Die Beklagte beantragt: 1. Die Klägerin trägt die Kosten des Verfahrens im Umfang der gemäß Ziff. II 1b
zurückgenommenen Klage.
2. Dem Antrag der Klägerin vom 5. Juni 2024 auf Zulassung der Erweiterung der Klage
gemäß Regel 263.1 VerfO um die im Schriftsatz vom 5. Juni 2024 spezifizierten
Anträge gemäß Antrag II.1b‘ (sinnfällige Herrichtung mit „insbesondere“-Antrag) und
II.2 (mittelbare Verletzung) wird nicht stattgegeben.
3. Die Klageerwiderungsfrist und die Frist zur Einreichung einer Nichtigkeitswiderklage
werden bis zum 29. Juli 2024 verlängert.
VORTRAG DER PARTEIEN
Die Klägerin führt zur Begründung aus, dass die beantragte Klageänderung zum einen den durch die Rücknahme der Nichtigkeitsberufung der hiesigen Beklagten gegen den deutschen Teil des Klagepatents geänderten Anspruchsgegenstand reflektiere und ferner mit der beantragten Klageänderung die Klage um die mittelbare Verletzung des Verfahrensanspruchs erweitert werden solle. Die beantragte Klageänderung sei nicht bereits in der ursprünglichen Klage zu berücksichtigen gewesen, da das nationale Rechtsbestandsverfahren noch nicht abgeschlossen und die
mit der Klage geltend gemachte Anspruchsfassung dort mit der Anschlussberufung
rechtshängig gewesen sei. Die Klageänderung sei erst durch die rechtskräftige Beendigung
des nationalen Nichtigkeitsverfahrens erforderlich geworden. Dies gelte auch für die nunmehrige Geltendmachung der mittelbaren Verletzung des Verfahrensanspruchs. Im Zeitpunkt der Klageerhebung habe hierfür kein Anlass bestanden, da die Beklagte wegen Benutzung des Sachanspruchs zur Unterlassung zu verurteilen gewesen sei. Nachdem durch die Berufungsrücknahme nun mit Blick auf die Bundesrepublik Deutschland ein Verwendungsanspruch geltend zu machen sei, zu dessen Behandlung im Verletzungsverfahren sich im EPG (soweit ersichtlich) noch keine Rechtsprechungspraxis gebildet habe, diene die Geltendmachung der mittelbaren Verletzung vorsorglich der Wahrung der klägerischen Ansprüche mit Blick auf den Vertrieb der angegriffenen Ausführungsformen durch die Beklagte.
Die Klägerin habe den Antrag auf Klageänderung unmittelbar nachdem ihrer Konzernschwester der verfahrensbeendende Beschluss des BGH zugestellt worden sei vorbereitet.
Die Beklagte führt aus, dass die Anträge der Klägerin als bloße Klarstellung der Antragsfassung (Antrag Ziff. II.1.a), kostenauslösende Klagerücknahme (Ziff. II.1b, Ziff. II.1b‘, III.) und teilweise
als unzulässige Klageerweiterung (Ziff. II.2, III.) einzuordnen seien. Die Änderungen im Antrag gem. Ziff. II.1a seien in Bezug auf den französischen und den italienischen Teil des Klagepatents lediglich klarstellend. Die Beklagte trete diesen Änderungen daher nicht weiter entgegen. Die neue Fassung der Anträge in Ziff. II.1b sei als Klagerücknahme zulässig, führe jedoch zur Kostentragung der Klägerin im Umfang der Rücknahme. Im Zusammenhang mit dem Hilfsantrag gem. Ziff. II.1b‘ liege eine unzulässige Klageerweiterung vor. Die Klägerin habe das Klagepatent im deutschen Nichtigkeitsverfahren bereits in ihrer
Widerspruchsbegründung vom 17. März 2022 nur in der nunmehr geltend gemachten Fassung verteidigt, was schließlich auch vom Bundespatentgericht im Urteil vom 7. November 2023 bestätigt worden sei. Eine Berufung habe die Klägerin selbst zunächst nicht eingelegt, sondern erst am 15. März 2024 – mithin drei Tage nach der Erhebung der Klage in diesem Verfahren am 12. März 2024 – Anschlussberufung eingelegt. Warum die Klägerin nicht bereits bei Erhebung
ihrer Klage eine entsprechend auf die vom Bundespatentgericht bereits bestätigte Fassung des Klagepatents abgestimmten Hilfsantrag gestellt hat, erschließe sich insoweit nicht und werde von der Klägerin auch nicht begründet. Die Klägerin hätte den nunmehr gestellten Hilfsantrag daher bei gebotener Sorgfalt und Berücksichtigung ihres eigenen Prozessverhaltens ohne Weiteres – bspw. auch als einen auf den Eintritt der Rechtskraft des Urteils des Bundespatentgerichts bedingten Hilfsantrag – „früher“ stellen können. Die Begründung der Klägerin bleibe insoweit schließlich auch unvollständig, was seinerseits die Zurückweisung des Hilfsantrags begründen könne. Darüber hinaus sei auch der „insbesondere“-Antrag nicht zuzulassen. Sog.
„insbesondere“-Anträge hätten auf die materielle Reichweite des Tenors keinen
Einfluss. Eine Zulassung verbiete sich daher auch aus diesem Grund. Mit dem Antrag in Ziff. II. 2 mache die Klägerin erstmals die mittelbare Verletzung des
Anspruchs 5 des deutschen bzw. des Anspruchs 6 des französischen und italienischen
Teils des Klagepatents geltend und begründe die Erweiterung ihres Begehrens mit dem
Eintritt der Rechtskraft im deutschen Verfahren. Dem sei nicht zu folgen. Zunächst ergebe sich aus der Entscheidung im deutschen Verfahren für die weiteren Patente in Frankreich und Italien keine Änderung durch das hiervon unabhängige deutsche Verfahren. Die Klägerin habe sich auch im deutschen Verfahren bereits seit ihrer Widerspruchsbegründung vom 17. März 2022 auf eine Verteidigung des deutschen Patents in der nunmehr bestehenden Fassung beschränkt. Der Klägerin sei daher bereits lange vor der Klageerhebung bewusst gewesen, dass eine mittelbare
Patentverletzung erforderlich werden könnte. Eine Änderung der Rechtslage habe sich gemäß den eigenen Erläuterungen der Klägerin bisher nicht ergeben. Die Klägerin stütze sich zur Begründung ihres Antrags zudem allein auf die geänderte Situation in Deutschland. Für den französischen und den italienischen Teil ergäben sich insoweit bereits überhaupt keine Abweichungen, so dass für den französischen und den italienischen Teil bereits keine Gründe für die Klageänderung vorgetragen worden seien. Schließlich übersehe die Klägerin, dass ihre Änderungen in den Hauptanträgen auch
zu einer Erweiterung des Streitgegenstandes in Bezug auf die hierauf rückbezogenen
Anträge in Ziff. III führten. Insoweit begründe die Klägerin ihre Erweiterung schon
nicht, die daher bereits aus diesem Grund zurückzuweisen sei. Darüber hinaus sei auch
insoweit nicht erkennbar, warum eine entsprechende Antragstellung nicht schon früher
möglich gewesen sei. Darüber hinaus drohe der Beklagten eine Behinderung der Verfahrensführung, weil zur Erwiderung in Bezug auf die nunmehr geltend gemachten Verletzungshandlungen weiterer Aufwand entstehe. Die Beklagte müsse entsprechende Handlungen in Bezug auf mögliche Einwände und Verhältnismäßigkeitsüberlegungen gänzlich neu prüfen, was wiederum Zeit und
Ressourcen binde. Die Klägerin trägt hierzu vor, dass die Beklagte nicht begründe, worin die Klageerweiterung liegen solle. Richtig sei, dass der Antrag zu Ziff. II.1b‘ nicht auf die bloße Verwendung, sondern auf die sinnfällige Herrichtung gerichtet sei. In dieser Differenzierung liege aber keine Klageerweiterung, da der bisherige Unterlassungsantrag nicht auf die Verwendung
beschränkt gewesen sei. Tatsächlich handele es sich bei der sinnfälligen Herrichtung
(„Empfehlung zum festen Verbinden von Bauelementen“) um ein Minus zum Anbieten als Teil des ursprünglichen Unterlassungsantrags. Mit der Klage sei (u.a.) die Unterlassung von Angebotshandlungen hinsichtlich der klagepatentanspruchsgemäßen Sinterpasten beantragt worden. Nunmehr solle beantragt werden, die klagepatentanspruchsgemäßen Sinterpasten nicht zum festen Verbinden von Bauelementen zu empfehlen oder derartig sinnfällig hergerichtete Metallsinterzubereitungen anzubieten. Ein inhaltlicher Überschuss sei weder dargetan noch ersichtlich. Dies bestätige sich auch anhand folgender Vergleichsüberlegung: Der Antrag nach
Ziff. II.1b sei sei u.a. auf die Unterlassung des Anbietens von klagepatentanspruchsgemäßen Sinterpasten (wenn diese zum festen Verbinden von Bauelementen geeignet sind, was bereits aus der Verwirklichung der räumlich-körperlichen Anspruchsmerkmale folge) gerichtet gewesen. Der Antrag zu Ziff. II.1b‘ sei nach übereinstimmender Auffassung der Parteien ein Hilfsantrag hierzu, bilde also auch unter diesem Gesichtspunkt ein „Minus“ ab. Vor diesem Hintergrund bedürfe es zuletzt auch keiner Entscheidung, ob Hilfsanträge grundsätzlich gem. R. 263 VfO zulassungsbedürftig seien.
Der Vortrag der Beklagte zu den „insbesondere“-Anträgen (SSTZ, S. 6 Abs. 2) sei nicht ganz nachvollziehbar. Weder scheine die Rechtsprechung des LG Mannheim für das Gericht von besonderer Bedeutung, noch führe die Aufnahme von nicht materiell-beschränkenden
Ausgestaltungen in den Antrag zu einer Unzulässigkeit des Antrags, geschweige
denn der Klageänderung. Im Gegenteil. Die Entscheidung des LG Mannheim (7 O 145/09 BeckRS 2010, 21526 – covenant not to sue) betriffe primär die „insbesondere“-Geltendmachung von Unteransprüchen. Im Übrigen besage sie auch nicht, dass ein solcher Antrag unzulässig sei
