Entscheidung des Gerichts erster Instanz des Einheitlichen Patentgerichts Lokalkammer Wien
betreffend das Europäische Patent 2 643 717

Leitsätze:
1. Wenn im Verfahren die Behauptung aufgestellt wird, dass das angeblich verletzte Patent ungültig ist, muss nach R 25 VerfO die Klageerwiderung eine Widerklage auf Nichtigerklärung des Patents gegen den Inhaber des Patents in Übereinstimmung mit R 42 VerfO enthalten. Wenn dies nicht erfolgt, ist auf den Nichtigkeitseinwand (hier: Überschreitung der Ursprungsoffenbarung) inhaltlich nicht einzugehen.
2. Die endgültige Entfernung aus den Vertriebswegen ist eine eigenständige, von dem Rückruf zu trennende Maßnahme. Sie flankiert den Rückruf, wobei eine Entfernung nur in Betracht kommt, wenn der Verletzer hierzu die tatsächlichen und rechtlichen Möglichkeiten hat. Die Formulierung konkreter und hinreichend bestimmter Maßnahmen hat sich daran auszurichten.
3. Art 80 EPGÜ stellt es in das Ermessen des Gerichts, ob es eine Veröffentlichung gestattet oder nicht. Damit eine solche Anordnung ergehen kann, muss das Interesse der Klägerin an der Veröffentlichung die allfälligen (nachteiligen) Folgen einer solchen für die Beklagte überwiegen. Im Regelfall kommt eine solche Veröffentlichung nur in Betracht, wenn der Schutz der Klägerin nicht bereits durch andere Maßnahmen gewährleistet ist (vgl UPC_CFI_373/2023 (LK Düsseldorf), Entscheidung vom 31.10.2024 – SodaStream v. Aarke; UPC_CFI_16/2024 (LK Düsseldorf), Entscheidung vom 14.1.2025 – Ortovox v. Mammut). Bei der Ermessensausübung sind auch die von Art 80 EPGÜ verfolgten Zwecke (Abschreckung künftiger Verletzer und Sensibilisierung der Öffentlichkeit) einzubeziehen. Dazu ist aber ein Vorbringen erforderlich, worin im konkreten Verletzungsfall das Präventionsinteresse begründet ist.
4. Obwohl die VerfO keine gesonderte Kostenregel für die Streithilfe vorsieht, ist aus dem Grundsatz der R 315.4 VerfO abzuleiten, dass die Streithelferin auch hinsichtlich der Kostentragung wie eine Partei behandelt wird. Im Fall, dass die von ihr unterstützte Partei – wie im konkreten Fall – verliert, wäre eine verhältnismäßige Kostenbeteiligung dem Grunde nach jedenfalls dann gerechtfertigt, wenn sie durch ihr Einschreiten bei der obsiegenden Partei einen Mehraufwand verursacht hat. Jedenfalls hat sie im Fall des Unterliegens ihre eigenen Kosten selbst zu tragen.

KURZE DARSTELLUNG DES SACHVERHALTS:
Die Klägerin nimmt die Beklagte wegen einer Verletzung ihres europäischen Patents EP 2 643 717 B1 mit der Bezeichnung „Farbmischende Sammeloptik“ (kurz: Streitpatent) in Anspruch. Das Streit-patent, dessen Erteilung am 26.1.2022 veröffentlicht wurde, wurde am 17.11.2011 angemeldet. Die Anmeldung wurde am 26.1.2022 veröffentlicht und nimmt die Priorität vom 23.11.2010 in An-spruch (AT 19512010); es steht in Kraft in verschiedenen EPGÜ Mitgliedsstaaten.
Das Streitpatent betrifft eine farb- und lichtmischende Sammeloptik für bildgebende Anzeigetafeln im Freien für Spotlichter oder Signalisierung, bestehend aus einer LED-Lichtquelle sowie einem davor angeordneten Lichtleiterstab und einer Sammellinse. Aus dem Stand der Technik gemäß US 2007/0024971 war eine farb- und lichtmischende Sammeloptik bekannt, wobei das Mischen durch die spezielle Ausgestaltung des Querschnittes des Lichtleiterstabes mit Leisten und konkaven Ein-buchtungen erreicht wird. In Ausgestaltungen sind auch TIR-Kollimatoren als Sammellinsen mit spezieller Anordnung vor dem Lichtleiterstab vorgesehen. Nachteilig ist besonders der hohe Auf-wand für den komplexen Lichtleiterstab und die relativ große Längserstreckung ([0002]).
Bei LED-Großbildschirmen ist es sehr aufwändig, einzelne einfarbige LED mit Linsenkuppe so zu verbauen, dass sie alle präzise zueinander ausgerichtet sind ([0011]). Grundsätzlich ist eine Licht-übertragung mittels eines Lichtleiters, an dessen einem Ende eine Lichtquelle einstrahlt und an dessen anderem Ende das abstrahlende Licht durch eine Optik verteilt wird, schon lange bekannt. Dieses Basissystem kann jedoch durch eine enorme Vielzahl von Parametern abgewandelt werden, sodass eine unübersehbare Vielfalt an Eigenschaften und Gestaltungsmöglichkeiten entsteht ([0020]).
Ausgehend vom Stand der Technik lag der Erfindung gemäß der Beschreibung des Patents die Auf-gabe zugrunde, eine Optik zu bauen, welche das Licht unterschiedlicher LED-Kristalle einer Full-Color- oder Multi-LED untereinander vollständig so vermischt, dass seine Intensität und Richtung auf kleinem Raum erhalten bleibt und anschließend in bekannter Weise gebündelt werden kann, ohne für den Betrachter Farbunterschiede, Farbsäume oder Farbflecken auszubilden, wobei die Anordnung kostengünstig und klein sein muss ([0028 und 0032]).
Zur Lösung der Aufgabe schlägt das Streitpatent eine Sammeloptik mit den Merkmalen des Pa-tentanspruchs 1 vor. Der Patentanspruch 1 lautet:
1. Farb- und lichtmischende Sammeloptik, insbesonders als vollfarbtaugliches Pixel für bild-gebende Anzeigetafeln im Freien, für Spotlichter oder Signalisierung, bestehend aus einer LED-Lichtquelle, sowie einem davor angeordneten Lichtleiterstab und einer Sammellinse, wobei die LED-Lichtquelle (1) mehrere LED-Kristalle (R, G, B) enthält, die Lichteintrittsfläche (3) des Lichtleiterstabes (2) vor der Lichtaustrittsfläche der LED-Lichtquelle (1) angeordnet ist und Licht jedes LED-Kristalls einfängt, wobei sich der Lichtleiterstab (2) senkrecht zur Eintrittsfläche (3) erstreckt und wobei sein Querschnitt konstant ist oder allmählich zu-nimmt, dadurch gekennzeichnet, dass der Lichtaustritt (4) des Lichtleiterstabes (2) sich im Bereich des Fokus (F) der Sammellinse (5) befindet, dass diese das aus dem Mittelpunkt (F) austretende Licht achsparallel bündelt und das Licht, das seitlich des Mittelpunktes (F) des Lichtaustritts (4) aus einem Punkt (P) des Lichtaustritts (4) austritt, in einer zugehörigen Richtungen (p) parallel bündelt, dass die Mantelfläche des Lichtleiterstabes (2) aus optisch hochglanzpolierten Ebenen gebildet ist, welche scharfkantig aneinandergrenzen und somit jeder Querschnitt die Form eines Polygons aufweist, dass das Material des Lichtleiterstabs (2) frei von lichtstreuenden Komponenten ist, und dass der Lichtaustritt (4) des Lichtleiter-stabes (2) in seinem Umriss bereits weitgehend der auf den Kopf gestellten benötigten Lichtverteilung entspricht und das durchtretende Licht durch die vorgeschaltete Sammel-linse (5) nach dem optischen Projektionsgesetz in Form des aufrechten Umrisses abge-strahlt wird.
Der Patentanspruch 1 lässt sich in folgende Merkmale gliedern:
M1 Farb- und lichtmischende Sammeloptik, insbesondere als vollfarbtaugliches Pixel für bild-gebende Anzeigetafeln im Freien, für Spotlichter oder Signalisierung, bestehend aus
M2 einer LED-Lichtquelle, sowie
M3 einem davor angeordneten Lichtleiterstab und
M4 einer Sammellinse,
M5 wobei die LED-Lichtquelle (1) mehrere LED-Kristalle (R, G, B) enthält,
M6 die Lichteintrittsfläche (3) des Lichtleiterstabes (2) vor der Lichtaus-
trittsfläche der LED-Lichtquelle (1) angeordnet ist und
M7 Licht jedes LED-Kristalls einfängt,
M8 wobei sich der Lichtleiterstab (2) senkrecht zur Eintrittsfläche (3) erstreckt und
M9 wobei sein Querschnitt konstant ist oder allmählich zunimmt,
dadurch gekennzeichnet,
M10 dass der Lichtaustritt (4) des Lichtleiterstabes (2) sich im Bereich des Fokus (F) der Sam-mellinse (5) befindet,
M11 dass diese das aus dem Mittelpunkt (F) austretende Licht achsparallel bündelt und das Licht, das seitlich des Mittelpunktes (F) des Lichtaustritts (4) aus einem Punkt (P) des Lichtaustritts (4) austritt, in einer zugehörigen Richtungen (p) parallel bündelt,
M12 dass die Mantelfläche des Lichtleiterstabes (2) aus optisch hochglanzpolierten Ebenen ge-bildet ist, welche scharfkantig aneinandergrenzen und somit jeder Querschnitt die Form eines Polygons aufweist,
M13 dass das Material des Lichtleiterstabs (2) frei von lichtstreuenden Komponenten ist, und
M14 dass der Lichtaustritt (4) des Lichtleiterstabes (2) in seinem Umriss bereits weitgehend der auf den Kopf gestellten benötigten Lichtverteilung entspricht und das durchtretende Licht durch die vorgeschaltete Sammellinse (5) nach dem optischen Projektionsgesetz in Form des aufrechten Umrisses abgestrahlt wird.
Die nachstehend wiedergegebene Figur 3 zeigt einen Schnitt durch eine erfindungsgemäße Anord-nung samt Strahlengang; die Figuren 4 und 5 erfindungsgemäße Optiken in anschaulicher Darstellung:
Die Beklagte erhielt mit öffentlicher Bekanntmachung vom 22.10.2022 von der ASFINAG den Auf-trag, an den Standorten A12, VKP Kundl, RFB Innsbruck, AQ km 22,525 und AQ km 23,007 die vor-handenen Prismenwender durch LED-Wechselverkehrszeichen bis 14.04.2023, im Übrigen bis 31.08.2023 zu erneuern (Beilage K8). Die Beklagte installierte in der Folge an den auftragsgegen-ständlichen Standorten LED-Wechselverkehrszeichen (CHAINZONE V1.2 - „Optik Version 2“), die
sie (unstrittig) von der Streithelferin bezog.
ANTRÄGE DER PARTEIEN:
Die Klägerin beantragte,
1. Es werde festgestellt, dass die in LED-Anzeigetafeln der mit der Seriennummer 18023020550 identifizierten Bauserie des Herstellers Chainzone (Foshan) Technology Co., Ltd. verbauten Sam-meloptiken die Patentansprüche 1, 2, 3, 4, 5, 10 und 14 des europäischen Patents EP 2 643 717 B1 verletzen.
2. Der Beklagten werde unter Androhung eines für jeden Fall der Zuwiderhandlung vom Gericht festzusetzenden Zwangsgeldes von bis zu EUR 100.000,00 aufgetragen, es ab sofort zu unterlas-sen, in Belgien, Deutschland, Dänemark, Frankreich, Italien, Luxemburg, Niederlande, Österreich, Schweden und Slowenien
farb- und lichtmischende Sammeloptiken, insbesondere als vollfarbtaugliches Pixel für bild-gebende Anzeigetafeln im Freien, für Spotlichter oder Signalisierung, die aus einer LED-Licht-quelle, sowie einem davor angeordneten Lichtleiterstab und einer Sammellinse bestehen, wobei die LED-Lichtquelle mehrere LED-Kristalle (Rot, Grün, Blau) enthält, die Lichteintritts-fläche des Lichtleiterstabes vor der Lichtaustrittsfläche der LED-Lichtquelle angeordnet ist und Licht jedes LED-Kristalls einfängt, wobei sich der Lichtleiterstab senkrecht zur Eintritts-fläche erstreckt und wobei sein Querschnitt konstant ist oder allmählich zunimmt,
anzubieten, in Verkehr zu bringen, zu gebrauchen oder zu diesen Zwecken einzuführen oder zu besitzen, bei denen
der Lichtaustritt des Lichtleiterstabes sich im Bereich des Fokus der Sammellinse befindet,
die Sammellinse das aus dem Mittelpunkt austretende Licht achsparallel bündelt und das Licht, das seitlich des Mittelpunktes des Lichtaustritts aus einem Punkt des Lichtaustritts austritt, in einer zugehörigen Richtungen parallel bündelt,
die Mantelfläche des Lichtleiterstabes aus optisch hochglanzpolierten Ebenen gebildet ist, welche scharfkantig aneinandergrenzen und somit jeder Querschnitt die Form eines Poly-gons aufweist, dass das Material des Lichtleiterstabs frei von lichtstreuenden Komponenten ist, und
der Lichtaustritt des Lichtleiterstabes in seinem Umriss bereits weitgehend der auf den Kopf gestellten benötigten Lichtverteilung entspricht und das durchtretende Licht durch die vor-geschaltete Sammellinse nach dem optischen Projektionsgesetz in Form des aufrechten Um-risses abgestrahlt wird;
insbesondere, wenn
der Lichtleiterstab (2) eine Länge aufweist, die ein Vielfaches des Durchmessers der Eintritts-fläche (3) ist;
oder wenn
die LED-Kristalle unterschiedliche Farben abstrahlen;
oder wenn
die Lichtquelle eine FullColor- oder Multi-LED mit einer Anzahl von Kristallen und/oder Far-ben in einem gemeinsamen Gehäuse ist;
insbesondere, wenn
die Lichtquelle eine FullColor- oder Multi-LED mit drei Kristallen in den Grundfarben Rot, Grün und Blau ist,
oder wenn
der Lichtleiterquerschnitt ein gleichseitiges Dreieck oder regelmäßiges Sechseck, Quadrat oder Rechteck ist;
und/oder wenn
der Lichtaustritt des Lichtleiterstabes nur virtuell vorhanden ist und der Lichtleiterstab un-mittelbar in die Sammellinse übergeht;
insbesondere in der Form der in LED-Anzeigetafeln der mit der Seriennummer 18023020550 identifizierten Bauserie des Herstellers Chainzone (Foshan) Technology Co., Ltd. verbauten Sam-meloptiken, wie sie auf den folgenden Abbildungen wiedergegeben seien:
3. Der Beklagten werde unter Androhung eines vom Gericht festzusetzenden Zwangsgeldes von bis zu EUR 100.000,00 für jeden Tag der Verzögerung aufgetragen, der Klägerin binnen 14 Tagen in schriftlicher Form Auskunft über den Ursprung und die Vertriebswege von Gegenständen gemäß Punkt 2. des Entscheidungsbegehrens, insbesondere der gemäß Punkt 1. das Streitpatent verlet-zenden Erzeugnisse, zu erteilen, und zwar unter Angabe
der Namen und Anschriften sowie sonstiger zur eindeutigen Identifikation erforderli-chen oder nützlichen Angaben aller an deren Herstellung und deren Vertrieb, insbeson-dere deren Einfuhr nach Österreich, beteiligten Personen;
der Namen und Anschriften aller gewerblichen Abnehmer, die diese Gegenstände von der Beklagten bezogen haben; und
der bestellten, erhaltenen und/oder ausgelieferten Mengen dieser Gegenstände sowie der Preise, die dafür von der Beklagten gezahlt wurden,
wobei zum Nachweis der Angaben die entsprechenden Kauf- und Verkaufsbelege (Rechnungen, Lieferscheine u.ä.) in Kopie vorzulegen seien, wobei geheimhaltungsbedürftige Details außerhalb der auskunftspflichtigen Daten geschwärzt werden dürfen.
4. Der Beklagten werde unter Androhung eines vom Gericht festzusetzenden Zwangsgeldes von bis zu EUR 100.000,00 für jeden Tag der Verzögerung aufgetragen, binnen 14 Tagen alle Gegen-stände gemäß Punkt 2. des Entscheidungsbegehrens, insbesondere alle gemäß Punkt 1. patent-verletzenden Erzeugnisse, die sich in ihrem unmittelbaren oder mittelbaren Besitz oder Eigentum befinden, auf eigene Kosten zu vernichten;
5. Der Beklagten werde unter Androhung eines vom Gericht festzusetzenden Zwangsgeldes von bis zu EUR 100.000,00 für jeden Tag der Verzögerung aufgetragen, auf eigene Kosten binnen 14 Ta-gen alle von ihr vertriebenen Gegenstände gemäß Punkt 2. des Entscheidungsbegehrens, insbe-sondere alle gemäß Punkt 1. patentverletzenden Erzeugnisse, unter Hinweis auf deren patentver-letzenden Zustand zurückzurufen und sich dabei, soweit erforderlich, gegenüber den Abnehmern zu verpflichten,
von diesen etwaig entrichtete Entgelte rückzuerstatten,
notwendige Demontage-, Verpackungs- und Transportkosten, und
mit der Rückgabe verbundene Zoll- und Lagerkosten zu übernehmen,
und die endgültig aus den Vertriebswegen zu entfernen, indem die Beklagte
die zurückgerufenen Gegenstände wieder an sich nimmt und gemäß Punkt 4. des Ent-scheidungsbegehrens vernichtet, oder
die Vernichtung der zurückgerufenen Produkte beim jeweiligen Besitzer veranlasst.
6. Die Beklagte sei verpflichtet, der Klägerin jeden Schaden inklusive entgangenen Gewinns zu er-setzen, welcher der Klägerin durch Handlungen gemäß Punkt 2. des Entscheidungsbegehrens entstanden sei oder zukünftig entstehen werde, wobei die Bestimmung der Höhe des Schadener-satzes einem Verfahren zur Festsetzung des Schadensersatzes gemäß R 125 ff VerfO vorbehalten sei.
7. Die Beklagte sei verpflichtet, der Klägerin die Kosten des Rechtsstreits und sonstigen in Zusam-menhang damit stehenden Kosten bis zur der vom Verwaltungsrat festgelegten Obergrenze zu ersetzen, wobei die Bestimmung der Höhe der zu ersetzenden Kosten einem Kostenfestsetzungs-verfahren gemäß R 150 ff VerfO vorbehalten bleibe.
8. Der Beklagten werde aufgetragen, den der Klage stattgebenden Teil der gegenständlichen Ent-scheidung binnen 8 Wochen auf eigene Kosten
jeweils in einer Ausgabe der Zeitschriften „tti – Traffic Technology International“ und „ITS International“ jeweils im Textteil mit Normallettern, wie für redaktionelle Beiträge be-stimmt, mit Fettdruckumrandung, Fettdrucküberschrift, gesperrt und fett gedruckten Na-men der Prozessparteien;
in eventu
in einem nach Ermessen des Gerichts zu bestimmenden Printmedium in vom Gericht fest-
gelegter Art zu veröffentlichen.
Die Klägerin beantragte ergänzend nach R 190 VerfO, der Beklagten die Vorlage eines von ihr an die ASFINAG gelieferten LED-Wechselverkehrszeichens anzuordnen, in eventu eines Bauteils („Display-Moduls“) daraus mit darin verbauten Eingriffsgegenständen, oder eines aus derselben Bauserie stammenden (i.e. mit derselben Seriennummer bezeichneten) LED-Wechselverkehrszeichens oder Bauteils („Display-Moduls“) daraus.
Die Beklagte und die Streithelferin beantragten,
1. Den Antrag auf Beweisvorlage nach R 190 VerfO abzuweisen;
2. Die Klage abzuweisen;
3. Die Klägerin zu verpflichten, der Beklagten die Kosten des Rechtsstreits und sonstigen in Zusammenhang damit stehenden Kosten bis zu der vom Verwaltungsrat festgelegten Obergrenze zu ersetzen, wobei die Bestimmung der Höhe der zu ersetzenden Kosten einem Kostenfestsetzungsverfahren gemäß R 150 ff VerfO vorbehalten bleibe.

