LAMA FRANCE (ci-après « LAMA ») a déposé des demandes datées du 13 décembre 2024 en
réponse à la demande déposée par HEWLETT-PACKARD DEVELOPMENT COMPANY (ci-après
« HPDC ») le 21 novembre 2024 (Applicaon n° 66323/2024) aux fins d’exécuon de la
décision au fond rendue le 13 novembre 2024 (ci-après « la Décision »). LAMA sollicite un
sursis à l’exécuon de la Décision pendant le délai d’appel, à tre subsidiaire, la constuon
d’un cercle de confidenalité restreint aux seuls conseils des pares pour l’exécuon de la
communicaon des informaons tel que menonné au IV du disposif de la Décision, et à tre
infiniment subsidiaire, d’accorder une garane de deux millions d’Euros versée à son profit par
HPDC si le cercle de confidenalité restreint n’était pas accordé.
Par ordonnance préliminaire du juge président rendue le 16 décembre 2024, il a été demandé
l’avis de HPDC sur les demandes de LAMA (Ordonnance nº ORD_66525/2024 dans l’ACTION
Nº: ACT_578697/2023) ;
HPDC a déposé ses commentaires écrits via CMS le 18 décembre 2024. Il souent que la
demande de sursis relave à la demande d’exécuon relève exclusivement de la Cour d’appel.
HPDC sollicite donc que le Juge-Président ou la Division Locale de Paris déclare le tribunal de
première instance incompétent pour statuer sur cee demande. Il ajoute qu’en tout état de
cause, la demande de LAMA FRANCE n’est ni jusfiée, ni fondée et devra être rejetée.
HPDC a en outre demandé au Tribunal de rejeter la demande de LAMA FRANCE sollicitant un
club de confidenalité restreint aux seuls représentants des pares.
-A tre principal, HPDC ne s’oppose pas à ce que les informaons suivantes soient
communiquées dans un club de confidenalité composé des représentants et d’une personne
physique pour chaque pare :
- les factures d’achat et de revente aux grossistes concernés sur la période non couverte
par la prescripon relaves aux types de cartouches contrefaisantes, toutefois pour
permere la mise en œuvre praque d’une vérificaon de l’exécuon de la mesure
d’interdicon et de rappel, les noms des grossistes et autres clients de LAMA relavement
aux cartouches concernées par la décision pourront être librement communiqués à
HPDC ;
- les informaons comptables relaves à l’importaon, l’achat ou la vente sur la période
non couverte par la prescripon relaves aux types de cartouches contrefaisantes.
En revanche, concernant, l’identé des fabricants et/ou fournisseurs des cartouches
contrefaisantes, HPDC sollicite l’accès complet à ces informaons du fait de l’absence
de toute jusficaon du caractère confidenel de ces informaons.
Enfin sur la demande subsidiaire de garane, HPDC demande au Tribunal de déclarer la
demande de garane de LAMA FRANCE irrecevable en soutenant que :
- la demande de LAMA FRANCE étant tardive par rapport au caractère « front loaded » de la
procédure devant le Tribunal, les pares étant tenues de former leur demande en temps ule,
- et la règle 118.8 ne permeant de toute façon pas au Tribunal de première instance de
rajouter une garane postérieurement à une décision déjà rendue.
A tre subsidiaire, HPDC sollicite le rejet de cee demande de garane, au mof que cee
demande n’est ni jusfiée ni proporonnée au vu des arguments avancés par LAMA France,
en ce que les conséquences graves alléguées ne sont pas démontrées et qu’il n’est pas jusfié
que cee garane aurait pour but de réparer le dommage en cas d’une violaon de
confidenalité.
LAMA, invitée dans l’ordonnance préliminaire, à se posionner sur la queson de la
compétence du Tribunal concernant sa demande de sursis à exécuon, a soutenu que la
combinaison des règles 223-4 (sur la suspension de l’exécuon pendant la procédure d’appel)
et 345-5 RdP (sur le juge de permanence de première instance en cas d’extrême urgence)
pendant la période transitoire dans le délai d’appel et avant que l’appel ne soit formé,
donnerait compétence au Tribunal pour suspendre l’exécuon.