(wobei auch dies keine Frage der R. 263 VfO, sondern allenfalls der R. 13.1 (k)
VfO sein dürfte), sondern allein, dass es dem Gericht freistehe, diese nicht in den
Urteilstenor aufzunehmen, also einen breiten Tenor zu wählen (vgl. i.Ü. zur nationalen Rechtsprechung auch BGH GRUR 2012, 945, Rn. 22 – Tribenuronmethyl). Das hier angerufene und zuständige Gericht habe indes „insbesondere“-Formulierungen in den Tenor aufgenommen, wenn dies – wie hier – der Konkretisierung der Verletzungshandlungen diente (Entscheidung v. 03.07.2024 UPC_CFI_7/2023 ACT_459767/2023 ORD_598324/2023 – Franz Kaldewei / Bette; Anordnung v. 21.05.2024 UPC_CFI_443/2023 ACT_589207/2023 ORD_598328/2023 –
SharkNinja / Dyson). Selbst wenn jedoch das Gericht Zulässigkeitsbedenken haben sollte, so wären diese gem. R. 111 (b), 334 (c) VfO und nicht nach R. 263.2 VfO zu behandeln.
Auch der Vortrag der Beklagten zur Möglichkeit einer früheren Geltendmachung (SSTZ, S. 6 Abs. 1) sei bereits im Ausgangspunkt nicht nachvollziehbar: Der guten Ordnung halber sei einmal klarzustellen, dass die Behauptung der Beklagten, die Klägerin habe erst nach Erhebung der hiesigen Verletzungsklage Anschlussberufung im deutschen Nichtigkeitsverfahren erhoben (SSTZ S. 6 Abs. 1) falsch sei – dies ergebe sich auch bereits aus der Akte. Die Klägerin habe am
12.03.2024 – vor Erhebung der hiesigen Klage am selben Tag – Anschlussberufung erhoben (Anlage CBH 09; vgl. Klage, Rn. 14). Am 15.03.2024 habe die Klägerin vorsorglich erneut Anschlussberufung erhoben (Anlage CBH 26, vgl. Antrag auf Klageänderung, Rn. 2), nachdem der Vorsitzende des X. Zivilsenats Bedenken an der Zulässigkeit geäußert habe. Für das vorliegende Verfahren sei all dies irrelevant. Richtig sei, dass der Verwendungsanspruch mit der Widerspruchsbegründung im deutschen Nichtigkeitsverfahren eingeführt wurde (vgl. zum geltend gemachten Anspruch i.Ü. Klage, Rn. 14, 37, 117; Antrag auf Klageänderung, Rn. 1-5). Dem Gericht sei bekannt (und insoweit bestehe auch Einigkeit zwischen den Parteien,
vgl. SSTZ S. 4 Abs. 2), dass nach deutscher Rechtsprechung die beschränkte
Verteidigung im Nichtigkeitsverfahren nicht bindend sei (vgl. vorsorglich die in Anlage CBH 26, Rn. 9 zitierte Rechtsprechung, auf die es hier aber nicht ankomme). Wenn aber im nationalen Rechtsbestandsverfahren ein Anspruch verteidigt werden könne (und verteidigt worden sei), sei
nicht ersichtlich, wieso dieser nicht zum Gegenstand eines Verletzungsverfahrens gemacht werden können soll. Hiergegen wende sich die Beklagte indes auch nicht. Sie scheine vielmehr der Auffassung zu sein, dass die Klägerin gehalten gewesen sei, mit der Klage sowohl den im deutschen Nichtigkeitsverfahren verteidigten Sachanspruch als auch bereits hilfsweise den nunmehr geltend gemachten Verwendungsanspruch geltend zu machen. Dies sei indes nicht nachvollziehbar: Denn die – auch in R. 263 VfO reflektierte – Prozessförderungsmaxime erfordere es auch vor dem Hintergrund eines „front loaded“ Verfahrens nicht, das Verfahren
zum frühestmöglichen Zeitpunkt mit Hilfsanträgen zu belasten, für deren Stellung es keinen konkreten Anlass gebe (vergleichbar Hessel/Gessat, GRUR Patent 2024, 197, Rn. 17 ff.). Andernfalls müsste etwa ein Patentinhaber, der sein Patent im europäischen Einspruchsverfahren mit Blick auf die dortige Verfahrensordnung frühzeitig mit zahlreichen Hilfsanträgen verteidige, um sämtlichen Eventualitäten zu begegnen, all diese Hilfsanträge bereits mit der Verletzungsklage geltend machen, um sich nicht – wie dies die Beklagte hier tue – den Vorwurf gefallen zu lassen, er hätte die Hilfsanträge auch früher stellen können. R. 263.1 S. 2 sowie R. 263.2 (a) VfO besagten damit, auch nach der Rechtsprechung der Kammer, nicht, dass neue Anträge immer dann abzulehnen sind, wenn sie theoretisch bereits früher hätten gestellt werden können. Vielmehr stelle R. 263 auf die „gebotene Sorgfalt“ ab und gehe es darum, eine Verfahrensverzögerung oder unangemessene Behinderung der Beklagten in dem Fall zu verhindern, dass sich die späte Geltendmachung nicht rechtfertigen lasse. Im vorliegenden Fall habe jedoch kein Grund für eine frühere (hilfsweise) Geltendmachung des Verwendungsanspruchs bestanden: Das Bundespatentgericht habe (BPatG gem. Anlage CBH 08, S. 14, Ziff. A II.2, S. 18 ff.; vgl. hierzu Rn. 12 ff. der Anschlussberufung gem. Anlage CBH 26) in seinem Urteil festgehalten, dass es bereits den Sachanspruch für patentfähig erachte. Dass die Beklagte die Nichtigkeitsberufung zurücknehmen und damit den Verwendungsanspruch „zementiert“ würde sei bei der gebotenen Sorgfalt nicht zu erwarten gewesen.
Die Beklagte werde durch die Klageänderung auch nicht behindert. Substantielles – denn ein gewisser Grad der Behinderung stehe der Zulassung nicht entgegen (Anordnung v. 11.12.2023 UPC_CFI_9/2023 ACT_459771/2023 App_587438/2023 GRUR-RS 2023, 45174 – Huawei/Netgear) – lasse sich ihrer Stellungnahme nicht entnehmen: Die „Anpassung ihres Vortrags“ (SSTZ, S. 6 a.E.) sei jeder Klageänderung immanent und begründe damit keine Behinderung. Der Verweis auf die Anpassung von Sachverständigengutachten bleibe im Vagen.
Er erscheine auch unschlüssig zu sein: Erstens müsse sich die Beklagte bereits auf Ebene
des (nach übereinstimmender Auffassung der Parteien zulässigen) Antrags zu
Ziff. II.1b mit der Verletzung des Verwendungsanspruchs befassen. Mit der Zulassung des Antrags zu Ziff. II.1b‘ gehe insoweit keine Änderung einher. Zweitens seien die strukturellen bzw. räumlich-körperlichen Merkmale des Verwendungsanspruchs identisch zu dem bereits seit jeher geltend gemachten Sachanspruch (vgl. Anlage CBH 29). „Ermittlungen bei der Mandantin in drei Ländern“ seien – wenn überhaupt – bereits zuvor notwendig gewesen. Eine zusätzliche Belastung sei nicht ersichtlich. Die Behauptung zusätzlicher „erheblicher Zeit und Ressourcen“ bleibe phrasenhaft. Dass die Klägerin „bisher in noch keinem Verfahren“ einen entsprechenden Verletzungsvorwurf erhoben habe, liege daran, dass bislang noch kein Verletzungsverfahren zwischen den Parteien anhängig gewesen sei. Wie die Beklagte zutreffend festhalte, kenne sie den Verwendungsanspruch bereits seit dem 17.03.2022. Die Konzernschwester der Klägerin habe als frühere Patentinhaberin auch im anhängigen Besichtigungsverfahren (vgl. Klage, Rn. 9, 12, 108 ff.) ausgeführt, dass die Patentverletzung (sowie die Feststellungen des dortigen Gerichtssachverständigen) durch den Wechsel vom Sach- auf einen Verwendungsanspruch nicht berührt werde. Dem sei die Beklagte dort auch nicht entgegengetreten. Die Beklagte habe mit der Rücknahme ihrer Nichtigkeitsberufung die beantragte Klageänderung bewusst herbeigeführt.
Sie werde auch insoweit nicht unangemessen behindert, als sie von der beantragten Klageänderung nicht überrascht sein könne.
Im Rahmen der Geltendmachung des Verfahrensanspruchs sei richtig, dass (allein) der Antrag zu II.2 mit der Geltendmachung der mittelbaren Patentverletzung des Verfahrensanspruchs eine Klageerweiterung begründe. Allein dies begründe jedoch keine Unzulässigkeit. Die Beklagte stütze sich maßgeblich darauf, dass die erfolgte Änderung des deutschen Teils des Klagepatents für die französischen und italienischen Teile nicht relevant sei. Mit Blick auf den deutschen Teil betone sie, der Klägerin müsse bewusst gewesen sein, dass eine mittelbare Verletzung „erforderlich werden könnte“. Umgekehrt werde die Beklagte dadurch behindert, dass sie die „relevanten Tatsachen“ in Bezug auf die weiteren Tatbestandsmerkmale der mittelbaren Verletzung in „drei Jurisdiktionen“ aufarbeiten müsse. Es bedürfe keiner Vertiefung, dass der durch die Rücknahme der Nichtigkeitsberufung durch die Beklagte veranlasste Wechsel zum Verwendungsanspruch Ausgangspunkt der nunmehr geltend gemachten mittelbaren Verletzung sei. Wie bereits im Kontext der Zulässigkeit des Antrags zu Ziff. II.1b‘ (Rn. 15 ff.) dargelegt worden sei, gebe es keinen Rechtssatz dahingehend bzw. gehöre es nicht zur gebotenen Sorgfalt, Anträge zu stellen, für die es keinen konkreten bzw. ersichtlichen Anlass gebe. Auslöser der Klageänderung sei die nicht vorhersehbare Rücknahme der Nichtigkeitsberufung gewesen.
Nachdem die Klage zulässig und entsprechend der gebotenen Sorgfalt auf den verteidigten Sachanspruch gestützt worden sei, habe es ex ante auch keinen Anlass zur Geltendmachung der mittelbaren Patentverletzung gegeben. Denn mit Geltendmachung der mittelbaren Patentverletzung habe die Klägerin nichts erreichen können, was sie nicht bereits mit Geltendmachung der unmittelbaren Verletzung des Sachanspruchs haben erreichen können. Anlass zur ergänzenden Geltendmachung der mittelbaren Verletzung des Verfahrensanspruchs habe es erst mit der „Fixierung“ des Verwendungsanspruchs durch die Beklagte gegeben.