Die Klägerin brachte vor, dass die in den von der Beklagten benützten LED-Wechselverkehrszei-chen verbauten Licht-Sammeloptiken in den Schutzbereich der Streitpatentansprüche 1 bis 5, 10 und 14 eingreifen würden; sämtliche Merkmale des Anspruchs 1, insbesondere die strittigen Merk-male M4 und M10 (Sammellinse, dadurch gekennzeichnet, dass der Lichtaustritt (4) des Lichtleiter-stabes (2) sich im Bereich des Fokus (F) und der Sammellinse (5) befindet), das Merkmal M11 (Mit-telpunkt (F)) sowie die Merkmale M12, M13 und M14 seien im Eingriffsgegenstand verwirklicht. Damit werden auch die (Unter-)Ansprüche 2 bis 5, 10 und 14 des Streitpatents verletzt.
In der mündlichen Verhandlung am 3.12.2024 führte die Klägerin ergänzend an, dass der Lichtleiter funktionell zu definieren sei. Der Lichtleiter ende dort, wo es keine Totalreflexion mehr an allen vier Seitenflächen der Mantelfläche gäbe. Daher liege der Fokus punktgenau an der Fläche, wo die grüne Line in der Abbildung 5 (Replik, Seite 15) ende. Da die Gutachtenserstellung und Einschät-zung von Dr. Gotschy (Beilage K12) sehr schwierig gewesen sei, weil sie auf der Autobahn zu erfol-gen gehabt habe, sei der Antrag auf Beweisvorlage gestellt worden. Sie verfüge nicht über den Eingriffsgegenstand und sei es ihr daher nicht möglich gewesen, die durch Augenscheinnahme auf der Autobahn gewonnenen Erkenntnisse über die Verletzung ihres Patents experimentell zu veri-fizieren. Beim Merkmal M11 gehe es um die Invertierung des Lichtaustritts, wobei es zwischenzei-tig auch gelungen sei, durch Versuche mit einer baugleichen Linse diese Invertierung nach Merk-mal M11 nachzuweisen. Es habe sich das bestätigt, was zuvor bereits angenommen worden sei. Diese Versuchsnachweise könnten noch vorgelegt werden.
Die Beklagte und die Streithelferin hielten dem entgegen, dass die von der Streithelferin bezogenen Anzeigetafeln eine Vielzahl von LED-Lichtquellen aufweisen würden, die jeweils LED-Kristalle in den Grundfarben enthalten. Vor jeder dieser LED-Lichtquelle sei ein Lichtleiterstab angeordnet, der einstückig mit einer Linse ausgebildet sei. Die Lichteintrittsfläche des Lichtleiterstabes sei vor der Lichtaustrittsfläche der LED-Lichtquelle angeordnet, wobei das Licht jedes LED-Kristalls eingefangen werde. Der Lichtleiterstab erstrecke sich jeweils senkrecht zu einer Eintrittsfläche. Die Streithelferin stelle zwei ähnliche optische Systeme her. „Version 1“ sei eine vereinzelte Sammeloptik einer ersten (größeren) Größe, die in eine Lochplatte einsetzbar oder aus der Lochplatte entnehmbar sei. „Version 2“ sei dem IOSB (Fraunhofer-Institut für Optronik) in einem verbauten Zustand als Bestandteil zweier Anzeigetafeln übersendet worden; je Anzeigetafel seien 8 × 16 optische Systeme matrixförmig zusammengefasst. Die „Version 2“ entspreche dem optischen System der Streithelferin, das von der Beklagten an die ASFINAG geliefert worden sei, wobei diese eine asymmetrische oder asphärische Linse habe, die aus dem Materialblock aus Polycarbonat ohne sichtbare Zwischenflächen gefertigt sei. Die Anzeigetafeln der Streithelferin, die an die ASFINAG geliefert worden seien, verwirklichen eine Vielzahl der Merkmale des Anspruchs 1 nicht.
Rein aus prozessökonomischen Gründen sei von einer Nichtigkeitswiderklage abgesehen worden, obgleich das Streitpatent gleich mehrfach über den Inhalt der Ursprungsoffenbarung hinausgehe (Erweiterung auf „Mantelflächen“ statt „allen Oberflächen“ oder Wegfall von „glatt“ bei optisch hochglanzpoliert“) und demnach aufgrund Art 138 Abs 1 lit c EPÜ nichtig zu erklären wäre. Da der Anspruch 1 des Streitpatents nicht verletzt werde, können auch die davon abhängigen Ansprüche 2 bis 5, 10 und 14 nicht verletzt werden.
Die Beklagte und die Streithelferin sprachen sich in der Verhandlung vom 3.12.2024 gegen die Vorlage neuer Vergleichsmessungen aus. Diese seien zum einen nach den Regelungen der VerfO verspätet; zum anderen widerspräche es einem fairen Verfahren, wenn diese Beweise zugelassen würden, weil für eine Überprüfbarkeit kein Raum und keine Zeit bestünde. Insgesamt sei der Vortrag der Klägerin unvollständig und widersprüchlich. Es gäbe keinen Nachweis einer Verletzung des Streitpatents. Wie mit dem IOSB objektiviert worden sei, gäbe es keine Totalreflexion mehr hinter der blauen Linie, also hinter dem Bereich, wo nicht mehr alle vier Oberflächen des Lichtleiterstabs optisch glatt hochglanzpoliert seien. Somit sei die Fokuslage beim Eingriffsgegenstand von der Klägerin falsch interpretiert worden. Es komme nach der abgeneigten Mantelfläche zu keiner Lichtdurchmischung mehr. Die eigentliche Lichtdurchmischung erfolge im Lichtleiterstab. Im Übrigen werde die Spiegelfläche im Streitpatent nicht definiert. Das Merkmal M10 sei nicht verwirklicht. Es erfolge keine Invertierung mehr nach der Lichtaustrittsfläche aus dem Lichtleiterstab. Das Merkmal M11 sei mit dem Merkmal M4 zu lesen, womit nichts anderes als eine sphärische Linse definiert werde. Der Eingriffsgegenstand habe aber eine asphärische Linse, wie sich dies aus Abbildung 3 des IOSB auf Seite 13 ergäbe. Der Fachmann verstehe unter einer hochglanzpolierten Fläche eine spezielle Herstellungsweise, die der Eingriffsgegenstand nicht erfülle, weil er eine in einem Spritzgussverfahren hergestellte Fläche sei. Die Merkmale M10 und M14 würden zwei Bedingungen erfordern: Merkmal M 10 definiere den Fokus im Bereich der Sammellinse dort, wo noch nach Merkmal M14 eine Invertierung stattfinden müsse. Erfolge keine Invertierung der Lichtverteilung in der Lichtaustrittsfläche mehr, liege der Lichtaustritt jedenfalls nicht im Bereich des Fokus (F) gemäß Merkmal M14. Dort wo die Klägerin den Fokus beim Eingriffsgegenstand sehe, gäbe es jedoch keine Invertierung mehr.
ENTSCHEIDUNGSGRÜNDE:
A.
Die Klage ist zulässig und begründet.
Die Zuständigkeit der angerufenen Lokalkammer ist zwischen den Parteien zu Recht nicht strittig. Die Klägerin ist zur Geltendmachung der streitgegenständlichen Ansprüche aus dem Streitpatent befugt.
B.
Die Beklagte und die Streithelferin haben keine Nichtigkeitswiderklage erhoben. Nach R 25 VerfO muss jedoch die Klageerwiderung eine Widerklage auf Nichtigerklärung des Patents gegen den Inhaber des Patents in Übereinstimmung mit R 42 VerfO enthalten, wenn die Behauptung aufgestellt wird, dass das angeblich verletzte Patent ungültig ist.
Da keine Nichtigkeitswiderklage erhoben wurde, ist auf den diesbezüglichen Nichtigkeitseinwand (Überschreitung der Ursprungsoffenbarung) inhaltlich nicht einzugehen.
C.
1. Der Schutzbereich des Streitpatents wurde bereits bei der kurzen Darstellung des Sachverhalts dargelegt. Zur Vermeidung von Wiederholungen wird darauf verwiesen.
2. Der Anspruch 1 des Streitpatents, insbesondere die zwischen den Parteien strittigen Merkmale M4, M 9, M10, M11 M 12 und M 14 in diesem Anspruch 1 bedürfen der näheren Auslegung:
2.1 Gemäß Art. 69 EPÜ iVm dem Protokoll über dessen Auslegung ist der Patentanspruch nicht nur der Ausgangspunkt, sondern die maßgebliche Grundlage für die Bestimmung des Schutzbereichs eines europäischen Patents. Für die Auslegung eines Patentanspruchs kommt es nicht allein auf seinen genauen Wortlaut im sprachlichen Sinne an. Vielmehr sind die Beschreibung und die Zeichnungen als Erläuterungshilfen für die Auslegung des Patentanspruchs stets mit heranzuziehen und nicht nur zur Behebung etwaiger Unklarheiten im Patentanspruch anzuwenden. Das bedeutet aber nicht, dass der Patentanspruch lediglich als Richtlinie dient und sich sein Gegenstand auch auf das erstreckt, was sich nach Prüfung der Beschreibung und der Zeichnungen als Schutzbegehren des Patentinhabers darstellt (UPC_CoA_335/2023, Anordnung vom 26.2.2023 iVm Anordnung vom 11.03.2024, GRUR-RS 2024, 2829, Leitsatz 2. und Rz 73 - 77 – 10x Genomics v. NanoString; UPC_CoA_182/2024, Anordnung vom 25.9.2024, Rz. 82 – Mammut v. Ortovox; vgl auch UPC_CFI_7/2024 (LD Düsseldorf), Entscheidung vom 3.7.2024, ORD_598324/2023 – Franz Kaldewei v. Bette).
2.2 Die Parteien definieren die zuständige Fachperson übereinstimmend und zu Recht als Signaltechniker mit Erfahrung im Bereich der optischen Signalanlagen, wobei die Fachperson mit den Grundlagen der geometrischen Optik vertraut ist, wie es bei einem Physiker mit Bachelorabschluss der Fall ist.
2.3 Dies vorausgesetzt legt die Lokalkammer der Entscheidung folgendes Verständnis der Merkmale des Anspruchs 1 des Streitpatents zugrunde:
2.3.1 Nach dem Verständnis der Fachperson vom Begriff „Sammellinse“ sollen ein auf sie fallen-
des paralleles Licht hinter der Linse zunächst in einem Bereich des Fokus zusammenkommen. Eine
Sammellinse kann grundsätzlich unterschiedliche Formen haben. Die Fachperson versteht unter
einer Sammellinse zwar insbesondere eine (einfache) sphärische Linse mit einer Ein- bzw Austritts-
fläche in Form eines Kugelsegments und einem entsprechenden Krümmungsradius. Sie weiß aller-
dings auch, dass bei sphärischen Linsen Abbildungsfehler/Aberrationen auftreten, die sich durch
asphärisch geformte Linsen vermeiden lassen.
Fraglich ist, ob die Beschreibung des Streitpatents eine (definitionsmäßige) Eingrenzung dieses Verständnisses der Fachperson beinhaltet. Das ist nicht der Fall: In Abs [0001] steht "...und einer Sammellinse, gemäß dem Oberbegriff des Anspruchs 1 und der US 2007/0024971“. In der US 2007/0024971 steht neben einer asphärischen Linse ua auch etwas von einer Fresnel-Linse. Damit ist davon auszugehen, dass weder die Beschreibung noch das US-Patent eine Eingrenzung von Merkmal M4 oder des dargelegten Verständnisses der Fachperson stützen, dass nur sphärische Sammellinsen vom Streitpatent erfasst sein sollen.
Damit ist der Klägerin zuzustimmen, dass die Fachperson unter dem Begriff „Sammellinse“ nicht nur (einschränkend) eine sphärische Linse versteht, sondern auch eine asphärische Linse. Eine Sammellinse muss in der Lage sein, Licht in einem Fokus – also einem Brennpunkt – der Linse zu bündeln. Für diese technische Funktion ist es (auch) nicht zwingend notwendig, dass die Linse per-fekt sphärisch ist (vgl Ausführungen in 2.3.2 zum Merkmal M10)
2.3.2 Dieses Verständnis lässt sich auch dem Merkmal M10 entnehmen. Das Merkmal M10 ist so definiert, dass der Lichtaustritt (4) des Lichtleiterstabes (2) sich im Bereich des Fokus (F) der Sam-mellinse (5) befindet. Grundsätzlich muss eine Sammellinse in der Lage sein, das Licht in einem Fokus – also einem Brennpunkt – der Linse zu bündeln. Wegen der möglichen Abbildungsfehler handelt es sich bei realen Sammellinsen jedoch nicht in der Regel um einen perfekten Fo-kus/Brennpunkt im Sinne eines geometrischen Punktes der Linse, so wie es die Beklagte zu inter-pretieren versucht. Damit im Einklang führt das Streitpatent in der Formulierung im Merkmal M10 daher offensichtlich einen „Bereich des Fokus (F)“ der Sammellinse (5) an.
2.3.3 Bei dem im Merkmal M11 angeführten Mittelpunkt (F) handelt es sich um den Mittelpunkt des Lichtaustritts (4) aus dem Lichtleiterstab (2). Der Lichtaustritt (4) soll sich gemäß Merkmal M10 nur im Bereich des Fokus (F) der Sammellinse (5) befinden und damit wiederum auch nicht zwingend exakt in einem perfekten Fokus/Brennpunkt der Sammellinse (vgl [0048], sowie Figur 3 und Figur 4 mit farblicher Markierung seitens der Klägerin / Merkmale M10 und M11). Dies drückt sich durch die unterschiedlichen Bezeichnungen „Fokus“ einerseits und „Mittelpunkt“ andererseits aus.
