' exhibition stands in advance of a main action.
The applicant is the sole proprietor of European Patent 2 983 864 B1 (Annex HRM 2; hereinafter referred to as the “patent in suit”), which was filed on 26 March 2014 in German, claiming priority from two German patent applications (DE 102013006010 and DE 102013016053) dated 9 April 2013 and 27 September 2013, respectively. The grant of the patent application was published on 26 April 2017. The patent application is currently in force in Austria, Belgium, Switzerland, Liechtenstein, the Czech Republic, Germany, Spain, France, Great Britain, Ireland, Italy, Luxembourg, Poland and Turkey. The opt-out initially declared was withdrawn by application dated 24 March 2025 (App_14363/2025).
No opposition was filed against the grant of the patent application. Furthermore, no nullity proceedings were initiated after the expiry of the opposition period.
The patent application is entitled ‘Method and apparatus for surface treatment of workpieces’. Its patent claim 1 is worded as follows:
‘Method for surface treatment of workpieces by moving the workpiece relative to a bed of grinding and/or polishing granulate, wherein the workpiece is rotated (P4) relative to the bulk material of the grinding and/or polishing granulate about at least one axis, wherein the workpiece is accelerated relative to the bulk material of the grinding and/or polishing granulate to different rotational speeds (R1, R2), characterised in that that the workpiece and/or a container (11) receiving the bulk material from the grinding and/or polishing granulate is rotated at continuously varying rotational speeds with continuous acceleration.
The first respondent develops, manufactures and distributes machines and technologies for vibratory grinding and electropolishing. Its range of services includes the precise smoothing, polishing, rounding and deburring of workpieces.
The first respondent is the parent company of the GPAINNOVA Group. The second respondent is a specialist dealer and customer of the first respondent, which, among other things, offers and sells the products of the first respondent.

The product portfolio of the first respondent includes electropolishing machines for various areas of application, including the dental market. It offers these machines on its website https://www.dlyte.com/de/produkte/, including in Germany. The products offered by the first respondent under the ‘DLyte’ brand for the dental market include the ‘DLyte 1D’, ‘DLyte 10D’ and ‘DLyte 100D’ products, all of which belong to the first respondent's ‘Compact Series’. The second respondent also offers these machines on its website. With regard to the content of these websites, reference is made to Annexes HRM 7 to HRM 9.
The respondents are currently exhibiting at the ‘Interdentalschau 2025’ trade fair (hereinafter: IDS 2025), which is taking place in Cologne from 25 March 2025 to 29 March 2025.
The applicant submits that all of the aforementioned products in the ‘Compact Series’ are currently being exhibited at the ‘IDS 2025’ trade fair. It is virtually impossible for the applicant to gain access to these machines. On the one hand, the prices of between EUR 30,000 and EUR 50,000 are too high to purchase them solely for testing purposes. On the other hand, this is a personalised business. In the parties' industry, machines are only sold through “known” distribution channels, an exclusive dealer network. There is usually only one fixed reseller of the respondent's machines per country, or two in larger countries. The resellers have a very close relationship with the respective manufacturer of the machines, so that the applicant would not be supplied. An anonymous purchase of the machines in question was also not possible because, due to the enormous financial burden of a purchase, the buyers of these machines wanted to ensure that the machines would bring the desired added value to their business. Normally, a trial run would take place on the manufacturer's premises or the customers would first receive a test machine. The test phase allows the test purchaser or its exclusive resellers to establish close contact. It would therefore be noticeable if this close contact were lacking in individual cases, for example if the applicant only wished to purchase the machine for testing purposes. The sale would probably be stopped.
The applicant only obtains access to the respondents' machines for testing purposes in individual cases via dissatisfied customers. A complete verification of the alleged infringements is therefore not possible. Among other things, the applicant purchased the “DLyte 10D” second-hand from a mutual customer for testing purposes. However, this was coincidental and did not take place with the applicant's patent in mind at the time. In addition, the applicant was able to examine the ‘DLyte 100D’ at a mutual customer in Turkey, although it is unclear whether the machine found in Turkey is identical to the corresponding machines sold in the EPG contracting states. The investigations had revealed, among other things, that the ‘DLyte 10D’ and the ‘DLyte 100D’ found in Turkey would infringe the patent applied for if they were identical in design in the EPG contracting states. For details of the investigation results, reference is made to Annex HRM 14.
The applicant's efforts to also examine the third member of the ‘Compact Series’, the ‘DLyte 1D’, were unsuccessful. The same applies to an examination of the ‘DLyte 100D’ in a version distributed in the EPG member states. Information on the respondent's website and product videos suggest that the ‘DLyte 1D’ and the ‘DLyte 100D’, insofar as they are relevant to the infringement of the patent in suit, are identical in construction to the ‘DLyte 10D’.