Nachdem jedoch die Klageerweiterung mit Blick auf den deutschen Verfahrensanspruch
vor diesem Hintergrund ohne Weiteres gem. R. 263 VfO zulässig sei, gebe es keinen
Grund, die parallele Geltendmachung des inhaltsgleichen Anspruchs der inhaltsgleichen
Verfahrensansprüche des französischen und italienischen Teils des Klagepatents anders
zu behandeln. Die Patentverletzung ergebe sich technisch wie patentrechtlich aus denselben Gründen. Auch insofern gelte (wie bereits i.R.d. Zulässigkeit des Antrags zu Ziff. II.1b‘ dargelegt
worden sei – Rn. 21 ff.), dass die Beklagte ersichtlich nicht – geschweige denn unangemessen
– behindert werde und dies auch nicht vortrage: Unklar bleibe bereits, welche ergänzenden
Tatsachen für die mittelbare Patentverletzung aufzuklären seien. Am Vorliegen eines wesentlichen Mittels bestehe bereits mit Blick auf den Klagevortrag zur Verwirklichung
des Sachanspruchs kein Zweifel. Dass die Beklagte die angegriffene Ausführungsform
zur klagepatentgemäßen Verwendung empfehle und bewerbe und damit auch die Durchführung des anspruchsgemäßen Verfahrens offensichtlich sei, ergebe sich ebenfalls bereits
aus dem Klagevortrag. Die Behauptung einer Aufarbeitung in „drei Jurisdiktionen“ übersehe die Anwendbarkeit einheitlichen materiellen Rechts, Art. 24 (1)(b), 26 (1) EPGÜ.
Eine Erweiterung durch den Rückbezug des Antrags zu Ziff. III sei nicht ersichtlich. Ziff. III
beinhalte die Anträge auf Auskunft (III.1), Offenlegung der Bücher (III.2), Vernichtung
(III.3) und Rückruf (III.4), jeweils unter Bezug auf die Erzeugnisse gem. Nr. II. Diese Anträge seien mithin akzessorisch und gingen in ihrem Umfang nicht über die – nach dem Vorstehenden zulässigen – Änderungen in Ziff. II hinaus. Konkrete Einwände erhebe die Beklagte nur in Bezug auf die Zulässigkeit der Anträge auf Rückruf und Vernichtung hinsichtlich der mittelbaren Patentverletzung und beziehe sich auf Art. 64 (EPGA, gemeint sein dürfte EPGÜ). Die Klägerin könne Art. 64 EPGÜ keine entsprechende Beschränkung entnehmen. Entsprechende Zweifel dürften sich im Übrigen auf die Begründetheit und nicht auf die Zulässigkeit gem. R. 263.2 VfO
beziehen. Zu guter Letzt mache die Klägerin nicht nur eine mittelbare Verletzung, sondern v.a. auch eine unmittelbare Patentverletzung geltend, was die Ansprüche auf Rückruf und Vernichtung begründete. Hinzu komme, dass nicht jede Änderung in den Anträgen zu einer R. 263 VfO unterfallenden Klageänderung führe. So wie Berichtigungen und Präzisierungen keine Klageänderung darstellten, gelte dies spiegelbildlich für – unterstellte – Unschärfen, die am inhaltlich Gewollten nichts änderten. In Bezug auf die Kostenfolge habe das Gericht die Beklagte mit Anordnung vom 19.06.2024 zur Stellungnahme zum Antrag auf Klageänderung aufgefordert. Der vorrangig gestellte Kostenantrag zu Ziff. 1 der Beklagten betreffe keine Frage der Zulässigkeit gem. R. 263 VfO. Das Gericht dürfte gem. R. 118.5 VfO eine Kostengrundentscheidung zusammen mit seiner Entscheidung in der Sache treffen. Gleichwohl sei entsprechend der Anordnung vom 03.07.2024 vorsorglich bereits jetzt auch hierzu Folgendes angemerkt: Art. 69 (1), (2) EPGÜ regelr die Kostentragung grundsätzlich entsprechend dem Anteil an Obsiegen und Unterliegen. Der Antrag der Beklagten zu 1) unterstelle ein Unterliegen der Beklagten in der Sache und eine Kostentragung der Klägerin scheinbar entsprechend den Grundsätzen des § 269 Abs. 3 S. 2 der deutschen ZPO. Eine solche Regelung fehle in R. 265 VfO; R. 265.2 (c) VfO verweise lediglich auf die R. 150 ff. VfO. Auch wenn man davon ausgehe, dass eine (Teil-)Klagerücknahme entsprechend R. 265 VfO oder eine beschränkende Klageänderung entsprechend R. 263 VfO ein teilweises Obsiegen i.S.d. Art. 69 (2) EPGÜ darstelle, so sei ein solcher Fall hier nicht gegeben:
Nach allgemeinen Grundsätzen bestimme sich die Bemessung des Obsiegens bzw. Unterliegens nach wirtschaftlichen Gesichtspunkten. Eine formalistische Betrachtungsweise sei nicht geboten. Richtig sei, dass der nunmehr geltend gemachte Verwendungsanspruch gegenüber dem ursprünglichen Sachanspruch ein Minus darstelle. Dieses Minus habe jedoch keine wesentlichen Auswirkungen auf das klägerische Begehr. Denn mit dem ursprünglichen Antrag zu II habe die Klägerin u.a. beantragt, der Beklagten die Herstellung, das Angebot, das Inverkehrbringen, Gebrauchen oder Besitzen zu diesen Zwecken anspruchsgemäßen Metallsinterzubereitungen/Sinterpasten in der Bundesrepublik Deutschland zu untersagen. Mit dem nunmehrigen Antrag zu II.1b beantrage die Klägerin, der Beklagten zu untersagen, anspruchsgemäße Metallsinterzubereitungen/Sinterpasten in der Bundesrepublik Deutschland anzubieten, in Verkehr zu bringen oder zu gebrauchen oder zu diesen Zwecken zu besitzen, wenn diese dazu geeignet sind, zum festen Verbinden von Bauelementen verwendet zu werden. Nachdem die Eignung zur Verwendung aus der Anspruchsverwirklichung folge, liege das
einzige inhaltliche Minus des geänderten Antrags II.1b gegenüber dem ursprünglichen
Antrag II.1 darin, dass die Klägerin nicht länger die Unterlassung der Herstellung der angegriffenen Ausführungsformen in der Bundesrepublik Deutschland begehre. Dem mag
ein wirtschaftlicher Wert zukommen; mit Blick darauf, dass die Beklagte etwaige in
Deutschland hergestellte Ausführungsformen weder in Deutschland noch sonst wie vertreiben könne – denn der Export begründe ebenfalls ein patentrechtliches Inverkehrbringen – sei dieser jedoch geringfügig. Die Klägerin hätte damit aus Billigkeitsgründen (Art. 69 (2) EPGÜ) keine Kosten zu tragen.
Die Beklagte hat hierzu wie folgt Stellung genommen:
− Ziff. II.1a & Ziff. II.1b:
Die Klarstellungen in Ziff. II. 1a sowie die Beschränkung des Antrags in Ziff. II.1b stünden zwischen den Parteien nicht weiter in Streit (vgl. Schriftsatz vom 21. Juni 2024 S. 3 f. Ziff. I, II). Für den Fall einer Klageerweiterung verweise die Beklagte auf die bisherigen Ausführungen und merke insoweit lediglich an, dass die Feststellung der „gebotenen Sorgfalt“ im Sinne von Regel 263.1 VerfO nicht vom Eintritt der Rechtskraft abhängig sei, sondern von den konkreten Umständen des Einzelfalles. Dass die Klägerin die Beschränkung des Klagepatents im deutschen
Nichtigkeitsverfahren seit ihrer Widerspruchsbegründung vom 17. März 2022 verfolge,
sei unstreitig, §§ 404, 402 BGB (vgl. Schriftsatz vom 21. Juni 2024 S. 4).
− Ziff. II.1b‘:
Die Beklagte meine, das Verbot eines sinnfälligen Herrichtens sei bereits von ihrem ursprünglichen Antrag erfasst gewesen und daher keine Klageerweiterung (vgl. Schriftsatz vom 10. Juli 2024 S. 3 f.). Dem sei nicht zuzustimmen. Das Verbot von Vorbereitungshandlungen in Bezug auf das sinnfällige Herrichten zum Zwecke der Verwendung und das Verbot von Benutzungshandlungen in Bezug auf den Erzeugnisanspruch seien nicht deckungsgleich. Die Klägerin beanspruche Verbote in Bezug auf angebliche Verwendungsangaben wie bspw. “Low Temperature Sintering“ oder „low temperature joining technology”, die außerhalb der behaupteten Verletzung des ursprünglichen Erzeugnisanspruchs stünden und lediglich Angaben zur Verwendung enthalten sollen, ohne dass hierin gleichzeitig bspw. ein Angebot in Bezug
auf das zunächst angegriffene Erzeugnis läge. Im Übrigen bleibe unstreitig, dass der
Klägerin die Beschränkungen des Klagepatents bereits seit ihrer Widerspruchsbegründung vom 17. März 2022, jedenfalls aber seit dem Urteil des Bundespatentgerichts vom 7. November 2023 bei Klageerhebung bekannt gewesen sei und sie daher ihren erst am 5. Juni 2024 gestellten Hilfsantrag bei gebotener Sorgfalt bereits bei Klageerhebung hätte stellen müssen. Es sei für die Klägerin – auf der Grundlage ihres eigenen Antrags – ohne weiteres erkennbar gewesen, dass das Klagepatent im Gebiet der Bundesrepublik Deutschland nur unter den nunmehr eingeführten Einschränkungen fortbestehen würde. Wieso die Klägerin dem nicht durch eine entsprechende
Antragstellung bereits bei Klageerhebung Rechnung habe tragen können, sei nicht ersichtlich.
Dass durch die vorgenommenen Änderungen ein erheblicher Mehraufwand für die
Beklagte entstehe, sei darüber hinaus evident. Unstreitig habe die Klägerin mit der
Erweiterung ihrer Klage die Verletzung des Verwendungsanspruchs und der hieraus
resultierenden weiteren Merkmale erstmals behauptet, obschon ihr eine entsprechende Antragstellung bereits im Zeitpunkt der Klageerhebung möglich gewesen wäre. Im
Übrigen verweise die Beklagte auf die bisherigen Ausführungen hierzu (vgl. Schriftsatz
vom 21. Juni 2024 S. 5 f.).
− Ziff. II.2:
In Bezug auf die nunmehr geltend gemachte mittelbare Patentverletzung trage die Klägerin nichts vor. Es bleibe daher ohne jede Rechtfertigung, warum die Klägerin eine mittelbare Patentverletzung für das Gebiet der Französischen und Italienischen Republik erst nach der Klageerhebung geltend gemacht habe. Selbiges gelte in Bezug auf die Bundesrepublik Deutschland. Für die Klägerin wäre es in Anbetracht ihrer eingeschränkten Verteidigung des Klagepatents im Nichtigkeitsverfahren ohne weiteres möglich und geboten gewesen, einen entsprechenden (Hilfs-)Antrag bereits bei Klageerhebung zu stellen. Unmittelbare und mittelbare Patentverletzung entsprächen sich schließlich weder der Zielrichtung noch ihren Voraussetzungen nach, Art. 25, 26 EPGÜ (vgl. im Übrigen Schriftsatz vom 21. Juni 2024 S. 7 Ziff. IV).
− Ziff. III.3 & Ziff. III.4:
Die Klägerin meine, ein Rückbezug der Anträge in Ziff. III.3 und Ziff. III.4 auf die geänderten Ansprüche in Ziff. II müsse zulässig sein, da es sich lediglich um akzessorische Anträge handle
(vgl. Schriftsatz vom 10. Juli 2024 S. 9 f. Ziff. 4). Dem sei nicht so. Regel 263.1 VerfO unterscheide nicht zwischen einer Erweiterung akzessorischer und nicht-akzessorischer Anträge, sondern mache eine Änderung des ursprünglichen Umfangs der Klage von den darin genannten
Voraussetzungen abhängig, zu denen die darlegungsbelastete Klägerin nichts
Konkretes vorgetragen habe. Die Beklagte verweise daher auf ihre bisherigen Erläuterungen hierzu (siehe Schriftsatz vom 21. Juni 2024 S. 7 f. Ziff. V).
− Kostenentscheidung:
Gemäß Regel 265.2 lit. (c) VerfO sei bei der Zulassung einer Rücknahme eine Kostenentscheidung zu treffen („Wird die Rücknahme zugelassen, erlässt das Gericht… eine Kostenentscheidung“; „If withdrawal is permitted, the Court shall: … issue a cost decision“), wobei die Kosten der lagerücknahme im Grundsatz zu Lasten der Klägerin gehen müssten, § 69 Abs. 2 EPGÜ (vgl. Momtschilow in Luginbühl/Hüttermann, Einheitspatentsystem, 1. Auflage 2024, Art. 69 Rn. 52:
„Mangels einer konkreten Regelung der Kostenfolge bei einer Klagerücknahme (hier
gibt es lediglich die Rückverweisung der R 265.2.[c] VerfO auf das Kostenfestsetzungsverfahren der R 150–157 VerfO) oder einer Erledigungserklärung können diese Fälle als außergewöhnliche Umstände nach Abs 2 behandelt werden.“; Dold/W. Tilmann in Tilmann/Plassmann, EPGÜ, 2024, Art. 69 Rn. 72, Rn. 109: „Um Art. 69 EPGU auf die Klagerücknahme anzuwenden, muss davon ausgegangen werden, dass im Fall der Klagerücknahme immer ein außergewöhnlicher Umstand i. S. v. Art. 69 Abs. 2 EPGÜ vorliegt. Dann sind die Kosten nach Billigkeit zu verteilen. Das
bedeutet im Grundsatz, dass der Kläger die Kosten zu tragen hat.“). Die Beschränkung
des deutschen Teils des Klagepatents sei für die Klägerin infolge ihres eigenen
Antrags, der Entscheidung des Bundespatentgerichts vom 7. November 2023 und der
nicht selbst erhobenen Berufung bereits vor Klageerhebung offenkundig gewesen.
STRITTIGE PUNKTE
Über die Zulässigkeit der Klageänderung und die Folgen für das Fristenregime ist zu befinden.
BEGRÜNDUNG DER ANORDNUNG
I. Die Beklagte hat die Widerklage auf Nichtigerklärung des Klagepatents (CC_43919/2024 UPC_CFI_448/2024 ) gegen die Heraeus Precious Metals GmbH & Co. KG gerichtet mit der Begründung, dass diese zum Zeitpunkt der Erhebung der Nichtigkeitswiderklage im Register als Patentinhaberin eingetragen gewesen sei und daher gemäß Regel 25.1, 42.2 und 8.6 VerfO aus formalen Gründen als richtige Beklagte der Nichtigkeitswiderklage anzusehen gewesen sei.
Dieses Unternehmen wird im Rubrum zur Vereinfachung als Klägerin zu 2) geführt. Die Klage wurde allein von der Klägerin zu 1) erhoben.
II. Die Voraussetzung zur Zulassung der Klageänderung liegen nur teilweise vor: 1. Nach Regel 263 VerfO kann eine Partei zu jedem Zeitpunkt des Verfahrens beim Gericht die Zulassung einer Klageänderung oder Klageerweiterung, einschließlich einer Widerklage, beantragen. In dem Antrag ist zu begründen, weshalb die Änderung oder Ergänzung nicht schon in dem ursprünglichen Schriftsatz enthalten war. Vorbehaltlich des Absatzes 3 wird die Zulassung abgelehnt, wenn die Partei, welche die Änderung beantragt, unter Berücksichtigung aller Umstände das Gericht nicht davon überzeugen kann, dass (a) die in Rede stehende Änderung bei gebotener Sorgfalt nicht früher vorgenommen werden konnte und (b) die Änderung die andere Partei in ihrer Verfahrensführung nicht unangemessen behindert. Die bedingungslose Beschränkung eines Klageanspruchs wird immer zugelassen. Das Gericht kann die bereits entrichteten Gebühren im Lichte einer Änderung neu festsetzen.
Beide Bedingungen müssen unabhängig voneinander erfüllt sein. Wenn eine der Bedingungen nicht erfüllt ist, ist das Ermessen des Gerichts auf null reduziert und es muss den Antrag ablehnen. Die Beweislast, dass sowohl die Anforderungen von R. 263.1 VerfO als auch die Ausschlussgründe gemäß R. 263.2 VerfO nicht erfüllt sind, liegt beim Antragsteller. Daher muss der Antragsteller erklären, warum die Änderung nicht in den ursprünglichen Schriftsätzen enthalten war, R. 263.1 VerfO. Ebenso muss das Gericht in der Lage sein, auf der Grundlage der Erklärung des Antragstellers über die in R. 263.2 RoP enthaltenen Ausschlusskriterien zu entscheiden (LK München, APP_25265/2024 UPC_CFI_42/2024).
Dies vorausgeschickt gilt folgendes:
2. Antrag II.1a Der Antrag bleibt in Bezug auf die Französische Republik und die Italienische Republik unverändert.
In Bezug auf die Bundesrepublik Deutschland wurde er zurückgenommen bzw. durch die Anträge II.1b und II.1b` ersetzt. Auf die dortigen Ausführungen wird verwiesen.
3. Antrag II.1.b
Der Antrag trägt der am 7. Mai 2024 eingetretenen Rechtskraft des Urteils des Bundespatentgerichts (Anlage CBH 8) Rechnung. In diesem Urteil wurde der Vorrichtungsanspruch vernichtet und der hilfsweise geltend gemachte Verwendungsanspruch aufrechterhalten. Da der Verwendungsanspruch gegenüber dem Vorrichtungsanspruch einen geringeren Schutzumfang aufweist und der Antrag als Hauptantrag unbedingt gestellt wird, liegt eine bedingungslose Beschränkung des Klageanspruchs vor, die immer zugelassen wird. Dies gilt auch mit Blick auf die darauf Bezug nehmenden Folgeansprüche.
Eine Kostenentscheidung ist derzeit nicht veranlasst. Es gilt der Grundsatz der Einheit der Kostenentscheidung.
4. Antrag II.1.b`
Dieser Antrag steht zum Antrag II.1.b in einem Hilfsverhältnis, sodass keine bedingungslose Beschränkung vorliegt. Der Antrag betrifft ein sinnfälliges Herrichten für eine spätere Verwendung und trägt daher der am 7. Mai 2024 eingetretenen Rechtskraft des Urteils des Bundespatentgerichts (Anlage CBH 8) Rechnung. In diesem Urteil wurde der Vorrichtungsanspruch vernichtet und der hilfsweise geltend gemachte Verwendungsanspruch aufrechterhalten. Eine Antragsänderung vor Eintritt der Rechtskraft ist zwar möglich, im Rahmen der Regel 263 VerfO aber nicht zu fordern. Der zeitliche Verzug zwischen Zustellung des Beschlusses vom 7. Mai 2024 am 13. Mai 2024 und der Erklärung der Klageänderung am 5. Juni 2024 hält sich noch im Rahmen der gebotenen Sorgfalt. Dies gilt auch mit Blick auf die darauf Bezug nehmenden Folgeansprüche.
Die Beklagte wird durch die Zulassung in ihrer Verfahrensführung nicht unangemessen behindert. Die Erholung von technischen Gutachten erscheint insoweit nicht erforderlich, weil als weiterer Aspekt allein nicht-technische Details der Angebotshandlungen hinzugekommen sind. Unabhängig hiervon hatte die Beklagte bereits seit dem Tag der Antragstellung Zeit, sich in ihrer Verteidigung auf die neue Situation einzurichten. Vorsorglich wird ihr eine weitere Stellungnahmefrist von weiteren 30 Tagen eingeräumt
5. Antrag II.2
Dieser Antrag betrifft die mittelbare Verwendung des Verfahrensanspruchs und trägt daher auch nicht für das Gebiet der Bundesrepublik Deutschland der am 7. Mai 2024 eingetretenen Rechtskraft des Urteils des Bundespatentgerichts (Anlage CBH 8) Rechnung. Dieser Antrag hätte daher bereits mit der Klage vom 12. März 2024 geltend gemacht werden können. Die Klageänderung knapp drei Monate später bewegt sich nicht mehr im Bereich der gebotenen Sorgfalt und ist daher zwingend abzulehnen. Dies gilt auch mit Blick auf die darauf Bezug nehmenden Folgeansprüche. Der Klägerin steht es frei, diese Ansprüche im Wege einer gesondert einzureichenden weiteren Klage geltend zu machen.
ANORDNUNG
1. Die Klageänderung durch die Klägerin zu 1) gem. Anlage CBH 25 wird mit Ausnahme des Antrags zu Ziffer II.2 inklusive den darauf bezugnehmenden Folgeansprüche zugelassen und im Übrigen abgelehnt.
2. Die Beklagte kann zum Gegenstand der zugelassenen Klageänderung innerhalb von weiteren 30 Tagen schriftsätzlich Stellung nehmen.