1) Sur la demande de sursis à cee demande d’exécuon :
Seule la Cour d’appel a le pouvoir pour de suspendre l’exécuon d’une décision (Arcle 74
AJUB et R. 223 RdP) et à ce jour aucun appel n’a été formé à l’encontre de la décision au fond.
Il convient de constater que la règle 118.8 RdP ne donne aucun pouvoir à la juridicon de
première instance de suspendre l’exécuon dans ce cas.
Les délais pour l’exécuon ont été fixés dans le disposif de la Décision.
Contrairement à ce que souent LAMA, si R. 345 (5) RdP donne compétence au juge de
première instance de statuer immédiatement dans le cas d’une extrême urgence, c’est dans le
cadre des pouvoirs que déent le Tribunal de première instance, or celui-ci n’a aucun pouvoir
pour suspendre une décision pendant le délai d’appel.
Par conséquent, la demande de sursis à exécuon ne peut qu’être rejetée, la Juridicon saisie
n’ayant pas le pouvoir de surseoir l’exécuon de la décision sur le fond qu’elle a rendue.
2) Sur la demande subsidiaire aux fins d’une cercle de confidenalité limité aux seuls
représentants des pares :
La Juridicon constate que HPDC ne s’oppose pas au principe de l’organisaon d’un cercle de
confidenalité sur le fondement de la règle 262A RdP pour protéger les informaons
confidenelles qui seront communiquées dans le cadre de l’exécuon de la communicaon
d’informaons ordonnée dans la décision au fond du 13 novembre 2024 (§ 312 et 313 dans
les mofs et pare IV du disposif) concernant les factures et les éléments comptables.
Le Tribunal considère que cee demande est légime car les documents à communiquer sont
suscepbles de contenir des informaons relevant du secret des affaires.
La règle 262A.6 RdP prévoit que « Le nombre de personnes visées au paragraphe 1 ne doit pas
être supérieur à ce qui est nécessaire pour assurer le respect des droits des pares à la
procédure à un remède effecf et à un procès équitable ; il inclura, au moins, une personne
physique pour chaque pare et les avocats ou autres représentants des pares à la
procédure. »
Il est rappelé que la jurisprudence au sein de la JUB a admis de restreindre ce cercle aux seuls
représentants des pares à la procédure (en n’y incluant pas une personne privée représentant
chacune des pares), seulement en cas d’accord entre les pares sur ce point. (LD Paris, 26
mars 2024, UPC_CFI_397/2023 ; LD The Hague, 4 mars 2024, UPC_CFI_239/2023)
Dans le cas présent, le Tribunal note qu’il n’y a pas d’accord sur la composion du cercle de
confidenalité et considère que la Règle 262A.6 RdP doit donc s’appliquer. Il n’y a dès lors pas
lieu de modifier la composion du cercle de confidenalité tel que constué par l’ordonnance
procédurale rendue le 2 août 2024 (Ordonnance nº ORD_43600/2024 dans l’ACTION Nº
ACT_578697/2023_UPC nº : UPC_CFI_358/2023).
Par ailleurs, ne seront concernées que les informaons comptables et les factures
communiquées par LAMA à HPDC. En effet, il n’est pas jusfié par LAMA que les informaons
relaves aux réseaux de fabricants et/ou fournisseurs doivent être tenues confidenelles à
l’égard de HPDC.
3) Sur la demande subsidiaire aux fins d’une garane :
La règle 118.8 RdP prévoit in fine que : « La Juridicon peut subordonner toute disposion ou
mesure à la fourniture d’une garane par la pare ayant obtenu gain de cause au profit de la
pare qui succombe, telle que déterminée par la Juridicon conformément à la règle 352. »
Le Tribunal note que LAMA n’avait pas demandé à bénéficier de la constuon d’une garane
à la suite de la demande de communicaon d’informaons formulée par HPDC. En outre, le
Tribunal considère que la constuon d’un cercle de confidenalité en conformité avec les
disposions de R. 262A.6 RdP pour protéger la confidenalité des informaons confidenelles
qui seront communiquées par LAMA est suffisante pour protéger les intérêts de cee dernière.
Le fait que HPDC s’oppose à la composion d’un cercle de confidenalité restreint aux seuls
conseils des pares ne peut jusfier en l’espèce la constuon d’une garane en faveur de
LAMA à ce stade de la procédure, cee demande sera donc rejetée comme non fondée.