Damit ist das Merkmal M11 nicht anders zu verstehen, als dass das aus dem Mittelpunkt des Licht-austritts (4) des Lichtleiterstabs (2) austretende Licht achsparallel gebündelt wird und das Licht, das seitlich des Mittelpunktes (F) des Lichtaustritts (4) aus einem Punkt (P) des Lichtaustritts (4) austritt, in einer zugehörigen Richtung (p) (nicht Richtungen[!]) parallel gebündelt wird (vgl [0048], sowie Figur 3, Bezugszeichen (p)). Es ist daher nachvollziehbar, dass der Lichtaustritt (4) nach den optischen Gesetzen ins Unendliche projiziert wird, wobei jeder Punkt (P) des Lichtaustritts (4) sich in eine nach den optischen Gesetzen bestimmte Richtung (p) abbildet, unabhängig davon, welche Richtung die aus diesem Punkt austretenden einzelnen Lichtstrahlen haben (so wie es in [0048] beschrieben ist).
2.3.4 Die Mantelfläche des Lichtleiterstabes (2) hat gemäß den Merkmalen M12 und M13 die Form eines Polygons und ist aus optisch hochglanzpolierten Ebenen gebildet, wobei dessen Mate-rial frei von lichtstreuenden rauen Komponenten ist. Dies deckt sich mit dem Verständnis einer Fachperson, die davon ausgeht, dass die Wirkung eines Lichtleiters oder Lichtleiterstabs auf der sogenannten „Totalreflexion“ von Licht an dessen Mantelinnenfläche basiert. Durch die polygo-nale Form, deren Querschnitt nach Merkmal M9 konstant ist oder allmählich zunimmt, und durch die optisch hochglanzpolierten Ebenen (ohne streuende Komponenten) ist gewährleistet, dass das Licht der LED-Lichtquelle (1) durch eine mehrfache verlustlose Totalreflexion an den Wandungen des Lichtleiterstabes (2) bis zu dessen Lichtaustritt (4) geleitet wird (vgl [0034] und [0052]). Eine solche „Leitung“ des Lichts im Sinne eines Lichtleiters wäre im Falle von streuenden Komponenten in der Mantelfläche und dessen Ebenen nicht mehr gegeben.
Damit definieren die in Merkmal M12 genannten hochglanzpolierten Ebenen (ohne streuende Komponenten) und der Verlauf des Querschnitts auch das Ende des Lichtleiterstabs und den in den Merkmalen M10 und M14 angeführten Lichtaustritt (4) funktionell.
Entgegen der Behauptung der Beklagten setzt die Fachperson bei den Merkmalen M12 und M13 nicht voraus, dass oder wie der Lichtleiterstab tatsächlich im wörtlichen Sinne bei dessen Herstel-lungsprozess „hochglanzpoliert“ ist oder wurde. Die Fachperson weiß, dass ein Polierverfahren nicht der einzige Weg ist, um eine optisch polierte oder eine entsprechend glatte und damit eine spiegelnde/hochreflektierende Mantelfläche des Lichtleiterstabs zu erhalten. Es geht im Patentan-spruch darum, dass die Mantelfläche so glatt ist, dass sie das Licht beim Verlauf durch den Licht-leiterstab (vollständig/total) reflektiert.
Wie oben angeführt definiert das Ende der hochglanzpolierten Ebene (ohne streuende Kompo-nenten) und das Ende der damit verbundenen Totalreflexion des Lichts an der glatten Mantelflä-che den Lichtaustritt in funktioneller Weise. Im Streitpatent wird dazu erläutert, dass der Lichtaus-tritt (4) nur virtuell vorhanden sein kann (siehe das Ausführungsbeispiel gemäß Figur 4), wobei sich das Material bis zur Austrittskuppe (6) der Sammellinse (2) erstreckt, deren Fokus im virtuellen Lichtaustritt liegt (vgl [0055] und Abs. [0053]: In weiterer Ausgestaltung der Erfindung kann der Lichtaustritt (4) nur virtuell vorhanden sein, die Sammellinse (5) schließt unmittelbar und einstückig an den Lichtleiterstab 2 an). In [0055] der Patentschrift findet sich im Hinblick auf den virtuellen Lichtaustritt und anschließenden spiegelnden Seitenflächen zudem folgende Erläuterung: „An-schließend an den Lichtleiterstab (2) ist an der Oberseite eine geneigte Fläche(8) angesetzt, welche ein Spiegelbild des virtuellen Lichtaustritts unmittelbar oberhalb angrenzend erzeugt, ebenso wer-den die Seitenflächen (8a) des Lichtleiterstabes weitergeführt, wobei auch sie ein angrenzendes Spiegelbild des virtuellen Lichtaustritts erzeugen.“
Gemäß der Beschreibung des Streitpatents ist eine streuende Struktur bzw. Fläche als mögliche Ausgestaltung – entgegen der Auffassung der Beklagten – nicht als Teil des Lichtleiterstabes, son-dern als eine optisch wirksame Struktur im Bereich der Sammellinse (5) zu verstehen (vgl [0054] sowie auch [0053] und Figur 4 / Merkmal M13).
2.3.5 Das Merkmal M14, das die Fachperson in Zusammenhang mit Merkmal M10 liest, stellt ein inhärentes Merkmal der gegebenen Optik auf Basis der Gesetze der geometrischen Optik (wie auch von der Streithelferin auf Seite 5 des Streithilfeschriftsatzes erklärt) unter Berücksichtigung des Lichtaustritts (4) des Lichtleiterstabes (2) und der Sammellinse (5) dar. Es ergibt sich, dass – solange der Lichtaustritt sich im Fokusbereich der Sammellinse befindet – der Umriss des Lichtaus-tritts (4) des Lichtleiterstabes (2) weitgehend der auf den Kopf gestellten benötigten Lichtvertei-lung entspricht. Das durch den Lichtaustritt (4) tretende Licht wird dabei durch die vorgeschaltete Sammellinse (5) nach dem optischen Projektionsgesetz in Form des aufrechten Umrisses des Licht-austritts (4) abgestrahlt. Wie in der Patentschrift in [0048] mit Bezugnahme auf Figur 3 und einen Punkt P am Lichtaustritt (4) beschrieben, wird der Lichtaustritt (4) nach den optischen Gesetzen ins Unendliche projiziert, wobei jeder Punkt (P) des Lichtaustritts (4) sich in eine nach den opti-schen Gesetzen bestimmte Richtung (p) abbildet. Als Lichtverteilung der optischen Anordnung ergibt sich demnach ein gleichmäßig heller, gleichfarbiger, auf den Kopf gestellter Bereich in der Gestalt des Lichtaustritts (4).
3. Ausgehend von diesem Verständnis der Merkmale des Anspruch 1 des Streitpatents liegt eine Patentverletzung durch die Sammeloptik CHAINZONE V1.2 („Optik Version 2“) vor, die die Beklagte an die ASFINAG gelieferten hat. In dieser Sammeloptik wird von sämtlichen Merkmalen des An-spruchs 1 Gebrauch gemacht.
3.1 Bei der von der Klägerin angegriffenen Sammeloptik CHAINZONE V1.2 („Optik Version 2“) han-delt es um eine Sammeloptik, die einen Bildpunkt/Pixel eines Anzeigefelds einer im Freien ange-brachten bildgebenden Anzeigetafel für eine Signalisierung erzeugt (vgl. Abbildungen 2 und 3 der Klageschrift). Dabei entstehen für einen Betrachter durch eine additive Farbmischung des von ei-ner LED-Lichtquelle emittiertem Licht aus dem RGB-Farbraum (Rot, Grün, Blau) farbige oder weiße Bildpunkte/Pixel entsprechend Merkmal M1 (vgl Abbildung 3 der Klageschrift).
Die Sammeloptik weist (unstreitig) eine LED-Lichtquelle sowie einen davor angeordneten Licht-leiterstab entsprechend den Merkmalen M2 und M3 auf (vgl Abbildung 3 iVm Abbildung 4 in der Klageschrift sowie auch die Klageerwiderung samt Anlage S 13, Abbildung 5).
Neben der LED-Lichtquelle und dem davor angeordneten Lichtleiterstab beinhaltet die Sammelo-ptik auch eine Sammellinse, wobei es mit Verweis auf die obige Auslegung und das Verständnis der Fachperson unerheblich ist, ob es sich dabei um eine sphärische oder eine asphärische Linse handelt. Damit besteht die in Rede stehende Sammeloptik aus einer LED-Lichtquelle, einem Licht-leiterstab und auch einer Sammellinse, wie es in den Merkmalen M2 bis M4 angegeben ist.
Der sich senkrecht zur Lichteintrittsfläche erstreckende Lichtleiterstab der Sammeloptik ist vor der Lichtaustrittsfläche der LED-Lichtquelle mit mehreren farbigen LED-Kristallen (Rot, Grün, Blau) an-geordnet, wobei die Lichteintrittsfläche ebenfalls Licht jedes LED-Kristalls (RGB) einfängt, wie es in den Merkmalen M5 bis M8 angeführt ist (vgl ua Abbildungen 3 und 4).
3.2 Der Lichtleiterstab weist offensichtlich einen rechteckigen – und somit polygonalen – Quer-schnitt mit scharfkantig aneinandergrenzenden und glatten totalreflektierenden Ebenen auf, die den im Anspruch genannten hochglanzpolierten Ebenen entsprechen (vgl. Abbildung 4 der Klage-schrift sowie auch Abbildung 5 der Anlage S13 zur Klageerwiderung / Merkmal M12). Dabei er-kennt die Fachperson, dass sich der Lichtleiterstab entlang der hochglanzpolierten Mantelfläche ohne lichtstreuende Struktur infolge einer rauen Fläche erstreckt (vgl. blaue Linie in Abbildung 5 der Anlage S13 der Klageerwiderung sowie die blaue Linie in Abbildungen 5 und 6 der Replik / Merkmal M13). Dort wo der Querschnitt nicht länger (=konstant) oder (nur) allmählich zunimmt und die lichtstreuende Struktur in Form einer rauen, nicht mehr glatten Fläche des Materials) be-ginnt und damit die Totalreflexion an zumindest einer Ebene endet (vgl. linkes Ende der blauen Linie in Abbildung 5 der Replik), endet der Lichtleiterstab und findet der Lichtausritt aus dem Licht-leiterstab statt. Damit liegt der Lichtaustritt dort, wo in der Abbildung 5 der Replik eine grüne ge-strichelte Linie eingezeichnet ist (vgl Merkmale M10 und vorherige Ausführungen zur Auslegung und dem Verständnis der Fachperson im Zusammenhang mit Figur 4 des Streitpatents mitsamt zugehörigem Text [0053] sowie [0055]). Der Lichtaustritt entspricht damit einem virtuellen Licht-austritt, so wie es in der Patentschrift in Zusammenhang mit Figur 4 und dem zugehörigen Text beschrieben wird (vgl [0055] der Patentschrift: „Anschließend an den Lichtleiterstab (2) ist an der Oberseite eine geneigte Fläche (8) angesetzt, welche ein Spiegelbild des virtuellen Lichtaustritts unmittelbar oberhalb angrenzend erzeugt, ebenso werden die Seitenflächen (8a) des Lichtleiter-stabes weitergeführt, wobei auch sie ein angrenzendes Spiegelbild des virtuellen Lichtaustritts erzeugen“).
Entgegen der Auffassung der Beklagten ist der sich an den Lichtleiterstab anschließende Bereich mit einer aufgerauten streuenden Struktur (vgl rote Umrandung in Abbildung 6 der Replik) nicht mehr als Teil des Lichtleiterstabes anzusehen. Vielmehr handelt es ich hier um eine an den Licht-leiterstab anschließende Struktur. Der Lichtleiterstab selbst ist somit frei von lichtstreuenden Kom-ponenten, um Licht an seinen vier hochglanzpolierten Wänden als Mantelfläche mittels Totalre-flexion bis zu seiner Austrittsfläche zu leiten - und nicht schon vor der Austrittsfläche zu streuen (vgl vorherige Auslegung des Merkmals M10 iVm Merkmal M12 und insbesondere Merkmal M13).
3.3 Folglich befindet sich der Lichtaustritt bei der im Streit stehenden Sammeloptik CHAINZONE V1.2 am Ende der allmählich im Querschnitt zunehmenden polygonalen, polierten Mantelfläche (grün markiert in Abbildungen 5 bis 7 der Replik), in anderen Worten am Ende des Lichtleiterstabs (vgl Auslegung). Es handelt sich um einen virtuellen Lichtaustritt, und zwar einen solchen, der vom Anspruch 1 umfasst ist (vgl [0055] und vorstehende Ausführungen zur Auslegung des Begriffs „Lichtaustritt“). Davon ausgehend nimmt der Querschnitt des Lichtleiterstabs der im Streit stehen-den Sammeloptik CHAINZONE V1.2 – vom Lichteintritt in den Lichtleiterstab aus betrachtet – nur allmählich zu (und nicht abrupt aufgrund einer Kante [Merkmal M9 spricht von einer beanspruch-ten „oder“-Merkmalsalternative zu einem konstanten Querschnitt]).
