ABSTRACT :
1. Les questions orales posées au témoin, auteur d'une attestation écrite déjà produite en
demande, auront pour objectif d’éclaircir les points qui ne seraient pas clairs et qui sont
contestés en défense.
2. La Cour considère d’une part, que l’anglais étant l’une des deux langues de procédure
possible devant la Division locale de Paris, il s’agit d’une langue utilisée et comprise par
tous les membres du panel ; et d’autre part, que l’anglais étant la langue de travail
commune devant toutes les divisions de la JUB, elle est censée être comprise par tous les
représentants devant la JUB. La demande en interprétation simultanée de l’audition de
témoin en anglais est donc rejetée.

Rappel de la procédure
Dans le cadre de son action en contrefaçon initiée à l’égard de LAMA France (ci-après « LAMA »),
Hewlett-Packard Development Company (ci-après « HPDC ») sollicite par demande procédurale du
15 juillet 2024 qu’un témoin soit auditionné lors de l’audience orale prévue le 2 octobre 2024.
LAMA a déposé le 8 août 2024 ses commentaires écrits à la suite de cette demande procédurale,
dans le CMS via App_46034/2024 UPC_CFI_358/2023 et en a informé le greffe de la Division locale
de Paris le même jour par un email avec son contradicteur en copie.
Cadre légal
Règle 176 – Demande d’audition d’un témoin en personne
Sous réserve des décisions de la Juridiction visées aux règles 104, point e) et 112, § 2, point b),
une partie souhaitant produire un témoignage oral dépose une demande d’audition d’un témoin
en personne qui expose :
a) les motifs pour lesquels le témoin devrait être entendu en personne ;
b) les faits dont la partie s’attend à ce qu’ils soient confirmés par le témoin ; et
c) la langue dans laquelle le témoin déposera.
Règle 177 – Citation de témoins à l’audience
1. La Juridiction peut ordonner qu’un témoin soit entendu en personne :
a) de sa propre initiative ;
b) lorsqu’une attestation de témoin est remise en question par l’autre partie ; ou
c) sur demande d’audition d’un témoin en personne [règle 176].
2. Une ordonnance de la Juridiction citant un témoin à l’audience indique notamment :
a) le nom, l’adresse et l’identification du témoin ;
b) la date et le lieu de l’audience ;
c) une indication des faits de l’affaire à propos desquels le témoin sera interrogé ;
d) des informations sur le remboursement des frais engagés par le témoin ;
e) que le témoin sera interrogé par la Juridiction et les parties ; et
f) la langue de procédure et la possibilité d'organiser une interprétation simultanée entre cette
langue et la langue du témoin, si nécessaire [règle 109].
3. Dans son ordonnance de convocation du témoin, la Juridiction informe également le témoin
de ses devoirs et de ses obligations en tant que témoin conformément aux règles 178 et 179, y
compris les sanctions pouvant être imposées à un témoin défaillant.
Motifs de l’ordonnance
Sur la régularité de la demande
La demande en audition de témoin de HPDC intervient avant la date de la conférence de mise en
état qui est prévue le 6 septembre 2024.
Au soutien de sa demande, HPDC expose avoir produit des attestations écrites (pièces AD 20 et
20bis ; AD 60 et 60 bis) dans le cadre des échanges de mémoire de la procédure écrite et demande
que M. qui est l’auteur de ces deux attestations écrites soit entendu lors de l’audience
orale.
HPDC explique les raisons de sa demande, notamment du fait que la valeur probante de ces attes-tations
écrites est contestée par LAMA et précise que le témoin doit être entendu en langue an-glaise.
Au vu de ces éléments, la demande doit être dite régulière, car conforme aux règles 177.1 a) et b)
RdP.
Sur l’opportunité d’entendre le témoin à l’audience orale
LAMA s’oppose à la demande de HPDC en faisant valoir les arguments suivants :
- du fait de sa qualité de salarié du groupe Hewlett-Packard (ci-après « HP ») de l’auteur de l’at-
testation : l’existence d’un lien de subordination entre M. salarié, et le groupe HP ne per-met
pas de s’assurer de l’impartialité et de la neutralité totale de cette déclaration dictée pour
les besoins du procès ;
- du fait de l’incapacité de ce salarié à présenter clairement, sans aucune équivoque des informa-tions
sur les PID et FID des cartouches permettant soi-disant d’identifier leur origine de première
commercialisation, lesquelles informations non fiables ne sont, de surcroît, corroborées par au-cun
document objectif et pertinent.
LAMA soutient en outre que les méthodes employées par M. pour déterminer l’origine des
cartouches ne peuvent pas être vérifiées car elles reposent sur les bases de données de HPDC
lesquelles sont totalement inaccessibles aux tiers, et sans aucune possibilité de vérification.
Sur la nécessité d’un témoignage oral
Il est constant que le témoin est salarié d’une filiale du groupe de sociétés HP, néanmoins, son
témoignage sera livré sous serment prévu à la règle 178.1 2eme paragraphe RdP.
En outre, le témoignage de M. est intéressant pour le litige du fait de sa connaissance du
fonctionnement interne du groupe HP.
Enfin, les questions orales auront pour objectif d’éclaircir les points qui ne seraient pas clairs et qui
sont importants dans l’appréciation du rôle joué par LAMA notamment dans les actes de contre-façon
des cartouches dites « IPNA » (importation parallèle non autorisée) allégués par le deman-deur.
Les modalités de l’audition et le sujet des questions qui seront posées au témoin seront précisés
dans l’ordonnance prise par le juge-rapporteur à la suite de la conférence de mise en état du 6
septembre prochain conformément à la règle 104 (e) RdP.
Sur la nécessité d’une interprétation simultanée sur le fondement de la règle 109 RdP
LAMA sollicite, la langue de la procédure étant le français, que l’audition en anglais se tienne avec
l’assistance d’un interprète assermenté qui procèderait à la traduction simultanée du français vers
l’anglais et inversement, à l’audience du 2 octobre 2024.
Cette demande est régulière au vu de la règle 109 RdP car soumise au moins un mois avant l’au-
dience.
Cependant, la Cour considère d’une part, que l’anglais étant l’une des deux langues de procédure
possible devant la Division locale de Paris, il s’agit d’une langue utilisée et comprise par tous les
membres du panel ; et d’autre part, que l’anglais étant la langue de travail commune devant toutes
les divisions de la JUB, elle est censée être comprise par tous les représentants devant la JUB.
Par conséquent, la demande soumise par LAMA tendant à l’organisation par la Cour d’un interpré-tariat
simultané à l’audience orale sera rejetée comme non nécessaire au vu du principe d’écono-
mie des moyens exposé dans le préambule (point 4) du règlement de procédure de la Juridiction
Unifiée du Brevet. Il reste à LAMA la possibilité prévue par la règle 109.4 RdP d’engager un inter-prète
à ses propres frais et dans ce cas d’en informer le greffe au plus tard deux semaines avant
l’audience.
Par ces Motifs, le juge-rapporteur :
-ordonne que M. soit auditionné en anglais comme témoin (sur ses déclarations écrites
faites en pièces AD 20 et 40 de HPDC) lors de l’audience orale selon les modalités précisées dans
une ordonnance qui sera prise à la suite de la conférence de mise en état,
-dit qu’en l’espèce une interprétation simultanée pendant l’audience de l’anglais vers le français
n’est pas nécessaire pour cette audition de témoin,
-rappelle que la présente ordonnance est susceptible de révision selon les modalités de la règle
333 RdP.