Au vu de ces éléments, la Juridicon :
- Constate qu’elle n’a pas le pouvoir de surseoir l’exécuon de la décision sur le fond du
13 novembre 2024 qu’elle a rendue ;
- Ordonne que les informaons confidenelles relaves aux factures et à la comptabilité
de LAMA France qui seront communiquées dans le cadre de l’exécuon de la
communicaon d’informaons ordonnée dans la décision au fond du 13 novembre
2024 (§ 312 et 313 dans les mofs et pare IV du disposif) seront accessibles
uniquement aux personnes désignées dans le cercle de confidenalité tel que
constué dans l’ordonnance du 2 août 2024 ;
- Rejee la demande de LAMA France concernant la garane sur le fondement R. 118.8
et R. 352 RdP.
- Rappelle que la présente ordonnance est suscepble d’appel dans les condions
prévues par les disposions de R. 220.2 RdP.

LAMA FRANCE (hereinafter "LAMA") has filed applications dated 13 December 2024 in response to
the application filed by HEWLETT-PACKARD DEVELOPMENT COMPANY (hereinafter "HPDC") on 21
November 2024 (Application No. 66323/2024) for the purpose of enforcing the decision on the
merits of the case.
("HPDC") on November 21, 2024 (Application No. 66323/2024) for enforcement of the decision
on the merits rendered on November 13, 2024 (the "Decision"). LAMA seeks a stay of execution
of the Decision during the appeal period, in the alternative, the establishment of a circle of
confidentiality restricted solely to counsel for the parties for the execution of the communication
of information as referred to in IV of the operative part of the Decision, and in the infinitely
alternative, to grant a guarantee of two million Euros paid for its benefit by HPDC if the restricted
circle of confidentiality is not granted.
By Preliminary Order of the Presiding Judge issued on December 16, 2024, HPDC's views on
LAMA's requests were sought (Order No. ORD_66525/2024 in ACTION NO.: ACT_578697/2023);
HPDC filed its written comments via CMS on 18 December 2024. It submits that the application
for a stay of the enforcement application is a matter exclusively for the Court of Appeal. HPDC
therefore requests that the Presiding Judge or the Paris Local Division declare that the court of
first instance does not have jurisdiction to rule on this application. It adds that, in any event,
LAMA FRANCE's claim is neither justified nor well-founded and should be dismissed.
HPDC also asked the Court to reject LAMA FRANCE's application for a
confidentiality club restricted to representatives of the parties.
-Primarily, HPDC does not object to the following information being communicated in a
confidentiality club composed of the representatives and one natural person for each party:
- the purchase and resale invoices to the wholesalers concerned over the period not covered
by the limitation period relating to the types of counterfeit cartridges; however, in order to
allow the practical implementation of a verification of the execution of the prohibition and
recall measure, the names of the wholesalers and other customers of LAMA relating to the
cartridges concerned by the decision may be freely communicated to
HPDC;
- accounting information relating to the import, purchase or sale of the types of counterfeit
cartridges during the period not covered by the statute of limitations.
On the other hand, HPDC requests full access to the identity of the manufacturers and/or
suppliers of the infringing cartridges, as there is no justification for the confidential nature
of this information.
Finally, on the subsidiary warranty claim, HPDC asks the Court to declare LAMA FRANCE's warranty
claim inadmissible on the grounds that :
- LAMA FRANCE's application being out of time in relation to the "front loaded" nature of the
of the proceedings before the Court of First Instance, the parties being required to make their
application in good time,
- and Rule 118.8 does not in any event allow the Court of First Instance to add a guarantee after
a decision has already been given.
In the alternative, HPDC seeks dismissal of the warranty claim on the grounds that it is neither
justified nor proportionate in the light of the arguments put forward by LAMA France, in that the
alleged serious consequences have not been demonstrated and it has not been shown that the
purpose of the warranty would be to compensate for damage in the event of a breach of
confidentiality.