Der Lichtaustritt befindet sich somit nicht am Ende des – an die hochglanzpolierte Mantelfläche des Lichtleiterstabs anschließenden – aufgerauten und damit lichtstreuenden Bereichs (rot um-randet in Abbildung 6 der Replik), wie es die Beklagte darzustellen versucht.
Des Weiteren ergibt sich daraus auch, dass sich der Lichtaustritt des hochglanzpolierten Lichtleiter-stabes im Bereich des Fokus der Sammellinse befindet, wobei den Ausführungen der Klägerin in ihrer Replik mit Verweis auf den in der Abbildung 8 dargestellten Strahlengang bzw. die optische Geometrie zuzustimmen ist (Merkmal M10).
Dies gilt ebenso in Bezug auf die Merkmale M11 und M14, die bei der im Streit stehenden Sam-mellinse aufgrund der zuvor genannten optischen Gegebenheiten verwirklicht sind (vgl Abbildun-gen 7, 8 und 9 der Replik, die jeweils auf Abbildung 18 der Klageerwiderung basieren).
3.4 Wie von der Klägerin in ihrer Replik zutreffend ausgeführt ist es aufgrund der von der Beklagten in Auftrag gegebenen Simulationen (durch IOSB) zwischen den Parteien nicht (mehr) streitig, wo der Fokusbereich der Sammellinse liegt. Dies wird durch den roten Kreis in der obigen Abbildung 8 angezeigt. Dies entspricht der Bildunterschrift der (ursprünglichen) Abbildung 18 in Seite 13, die lautet: „…Die „Raytracing“ Simulation zeigt, dass die Fokusbereiche im Inneren des Lichtleiterstabs liegen…“ (wobei der Lichtaustritt des Lichtleiterstabs von der Beklagten nicht korrekt an der Stelle der roten Linie dargestellt/definiert“ ist).
Nachdem der Spruchkörper oben dargelegt hat, dass sich der (virtuelle) Lichtaustritt am Ende des Lichtleiterstabs (grün gekennzeichnet in Abbildungen 7 und 8) befindet, ist somit gegeben, dass der Lichtaustritt sich im Bereich des Fokus der Sammellinse befindet. Nach optischen Projektions-gesetz ergibt sich, dass das Licht durch die vorgeschaltete Sammellinse in Form des aufrechten Umrisses des Lichtaustritts abgestrahlt wird. Daraus folgt auch, dass ein im unteren Bereich des Umrisses des Lichtaustritts des Lichtleiters der Sammeloptik CHAINZONE V1.2 liegender Punkt (ge-nauso wie Punkt (P) beim Lichtaustritt gemäß Figur 3 der Patentschrift) gemäß den optischen Ge-setzen in eine Richtung von unten nach schräg oben und damit auf den Kopf gestellt in eine Rich-tung projiziert, welcher der Richtung (p) in der Figur 3 der Patentschrift entspricht. Mit dem grün in den vorstehenden Abbildungen 7 und 8 eingezeichneten Lichtaustritt des Lichtleiterstabes im Bereich des Fokus der Sammellinse (vgl Merkmal M10) ergibt sich damit, dass der Umriss des Licht-austritts bereits weitgehend der auf den Kopf gestellten benötigten Lichtverteilung entspricht, wo-bei das durchtretende Licht durch die vorgeschaltete Sammellinse nach dem optischen Projekti-onsgesetz in Form des aufrechten Umrisses abgestrahlt wird; nicht anders als es im (inhärenten) Merkmal M14 angegeben ist.
Die Streithelferin berücksichtigt in ihrer Duplik nicht, dass der Anspruch/das Streitpatent nicht aus-schließt, dass weitere optische Strukturen nach dem (virtuellen) Lichtaustritt aus dem Lichtleiter-stab vorhanden sein können, die das Licht ebenfalls reflektieren können (wie oben besprochen unter Verweisung auf [0055]). Wird - basierend auf den durch zusätzliche Simulationen untermau-erten Behauptungen von der Streithelferin (CH3) - angenommen, dass dies bei der verletzenden Vorrichtung der Fall wäre, folgt daraus nicht, dass es am Ende des Lichtleitstabs im Sinne des An-spruchs keinen Lichtaustritt gibt; dass dies so ist, hat die Lokalkammer bereits erläutert.
3.5 Im Ergebnis weist die streitgegenständliche Sammeloptik CHAINZONE V1.2 sämtliche Merk-male der Sammeloptik gemäß dem Anspruch 1 des Streitpatents auf. Damit wird auch von den in den (Unter-)Ansprüchen 2 bis 5 sowie 10 und 14 genannten Merkmalen Gebrauch gemacht (vgl vorherige Ausführungen, die hier in gleicher Weise gelten). Sowohl die Beklagte als auch die Streit-helferin haben jeweils selbst vorgebracht, dass es sich bei den Ansprüchen 2 bis 5, 10 und 14 um von Anspruch 1 abhängige Ansprüche handelt, womit keine (inhaltlichen) Einwände gegen die Ver-letzung dieser Unteransprüche erhoben wurden.
4. Die Beklagte hat unstreitig Verletzungshandlungen nach Art 25 lit a EPGÜ begangen. Sie hat die von der Streithelferin erzeugten rechtsverletzenden LED-Wechselverkehrszeichen (CHAINZONE V1.2) aufgrund der Beauftragung durch die ASFINAG an den Standorten A12, VKP Kundl, RFB Innsbruck AQ km 22,525 und AQ km 23,007 verbaut und somit in den Verkehr gebracht.
In Bezug auf die sich daraus ergebenden Rechtsfolgen, die von der Klägerin beantragten wurden, muss vorausgeschickt werden, dass sich die Beklagte und die Streithelferin ausschließlich auf die Bestreitung der Nichtverletzung des Streitpatents fokussierten und zu den einzelnen begehrten Rechtsfolgen kein substanziiertes Vorbringen erstattet haben.
Vor diesem Hintergrund sind folgende im Einzelnen erläuterte Rechtsfolgen gerechtfertigt:
4.1 Feststellung der Patentverletzung (Punkt 1. des Klagebegehrens):
Die Feststellung der Patentverletzung gründet sich auf Art 64 Abs 2 lit a EPGÜ. Die Feststellung der Patentverletzung bildet die Grundlage dafür, dass das Gericht seine Befugnisse nach Art 56 ff EPGÜ ausüben kann (vgl. hierzu: Luginbühl/Hüttermann/Klein, Einheitspatentsystem, Art 64 Rz 8; Til-mann/Plassmann/Steininger, Einheitspatent/Einheitliches Patentgericht, Rz 13 Rz 19; so auch: UPC_CFI_210/2023 (LK Mannheim), Entscheidung vom 22.11.2024 – Panasonic v. OPPO).
4.2 Unterlassung (Punkt 2. des Klagebegehrens):
Die Klägerin hat unter Berücksichtigung der Umstände des Falls ein Recht auf Untersagung der Fortsetzung der Verletzung gem Art 25 lit a EPGÜ und/oder Art 26 EPGÜ iVm Art 63 Abs 1 EPGÜ.
Im Hinblick auf die begehrte Unterlassungsanordnung ist zu berücksichtigen, dass das Ausschließ-lichkeitsrecht der Kern des Wesens des Patentrechts (Art 25 EPGÜ) ist. Ein Absehen von einer Un-terlassungsanordnung kommt allenfalls nur in begründeten Ausnahmefällen in Betracht (vgl dazu Tilmann/von Falck/Tilmann, Einheitspatent, Einheitliches Patentgericht, Art 63 EPGÜ, Rz 29 ff.), wobei derartige Gründe hier nicht ersichtlich sind.
Die Beklagte hat nicht in Abrede gestellt, dass sie die streitgegenständlichen LED-Anzeigetafeln von der Streithelferin bezogen hat. Auch wenn die Klägerin nicht für jeden hier beantragten Ver-tragsmitgliedstaat ein in Verkehr bringen dargelegt hat, genügt der klägerische Vortrag jedenfalls dann, wenn die Beklagte das in Verkehr bringen nicht konkreter bestreitet. Indem die Beklagte anbietet und/oder in Verkehr bringt, liegt eine widerlegbare Vermutung dafür vor, dass sie die angegriffene Ausführungsform ebenfalls zu Zwecken des Anbietens, Inverkehrbringens oder Ge-brauchens einführt und/oder besitzt.
Es sind keine Umstände ersichtlich noch sind solche vorgetragen worden, die für eine Unverhält-nismäßigkeit der beantragten Unterlassungsanordnung sprechen würden. Die Beklagte darf in den von der Klage erfassten Vertragsmitgliedstaaten weder das Anbieten noch den Vertrieb fortsetzen. Gleiches gilt auch für das Gebrauchen sowie Einführen und Besitzen.
4.3 Auskunftsbegehren (Punkt 3. des Klagebegehrens):
Der Ausspruch, die begehrten Auskünfte zu erteilen, gründet sich auf Art 25 lit a, Art 26 iVm Art 67 Abs 1 EPGÜ. Die Auskünfte sind zur Berechnung des Schadenersatzes und zur Beurteilung, nö-tig, ob allenfalls weitere Personen/Unternehmen (Zwischenhändler, Importeure etc) an den Ver-letzungshandlungen beteiligt waren und/oder selbst solche gesetzt haben.
4.4 Vernichtung (Punkt 4. des Klagebegehrens):
Die Anordnung der Vernichtung gründet sich auf Art 25 li a EPGÜ iVm Art 64 Abs 2 lit e und Abs 4 EPGÜ.
Die Vernichtung soll den Eintritt oder Wiedereintritt der Erzeugnisse in den Markt zuverlässig ver-
hindern (Tilmann/von Falck/Tilmann, Einheitspatent, Einheitliches Patentgericht, Art 64 EPGÜ, Rz
33). Das diesbezügliche Klagebegehren zielt ohnedies nur auf eine Vernichtung der sich unmittel-
bar oder mittelbar im Beitz oder Eigentum der Beklagten befindlichen Eingriffsgegenstände ab,
womit keine Unverhältnismäßigkeit der Maßnahme gegeben ist.
4.5 Rückruf und Entfernung aus den Vertriebswegen (Punkt 5. des Klagebegehrens):
Der beantragte Rückruf aus den Vertriebswegen ist in Bezug auf die unmittelbar verletzenden Er-zeugnisse gerechtfertigt (vgl Art 25 lit a EPGÜ iVm Art 64 Abs 2 lit b und Abs 4 EPGÜ). Die Fassung des Antrags ist auch unter Bestimmtheitsgesichtspunkten nicht zu beanstanden.
Der Entscheidung hinsichtlich der endgültigen Entfernung aus den Vertriebswegen hat seine Grundlage in Art 25 lit a EPGÜ iVm Art 64 Abs 2 lit d und Abs 4 EPGÜ. Die endgültige Entfernung aus den Vertriebswegen ist nach dem Wortlaut des EPGÜ eine eigenständige, vom Rückruf zu tren-nende Maßnahme. Sie flankiert den Rückruf, wobei eine Entfernung nur dann in Betracht kommt, wenn der Verletzer hierzu die tatsächlichen und rechtlichen Möglichkeiten hat. Die Formulierung konkreter und hinreichend bestimmter Maßnahmen hat sich daran auszurichten (vgl UPC_CFI_7/2024 (LK Düsseldorf), Entscheidung vom 3.7.2024 – Kaldewei v. Bette). Dem trägt die Fassung des diesbezüglichen Klagebegehrens in einem noch ausreichendem Maß Rechnung.
4.6 Androhung von Zwangsgeld:
Die Androhung von Zwangsgeld in Bezug auf die Klagebegehren 2. bis 5. begegnet keinen Beden-ken (Art 63 Abs 2 EPGÜ); auch nicht bis zu dieser Höhe. Dies gilt auch unter Verhältnismäßigkeits-
gesichtspunkten. Die Androhung für die Maßnahmen der Unterlassung, Auskunft, Entfernung, Ver-
nichtung und Rückruf finden ihre Grundlage in Art 82 Abs 1 und Abs 4 EPGÜ, R 354.3 VerfO
(UPC_CFI_7/2023 (LK Düsseldorf), Entscheidung v. 3.7.2024, S. 31, F. 5. – Kaldewei v. Bette).
Das angedrohte Zwangsgeld gibt der Lokalkammer jeweils die notwendige Flexibilität, um im Fall des Zuwiderhandelns die jeweiligen Umstände des Einzelfalls einschließlich des Verhaltens des Verletzers zu berücksichtigen. Davon ausgehend kann gemäß Art 82 Abs 4 S 2 EPGÜ iVm R 354.4 VerfO ein angemessenes Zwangsgeld festgesetzt werden.
4.7 Feststellung der Schadenersatzpflicht dem Grunde nach (Punkt 6. des Klagebegehrens):
Art 68 Abs 1 EPGÜ ermöglicht die Feststellung der Zuerkennung der Schadenersatzpflicht dem Grunde nach. Ausgehend von den Umständen in diesem Fall hätte die Beklagte bei entsprechender Sorgfalt erkennen können und müssen, dass sie mit dem Eingriffsgegenstand der Streithelferin das Streitpatent verletzt. Dies zumindest seit der Erhebung der gegenständlichen Klage.
4.8 Veröffentlichung (Punkt 8. des Klagebegehrens):
Art 80 EPGÜ stellt es in das Ermessen des Gerichts, ob es eine Veröffentlichung gestattet oder nicht. Dabei ist zu berücksichtigen, dass eine Veröffentlichung auch ein zusätzliches Sanktionsele-ment enthält. Damit eine solche Anordnung ergehen kann, muss das Interesse der Klägerin an der Veröffentlichung die negativen Folgen für die Beklagte überwiegen. Im Regelfall kommt die Ge-stattung einer Veröffentlichung nur in Betracht, wenn der Schutz der Klägerin nicht bereits durch andere Maßnahmen gewährleistet ist (vgl UPC_CFI_373/2023 (LK Düsseldorf), Entscheidung vom 31.10.2024 – SodaStream v. Aarke).