On 25 March 2025, one of the applicant's legal representatives was able to visually inspect the DLyte 1D and DLyte 100D at the exhibition stand of the first respondent. The visual inspection confirmed the assumption that the ‘DLyte 1D’ and the ‘DLyte 100D’ were identical in construction to the ‘DLyte 10D’ insofar as this was relevant to the infringement of the patent in suit. In addition, the ‘DLyte 1D’ and the ‘DLyte 100D’ were illuminated and switched on. Finally, a ‘DLyte’ machine, presumably from the ‘Compact Series’, was exhibited at the stand of the second respondent. Reference is also made to the photographs submitted as Annexes HRM 16 to HRM 17 and to an affidavit.
PLAINTIFF'S CLAIMS:
I. To grant the applicant:
1. a DLyte 1D and DLyte 100D in working order on site at the IDS trade fair, which will take place from 25 to 29 March 2025 at Cologne Exhibition Centre, Messeplatz 1, 50679 Cologne, Germany, at the stand of the first respondent, to be inspected by an expert and a bailiff, in particular
a. to put the DLyte 1D and DLyte 100D into operation, whereby the respondent is required to enter any necessary passwords,
b. attaching a smartphone to the workpiece holder for the purpose and duration of measuring the movement sequence and rotational speed of the workpiece holder of the DLyte 1D or DLyte 100D,
c. making suitable adjustments to the machine to avoid falsification of the measurement results, in particular deactivating the vibration unit of the container,
d. to select and activate a programme on the DLyte 1D or DLyte 100D that sets the workpiece holder in motion for the purpose of measurement,
e. if provided by the DLyte 1D or DLyte 100D, to configure and activate a programme that sets the workpiece holder in motion for the purpose of measurement,
f. to carry out the measurement during operation of the DLyte 1D or DLyte 100D,
g. to repeat the measurement process until a sufficient measurement of the rotational speed and movement sequence of the workpiece holder of the DLyte 1D or DLyte 100D has been obtained,
2. or to use a comparable measurement method;
3. alternatively, if claims I.1 and I.2 are impossible,

a. with regard to the DLyte 1D, to grant the measures requested in claims I.
1 and I. 2 during the IDS, which will take place from 25 to 29 March 2025
in Cologne Messe, Messeplatz 1, 50679 Cologne, Germany, at the
exhibition stand of the second respondent,
b. and with regard to the DLyte 100D, one DLyte 100D and all technical,
advertising and commercial documents in one copy each with regard
the DLyte 100D during the IDS, which will take place from 25 to 29 March
2025 at Cologne Exhibition Centre, Messeplatz 1, 50679 Cologne, Germany,
by a bailiff or to physically seize the DLyte
100D at any other location in Germany;
c. to prepare a detailed description of the DLyte 100D, including a
detailed description of the features of the DLyte 100D and the relevant
technical, advertising and commercial documentation relating to the
DLyte 100D, at all locations specified in Section I.1;
4. in the alternative, if requests I.1., I.2. and I.3. are impossible,
one DLyte 1D and one DLyte 100D and all technical, advertising and commercial
documents relating to the DLyte 1D and the DLyte 100D
during the IDS, which will take place from 25 to 29 March 2025 at Cologne Exhibition Centre,
Messeplatz 1, 50679 Cologne, Germany, by a bailiff,
or to physically seize the DLyte 1D and DLyte 100D at any
other location in Germany;
5. to prepare a detailed description of the DLyte 1D and the DLyte 100D,
which shall include a detailed description of the features of the DLyte 1D and the DLyte
100D as well as the relevant technical, advertising and commercial documentation
relating to the DLyte 1D and the DLyte 100D, at all locations specified in Section I.1.
II.
Appoint patent attorney Stephan Freischem, Salierring 47-53, 50677 Cologne, as expert witness and determine that he may be replaced by a European patent attorney working in the same law firm as Stephan Freischem;
III.
Authorise the bailiff Ms Köln to assist the expert witness in carrying out the measures to secure evidence in accordance with the order to be issued in this matter and determine that, in the event of her unavailability, she may be assisted by any other person authorised by the court;
that she may be assisted by the expert in carrying out the measures to preserve evidence in accordance with the
order to be issued in this matter,
and to determine that, in the event of her unavailability, she may be replaced by any
other competent expert;
IV. that Mr Joscha Torweihe, EPG representative and legal representative of the applicant in this matter, appointed by the law firm Hoyng ROKH Monegier, Steinstraße 20, 40212 Düsseldorf, may be present at the measures requested in section I.