LAMA, invited in the preliminary order to take a position on the question of the jurisdiction of
the Court of First Instance regarding its application for a stay of execution, argued that the
combination of Rules 223-4 (on the stay of execution during the appeal proceedings) and 345-5
RoP (on the duty judge of first instance in cases of extreme urgency) during the transitional
period in the appeal period and before the appeal is lodged, would give the Court of First
Instance jurisdiction to stay execution.
1) On the application for a stay of execution :
Only the Court of Appeal has the power to suspend the execution of a decision (Article 74
AJUB and R. 223 RdP) and to date no appeal has been lodged against the decision on the merits.
It should be noted that rule 118.8 RdP does not give the court of first instance any power to
suspend enforcement in this case.
The time limits for enforcement were set out in the operative part of the Decision.
Contrary to LAMA's contention, if R. 345(5) RoP empowers the court of first instance to rule
immediately in a case of extreme urgency, it is within the scope of the powers held by the Court
of First Instance, which has no power to suspend a decision during the appeal period.
Consequently, the application for a stay of execution can only be dismissed, as the Court of First
Instance does not have the power to stay the execution of the decision on the merits that it has
given.
2) On the subsidiary request f o r a confidentiality circle limited to the parties' representatives

The Court finds that HPDC does not oppose the principle of organising a confidentiality circle on
the basis of Rule 262A RoP to protect the confidential information that will be communicated in
the context of the execution of the communication of information ordered in the decision on the
merits of 13 November 2024 (paragraphs 312 and 313 of the grounds and part IV of the
operative part) concerning invoices and accounting elements.
The Court considers that this request is legitimate because the documents to be disclosed are
likely to contain information covered by business secrecy.
Rule 262A.6 RoP provides that "The number of persons referred to in paragraph 1 shall not be
greater than is necessary to ensure that the rights of the parties to the proceedings to an
effective remedy and to a fair trial are respected; it shall include, at least, one natural person for
each party and the lawyers or legal representatives of the parties.

It is recalled that the case law within the JUB has accepted to restrict this circle only to the
representatives of the parties to the proceedings (by not including in it a private person
representing each of the parties), only in case of agreement between the parties on this point
(LD Paris, 26 March 2024, UPC_CFI_397/2023; LD The Hague, 4 March 2024,
UPC_CFI_239/2023).
In the present case, the Court notes that there is no agreement on the composition of the circle
of confidentiality and considers that Rule 262A.6 RoP must therefore apply. There is therefore no
need to modify the composition of the circle of confidentiality as constituted by the procedural
order issued on 2 August 2024 (Order No. ORD_43600/2024 in ACTION No.
ACT_578697/2023_UPC No.: UPC_CFI_358/2023).
Furthermore, only accounting information and invoices communicated by LAMA to HPDC will be
concerned. In fact, LAMA has not justified that information relating to the networks of
manufacturers and/or suppliers must be kept confidential with regard to HPDC.
3) On the alternative request for a guarantee :
Rule 118.8 RoP provides in fine that "The Court may make any provision or measure subject to
the provision of security by the successful party for the benefit of the unsuccessful party, as
determined by the Court in accordance with Rule 352."
The Court notes that LAMA had not requested the provision of a guarantee following HPDC's
request for disclosure of information. Furthermore, the Court considers that the creation of a
confidentiality circle in accordance with the provisions of R. 262A.6 RoP to protect the
confidentiality of the confidential information to be communicated by LAMA is sufficient to
protect the latter's interests. The fact that HPDC objects to the composition of a confidentiality
circle restricted solely to counsel for the parties cannot justify the creation of a guarantee in
favour of LAMA at this stage of the proceedings, and this request will therefore be rejected as
unfounded.
In view of the foregoing, the Court :
- Finds that it does not have the power to stay the enforcement of the decision on the
merits of 13 November 2024 that it rendered;
- Orders that the confidential information relating to the invoices and accounts of LAMA
France that will be communicated in the context of the execution of the communication
of information ordered in the decision on the merits of 13 November 2024 (§ 312 and
313 of the grounds and part IV of the operative part) will be accessible only to the
persons designated in the circle of confidentiality as constituted in the order of 2 August
2024 ;
- Rejects LAMA France's request for a guarantee on the basis of R. 118.8
and R. 352 RdP.
- Recalls that this order may b e appealed in accordance with the provisions of R. 220.2 RdP.