Bei der Ermessensausübung sind jedoch die von Art 80 EPGÜ verfolgten Zwecke der Abschreckung künftiger Verletzer und der Sensibilisierung der Öffentlichkeit einzubeziehen. Das über den kon-kreten Verletzungsfall hinausgehende Präventionsinteresse der Patentinhaberin (= Klägerin) hat in die Abwägung der Interessen der Verfahrensparteien einzufließen (vgl Hoppe in Luginbühl/Hütter-mann, Einheitspatentsystem, EPGÜ Art 80 Rz 19).
Die Klägerin hat jedoch keine Gründe vorgetragen und/oder sind solche ersichtlich, die eine Ver-öffentlichung im Sinne der vorangestellten Grundsätze notwendig machen. Die Klägerin hat die Publikationsverpflichtung nur damit begründet, dass die relevante Öffentlichkeit über die erfolgte Patentverletzung informiert und aufgeklärt wird. Sie lässt aber offen, warum dies im konkreten Fall, insbesondere aufgrund welchen Präventionsinteresses es erforderlich wäre. Im Hinblick da-rauf und unter den Gesichtspunkten der Verhältnismäßigkeit sind daher die ohnedies zugespro-chenen Abhilfemaßnahmen nach Art 64 Abs 2 EPGÜ gegen die Beklagte ausreichend.
5. Beweismittelvorlage:
Ausgehend von den obigen Ausführungen konnte die Klägerin die Verletzung des Streitpatents unter Beweis stellen. Die Vorlage eines von der Beklagten an die ASFINAG gelieferten LED-Wech-selverkehrszeichens und/oder eines entsprechenden Bauteils daraus war nicht erforderlich, auch weil der Verletzungsgegenstand zwischen den Parteien nicht strittig war.
D. Kostengrundentscheidung:
Gemäß Art 69 Abs 2 EPGÜ iVm R 118.5 VerfO ist eine Kostengrundentscheidung zu treffen. Da die Beklagte in Bezug auf die Klage – bis auf das (nicht sonderlich ins Gewicht fallende) Veröffentli-chungsbegehren – unterlegen ist, ist es gerechtfertigt, ihr die Kosten der Klägerin insoweit dem Grunde nach aufzuerlegen.
Die Festsetzung der Obergrenzen für erstattungsfähige Vertreterkosten beruht auf dem Beschluss des Verwaltungsausschusses über die Obergrenzen erstattungsfähiger Kosten vom 24.4.2023 (D - AC/10/24042023_D).
Fraglich ist, inwieweit auch die Streithelferin der Klägerin dem Grunde nach Kosten zu ersetzen hat: Nach R 315.4 VerfO ist die Streithelferin als Partei zu behandeln. Obwohl die VerfO keine ge-sonderte Kostentragungsregel für die Streithilfe vorsieht, ist aus dem Grundsatz der R 315.4 VerfO abzuleiten, dass die Streithelferin auch hinsichtlich der Kostentragung wie eine Partei behandelt wird (vgl Greiner-Wittner; Werner in Luginbühl/Hüttermann, Einheitspatentsystem, VerfO R 315 Rz 41; Plassmann/Dorn in Tilmann/Plassmann, Einheitspatent Einheitliches Patentgericht, R 315 VerfO Rn 23).
Im Fall, dass die von ihr unterstützte Partei – wie im konkreten Fall – verliert, wäre eine verhält-nismäßige Kostenbeteiligung dem Grunde nach jedenfalls dann gerechtfertigt, wenn sie durch ihr Einschreiten bei der obsiegenden Partei einen Mehraufwand verursacht hat. Jedenfalls hat sie im Fall des Unterliegens ihr eigenen Kosten selbst zu tragen.
Im konkreten Fall hat die Streithelferin mit ihrem Streithilfeschriftsatz vom 19.8.2024 bei der Klä-gerin verhältnismäßig nur einen geringen Aufwand verursacht, weil das schriftliche Verfahren für sie zum damaligen Zeitpunkt schon abgeschlossen war. Die Klägerin hatte ihre Replik am selben Tag eingebracht. Die Klägerin hat sich daher nur mehr in der mündlichen Verhandlung mit dem Bestreitungsvorbringen der Streithelferin inhaltlich auseinandergesetzt. Dieser Umstand und je-ner, dass das Bestreitungsvorbringen der Streithelferin und der Beklagten sehr inhaltsähnlich wa-ren, was den zusätzlichen Aufwand für die Klägerin begrenzt, würde grundsätzlich eine (Mit-)Tra-gung der Kosten der Klägerin von 20 % durch die Streithelferin dem Grunde nach indizieren; 80 % der Kosten der Klägerin sollten von der Beklagten getragen werden. Sollten Argumente gegeben sein, die eine andere Aufteilung indizieren würden, könnten diese in einem allfälligen Kostenfest-setzungsverfahren noch vorgetragen werden.
ENTSCHEIDUNG:
1. Es wird festgestellt, dass die in LED-Anzeigetafeln der mit der Seriennummer 18023020550 identi-fizierten Bauserie des Herstellers Chainzone (Foshan) Technology Co. Ltd. verbauten Sammelopti-ken die Patentansprüche 1, 2, 3, 4, 5, 10 und 14 des europäischen Patents EP 2 643 717 B1 verlet-zen.
2. Der Beklagten wird unter Androhung eines für jeden Fall der Zuwiderhandlung vom Gericht fest-zusetzenden Zwangsgeldes von bis zu EUR 100.000,00 aufgetragen, es ab sofort zu unterlassen, in Belgien, Deutschland, Dänemark, Frankreich, Italien, Luxemburg, Niederlande, Österreich, Schwe-den und Slowenien
farb- und lichtmischende Sammeloptiken, insbesondere als vollfarbtaugliches Pixel für bild-gebende Anzeigetafeln im Freien, für Spotlichter oder Signalisierung, die aus einer LED-Licht-quelle, sowie einem davor angeordneten Lichtleiterstab und einer Sammellinse bestehen, wobei die LED-Lichtquelle mehrere LED-Kristalle (Rot, Grün, Blau) enthält, die Lichteintritts-fläche des Lichtleiterstabes vor der Lichtaustrittsfläche der LED-Lichtquelle angeordnet ist und Licht jedes LED-Kristalls einfängt, wobei sich der Lichtleiterstab senkrecht zur Eintritts-fläche erstreckt und wobei sein Querschnitt konstant ist oder allmählich zunimmt,
anzubieten, in Verkehr zu bringen, zu gebrauchen oder zu diesen Zwecken einzuführen oder zu besitzen, bei denen
der Lichtaustritt des Lichtleiterstabes sich im Bereich des Fokus der Sammellinse befindet,
die Sammellinse das aus dem Mittelpunkt austretende Licht achsparallel bündelt und das Licht, das seitlich des Mittelpunktes des Lichtaustritts aus einem Punkt des Lichtaustritts austritt, in einer zugehörigen Richtungen parallel bündelt,
die Mantelfläche des Lichtleiterstabes aus optisch hochglanzpolierten Ebenen gebildet ist, welche scharfkantig aneinandergrenzen und somit jeder Querschnitt die Form eines Poly-gons aufweist, dass das Material des Lichtleiterstabs frei von lichtstreuenden Komponenten ist, und
der Lichtaustritt des Lichtleiterstabes in seinem Umriss bereits weitgehend der auf den Kopf gestellten benötigten Lichtverteilung entspricht und das durchtretende Licht durch die vor-geschaltete Sammellinse nach dem optischen Projektionsgesetz in Form des aufrechten Um-risses abgestrahlt wird;
insbesondere, wenn
der Lichtleiterstab (2) eine Länge aufweist, die ein Vielfaches des Durchmessers der Eintritts-fläche (3) ist;
oder wenn
die LED-Kristalle unterschiedliche Farben abstrahlen;
oder wenn
die Lichtquelle eine FullColor- oder Multi-LED mit einer Anzahl von Kristallen und/oder Far-ben in einem gemeinsamen Gehäuse ist;
insbesondere, wenn
die Lichtquelle eine FullColor- oder Multi-LED mit drei Kristallen in den Grundfarben Rot, Grün und Blau ist,
oder wenn
der Lichtleiterquerschnitt ein gleichseitiges Dreieck oder regelmäßiges Sechseck, Quadrat oder Rechteck ist;
und/oder wenn
der Lichtaustritt des Lichtleiterstabes nur virtuell vorhanden ist und der Lichtleiterstab un-mittelbar in die Sammellinse übergeht;
insbesondere in der Form der in LED-Anzeigetafeln der mit der Seriennummer 18023020550 identifizierten Bauserie des Herstellers Chainzone (Foshan) Technology Co., Ltd. verbauten Sam-meloptiken, wie sie auf den folgenden Abbildungen wiedergegeben seien:
3. Der Beklagten wird unter Androhung eines vom Gericht festzusetzenden Zwangsgeldes von bis zu EUR 100.000,00 für jeden Tag der Verzögerung aufgetragen, der Klägerin binnen 14 Tagen in schriftlicher Form Auskunft über den Ursprung und die Vertriebswege von Gegenständen gemäß Punkt 2. des Entscheidungsbegehrens, insbesondere der gemäß Punkt 1. das Streitpatent verlet-zenden Erzeugnisse, zu erteilen, und zwar unter Angabe
der Namen und Anschriften sowie sonstiger zur eindeutigen Identifikation erforderli-chen oder nützlichen Angaben aller an deren Herstellung und deren Vertrieb, insbeson-dere deren Einfuhr nach Österreich, beteiligten Personen;
der Namen und Anschriften aller gewerblichen Abnehmer, die diese Gegenstände von der Beklagten bezogen haben; und
der bestellten, erhaltenen und/oder ausgelieferten Mengen dieser Gegenstände sowie der Preise, die dafür von der Beklagten gezahlt wurden,
wobei zum Nachweis der Angaben die entsprechenden Kauf- und Verkaufsbelege (Rechnungen, Lieferscheine u.ä.) in Kopie vorzulegen sind, wobei geheimhaltungsbedürftige Details außerhalb der auskunftspflichtigen Daten geschwärzt werden dürfen.
4. Der Beklagten wird unter Androhung eines vom Gericht festzusetzenden Zwangsgeldes von bis zu EUR 100.000,00 für jeden Tag der Verzögerung aufgetragen, binnen 14 Tagen alle Gegenstände gemäß Punkt 2. des Entscheidungsbegehrens, insbesondere alle gemäß Punkt 1. patentverletzen-den Erzeugnisse, die sich in ihrem unmittelbaren oder mittelbaren Besitz oder Eigentum befinden, auf eigene Kosten zu vernichten;
5. Der Beklagten wird unter Androhung eines vom Gericht festzusetzenden Zwangsgeldes von bis zu EUR 100.000,00 für jeden Tag der Verzögerung aufgetragen, auf eigene Kosten binnen 14 Tagen alle von ihr vertriebenen Gegenstände gemäß Punkt 2. des Entscheidungsbegehrens, insbeson-dere alle gemäß Punkt 1. patentverletzenden Erzeugnisse, unter Hinweis auf deren patentverlet-zenden Zustand zurückzurufen und sich dabei, soweit erforderlich, gegenüber den Abnehmern zu verpflichten,
von diesen etwaig entrichtete Entgelte rückzuerstatten,
notwendige Demontage-, Verpackungs- und Transportkosten, und
mit der Rückgabe verbundene Zoll- und Lagerkosten zu übernehmen,
und die endgültig aus den Vertriebswegen zu entfernen, indem die Beklagte
die zurückgerufenen Gegenstände wieder an sich nimmt und gemäß Punkt 4. des Ent-scheidungsbegehrens vernichtet, oder
die Vernichtung der zurückgerufenen Produkte beim jeweiligen Besitzer veranlasst.
6. Die Beklagte ist verpflichtet, der Klägerin jeden Schaden inklusive entgangenen Gewinns zu erset-zen, welcher der Klägerin durch Handlungen gemäß Punkt 2. des Entscheidungsbegehrens ent-standen ist oder zukünftig entstehen wird, wobei die Bestimmung der Höhe des Schadenersatzes einem Verfahren zur Festsetzung des Schadensersatzes gemäß R 125 ff VerfO vorbehalten ist.
7. Das Begehren, der Beklagten werde aufgetragen, den der Klage stattgebenden Teil der gegen-ständlichen Entscheidung binnen 8 Wochen auf eigene Kosten
jeweils in einer Ausgabe der Zeitschriften „tti – Traffic Technology International“ und „ITS
International“ jeweils im Textteil mit Normallettern, wie für redaktionelle Beiträge be-
stimmt, mit Fettdruckumrandung, Fettdrucküberschrift, gesperrt und fett gedruckten Na-
men der Prozessparteien, in eventu
in einem nach Ermessen des Gerichts zu bestimmenden Printmedium in vom Gericht fest-
gelegter Art
zu veröffentlichen, wird abgewiesen.
8. Die Beklagte und die Streithelferin sind dem Grunde nach verpflichtet, der Klägerin die Kosten des Rechtsstreits und sonstigen in Zusammenhang damit stehenden Kosten bis zur der vom Verwal-tungsrat festgelegten Obergrenze zu ersetzen, wobei die Bestimmung der Höhe der zu ersetzen-den Kosten einem Kostenfestsetzungsverfahren gemäß R 150 ff VerfO vorbehalten bleibt.