VI. to order that the employees and managing directors of the respondent may not be present during the enforcement of the order to be issued in this matter and that the bailiff is not entitled to make an exception to this in accordance with the applicable national law;
VII. order that the persons involved in the implementation of the measures for the preservation of evidence in accordance with the order to be issued, such as the bailiff, the expert and/or the party representative, the respondent or third parties, may not disclose any information about these measures and may not provide any opportunity to inspect the DLyte 1D and DLyte 100D or the respective detailed reports or examine them, unless the respondent agrees or on the basis of a further order by the EPG;
VIII. to oblige the respondents to cooperate in the implementation of the measures for inspection and preservation of evidence in accordance with the decision to be issued in this matter and to grant the bailiff and the expert, upon request,
- grant unrestricted access to DLyte 1D and DLyte 100D, including the input of passwords,
- grant access to part of DLyte 1D and DLyte 100D, and/or
- to put DLyte 1D and DLyte 100D into operation and into various operating states;
IX. to oblige the respondents to instruct their managing directors and employees to comply with the requests of the bailiff and/or the expert in accordance with Section VII;
X. to impose a penalty payment of EUR 2,500 for each 15-minute period that elapses between the request by the bailiff or the expert for access to the inspection in accordance with Section I and the actual granting of the requested access;
XI. order that the bailiff must submit a copy of the order to be issued in this matter, together with a copy of the application, to at least one representative of the respondents who is present at the place where the respective measures are being carried out;
XII. order that the order to be issued in this way is immediately enforceable;
XIII. order that the order to be issued in this manner is enforceable on all days and at all times;

XIV. order that service be effected by the bailiff in cooperation with Mr Joscha Torweihe, as specified in point IV, or another lawyer from the law firm Hoyng ROKH Monegier if Mr Torweihe is unavailable;
XV. suspend all decisions on costs for the time being.
REASONS FOR THE ORDER:
The application for an order for inspection and preservation of evidence (R. 192, 199 VerfO) is successful to the extent stated.
I. The Local Chamber of Düsseldorf has jurisdiction pursuant to Art. 32 (1) c), 33 (1) b), 60 EPGÜ. The application has been filed in a permissible manner pursuant to R. 192 VerfO. In particular, the applicant has stated that it intends to bring an action on the merits against the respondents before the Local Chamber in Düsseldorf.
II. Furthermore, the applicant has credibly demonstrated that the patent in suit may be infringed by the respondents (Art. 60 (1) EPGÜ).
In view of the circumstances of the case, it is possible that the products ‘DLyte 1D’ and ‘DLyte 100D’ as exhibited at the IDS in Cologne make use of the technical teaching of the patent in suit.
The applicant, who is the owner of the patent in suit and has standing to bring proceedings, has demonstrated in a product brochure (Exhibit HRM 21), a product video available on YouTube, the description of the Dental Series products (Exhibit HRM 23) and on the basis of an examination of the Compact Series sister product ‘DLyte 10D’ (Exhibit HRM 14) why it assumes that all the features of the patent application are realised in the product ‘DLyte 1D’.
In addition, it has already analysed the ‘DLyte 100D’ model at one of its customers in Turkey and submitted a corresponding investigation report as Annex HRM 14. On the basis of this analysis, the applicant has comprehensively explained why it also assumes that this embodiment realises the technical teaching protected by the patent application.
III. The applicant has also demonstrated that the application is urgent (R. 194.2 a) VerfO). In addition, it has provided reasons for issuing an ex parte order (R. 194. 2 b), c), 197 VerfO).
1. The inspection or measure to preserve evidence is urgent.
a)
The applicant has demonstrated in a comprehensible manner that the product ‘DLyte 1D’ exhibited at the ‘IDS 2025’ trade fair in Cologne may make use of