2 to disclose to the plaintiff its accounts to prove the information provided in accordance
with No. III.1. by making them available for each month of a calendar year and for
each infringing product in electronic form that can be analysed with the aid of a
computer:
(a) Evidence of the number and dates of products manufactured:
(b) Invoices - or, if these are not available, delivery notes - of the individual deliveries,
broken down by quantities offered, offer periods, prices of the goods offered and
type designations, as well as names and addresses of the commercial recipients of
the sales offers for all products sold or otherwise disposed of:

(c) Evidence of advertising carried out, broken down by advertising medium. its
distribution, the distribution period and the distribution area: including evidence
of these advertising activities:

(e) Invoices - or, if these are not available, delivery notes - and corresponding
statements of all costs incurred on which the defendant relies in calculating its

the accuracy of which shall be verified and certified at the defendant's expense by
a sworn auditor appointed by the plaintiff, whereby the auditor s h a l l b e bound
to secrecy vis-à-vis the plaintiff beyond the above-mentioned information;
3. any product which is directly or indirectly in its possession or ownership and which is
referred to in No. II. to hand over to a court auctioneer to be appointed by the
plaintiff for the purpose of destruction on the defendant's premises;
4. to recall the products referred to in No. II. and to permanently remove them from
the distribution channels and to inform the third parties from whom the products are
to be recalled that this court has found that the product infringes European Patent EP
3 215 288 B1, whereby the defendant shall give the third parties a binding
undertaking to reimburse the costs incurred, to bear the packaging and transport
costs incurred, to reimburse the customs and storage costs associated with the return of
the products and to take back the products.
IV. The plaintiff is authorised to publish the decision or extracts from it on the defendant's
website for a maximum amount of EUR 20,000.00 within 14 days.
The defendant is ordered to pay the plaintiff
1. EUR 250,000.00 as interim damages, to be adjusted if the acts referred to in No. II
continue;
2. any further damages incurred by Heraeus Preciaus Metals GmbH & Co KG,
Herausstraße 12-14, 63450 Hanau, Germany, for all past acts pursuant to No. II
until 31 July 2023 as well as damages incurred or to be incurred by the plaintiff for
all past, committed since 1 August 2023 and future acts pursuant to No. II,
3. to pay reasonable compensation for all acts pursuant to No. II in the Federal
Republic of Germany for which damages are not already payable pursuant to No.
V.2.
vi. The defendant is ordered to pay the costs and expenses of the proceedings.
VII. in the event that the defendant does not reply or fails to take other ordered procedural
steps, we request that a default judgement be issued in accordance with R. 355.