1. If it is alleged in the proceedings that the allegedly infringed patent is invalid, according to R 25
RoP the statement of defence must contain a counterclaim for a declaration of invalidity of the
patent against the proprietor of the patent in accordance with R 42 RoP. If this is not done, the

2. The final removal from the distribution channels is a separate measure from the recall. It
accompanies the recall, whereby removal can only be considered if the infringer has the actual

3. Art 80 UPCA leaves it to the discretion of the court whether or not to authorise publication. For
such an order to be issued, the plaintiff's interest in publication must outweigh the possible
(adverse) consequences of such publication for the defendant. As a rule, such publication can
only be considered if the protection of the plaintiff is not already guaranteed by other
measures (see UPC_CFI_373/2023 (LK Düsseldorf), decision of 31 October 2024 - SodaStream v.

When exercising discretion, the purposes pursued by Art 80 UPCA (deterrence of future
infringers and raising public awareness) must also be taken into account. However, this
requires a submission as to what justifies the preventive interest in the specific case of
infringement.
4. Although the RoP does not provide for a separate cost rule for intervention, it can be inferred
from the principle of R 315.4 RoP that the intervener is also treated as a party with regard to
the bearing of costs. In the event that the party supported by it loses - as in the specific case - a
proportionate contribution to costs would be justified on the merits in any case if it has caused
additional expenses for the winning party through its intervention. In any case, it must bear its
own costs if it loses.

BRIEF DESCRIPTION OF THE FACTS:
The plaintiff is bringing a claim against the defendant for infringement of its European patent EP 2
643 717 B1 entitled "Colour mixing collecting optics" (in short: patent in suit). The patent in suit, the
grant of which was published on 26 January 2022, was filed on 17 November 2011. The application
was published on 26 January 2022 and claims priority from 23 November 2010 (AT 19512010); it is in
force in various UPCA member states.
The patent in suit relates to a colour and light mixing collection optic for outdoor imaging display
panels for spotlights or signalling, consisting of an LED light source as well as a light guide rod
arranged in front of it and a collecting lens. A colour- and light-mixing converging lens was known
from the state of the art according to US 2007/0024971, whereby the mixing is achieved by the
special design of the cross-section of the light guide rod with strips and concave indentations. In
embodiments, TIR collimators are also provided as converging lenses with a special order in front of
the fibre optic rod. A particular disadvantage is the high cost of the complex light guide rod and the
relatively large longitudinal extension ([0002]).
With large LED screens, it is very complex to install individual single-colour LEDs with lens domes in
such a way that they are all precisely aligned with each other ([0011]). In principle, light transmission
by means of an optical fibre, at one end of which a light source shines in and at the other end of
which the emitted light is distributed by an optical system, has been known for a long time. However,
this basic system can be modified by an enormous number of parameters, resulting in an immense
variety of properties and design options ([0020]).
Based on the prior art, the invention according to the description of the patent was based on the task
of building an optical system which completely mixes the light of different LED crystals of a full-colour
or multi-LED with each other in such a way that its intensity and direction is maintained in a small
space and can then be bundled in a known manner without forming colour differences, colour fringes
or colour spots for the viewer, whereby the order must be inexpensive and small ([0028 and 0032]).
To solve this problem, the patent in suit proposes a collecting optic with the features of patent claim

emerging from the centre point (F) parallel to the axis and concentrates the light emerging

in parallel in an associated direction (p), in that the lateral surface of the light guide rod (2) is
formed from optically highly polished planes which adjoin one another with sharp edges and
thus each cross-section has the shape of a polygon, in that the material of the light guide rod
(2) is made of a polygonal material, and in that the light guide rod (2) is made of a polygonal
material.
(2) is free of light-scattering components, and that the outline of the light exit (4) of the light
guide rod (2) already largely corresponds to the required upside-down light distribution and
the light passing through is emitted by the upstream collecting lens (5) in accordance with the
optical projection law in the form of the upright outline.
Patent claim 1 can be subdivided into the following features:
M1 Colour- and light-mixing collecting optics, in particular as a full-colour pixel for image-outdoor

In a public announcement dated 22 October 2022, the defendant received an order from ASFINAG to
replace the existing prismatic variable message signs at the A12, VKP Kundl, RFB Innsbruck, AQ km
22.525 and AQ km 23.007 locations with LED variable message signs by 14 April 2023 and otherwise
by 31 August 2023 (Annex K8). The defendant subsequently installed LED variable message signs
(CHAINZONE V1.2 - "Optik Version 2") at the locations subject to the order, which it (undisputedly)
procured from the intervener.
FORM OF ORDER SOUGHT BY THE PARTIES:
The plaintiff requested,
1. It be declared that the sample optics installed in LED display panels of the series of the manufacturer
Chainzone (Foshan) Technology Co., Ltd. identified by the serial number 18023020550 infringe
patent claims 1, 2, 3, 4, 5, 10 and 14 of the European patent EP 2 643 717 B1.
2. The defendant is ordered, on pain of a penalty payment of up to EUR 100,000.00 to be determined
by the court for each case of infringement, to refrain with immediate effect from infringing in
Belgium, Germany, Denmark, France, Italy, Luxembourg, the Netherlands, Austria,
Sweden and Slovenia
Colour and light-mixing collecting optics, in particular as a full-colour pixel for outdoor display
panels, for spotlights or signalling, consisting of an LED light source and a light guide rod
arranged in front of it and a collecting lens, wherein the LED light source contains several LED
crystals (red, green, blue), the light entry surface of the light guide rod is arranged in front of the
light exit surface of the LED light source and captures light from each LED crystal, wherein the
light guide rod extends perpendicular to the entry surface and wherein its cross-section is
constant or gradually increases,
to offer, place on the market, use, import or possess for these purposes, in which
the light outlet of the light guide rod is located in the area of the focus of the converging lens,
the converging lens concentrates the light emerging from the centre parallel to the axis and
concentrates the light emerging from a point of the light outlet to the side of the centre of the
light outlet in parallel in an associated direction,
the lateral surface of the light guide rod is formed from optically highly polished planes which
adjoin each other with sharp edges and thus each cross-section has the shape of a polygon, that
the material of the light guide rod is free of light-scattering components, and
the outline of the light emission of the fibre-optic rod already largely corresponds to the required
upside-down light distribution and the light passing through is emitted by the upstream
converging lens in accordance with the optical projection law in the form of the upright outline;
especially if
the fibre-optic rod (2) has a length which is a multiple of the diameter of the entrance surface (3);
or if
the LED crystals emit different colours;
or if
the light source is a full-colour or multi-LED with a number of crystals and/or colours in a
common housing;
in particular if
the light source is a full-colour or multi-LED with three crystals in the primary colours red, green
and blue
or if
the light guide cross-section is an equilateral triangle or regular hexagon, square or rectangle;

and/or if
the light emission of the light guide rod is only virtual and the light guide rod merges directly into
the converging lens;
in particular in the form of the sample optics installed in LED display panels of the series of the
manufacturer Chainzone (Foshan) Technology Co., Ltd. identified with the serial number
18023020550, as shown in the following illustrations:
3. The defendant is ordered, on pain of a penalty payment of up to EUR 100,000.00 to be determined
by the court for each day of delay, to provide the plaintiff within 14 days with information in writing
on the origin and distribution channels of objects pursuant to item 2 of the request for a decision, in
particular the products infringing the patent in suit pursuant to item 1, stating
• the names and addresses and other information necessary or useful for clear identification
of all persons involved in their manufacture and distribution, in particular their importation
into Austria;
• the names and addresses of all commercial customers who have purchased these items
from the defendant; and
• the quantities of such items ordered, received and/or delivered and the prices paid for
them by the defendant,
whereby copies of the relevant purchase and sales documents (invoices, delivery notes, etc.) are to be
submitted as proof of the information, whereby details requiring secrecy outside the data subject to
disclosure may be blacked out.
4. The defendant is ordered, under penalty of a fine of up to EUR 100,000.00 to be determined by the
court for each day of delay, to destroy at its own expense within 14 days all items pursuant to item 2
of the request for a decision, in particular all products infringing the patent pursuant to item 1, which
are in its direct or indirect possession or ownership;
5. The defendant is ordered, on pain of a penalty payment of up to EUR 100,000.00 to be determined by
the court for each day of delay, to recall at its own expense within 14 days all items distributed by it
pursuant to item 2 of the request for a decision, in particular all products infringing the patent
pursuant to item 1, with reference to their patent-infringing condition and, if necessary, to undertake
vis-à-vis the customers,
• to refund any fees paid by the customers,
• necessary dismantling, packaging and transport costs, and
• to bear the customs and storage costs associated with the return, and to
permanently remove them from the distribution channels by the defendant
• taking back the recalled items and destroying them in accordance with point 4 of the
request for a decision, or
• the destruction of the recalled products at the respective owner.
6. The defendant is obliged to compensate the plaintiff for any damage, including loss of profit, which
the plaintiff has suffered or will suffer in the future as a result of actions pursuant to point 2 of the
request for a decision.

the amount of damages is reserved for a procedure for the determination of damages pursuant to R
125 et seq. of the RoP.
7. The defendant is obliged to reimburse the plaintiff for the costs of the legal dispute and other related
costs up to the upper limit set by the Board of Directors, whereby the determination of the amount
of the costs to be reimbursed is reserved for cost assessment proceedings pursuant to R 150 et seq.

8. The defendant is instructed to pay the part of the decision in favour of the action within 8 weeks at
its own expense.

International", in each case in the text section with normal type as intended for editorial
articles, with bold print border, bold print headline, blocked and bold print names of the
parties to the proceedings;

•in a print medium to be determined at the discretion of the court in a manner determined by
the court.
The plaintiff additionally requested, pursuant to R 190 RoP, that the defendant be ordered to
produce an LED variable message sign supplied by it to ASFINAG, or, in the alternative, a component
("display module") thereof with interfering objects installed therein, or an LED variable message sign
or component ("display module") thereof from the same series (i.e. labelled with the same serial
number).
The defendant and the intervener applied,
1. Dismiss the application for the submission of evidence pursuant to R 190 RoP;
2. Dismiss the action;
3. Order the applicant to reimburse the defendant for the costs of the dispute and other
related costs up to the upper limit set by the Board of Directors, with the determination of
the amount of the costs to be reimbursed being reserved for a cost determination
procedure pursuant to R 150 et seq. of the RoP.
ARGUMENTS OF THE PARTIES:
The plaintiff argued that the light-collecting optics installed in the LED variable message signs used by
the defendant would interfere with the scope of protection of the disputed patent claims 1 to 5, 10
and 14; all features of claim 1, in particular the disputed features M4 and M10 (converging lens,
characterised in that the light exit (4) of the light guide rod (2) is located in the area of the focus (F)
and the converging lens (5)), feature M11 (centre point (F)) and features M12, M13 and M14 are
realised in the subject-matter of the interference. Thus, (sub)claims 2 to 5, 10 and 14 of the patent in
suit are also infringed.
At the hearing on 3 December 2024, the plaintiff added that the light guide should be defined
functionally. The light guide ends where there is no longer total reflection on all four sides of the
lateral surface. Therefore, the focus is precisely on the surface where the green line in Figure 5
(replica, page 15) ends. As the expert opinion and assessment by Dr Gotschy (enclosure K12) was very
difficult because it had to be carried out on the motorway, the application for the submission of
evidence was made. She was not in possession of the object of the intervention and was therefore
not able to verify the findings obtained by visual inspection on the motorway.

the motorway to experimentally verify the findings on the infringement of its patent. Feature M11
concerned the inversion of the light emission, whereby it had also been possible in the meantime to
prove this inversion according to feature M11 by means of tests with an identical lens. What had
previously been assumed had been confirmed. This test evidence could still be presented.
The defendant and the intervener countered that the display panels purchased from the intervener
had a large number of LED light sources, each of which contained LED crystals in the primary colours.
In front of each of these LED light sources, a light guide rod was arranged, which was formed in one
piece with a lens. The light entry surface of the light guide rod is arranged in front of the light exit
surface of the LED light source, whereby the light of each LED crystal is captured. The light guide rod
extends perpendicular to an entry surface. The intervener manufactures two similar optical systems.
"Version 1" is an isolated collector optic of a first (larger) size, which can be inserted into a perforated
plate or removed from the perforated plate. "Version 2" was sent to the IOSB (Fraunhofer Institute of
Optronics) in an installed state as part of two display panels; 8 × 16 optical systems were combined in
a matrix form on each display panel. Version 2' corresponds to the intervener's optical system
supplied by the defendant to ASFINAG, which has an asymmetrical or aspherical lens made of a
polycarbonate material block without visible intermediate surfaces. The intervener's display panels
supplied to ASFINAG do not fulfil a large number of the features of claim 1.
Purely for reasons of procedural economy, a nullity counterclaim was not filed, although the patent
in suit goes beyond the content of the original disclosure in several respects (extension to "lateral
surfaces" instead of "all surfaces" or omission of "smooth" in the case of "optically highly polished")
and would therefore have to be declared null and void on the basis of Art 138 (1) (c) EPC. Since claim
1 of the patent in suit is not infringed, the dependent claims 2 to 5, 10 and 14 cannot be infringed
either.
The defendant and the intervener opposed the submission of new comparative measurements at the
hearing on 3 December 2024. On the one hand, these were late according to the provisions of the
RoP; on the other hand, it would be contrary to a fair trial if this evidence were admitted because
there would be no room and no time for verifiability. Overall, the applicant's submission was
incomplete and contradictory. There was no evidence of an infringement of the patent in suit. As
objectified by the IOSB, there was no longer any total reflection behind the blue line, i.e. behind the
area where all four surfaces of the light guide rod were no longer optically smooth and highly
polished. Thus, the focal position of the object of the intervention had been misinterpreted by the
plaintiff. There is no longer any mixing of light after the inclined lateral surface. The actual light
mixing takes place in the fibre optic rod. Moreover, the mirror surface is not defined in the patent in
suit. Feature M10 was not realised. There is no longer any inversion after the light exit surface from
the fibre-optic rod. Feature M11 was to be read with feature M4, which defined nothing other than a
spherical lens. However, the intervention object has an aspherical lens, as can be seen from Figure 3
of the IOSB on page 13. The skilled person would understand a highly polished surface to be a special
manufacturing method, which the subject-matter of the interference does not fulfil because it is a
surface manufactured using an injection moulding process. Features M10 and M14 would require
two conditions: Feature M10 defines the focus in the area of the converging lens where an inversion
must still take place according to feature M14. If the light distribution in the light-emitting surface is
no longer inverted, the light emission is in any case