the technical teaching of claim 1 of the patent applied for, has been comprehensibly demonstrated by the applicant. However, sufficient substantiation can only be provided by an examination of the product exhibited at the aforementioned trade fair, in the context of measurements of the machine's movement sequences and, in particular, its rotational speed and acceleration behaviour. According to the applicant, machines such as the ‘DLyte 1D’ are not readily available and companies that have purchased and use such machines are generally not prepared to grant ‘outsiders’ (patent proprietors) access to their premises or machines. The ‘IDS 2025’ trade fair therefore offers the applicant an opportunity to gather evidence of the alleged infringement of the patent in question.
With regard to the product ‘DLyte 100D’, the applicant has already examined a machine at one of its customers in Turkey. On the basis of this examination report, it has explained in a comprehensible manner why it assumes that this embodiment also makes use of the technical teaching of patent claim 1. However, since the applicant must prove patent infringement within the contracting member states of the EPG, an inspection of the product exhibited at the ‘IDS 2025’ trade fair can provide it with certainty as to whether this product corresponds to the product examined in Turkey in terms of the features relevant to a possible infringement of the patent in question. As the applicant has explained in a comprehensible manner, the extreme difficulty of obtaining such machines due to their unavailability on the open market leaves it with no other option than to carry out the inspection at the ‘IDS 2025’ trade fair in Cologne.
b) The order was to be issued ex parte pursuant to R. 192.3, 197 VerfO. Otherwise, there would be a demonstrable risk that evidence would be destroyed or no longer available for other reasons (R. 197.1 Alt. 2 VerfO).
As the applicant has explained in a comprehensible manner, there is a serious risk that the ‘DLyte 1D’ and ‘DLyte 100D’ will be removed from the exhibition grounds at short notice or that individual polishing processes pre-programmed by the first respondent will be deactivated by means of a software update. This could result in the loss of evidence that could be used to confirm the infringement. Due to the special market conditions already described in detail, it would be virtually impossible for the applicant to obtain evidence of the infringement of the patent in suit by the aforementioned products.
IV. In the exercise of its discretion, the interests of the applicant prevail.
On the basis of the information available to it so far, the applicant has demonstrated in a comprehensible manner why it assumes that all the features of patent claim 1 of the patent in suit are realised in the products exhibited at the ‘IDS 2025’ trade fair in Cologne. It has also explained in a comprehensible manner why, due to the special circumstances in the relevant market, it has no other means of obtaining evidence of the infringement of the patent in question by the products ‘DLyte 1D’ and the ‘DLyte 100D’ products, which is why it is dependent on an examination of the products exhibited at the ‘IDS 2025’ trade fair in order to preserve evidence.

Against this background, the present order is necessary in order to satisfy the patent holder's overriding interests in this respect. The measures ordered do not impose an unreasonable burden on the respondents. The confidentiality orders included in the order take sufficient account of their confidentiality interests.
V. The applicant has paid the court fee for the application for inspection/preservation of evidence, R. 192.5 VerfO.
VI. The order provides, pursuant to R. 196.4, .5 VerfO, that an expert shall be appointed to carry out the measures. In order to assist the expert in securing the evidence, the Chamber has made use of the option granted by R. 196.5 sentence 2 VerfO to order the assistance of a bailiff. The involvement of the bailiff was necessary in particular for the alternative request for seizure in rem, which falls within the jurisdiction of bailiffs under national law (UPC_CFI_539/2024 (LK Düsseldorf), order of 18 October 2024 – Bekaert Binjiang Steel v. Siltronic).
According to Rule 196.5 VerfO, members or representatives of the applicant itself were to be excluded from the inspection and preservation of evidence. In view of the proportionality and protection of confidential information, the number of legal representatives present during the inspection was also to be limited (Art. 60 (1) EPGÜ, R. 196.1 VerfO). The confidentiality measures ordered with regard to the legal representatives, the expert and the bailiff also take into account the confidentiality interests of the respondents, as does the procedure described above following receipt of the detailed description.
It was also ordered that the detailed description to be prepared by the expert may only be used in main proceedings against the respondents (R. 196.2 VerfO).
The costs of the inspection and preservation of evidence to be carried out by the expert, including the detailed description to be prepared by the expert, shall in any case be borne by the applicant until further notice, as it is the applicant who requested the inspection. If the expert does not waive payment of an advance for his costs, the applicant shall pay the expert an appropriate advance, to be determined by the expert, before the inspection begins.
This order, together with the documents referred to in section XVI, shall be served by the bailiff in cooperation with the applicant's legal representative present at the inspection and preservation of evidence in accordance with section IX.1, pursuant to R. 197.2 VerfO.
VII.
The general threat of coercive measures included in the order gives the Chamber the necessary flexibility to respond to any breaches of this order, taking into account the interests of both parties and the seriousness of the breach.
In the specific case, it was possible to refrain from ordering the provision of security. The special circumstances required for an ex parte order (R. 196.6 VerfO) are present. Unlike in the case of an injunction, the inspection