The defendant claims that the Court should:
1. That the plaintiff pay the costs of the proceedings to the extent of the
application withdrawn pursuant to paragraph II 1b above.
2. The plaintiff's application of 5 June 2024 for leave to extend the action pursuant to
Rule 263.1 RoP to include the claims specified in the pleading of 5 June 2024 in
accordance with claim II.1b' (meaningful preparation with "in particular" claim) and
II.2 (indirect infringement) is not granted.
3. The time limit for filing a statement of defence and the time limit for filing a
counterclaim for annulment are extended until 29 July 2024
SUBMISSION OF THE PARTIES
The plaintiff argues that the requested amendment to the action reflects, on the one hand, the
amended subject matter of the claim due to the withdrawal of the revocation appeal of the present
defendant against the German part of the patent in suit and, on the other hand, that the requested
amendment to the action is intended to extend the action to include the indirect infringement of the
procedural claim.
The requested amendment to the action was not already to be taken into account in the original
action, since the national validity proceedings had not yet been concluded and the
the version of the claim asserted in the action was pending there with the cross-appeal. The
amendment to the action had only become necessary as a result of the final
of the national nullity proceedings. This also applied to the current assertion of the indirect
infringement of the procedural claim. At the time the action was filed, there was no reason to do so,
as the defendant was to be ordered to cease and desist due to the use of the substantive claim. Since
the withdrawal of the appeal meant that a use claim was now to be asserted with regard to the
Federal Republic of Germany, on the treatment of which in infringement proceedings no case law
had yet been established in the UPC (as far as can be seen), the assertion of indirect infringement
served as a precautionary measure to safeguard the plaintiff's claims with regard to the defendant's
distribution of the attacked embodiments. The plaintiff had prepared the application to amend the
action immediately after its sister company had been served with the order of the BGH terminating
the proceedings.
The defendant argues that the plaintiff's motions should be classified as a mere clarification of the
version of the motion (motion no. II.1.a), a withdrawal of the action triggering costs (no. II.1b, no.
II.1b', III.) and in part as an inadmissible extension of the action (no. II.2, III.).
The amendments in the application pursuant to para. II.1a are merely clarifying with regard to the
French and Italian parts of the patent in suit. The defendant therefore does not oppose these
amendments any further.
The new version of the requests in para. II.1b is admissible as a withdrawal of the action, but leads
to the plaintiff bearing the costs to the extent of the withdrawal.
In connection with the auxiliary request according to item II.1b', there is an inadmissible extension of
the action. The plaintiff had already referred to the patent in suit in the German nullity proceedings in
its

opposition of 17 March 2022 only in the version now asserted, which was ultimately also confirmed
by the Federal Patent Court in its judgment of 7 November 2023. The plaintiff itself did not initially
file an appeal, but only on 15 March 2024 - i.e. three days after the action was filed in these
proceedings on
12 March 2024 - filed a cross-appeal. Why the plaintiff did not already file an auxiliary request in line
with the version of the patent in suit already confirmed by the Federal Patent Court when filing its
action is not apparent in this respect and is also not justified by the plaintiff. The plaintiff could
therefore have filed the now filed auxiliary request "earlier" without further ado - for example also as
an auxiliary request conditional on the entry into force of the judgement of the Federal Patent Court
- with due care and consideration of its own procedural behaviour. Finally, the plaintiff's statement of
grounds also remained incomplete in this respect, which in turn could justify the rejection of the
auxiliary request. Furthermore, the "in particular" request was also not admissible. So-called.
"in particular" requests have no influence on the material scope of the operative part.
Admission is therefore also prohibited for this reason.
With the request in para. II. 2, the plaintiff asserts for the first time the indirect
infringement of claim 5 of the German and claim 6 of the French and Italian part of the
patent-in-suit and justifies the extension of its request with the occurrence of res judicata
in the German proceedings.
of res judicata in the German proceedings. This cannot be accepted. Firstly, the decision in the
German proceedings does not result in any change for the other patents in France and Italy as a
result of the German proceedings, which are independent of them. Even in the German proceedings,
the plaintiff had already limited itself to defending the German patent in its current version since its
statement of opposition of 17 March 2022. The plaintiff had therefore been aware long before filing
the action that an indirect patent infringement could become necessary. According to the plaintiff's
own explanations, there had been no change in the legal situation to date. Moreover, the plaintiff
based its application solely on the changed situation in Germany. For the French and Italian parts,
there are already no deviations at all in this respect, so that no reasons for the amendment of the
action have already been submitted for the French and Italian parts.
Finally, the plaintiff overlooked the fact that its amendments to the main claims also led
to an extension of the subject matter of the dispute with regard to the claims in section
III, which relate back to this. In this respect, the plaintiff does not justify its extension
which must therefore be rejected for this reason alone. Furthermore, it was not
recognisable in this respect either why a corresponding application had not been possible
earlier.
Furthermore, the defendant is threatened with an impediment to the conduct of the proceedings
because further expenses would be incurred in order to respond to the acts of infringement now
asserted. The defendant would have to completely re-examine corresponding actions with regard to
possible objections and proportionality considerations, which in turn would tie up time and
resources.
The plaintiff argues in this regard that the defendant does not explain why the action should be
extended. It is correct that the application under point II.1b' is not directed at mere use, but at
meaningful preparation. However, this differentiation does not constitute an extension of the
claim, as the previous application for injunctive relief was not limited to use. In fact, the
meaningful preparation

("recommendation for the fixed connection of construction elements") is a minus to the offer as part
of the original application for injunctive relief. The action sought (inter alia) an injunction against acts
of offering with regard to the sintering pastes covered by the patent in suit. Now it was requested
that the sintering pastes according to the patent in suit should not be recommended for the
permanent bonding of components or that metal sintering preparations prepared in this way should
not be offered. A substantive surplus was neither shown nor apparent. This is also confirmed by the
following comparative consideration: The request under No. II.1b was directed, inter alia, to the
omission of the offering of sintering pastes according to the patent in suit (if these are suitable for
firmly joining components, which already follows from the realisation of the spatial-physical claim
features). According to the unanimous opinion of the parties, the request under item II.1b' was an
auxiliary request to this, i.e. it also constituted a "minus" from this point of view. Against this
background, there was ultimately no need to decide whether auxiliary requests were in principle
subject to admissibility pursuant to R. 263 VfO.
The defendant's submission on the "in particular" applications (SSTZ, p. 6 para. 2) is not entirely
comprehensible. Neither does the case law of the Mannheim Regional Court appear to be of particular
importance to the court, nor does the inclusion of non-substantive restrictive formulations in the
application lead to the inadmissibility of the application, let alone the amendment of the action.

Court (7 O 145/09 BeckRS 2010, 21526 - covenant not to sue) primarily concerned the "in particular"
assertion of sub-claims. Moreover, it does not state that such an application is inadmissible
(although this is also not a question of R. 263 VfO, but at most of R. 13.1 (k)
VfO), but only that the court is free not to include it in the operative part of the judgement,
i.e. to choose a broad operative part (cf.
case law also BGH GRUR 2012, 945, para. 22 - Tribenuronmethyl). However, the court seised and
competent here included "in particular" formulations in the operative part if - as here - this served to
specify the infringing acts (order of 3 July 2024 UPC_CFI_7/2023 ACT_459767/2023

SharkNinja / Dyson). However, even if the court were to have admissibility concerns, these
would have to be dealt with in accordance with R. 111 (b), 334 (c) VfO and not in accordance
with R. 263.2 VfO.
The defendant's submission on the possibility of an earlier assertion (SSTZ, p. 6 para. 1) is also not
comprehensible from the outset: For the sake of good order, it should be made clear that the
defendant's assertion that the plaintiff only filed a cross-appeal in the German nullity proceedings
after the infringement action here was filed (SSTZ p. 6 para. 1) is incorrect - this is already apparent
from the file. The plaintiff had filed a cross-appeal on 12 March 2024 - before the present action was
filed on the same day (Annex CBH 09; cf. action, para. 14). On 15 March 2024, the plaintiff again
filed a cross-appeal as a precautionary measure (Annex CBH 26, cf. application to amend the action,
para. 2), after the Chairman of the X. Civil Senate had expressed concerns about admissibility. All of
this is irrelevant for the present proceedings. It is correct that the use claim was introduced with the
statement of grounds for opposition in the German nullity proceedings (cf. on the asserted claim i.Ü.
Action, paras. 14, 37, 117; Request for amendment of the action, paras. 1-5).
The court is aware (and in this respect there is also agreement between the parties, see
SSTZ p. 4 para. 2) that, according to German case law, the limited defence in nullity
proceedings is not binding.