not in the area of the focus (F) according to feature M14. However, where the plaintiff sees the focus
at the object of intervention, there is no longer any inversion.
REASONS FOR THE DECISION:
A.
The action is admissible and well-founded.
The jurisdiction of the Local Division seised is rightly not in dispute between the parties. The plaintiff
is authorised to assert the claims at issue in the patent in suit.
B.
The defendant and the intervener have not filed a revocation counterclaim. However, according to R
25 RoP, the statement of defence must contain a counterclaim for a declaration of invalidity of the
patent against the proprietor of the patent in accordance with R 42 RoP if the allegation is made that
the allegedly infringed patent is invalid.
Since no nullity counterclaim was filed, the content of the related nullity objection (exceeding the
original disclosure) does not need to be addressed.
C.
1. The scope of protection of the patent in suit has already been set out in the brief description
of the facts. Reference is made to this in order to avoid repetition.
2. Claim 1 of the patent in suit, in particular features M4, M9, M10, M11, M12 and M14 in this
claim 1, which are disputed between the parties, require further interpretation:
2.1 According to Art. 69 EPC in conjunction with the Protocol on its interpretation, the patent
claim is not only the starting point, but the decisive basis for determining the scope of protection of a
European patent. The interpretation of a patent claim does not depend solely on its exact wording in
the linguistic sense. Rather, the description and the drawings must always be taken into account as
explanatory aids for the interpretation of the patent claim and not only be used to resolve any
ambiguities in the patent claim. However, this does not mean that the patent claim merely serves as a
guideline and that its subject matter also extends to what, after examination of the description and
the drawings, appears to be the patentee's request for protection (UPC_CoA_335/2023, order of 26
February 2023 in conjunction with order of 26 February 2023, UPC_CoA_335/2023).2.2023 in
conjunction with order of 11.03.2024, GRUR-RS 2024, 2829, Headnote 2. and para. 73 - 77 - 10x
Genomics v. NanoString; UPC_CoA_182/2024, order of 25.9.2024, para. 82 - Mammut
v. Ortovox; see also UPC_CFI_7/2024 (LD Düsseldorf), decision of 3 July 2024, ORD_598324/2023 -
Franz Kaldewei v. Bette).
2.2 The parties agree and rightly define the competent expert as a signalling technician with
experience in the field of optical signalling systems, whereby the expert is familiar with the basics of
geometric optics, as is the case with a physicist with a bachelor's degree.
2.3 Assuming this to be the case, the Local Division bases its decision on the following
understanding of the features of claim 1 of the patent in suit:

2.3.1 According to the specialist's understanding of the term "converging lens", a parallel light
falling on it should initially come together behind the lens in one area of the focus. A converging lens
can have different shapes. The skilled person understands a converging lens in particular to be a
(simple) spherical lens with an entrance or exit surface in the form of a spherical segment and a
corresponding radius of curvature. However, it also knows that imaging errors/ aberrations occur
with spherical lenses, which can be avoided with aspherically shaped lenses.
It is questionable whether the description of the patent in suit contains a (definitional) limitation of
this understanding of the skilled person. This is not the case: para [0001] states "...and a converging
lens, according to the generic term of claim 1 and US 2007/0024971". In addition to an aspherical
lens, US 2007/0024971 also mentions a Fresnel lens. It can thus be assumed that neither the
description nor the US patent support a limitation of feature M4 or the understanding of the skilled
person that only spherical converging lenses are to be covered by the patent in suit.
The applicant must therefore agree that the skilled person understands the term "converging lens" to
mean not only (restrictively) a spherical lens, but also an aspherical lens. A converging lens must be
able to concentrate light in a focus - i.e. a focal point - of the lens. For this technical function, it is
(also) not absolutely necessary for the lens to be perfectly spherical (see explanations in 2.3.2 on
feature M10)
2.3.2 This understanding can also be seen in feature M10. Feature M10 is defined in such a way
that the light exit (4) of the light guide rod (2) is located in the area of the focus (F) of the converging
lens (5). In principle, a converging lens must be able to concentrate the light in a focus - i.e. a focal
point - of the lens. However, due to the possible imaging errors, real converging lenses are not
generally a perfect focus/focal point in the sense of a geometric point of the lens, as the defendant
attempts to argue. In line with this, the wording in feature M10 of the patent in suit therefore
obviously refers to a "region of the focus (F)" of the converging lens (5).
2.3.3 The centre point (F) specified in feature M11 is the centre point of the light exit (4) from the
light guide rod (2). According to feature M10, the light exit (4) should only be located in the area of
the focus (F) of the converging lens (5) and therefore not necessarily exactly in a perfect focus/focal
point of the converging lens (see [0048], as well as Figure 3 and Figure 4 with coloured marking by the
applicant / features M10 and M11). This is expressed by the different designations "focus" on the one
hand and "centre point" on the other.
The feature M11 is thus to be understood in no other way than that the light emerging from the
centre of the light exit (4) of the light guide rod (2) is bundled parallel to the axis and the light
emerging from a point (P) of the light exit (4) to the side of the centre (F) of the light exit (4) is
bundled parallel in an associated direction (p) (not directions[!]) (see [0048], as well as Figure 3,
reference sign (p)). It is therefore understandable that the light exit (4) is projected to infinity
according to the laws of optics, whereby each point (P) of the light exit (4) is imaged in a direction (p)
determined according to the laws of optics, irrespective of the direction of the individual light rays
emerging from this point (as described in [0048]).

2.3.4 According to features M12 and M13, the cladding surface of the light guide rod (2) has the
shape of a polygon and is formed from optically highly polished planes, whereby its material is free of
light-scattering rough components. This is in line with the understanding of an expert who assumes
that the effect of a light guide or light guide rod is based on the so-called "total reflection" of light on
its inner surface. The polygonal shape, the cross-section of which is constant or gradually increases
according to feature M9, and the optically highly polished planes (without scattering components)
ensure that the light from the LED light source (1) is guided by multiple lossless total reflection on the
walls of the light guide rod (2) up to its light outlet (4) (see [0034] and [0052]). Such "guidance" of the
light in the sense of a light guide would no longer exist in the case of scattering components in the
cladding surface and its planes.
This means that the highly polished planes (without scattering components) mentioned in feature
M12 and the course of the cross-section also functionally define the end of the light guide rod and
the light outlet (4) mentioned in features M10 and M14.
Contrary to the defendant's assertion, the skilled person does not assume for features M12 and M13
that or how the light guide rod is or was actually "highly polished" in the literal sense during its
manufacturing process. The person skilled in the art knows that a polishing process is not the only
way to obtain an optically polished or a correspondingly smooth and thus a specular/highly reflective
surface of the light guide rod. The point of the patent application is that the cladding surface is so
smooth that it reflects the light (completely/totally) as it passes through the light guide rod.
As stated above, the end of the highly polished plane (without scattering components) and the end of
the associated total reflection of the light on the smooth outer surface defines the light exit in a
functional manner. The patent in suit explains that the light exit (4) can only be present virtually (see
the embodiment example according to Figure 4), with the material extending up to the exit dome (6)
of the converging lens (2), the focus of which lies in the virtual light exit (see [0055] and para. [0053]:
In a further embodiment of the invention, the light exit (4) can only be present virtually, the
converging lens (5) connects directly and integrally to the light guide rod 2). In [0055] of the patent
specification, the following explanation can also be found with regard to the virtual light exit and
subsequent reflective side surfaces: "An inclined surface (8) is attached to the top of the light guide
rod (2), which produces a mirror image of the virtual light exit immediately adjacent above, and the
side surfaces (8a) of the light guide rod are also continued, whereby they also produce an adjacent
mirror image of the virtual light exit."

According to the description of the patent in suit, a scattering structure or surface as a possible
embodiment - contrary to the defendant's view - is not to be understood as part of the light guide
rod, but as an optically effective structure in the area of the converging lens (5) (see [0054] and also
[0053] and Figure 4 / feature M13).
2.3.5 Feature M14, which the skilled person reads in connection with feature M10, represents an
inherent feature of the given optics on the basis of the laws of geometrical optics (as also explained
by the intervener on page 5 of the intervener's statement in intervention), taking into account the
light exit (4) of the light guide rod (2) and the converging lens (5). It can be seen that - as long as the
light exit is in the focal area of the converging lens - the outline of the light exit (4) of the light guide
rod (2) largely corresponds to the required light distribution turned upside down. The light passing
through the light outlet (4) is emitted through the upstream converging lens (5) in accordance with
the optical projection law in the form of the upright outline of the light outlet (4). As described in the
patent specification in [0048] with reference to Figure 3 and a point P at the light outlet (4), the light
outlet (4) is projected to infinity according to the laws of optics, whereby each point (P) of the light
outlet (4) is projected in a direction (p) determined according to the laws of optics. The light
distribution of the optical order is therefore a uniformly bright, equally coloured, upside-down area in
the shape of the light outlet (4).
3. Based on this understanding of the features of claim 1 of the patent in suit, the CHAINZONE V1.2
collection optics ("optics version 2") supplied by the defendant to ASFINAG constitutes a patent
infringement. All features of claim 1 are utilised in this collection optic.
3.1 The CHAINZONE V1.2 collection optics ("Optics Version 2") challenged by the plaintiff is a
collection optics which generates a pixel of a display field of an outdoor display panel for signalling
(see Figures 2 and 3 of the statement of claim). For a viewer, coloured or white pixels/pixels
corresponding to feature M1 are created by additive colour mixing of the light emitted by an LED
light source from the RGB colour space (red, green, blue) (see Figure 3 of the statement of claim).

The collection optics (indisputably) have an LED light source and a light guide rod arranged in front of
it in accordance with features M2 and M3 (see Figure 3 in conjunction with Figure 4 in the statement
of claim and also the statement of defence including Annex S 13, Figure 5).

In addition to the LED light source and the fibre-optic rod arranged in front of it, the collector optic
also includes a converging lens, whereby, with reference to the above interpretation and the
understanding of the skilled person, it is irrelevant whether this is a spherical or aspherical lens. The
collection optics in question thus consists of an LED light source, a light guide rod and also a
converging lens, as indicated in features M2 to M4.
The light guide rod of the collecting optics extending perpendicular to the light entry surface is
arranged in front of the light exit surface of the LED light source with several coloured LED crystals
(red, green, blue), whereby the light entry surface also captures light from each LED crystal (RGB), as
stated in features M5 to M8 (see also Figures 3 and 4).
3.2 The light guide rod obviously has a rectangular - and thus polygonal - cross-section with sharp-edged
and smooth total reflecting planes which correspond to the highly polished planes mentioned
in the claim (see Figure 4 of the application and also Figure 5 of Annex S13 to the statement of
defence / feature M12). The skilled person recognises that the light guide rod extends along the
highly polished lateral surface without a light-scattering structure as a result of a rough surface (cf.
blue line in Figure 5 of Annex S13 to the statement of defence and the blue line in Figures 5 and 6 of
the replica / feature M13). Where the cross-section no longer (=constantly) or (only) gradually
increases and the light-scattering structure begins in the form of a rough, no longer smooth surface
of the material) and thus the total reflection ends on at least one plane (cf. left end of the blue line in
Figure 5 of the replica), the light guide rod ends and the light exit from the light guide rod takes place.
Thus, the light exit is located where a green dotted line is drawn in Figure 5 of the replica (see
features M10 and previous explanations on the interpretation and understanding of the skilled
person in connection with Figure 4 of the patent in suit together with the associated text [0053] and
[0055]). The light exit thus corresponds to a virtual light exit, as described in the patent specification
in connection with Figure 4 and the associated text (see [0055] of the patent specification: "Following
the light guide rod (2), an inclined surface (8) is attached to the upper side, which produces a mirror
image of the virtual light exit immediately adjacent above, and the side surfaces (8a) of the light
guide rod are also continued, whereby they also produce an adjacent mirror image of the virtual light
exit").

Contrary to the opinion of the defendant, the area adjoining the fibre-optic rod with a roughened
scattering structure (see red outline in Figure 6 of the replica) is no longer to be regarded as part of
the fibre-optic rod. Rather, this is a structure adjacent to the fibre-optic rod. The light guide rod itself
is therefore free of light-scattering components in order to guide light on its four highly polished
walls as a lateral surface by means of total reflection up to its exit surface - and not to scatter it
before the exit surface (see previous interpretation of feature M10 in conjunction with feature M12
and in particular feature M13).

3.3 Consequently, the light exit of the CHAINZONE V1.2 collection optics in dispute is located at the
end of the gradually increasing polygonal, polished lateral surface (marked in green in Figures 5 to 7
of the replica), in other words at the end of the light guide rod (cf. interpretation). This is a virtual
light outlet, namely one which is covered by claim 1 (cf. [0055] and the above explanations on the
interpretation of the term
"light exit"). Based on this, the cross-section of the light guide rod of the CHAINZONE V1.2 collection
optics in dispute - viewed from the light entry into the light guide rod - only increases gradually (and
not abruptly due to an edge [feature M9 refers to a claimed "or" feature alternative to a constant
cross-section]).
The light emission is therefore not located at the end of the roughened and thus light-scattering area
(outlined in red in Figure 6 of the replica) adjoining the highly polished surface of the light guide rod,
as the defendant attempts to portray.
Furthermore, it also follows from this that the light exit of the highly polished fibre optic rod is
located in the area of the focus of the converging lens, whereby the plaintiff's statements in its reply
with reference to the beam path or optical geometry shown in Figure 8 must be accepted (feature
M10).
This also applies with regard to the features M11 and M14, which are realised in the case of the
converging lens in dispute due to the aforementioned optical conditions (see Figures 7, 8 and 9 of the
reply, which are each based on Figure 18 of the statement of defence).