and preservation of evidence. They are also still entitled to offer and distribute the products under investigation (distinction from: UPC_CFI_177/2023 (LK Düsseldorf), order of 22 June 2023 – myStromer v. Revolt). On this basis and taking into account the short duration of the trade fair, ordering the provision of security would unreasonably delay the preservation of evidence and inspection, which justifies refraining from ordering the provision of security in the present case.
VIII.
Insofar as the applicant has, in the alternative, sought permission to seize the products to be examined ‘at any other location,’ this could not be granted on grounds of either specificity or proportionality. These aspects also preclude the enforceability of this order ‘on all days and at all times’. The description of the permissible measures in the order also takes into account the requirement of specificity.
There are no apparent reasons for excluding representatives and employees of the respondents from participating in the inspection. Such an exclusion sought by the applicant is already precluded by the fact that the employees and managing directors of the respondents are required to comply with the requests of the bailiff and/or the expert in accordance with the applicant's request.

ORDER:
The following inspection and evidence order is issued without prior hearing of the respondents:
I. The applicant is permitted to inspect a ‘DLyte 1D’ and ‘DLyte 100D’ in working order at the IDS trade fair, which will take place from 25 to 29 March 2025 at Cologne Exhibition Centre, Messeplatz 1, 50679 Cologne, Germany, at the exhibition stand of the first respondent, by an expert and a bailiff, and in doing so
1. the ‘DLyte 1D’ and the ‘DLyte 100D’ are put into operation, whereby the respondent is required to enter any necessary passwords;
2. attach a smartphone to the workpiece holder for the purpose and duration of measuring the movement sequence and rotational speed of the workpiece holder of the ‘DLyte 1D’ or ‘DLyte 100D’;
3. to make suitable adjustments to the machine in order to avoid falsification of the measurement results, in particular deactivating the vibration unit of the container;
4. to select and activate a programme on the ‘DLyte 1D’ or ‘DLyte 100D’ which sets the workpiece holder in motion for the purpose of measurement;
5. If provided by the ‘DLyte 1D’ or ‘DLyte 100D’, configure and activate a program that sets the workpiece holder in motion for the purpose of measurement.
6. Carry out the measurement while the ‘DLyte 1D’ or ‘DLyte 100D’ is in operation.
7. repeat the measurement process until a sufficient measurement of the rotational speed and movement sequence of the workpiece holder of the ‘DLyte 1D’ or ‘DLyte 100D’ has been obtained.
II. If an on-site inspection in accordance with Section I is not possible, the applicant shall be permitted to
1. with regard to the ‘DLyte 1D’, to carry out the measures described in Section I.1. during the IDS, which will take place from 25 to 29 March 2025 at Cologne Exhibition Centre, Messeplatz 1, 50679 Cologne, Germany, at the exhibition stand of the second respondent
and
2. with regard to the ‘DLyte 100D’, to physically seize such a device and all technical, advertising and commercial documents relating to the ‘DLyte 100D’ in one copy each during the IDS, which will take place from 25 to 29 March 2025 in Cologne, Messeplatz 1, 50679 Cologne, Germany, by a bailiff and then have them physically seized by an expert as described in Section I.