Annex CBH 26, para. 9, which is not relevant here). However, if a claim can be defended in national
validity proceedings (and has been defended), it is

It is not apparent why this cannot be made the subject of infringement proceedings. However, the
defendant does not object to this. Rather, it appears to be of the opinion that the plaintiff was
required to assert both the substantive claim defended in the German nullity proceedings and, in
the alternative, the claim for use now asserted. However, this was not comprehensible: Even against
the background of "front-loaded" proceedings, the maxim of promoting litigation - also reflected in
R. 263 VfO - does not require the proceedings to be burdened at the earliest possible stage with
auxiliary requests for which there is no specific reason to file them (comparable Hessel/Gessat,
GRUR Patent 2024, 197, para. 17 et seq.).
Otherwise, a patent proprietor who defends his patent in European opposition proceedings with
numerous auxiliary requests at an early stage in view of the procedural rules there in order to
counter all eventualities would have to assert all these auxiliary requests already with the
infringement action in order not to be accused - as the defendant does here - of having been able to
file the auxiliary requests earlier. R. 263.1 sentence 2 and R. 263.2 (a) VfO thus do not state, even
according to the Chamber's case law, that new requests must always be rejected if they could
theoretically have been filed earlier. Rather, R. 263 is based on "due diligence" and is about
preventing a delay in proceedings or unreasonable obstruction of the defendant in the event that the
late assertion cannot be justified. In the present case, however, there was no reason for an earlier
(alternative) assertion of the use claim: The Federal Patent Court had stated (BPatG according to
Annex CBH 08, p. 14, para. A II.2, p. 18 et seq.; cf. para. 12 et seq. of the cross-appeal according to
Annex CBH 26) in its judgement that it already considered the substantive claim to be patentable.
The fact that the defendant would withdraw the nullity appeal and thus "cement" the use claim
would "cement" the utilisation claim was not to be expected with due diligence.
The defendant was also not hindered by the amendment to the action. Substantial - because a
certain degree of obstruction does not prevent admission (order of 11 December 2023
UPC_CFI_9/2023 ACT_459771/2023 App_587438/2023 GRUR-RS 2023, 45174 -
Huawei/Netgear) - cannot be inferred from their statement: The "adaptation of its submission" (SSTZ,
p. 6 a.E.) is inherent in any amendment to the action and thus does not constitute an obstruction.
obstruction. The reference to the adaptation of expert reports remains vague.
It also appears to be inconclusive: Firstly, the defendant already has to deal with the
request (which the parties agree is admissible) under
II.1b (which the parties agree is admissible). The admission of the application under II.1b' does not
entail any change in this respect. Secondly, the structural or spatial-physical characteristics of the use
claim are identical to the substantive claim that has always been asserted (cf. Annex CBH 29).
"Investigations at the client's premises in three countries" had - if at all - already been necessary
beforehand. An additional burden was not apparent. The assertion of additional "considerable time
and resources" remains phrase-like. The fact that the plaintiff has "not yet raised a corresponding
allegation of infringement in any proceedings" is due to the fact that no infringement proceedings
have yet been pending between the parties. As the defendant correctly states, it has been aware of
the use claim since 17 March 2022. As the former patent proprietor, the plaintiff's sister company
also stated in the pending inspection proceedings (see complaint, paras. 9, 12, 108 et seq.) that the
patent infringement (as well as the findings of the court expert there) was not affected by the change
from a substantive claim to a use claim. The defendant did not oppose this there either. By
withdrawing its appeal for annulment, the defendant had deliberately brought about the requested
amendment to the action.

It was also not unreasonably hindered insofar as it could not be surprised by the requested
amendment to the action.
In the context of the assertion of the procedural claim, it is correct that (only) the application under
II.2 with the assertion of the indirect patent infringement of the procedural claim constitutes an
extension of the action. However, this alone does not constitute inadmissibility. The defendant relies
primarily on the fact that the amendment made to the German part of the patent in suit is not
relevant for the French and Italian parts. With regard to the German part, it emphasises that the
plaintiff must have been aware that an indirect infringement
"could become necessary". Conversely, the defendant is hindered by the fact that it did not disclose
the
"relevant facts" in relation to the other elements of contributory infringement in "three jurisdictions".

use claim caused by the defendant's withdrawal of the cancellation appeal is the starting point of the
indirect infringement now asserted. As has already been explained in the context of the admissibility
of the application under II.1b (para. 15 et seq.), there is no legal principle to this effect and it is not
part of due diligence to file applications for which there is no concrete or obvious reason. The
amendment of the action was triggered by the unforeseeable withdrawal of the appeal for
annulment.
Since the action was admissible and based on the defended substantive claim in accordance with due
diligence, there was also no ex ante reason to assert contributory patent infringement. This is because
the plaintiff could not have achieved anything by asserting the indirect patent infringement that it
could not have achieved by asserting the direct infringement of the substantive claim.
There were only grounds for the supplementary assertion of the indirect infringement of the
procedural claim with the "fixing" of the use claim by the defendant.
However, since the extension of the action with regard to the German procedural claim was
permissible against this background without further ado pursuant to R. 263 VfO, there was
no reason to treat the parallel assertion of the substantively identical claim of the
substantively identical procedural claims of the French and Italian parts of the patent in suit
differently.

reasons. In this respect, too (as already explained in the context of the admissibility of the request
under point II.1b - para. 21 et seq.), the defendant is obviously not - let alone unreasonably -

clarified for the contributory patent infringement. The existence of an essential means is already
unclear in view of the submission on the realisation of the substantive claim.

patent and thus that the implementation of the method according to the claim was also obvious, was
also already evident from the statement of claim.
from the statement of claim. The assertion of a processing in "three jurisdictions" overlooks the
applicability of uniform substantive law, Art. 24 (1)(b), 26 (1) UPCA.
An extension by referring back to point III of the request is not apparent. Point III contains the
requests for information (III.1), disclosure of the books (III.2), destruction
(III.3) and recall (III.4), in each case with reference to the products pursuant to No. II. These requests
are therefore ancillary and do not go beyond the scope of the amendments in No. II, which are
admissible in accordance with the above. The defendant raises specific objections only with regard to
the admissibility of the requests for recall and destruction with regard to contributory patent
infringement and refers to Art. 64 (EPGA, probably meaning UPCA). The plaintiff could not infer any
corresponding restriction from Art. 64 UPCA. Corresponding doubts should, moreover, relate to the
merits and not to admissibility pursuant to R. 263.2 VfO

refer. Last but not least, the plaintiff asserted not only an indirect infringement, but above all a
direct patent infringement, which justified the claims for recall and destruction. In addition, not
every amendment in the applications leads to an amendment of the action subject to R. 263 VfO.
Just as corrections and clarifications do not constitute an amendment to the claim, the same applies
to - assumed - vagueness that does not change the content of the claim.
With regard to the costs consequence, the court had requested the defendant to comment on the
application to amend the action by order dated 19 June 2024. The defendant's priority application
for costs under no. 1 does not concern any question of admissibility pursuant to R. 263 VfO. Pursuant
to R. 118.5 VfO, the court should make a basic decision on costs together with its decision on the
merits. Nevertheless, in accordance with the order of 3 July 2024, the following should be noted now
as a precautionary measure: Art. 69 (1), (2) UPCA regulates the bearing of costs in principle according
to the proportion of winning and losing. The application of the defendant under 1) assumes that the
defendant was unsuccessful on the merits and that the plaintiff would apparently bear the costs in
accordance with the principles of Section 269 (3) sentence 2 of the German Code of Civil Procedure.
Such a provision is missing in R. 265 VfO; R. 265.2 (c) VfO merely refers to R. 150 et seq. VfO. Even if
one assumes that a (partial) withdrawal of the action pursuant to R. 265 VfO or a restrictive
amendment of the action pursuant to R. 263 VfO constitutes a partial victory within the meaning of
Art. 69(2) UPCA, such a case does not exist here: According to general principles, the assessment of
victory or defeat is determined according to economic aspects. A formalistic approach is not
required. It is correct that the claim for utilisation now asserted represents a minus compared to the
original claim in kind. However, this minus had no significant effect on the plaintiff's claim. With the
original application under II, the plaintiff had requested, among other things, that the defendant be
prohibited from manufacturing, offering, placing on the market, using or possessing metal sintering
preparations/sintering pastes in the Federal Republic of Germany for these purposes. With the
present application under II.1b, the plaintiff requests that the defendant be prohibited from offering,
placing on the market or using or possessing for these purposes sophisticated metal sintering
preparations/sintering pastes in the Federal Republic of Germany if they are suitable for being used
for the permanent bonding of components.
Since the suitability for use follows from the realisation of the claim, the only substantive minus
of the amended application II.1b compared to the original application II.1 is that the plaintiff no
longer seeks an injunction against the manufacture of the attacked embodiments in the
Federal Republic of Germany. This may have an economic value; however, in view of the fact
that the defendant does not manufacture any embodiments
Germany - because the export also constitutes a placing on the market under patent law - this is,
however, negligible. The plaintiff would therefore not have to bear any costs for reasons of equity
(Art. 69 (2) UPCA).
The defendant commented on this as follows:
− Sec. II.1a & Sec. II.1b:
The clarifications in para. II.1a as well as the limitation of the request in para. II.1b were no longer in
dispute between the parties (see statement of 21 June 2024 p. 3 f. para. I, II). In the event of an
extension of the action, the defendant refers to the previous statements and merely notes in this
respect that the determination of "due diligence" within the meaning of Rule

