LANGUE DE LA PROCEDURE: Français

ORDONNANCE
- la valeur probante du rapport d’analyse de TESCAN ANALYTICS ;
- la reproduction de la caractéristique 1.4 par les puces PKB ;
- la reproduction de la caractéristique 1.5 par les puces PKB ;
- la reproduction de la caractéristique 1.14 par les puces PKB ;

conclusions qu’en tire la défense.
solution du litige.

DECIDING JUDGE
President and Reporting Judge Camille Lignières

LANGUAGE OF THE PROCEEDINGS: French

ORDER
In accordance with Rule 105.5 of the Rules of Procedure (Rp), after the pre-trial conference, the
judge-rapporteur issues an order setting out the decisions taken.
In the present case, a pre-hearing conference was held online on 7 February 2025 and was audio-recorded
(Rule 106 RdP). All parties were represented, with the exception of the main defendant,
LASER COMPONENTS, which was summoned and informed that it would not be present, nor at
the oral hearing. This party was informed by the judge-rapporteur that a decision would be
rendered by default concerning it.
A) The main points of law at issue
In accordance with Rule 104(a), the parties represented agreed on the main points of law as
identified by the Judge-Rapporteur in the note sent to them by email on 3 February 2025.
The terms subject to interpretation in the patent in question:
- "contact electrode", "pad electrode" and "bump electrode" (features 1.4 and 1.5 of claim 1)
- "expose" in the context of feature 1.14 of claim 1 and the following question: do the openings
in the passivation layer of the PKB chips expose the pad electrode?
The most disputed points:
- the probative value of the TESCAN ANALYTICS analysis report;
- the reproduction of feature 1.4 by PKB chips;
- the reproduction of characteristic 1.5 by PKB chips;
- the reproduction of characteristic 1.14 by PKB buds;
- the absence of conclusive evidence relating to PKC and PKD.
The value of the share: (Rule 104(i) Rdp)
PHOTON WAVE disputes the amount declared by SEOUL VYOSIS when the action was brought,
namely EUR 500,000.
In support of this objection, PHOTON WAVE argues that the value of the share cannot be
estimated at more than EUR 250,000, given that the value of the claim for damages and the claim
for an injunction are relatively minimal, in view of the price of each chip in question and the
number of items sold to the main defendant. However, these assertions are not supported by
accounting documents and, in the absence of information useful for determining the extent of
the alleged damage, it is appropriate at this stage of the proceedings, in accordance with the
provisions of Rule 370.6 of the Rules of Procedure, according to which the estimate of the value
of the action reflects the objective interest pursued by the party bringing the action at the time
the action was brought, to set the total value of the dispute as assessed at the outset of the
action by the claimant, i.e. at a total sum of EUR 500,000.
Costs and damages:
With regard to costs, both parties agree that they should be examined in separate proceedings
(Art. 69.1 AJUB and Rule 118.5 RdP).
With regard to damages, the claimant in the main proceedings requested that they be examined
in separate proceedings.
In accordance with Rule 104(d), the judge-rapporteur asked the representatives about the
possibility of settling the dispute amicably. The representatives present replied that, at this stage
of the proceedings, no talks were envisaged.
The judge-rapporteur noted that the parties had not submitted any requests for the subsequent
production of additional written submissions, documents, expert reports (...) or other written
evidence as provided for in Rule 104(e).
The request for simultaneous interpretation
It was agreed that each of the parties present would be responsible for organising simultaneous
interpretation during the hearing for their respective needs, in accordance with Rule 109.4 of the
Rules of Procedure.
The question of the necessity of an oral witness
Regarding the question of whether it was necessary to summon a witness to the oral hearing,
having submitted several written witness statements for the defence (exhibits 13 and 4 of the
intervention brief), the parties agreed that this was not necessary since what is contested by
SEOUL VIOSYS is not the actual content of this witness's written statements but rather the
conclusions drawn from them by the defence. The summoning of this witness therefore does not
appear to be useful for the resolution of the dispute.
The pre-hearing conference then focused on preparations for the oral hearing, which will take
place on 13 March 2025, as set out in the order of 30 September 2024 (Rule 104(f)). The time
and order of the pleadings are set as follows (in accordance with the note from the judge-rapporteur,
with slight modifications to the allocation of speaking time between the
representatives).

B) Organisation of the hearing (Timing)
General organisation
In accordance with Rule 113 of the Rules of Procedure – Duration of the hearing, the Presiding
Judge may set time limits for the oral submissions of the parties prior to the hearing.