III. If the inspection referred to in Sections I and II.1 is not possible,
the applicant shall be permitted, as a last resort, in addition to the seizure

advertising and commercial documents relating to the
‘DLyte 1D’ during the IDS, which will take place from 25 to 29 March 2025 inclusive at Cologne

and then have them inspected by an expert
as described in Section I.
IV. Within a period of two weeks after completion of the
measures specified in Sections I to III, the expert shall prepare a detailed description of the
‘DLyte 1D’ and the “DLyte 100D” and submit it to the Chamber, which shall contain a
detailed description of the features of the “DLyte 1D” and the “DLyte 100D” that are relevant to the assessment of an infringement of the patent application.

and preservation of evidence may only be used in main proceedings against
the respondents.
VI. The following person is appointed as expert to carry out the above measures

IX. During the execution of this order, the following representatives of the applicant are permitted to be present in addition to the expert and the bailiff:

Mr Steffen Lenz, patent attorney, EPG representative and patent attorney acting in this matter for the patent law firm Lichti, Bergwaldstraße 1, 76227 Karlsruhe, may be present during the measures requested under Section I, or another patent attorney from the patent law firm Lichti if Mr Lenz is unavailable.
Representatives, employees or other staff of the applicant may not be present during the execution of this order with regard to the inspection and preservation of evidence.
X. The respondents are ordered to cooperate in the implementation of the measures for inspection and preservation of evidence in accordance with this order and, at the request of the bailiff and the expert, to
1. to allow them and the persons authorised to be present in accordance with Section IX to enter the defendants' exhibition stands at the IDS trade fair, which will take place from 25 to 29 March 2025 at Cologne Exhibition Centre, Messeplatz 1, 50679 Cologne, Germany, in order to carry out the inspection and preservation of evidence in accordance with this order;
2. to grant unrestricted access to the ‘DLyte 1D’ and the ‘DLyte 100D’, including the entry of passwords;
3. to grant access to part of the ‘DLyte 1D’ and the ‘DLyte 100D’;
4. to put the ‘DLyte 1D’ and the ‘DLyte 100D’ into operation and into various operating states
and to instruct its managing directors and employees to comply with the requests of the bailiff or the expert.
XI. The persons involved in carrying out the inspection and securing evidence, in particular the bailiff, the expert and the representatives of the applicant, are obliged to keep confidential any facts that come to their knowledge in the course of executing the entire order, both vis-à-vis third parties and vis-à-vis the applicant.

In addition, the aforementioned persons shall not give the applicant or third parties any opportunity to inspect the ‘DLyte 1D’ and ‘DLyte 100D’, any documents and products that may have been seized, or the detailed description to be prepared by the expert until a release order has been issued by the Unified Patent Court.
XII. The respondents shall be requested to comment on any confidentiality interests they may have after the expert appointed to carry out this order has submitted the detailed description to be prepared in accordance with Section IV. The above-mentioned representatives of the applicant who were allowed to be present during the inspection and preservation of evidence shall be heard. Only then shall the court decide whether and to what extent the detailed description shall be brought to the personal attention of the applicant and whether the duty of confidentiality shall be lifted for the applicant's representatives.
XIII. The applicant shall bear the costs of the inspection and preservation of evidence, including the preparation of the detailed description. The applicant is ordered to pay the expert an appropriate advance payment, to be determined by the expert, before the inspection begins, unless the expert waives such an advance payment.
XIV. In the event of a culpable breach of this order, the court may impose a penalty payment on each party for each breach, the amount of which shall be determined by the court taking into account the circumstances of the individual case.
XV. The measures for inspection and preservation of evidence shall be revoked at the request of the respondents or shall otherwise cease to have effect if the applicant does not, within a period of no more than 31 calendar days or 20 working days, whichever is longer, after the written description to be prepared by the applicant pursuant to Section IV. has been disclosed or the court has decided by final decision not to grant access to this description, has brought an action against the respondents.
XVI. This order shall be served personally by one of the representatives of the applicant named in Section IX. together with a copy of the application for this order, including the evidence and other documents on which the application is based prior to or upon execution of this order, as well as the notification of provisional measures and instructions for access to the proceedings (provided by CMS), immediately upon execution of the measures.
This shall be served by the bailiff in cooperation with the applicant's legal representative present at the inspection and preservation of evidence in accordance with Section IX.1.
XVII. In all other respects, the application for inspection and preservation of evidence is dismissed.

INFORMATION ON REVIEW AND APPEAL:
The respondents may request a review of this order within 30 days of the measures being carried out (Art. 60 (6) EPGÜ, R. 197.3 VerfO).
The party adversely affected may appeal against this order within 15 days of its delivery (Art. 73 (2) a) EPGÜ, R. 220.1 c) VerfO).