263.1 RoP is not dependent on the occurrence of res judicata, but on the specific circumstances of
the individual case. The fact that the applicant has been pursuing the limitation of the patent in suit
in the German nullity proceedings since its statement of opposition of 17 March 2022
is undisputed, Sections 404, 402 BGB (see statement of 21 June 2024 p. 4).
− Section II.1b':
The defendant is of the opinion that the prohibition of meaningful dressing was already covered by
its original application and was therefore not an extension of the claim (cf. statement of 10 July 2024
p. 3 f.). This is not to be agreed with. The prohibition of preparatory acts in relation to the obvious
preparation for the purpose of use and the prohibition of acts of use in relation to the product claim
are not congruent. The applicant claims prohibitions in relation to alleged indications of use such as
"low temperature sintering" or "low temperature joining technology", which are outside the alleged
infringement of the original product claim.

filed on 5 June 2024, with due diligence already when the action was filed. It was readily recognisable
to the plaintiff - on the basis of its own application - that the patent in suit would only continue to
exist in the territory of the Federal Republic of Germany subject to the restrictions now introduced. It
was not apparent why the plaintiff could not have taken this into account by filing a corresponding
application when filing the action. The fact that the changes made would result in considerable
additional expense for the
defendant was also evident. It is undisputed that the plaintiff, by extending its claim, had for
the first time alleged the infringement of the claim for use and the further characteristics
resulting therefrom, although it would already have been possible for it to file a
corresponding application at the time the claim was filed. In addition, the defendant refers to
the previous statements on this (see statement of 21 June 2024 p. 5 f.).
− Point II.2:
With regard to the indirect patent infringement now asserted, the plaintiff submits nothing. It
therefore remains without any justification why the plaintiff only asserted contributory patent
infringement for the territory of the French and Italian Republics after the action was filed. The same
applies with regard to the Federal Republic of Germany. In view of its limited defence of the patent
in suit in the nullity proceedings, it would have been possible and necessary for the plaintiff to file a
corresponding (auxiliary) request when the action was filed. Finally, direct and contributory patent
infringement do not correspond either in terms of their objective or their requirements under Art.
25, 26 UPCA (see also statement of 21 June 2024 p. 7 para.
IV).
− Points III.3 & III.4:
According to the plaintiff, a reference back of the requests in para. III.3 and para. III.4 to the
amended claims in para. II must be admissible, as they are merely accessory requests

(see statement of 10 July 2024 p. 9 f. para. 4). This is not the case. Rule 263.1 RoP does not
distinguish between an extension of accessory and non-accessory requests, but makes an
amendment to the original scope of the action dependent on the conditions stated therein, on which
the plaintiff, who is burdened with the burden of presentation, has not submitted anything concrete.
concrete arguments. The defendant therefore refers to its previous explanations in this regard (see
pleading of 21 June 2024 p. 7 f. para. V).
− Decision on costs:
Pursuant to Rule 265.2 lit. (c) RoP, a decision on costs is to be made if withdrawal is permitted ("If
withdrawal is permitted, the Court shall: ... issue a cost decision"), whereby the costs of withdrawal
must in principle be borne by the applicant, Sec. 69 (2) UPCA (cf.
Momtschilow in Luginbühl/Hüttermann, Unitary Patent System, 1st edition 2024, Art. 69 para. 52:
"In the absence of a specific provision on the cost consequences in the event of a withdrawal of an
action (here
there is only the referral of R 265.2.[c] RoP to the cost determination procedure of R 150-157 RoP) or
a declaration of surrender, these cases can be treated as exceptional circumstances under para. 2.";
Dold/W. Tilmann in Tilmann/Plassmann, UPCA, 2024, Art. 69 para. 72, para. 109: "In order to apply
Art. 69 UPCA to the withdrawal of an action, it must be assumed that in the case of withdrawal of an
action, an exceptional circumstance within the meaning of Art. 69 para.
within the meaning of Art. 69 para. 2 UPCA. The costs are then to be allocated on an
equitable basis. In principle, this means that the plaintiff has to bear the costs."). The
limitation of the German part of the patent in suit was already obvious to the plaintiff
before the action was filed as a result of its own request, the decision of the Federal
Patent Court of 7 November 2023 and the appeal it did not file itself.
POINTS IN DISPUTE
The admissibility of the amendment to the action and the consequences for the time limit regime
must be decided.
REASONS FOR THE ORDER
I. The defendant filed the counterclaim for revocation of the patent in suit (CC_43919/2024
UPC_CFI_448/2024 ) against Heraeus Precious Metals GmbH & Co. KG on the grounds that at the
time the revocation counterclaim was filed, this company was entered in the register as the patent
proprietor and was therefore to be regarded as the correct defendant in the revocation
counterclaim for formal reasons in accordance with Rules 25.1, 42.2 and 8.6 RoP.
For the sake of simplicity, this company is referred to in the headline as plaintiff 2). The action was
brought solely by plaintiff 1).
II. The requirements for the admission of the amendment to the action are only partially met:
1. Pursuant to Rule 263 RoP, a party may at any time during the proceedings apply to the court for
leave to amend or extend the claim, including a counterclaim. The application must state the
reasons why the amendment or addition was not already included in the original pleading. Subject
to paragraph 3, leave to amend shall be refused if the party seeking leave to amend cannot, having
regard to all the circumstances, satisfy the court that (a) the amendment in question could not have
been made earlier with due diligence and (b) the amendment would prejudice the other party in
the conduct of the proceedings.

amendment does not unreasonably impede the other party in its conduct of the proceedings. The
unconditional limitation of a cause of action is always permitted. The court may reassess the fees
already paid in the light of an amendment.
Both conditions must be fulfilled independently of each other. If one of the conditions is not met,
the court's discretion is reduced to zero and it must deny the motion. The burden of proof that both
the requirements of R. 263.1 RoP and the grounds for exclusion under R. 263.2 RoP are not met lies
with the applicant. Therefore, the applicant must explain why the amendment was not included in
the original pleadings, R. 263.1 RoP. Likewise, the court must be able to decide on the exclusion
criteria contained in R. 263.2 RoP on the basis of the applicant's explanation (LK München,
APP_25265/2024 UPC_CFI_42/2024).
Having said this, the following applies:
2. Motion II.1a
The request remains unchanged with regard to the French Republic and the Italian Republic.
With regard to the Federal Republic of Germany, it has been withdrawn or replaced by motions II.1b
and II.1b`. Reference is made to the comments there.
3. Motion II.1.b
The request takes into account the judgment of the Federal Patent Court (Annex CBH 8), which
became final on 7 May 2024. In this judgement, the device claim was destroyed and the use claim
asserted in the alternative was upheld. Since the use claim has a smaller scope of protection
compared to the device claim and the application is unconditionally filed as the main application,
there is an unconditional limitation of the claim, which is always allowed. This also applies with
regard to the subsequent claims referring to it.
There is currently no need for a decision on costs. The principle of unity of the decision on costs
applies.
4. Motion II.1.b`
This request is ancillary to request II.1.b, so that there is no unconditional restriction. The request
concerns a meaningful preparation for later use and therefore takes into account the legal force of
the judgement of the Federal Patent Court (Annex CBH 8), which entered into force on 7 May 2024.
In this judgement, the device claim was destroyed and the use claim asserted in the alternative was
upheld. Although it is possible to amend the application before the judgement becomes final, this is
not required under Rule 263 RoP. The delay between service of the order of 7 May 2024 on 13 May
2024 and the declaration of the amendment to the claim on 5 June 2024 is still within the bounds of
due diligence. This also applies with regard to the subsequent claims relating to this.

The defendant is not unreasonably hindered in its conduct of the proceedings by the admission. The
recovery of technical expert opinions does not appear necessary in this respect because only non-technical
details of the offer actions have been added as a further aspect.
Irrespective of this, the defendant has already had time since the day the application was filed to
adapt its defence to the new situation. As a precautionary measure, it has been granted a further 30
days to submit its defence
5. Motion II.2
This request concerns the indirect use of the procedural claim and therefore does not take into
account the legal force of the judgment of the Federal Patent Court (Annex CBH 8), which entered
into force on 7 May 2024, even for the territory of the Federal Republic of Germany. This request
could therefore already have been asserted in the action of 12 March 2024. The amendment of the
action almost three months later is no longer within the scope of due diligence and must therefore
be rejected. This also applies with regard to the subsequent claims referring to it. The plaintiff is free
to assert these claims by way of a further action to be filed separately.
ORDER
1. The amendment of the claim by the plaintiff under 1) pursuant to Annex CBH 25 is admitted
with the exception of the claim under II.2 including the subsequent claims relating thereto and is
otherwise rejected.
2. The defendant may comment in writing on the subject matter of the admitted amendment to
the action within a further 30 days.