3.4As correctly stated by the plaintiff in its reply, based on the simulations commissioned by the
defendant (by IOSB), there is no (longer) any dispute between the parties as to where the focal area
of the converging lens lies. This is indicated by the red circle in Figure 8 above. This corresponds to
the caption of the (original) Figure 18 on page 13, which reads: "...The "ray tracing" simulation shows
that the focal areas are located inside the fibre optic rod..." (whereby the light exit of the fibre optic
rod is not correctly shown/defined" by the defendant at the position of the red line).
Since the judgement body has explained above that the (virtual) light exit is located at the end of the
light guide rod (marked green in Figures 7 and 8), it is therefore given that the light exit is located in
the area of the focus of the converging lens. According to the optical law of projection, the light is
emitted through the upstream converging lens in the form of the upright outline of the light exit. It
also follows from this that a point located in the lower area of the outline of the light exit of the light
guide of the CHAINZONE V1.2 collecting optics (just like point (P) at the light exit according to Figure
3 of the patent specification) projects in a direction from below to diagonally above and thus upside
down in a direction that corresponds to the direction (p) in Figure 3 of the patent specification,
according to the optical laws. With the light exit of the light guide rod in the area of the focus of the
converging lens (see feature M10) shown in green in Figures 7 and 8 above, this means that the
outline of the light exit already largely corresponds to the required upside-down light distribution,
whereby the light passing through the upstream converging lens is emitted in the form of the upright
outline according to the optical projection law; no different from what is indicated in (inherent)
feature M14.
The intervener does not take into account in its rejoinder that the claim/patent in suit does not
exclude the possibility that further optical structures may be present after the (virtual) light exit from
the light guide rod, which may also reflect the light (as discussed above with reference to [0055]). If it
is assumed - based on the assertions of the intervener (CH3) supported by additional simulations -
that this would be the case with the infringing device, it does not follow that there is no light exit at
the end of the fibre optic rod within the meaning of the claim; the Local Division has already
explained that this is the case.
3.5 As a result, the CHAINZONE V1.2 collection optics in suit has all the features of the collection
optics according to claim 1 of the patent in suit. This means that use is also made of the features
mentioned in (sub)claims 2 to 5 as well as 10 and 14 (cf

previous remarks, which apply here in the same way). Both the defendant and the intervener have
themselves argued that claims 2 to 5, 10 and 14 are claims dependent on claim 1, which means that
no (substantive) objections to the infringement of these sub-claims have been raised.
4. The defendant has indisputably committed acts of infringement under Art 25 lit a UPCA. It has
installed the infringing LED variable message signs (CHAINZONE V1.2) produced by the intervener at
the locations A12, VKP Kundl, RFB Innsbruck AQ km 22.525 and AQ km 23.007 on the basis of the
order by ASFINAG and thus placed them on the market.
With regard to the resulting legal consequences requested by the plaintiff, it must be noted in
advance that the defendant and the intervener focussed exclusively on contesting the non-infringement
of the patent in suit and did not make any substantiated submissions on the individual
legal consequences requested.
Against this background, the following legal consequences explained in detail are justified:
4.1 Establishment of patent infringement (point 1. of the claim):
The finding of patent infringement is based on Art 64 para 2 lit a UPCA. The finding of patent
infringement forms the basis for the court to exercise its powers under Art 56 et seq UPCA (cf:
Luginbühl/Hüttermann/Klein, Unitary Patent System, Art 64 para. 8; Tilmann/Plassmann/Steininger,
Unitary Patent/Unified Patent Court, para. 13 para. 19; see also: UPC_CFI_210/2023 (LK Mannheim),
decision of 22 November 2024 - Panasonic v. OPPO).
4.2 Injunction (point 2 of the claim):
Taking into account the circumstances of the case, the plaintiff has a right to prohibition of the
continuation of the infringement pursuant to Art 25 lit a UPCA and/or Art 26 UPCA in conjunction
with Art 63 para 1 UPCA.
With regard to the requested injunction, it must be taken into account that the exclusive right is the
core of the essence of patent law (Art 25 UPCA). Refraining from an injunction can only be considered
in justified exceptional cases (see Tilmann/von Falck/Tilmann, Unitary Patent, Unified Patent Court,
Art 63 UPCA, para. 29 et seq.), whereby such reasons are not apparent here.
The defendant has not denied that it obtained the LED display panels at issue from the intervener.
Even if the plaintiff has not demonstrated a placing on the market for each Member State of the
contract applied for here, the plaintiff's submission is sufficient in any case if the defendant does not
dispute the placing on the market in more concrete terms. As the defendant offers and/or places on
the market, there is a rebuttable presumption that it also imports and/or possesses the attacked
embodiment for the purpose of offering, placing on the market or using it.
No circumstances are apparent, nor have any been presented, which would argue in favour of the
disproportionate nature of the injunction requested. The defendant may not continue to offer or
distribute in the contracting member states covered by the action. The same applies to use,
importation and possession.

4.3 Request for information (point 3. of the claim):
The decision to provide the requested information is based on Art 25 lit a, Art 26 in conjunction with
Art 67 para 1 UPCA. The information is necessary to calculate the damages and to assess whether any
other persons/companies (intermediaries, importers, etc.) were involved in the acts of infringement
and/or committed such acts themselves.
4.4 Destruction (point 4. of the application):
The order of destruction is based on Art 25 li a UPCA in conjunction with Art 64 para 2 lit e and para 4
UPCA.
Destruction is intended to reliably prevent the products from entering or re-entering the market
(Tilmann/von Falck/Tilmann, Unitary Patent, Unified Patent Court, Art 64 UPCA, para. 33). In any
case, the action sought in this regard is only aimed at destroying the interfering objects directly or
indirectly in the possession or ownership of the defendant, which means that the measure is not
disproportionate.
4.5 Recall and removal from the distribution channels (point 5 of the claim):
The requested recall from the distribution channels is justified with regard to the directly infringing
products (see Art 25 lit a UPCA in conjunction with Art 64 para 2 lit b and para 4 UPCA). The wording
of the request is also not objectionable from the point of view of certainty.
The decision regarding the final removal from the distribution channels has its basis in Art 25 lit a
UPCA in conjunction with Art 64 para 2 lit d and para 4 UPCA. According to the wording of the UPCA,
permanent removal from the distribution channels is a separate measure from recall. It accompanies
the recall, whereby removal can only be considered if the infringer has the factual and legal means to
do so. The formulation of concrete and sufficiently specific measures must be based on this (see
UPC_CFI_7/2024 (LK Düsseldorf), decision of 3 July 2024 - Kaldewei v. Bette). The wording of the
relevant claim takes this into account to a sufficient extent.
4.6 Threat of penalty payment:
The threat of a penalty payment in relation to the claims 2. to 5. does not raise any objections (Art 63
para 2 UPCA); not even up to this amount. This also applies from the point of view of proportionality.
The threat of the measures of omission, information, removal, refusal and recall are based on Art 82
(1) and (4) UPCA, R 354.3 RoP (UPC_CFI_7/2023 (LK Düsseldorf), decision of 3 July 2024, p. 31, F. 5. -
Kaldewei v. Bette).
The threat of a penalty payment gives the Local Division the necessary flexibility to take into account
the circumstances of the individual case, including the behaviour of the infringer, in the event of an
infringement. On this basis, an appropriate penalty payment can be imposed in accordance with Art
82 (4) sentence 2 UPCA in conjunction with R 354.4 RoP.
4.7 Determination of the liability for damages on the merits (point 6 of the claim):
Art 68 (1) UPCA allows the award of damages on the merits. Based on the circumstances of this case,
the defendant could and should have recognised with due care that it was infringing the patent in
suit with the intervener's subject matter. This has been the case at least since the action in question
was filed.

4.8 Publication (point 8. of the statement of claim):
Art 80 UPCA leaves it to the discretion of the court whether or not to authorise publication. It must
be taken into account that publication also contains an additional sanction element. For such an
order to be issued, the plaintiff's interest in publication must outweigh the negative consequences for
the defendant. As a rule, the granting of a publication is only possible if the protection of the plaintiff
is not already guaranteed by other measures (see UPC_CFI_373/2023 (LK Düsseldorf), decision of 31
October 2024 - SodaStream v. Aarke).
When exercising discretion, however, the purposes pursued by Art 80 UPCA of deterring future
infringers and sensitising the public must be taken into account. The preventive interest of the patent
proprietor (= plaintiff), which goes beyond the actual case of infringement, must be taken into
account when weighing up the interests of the parties to the proceedings (see Hoppe in
Luginbühl/Hüttermann, Unitary Patent System, UPCA Art 80 para. 19).
However, the plaintiff has not put forward any reasons and/or no such reasons are apparent which
make publication in the sense of the aforementioned principles necessary. The plaintiff has only
justified the publication obligation by stating that the relevant public should be informed and
educated about the patent infringement. However, it leaves open why this would be necessary in the
specific case, in particular due to which preventive interest. In view of this and from the point of view
of proportionality, the remedies already granted against the defendant under Art 64 (2) UPCA are
therefore sufficient.
5. Submission of evidence:
Based on the above, the plaintiff was able to prove the infringement of the patent in suit. The
submission of an LED variable message sign supplied by the defendant to ASFINAG and/or a
corresponding component thereof was not necessary, also because the subject matter of the
infringement was not in dispute between the parties.
D. Basic decision on costs:
Pursuant to Art 69 (2) UPCA in conjunction with R 118.5 RoP, a basic decision on costs must be made.
Since the defendant has been unsuccessful with regard to the action - with the exception of the (not
particularly significant) request for publication - it is justified to order it to pay the plaintiff's costs in
this respect on the merits.
The determination of the upper limits for reimbursable representative costs is based on the decision
of the Administrative Committee on the upper limits of reimbursable costs of 24 April 2023 (D -
AC/10/24042023_D).
It is questionable to what extent the intervener also has to reimburse the plaintiff's costs on the
merits: According to R 315.4 RoP, the intervener is to be treated as a party. Although the RoP does
not provide for a separate rule on the bearing of costs for the intervener, it can be inferred from the
principle of R 315.4 RoP that the intervener is also treated as a party with regard to the bearing of
costs (see Greiner-Wittner; Werner in Luginbühl/Hüttermann, Unitary Patent System, RoP R 315 para.
41; Plassmann/Dorn in Tilmann/Plassmann, Unitary Patent Unitary Patent Court, R 315 RoP para. 23).

In the event that the party supported by it loses - as in the specific case - a proportionate
contribution to costs would be justified on the merits in any case if it has caused additional expenses
for the winning party through its intervention. In any case, it must bear its own costs if it loses.
In this specific case, the intervener's statement in intervention of 19 August 2024 caused the plaintiff
relatively little effort because the written proceedings had already been concluded for her at that
time. The plaintiff had submitted her reply on the same day. The plaintiff therefore only dealt with
the content of the intervener's defence at the oral hearing. This circumstance and the fact that the
content of the intervener's and the defendant's defence was very similar, which limits the additional
costs for the plaintiff, would in principle indicate that the intervener should bear 20% of the plaintiff's
costs; 80% of the plaintiff's costs should be borne by the defendant. Should there be arguments that
would indicate a different apportionment, these could still be presented in any cost determination
proceedings.

DECISION:
1. It is established that the collection optics installed in LED display panels of the series of the
manufacturer Chainzone (Foshan) Technology Co. Ltd. identified by the serial number 18023020550
infringe patent claims 1, 2, 3, 4, 5, 10 and 14 of the European patent EP 2 643 717 B1.
2. The defendant is ordered, on pain of a penalty payment of up to EUR 100,000.00 to be fixed by the
court for each case of infringement, to refrain with immediate effect from using in Belgium, Germany,
Denmark, France, Italy, Luxembourg, the Netherlands, Austria, Switzerland and Slovenia
colour and light-mixing converging optics, in particular as a full-colour pixel for outdoor display
panels, for spotlights or signalling, consisting of an LED light source, a light guide rod arranged
in front of it and a converging lens, whereby the LED light source contains several LED crystals
(red, green, blue), which can be used as a light source, green, blue), the light entry surface of the
light guide rod is arranged in front of the light exit surface of the LED light source and captures
light from each LED crystal, wherein the light guide rod extends perpendicular to the entry
surface and wherein its cross-section is constant or gradually increases,
to offer, place on the market, use, import or possess for these purposes, in which
the light exit of the light guide rod is located in the area of the focus of the converging lens, the
converging lens concentrates the light emerging from the centre parallel to the axis and
concentrates the light emerging laterally of the centre of the light exit from a point of the light
exit in parallel in an associated direction,
the lateral surface of the light guide rod is formed from optically highly polished planes which
adjoin each other with sharp edges and thus each cross-section has the shape of a polygon, that
the material of the light guide rod is free of light-scattering components, and
the outline of the light emission of the fibre-optic rod already largely corresponds to the required
upside-down light distribution and the light passing through is emitted by the upstream
converging lens in accordance with the optical projection law in the form of the upright outline;
in particular if
the light guide rod (2) has a length which is a multiple of the diameter of the entrance surface (3);
or if
the LED crystals emit different colours;
or if
the light source is a full-colour or multi-LED with a number of crystals and/or colours in a
common housing;
in particular if
the light source is a full-colour or multi-LED with three crystals in the primary colours red, green
and blue,
or if
the optical fibre cross-section is an equilateral triangle or regular hexagon, square or rectangle;
and/or if
the light exit of the fibre-optic rod is only virtually present and the fibre-optic rod merges directly
into the converging lens;
in particular in the form of the collector optics installed in LED display panels of the series of the
manufacturer Chainzone (Foshan) Technology Co., Ltd. identified by the serial number 18023020550,
as shown in the following figures:

3. The defendant is ordered, on pain of a penalty payment of up to EUR 100,000.00 to be determined by
the court for each day of delay, to provide the plaintiff within 14 days with information in writing on
the origin and distribution channels of objects pursuant to point 2 of the request for a decision, in
particular the products infringing the patent in suit pursuant to point 1, stating
• the names and addresses and other information necessary or useful for clear identification
of all persons involved in their manufacture and distribution, in particular their importation
into Austria;
• the names and addresses of all commercial customers who have purchased these items
from the defendant; and
• the quantities of these items ordered, received and/or delivered and the prices paid for
them by the defendant,
whereby copies of the corresponding purchase and sales documents (invoices, delivery notes, etc.)
must be submitted as proof of the information, whereby details requiring secrecy outside the data
to be disclosed may be blacked out.
4. The defendant is ordered, under penalty of a fine of up to EUR 100,000.00 to be determined by the
court for each day of delay, to destroy at its own expense within 14 days all items pursuant to item 2
of the request for a decision, in particular all products infringing the patent pursuant to item 1, which
are in its direct or indirect possession or ownership;
5. The defendant is ordered, on pain of a penalty payment of up to EUR 100,000.00 to be determined by
the court for each day of delay, to recall at its own expense within 14 days all items distributed by it
pursuant to item 2 of the request for a decision, in particular all products infringing the patent
pursuant to item 1, with reference to their patent-infringing condition and, if necessary, to give an
undertaking to the purchasers,
• reimburse any fees paid by them,
• to bear the necessary dismantling, packaging and transport costs, and
• to bear the customs and storage costs associated with the return, and to
permanently remove them from the distribution channels by the defendant
• taking back the recalled items and destroying them in accordance with point 4 of the
request for a decision, or
• arranging for the destruction of the recalled products at the respective owner.
6. The defendant is obliged to compensate the plaintiff for any damage, including loss of profit, which
the plaintiff has suffered or will suffer in the future as a result of actions pursuant to point 2 of the
request for a decision, whereby the determination of the amount of damages is reserved for
proceedings to determine damages pursuant to R 125 et seq. of the RoP.
7. The request that the defendant be instructed to fulfil the part of the opposing decision that
upholds the claim within 8 weeks at its own expense.