ORDER
Reminder of the proceedings
In the context of its infringement action against LAMA France (hereinafter "LAMA"), Hewlett-Packard
Development Company (hereinafter "HPDC") requested by procedural application dated 15 July 2024
that a witness be heard at the oral hearing scheduled for 2 October 2024.
On 8 August 2024, LAMA filed its written comments in response to this procedural request in the
CMS via App_46034/2024 UPC_CFI_358/2023 and informed the Registry of the Paris Local Division by
email on the same day, with a copy to its counterpart.
Legal framework
Rule 176 - Request to hear a witness in person
Subject to the decisions of the Court referred to in Rules 104(e) and 112(2)(b), a party wishing to give
oral evidence shall file an application to hear a witness in person which sets out :
a) the reasons why the witness should be heard in person ;
b) the facts which the party expects the witness to confirm; and
c) the language in which the witness will give
evidence. Rule 177 - Summoning witnesses to
the hearing
1. The Court may order that a witness be heard in person :
a) on its own initiative ;

b) where the testimony of a witness is challenged by the other party; or
c) on application to hear a witness in person [rule 176].
2. An order of the Court summoning a witness to the hearing shall state inter alia:
a) the name, address and identification of the witness ;
b) the date and place of the hearing;
c) an indication of the facts of the case about which the witness will be questioned;
d) information on the reimbursement of expenses incurred by the witness;
e) that the witness will be examined by the Court and the parties; and
f) the language of the proceedings and the possibility of arranging simultaneous interpretation
between that language and the language of the witness, if necessary [Rule 109].
3. In its order summoning the witness, the Court will also inform the witness of his or her duties
and obligations as a witness in accordance with Rules 178 and 179, including the sanctions that
may be imposed on a defaulting witness.
Reasons for the order
Regularity of the application
HPDC's request to be heard as a witness comes before the date of the status conference, which is
scheduled for 6 September 2024.
In support of its application, HPDC states that it produced written statements (exhibits AD 20 and
20bis; AD 60 and 60bis) as part of the exchange of written pleadings and requests that Mr ,
who is the author of these two written statements, be heard at the oral hearing.
HPDC explained the reasons for its request, in particular the fact that the probative value of these
written statements was disputed by LAMA and specified that the witness should be heard in English.
In view of these factors, the request must be deemed to be in order, as it complies with rules 177.1 a)
and b) of the Rules of Procedure.
Whether the witness should be heard at the oral hearing
LAMA objected to HPDC's request, putting forward the following arguments:
- the fact that the author of the statement was an employee of the Hewlett-Packard group
(hereinafter "HP"): the existence of a relationship of subordination between Mr. , an
employee, and the HP group does not make it possible to ensure the impartiality and total neutrality
of this statement, which was dictated for the purposes of the trial;
- because of the inability of this employee to present clearly and unequivocally information on the
PID and FID of the cartridges, supposedly allowing their origin of first marketing to be identified,
which unreliable information is not available to the court; and
which unreliable information is, moreover, not corroborated by any objective and relevant
document.
LAMA further contends that the methods used by Mr to determine the origin of the cartridges
cannot be verified because they are based on HPDC databases which are totally inaccessible to third
parties, and without any possibility of verification.
On the need for oral testimony
It is clear that the witness is an employee of a subsidiary of the HP group of companies. Nevertheless,
his testimony will be given under oath, as provided for in rule 178.1 2nd paragraph of the Rules of
Procedure.
In addition, Mr. 's testimony is relevant to the dispute because of his knowledge of the internal
workings of the HP group.
Lastly, the oral questions will aim to clarify any points that are unclear and that are important in
assessing the role played by LAMA, in particular in the acts of counterfeiting so-called "IPNA"
cartridges (unauthorised parallel imports) alleged by the plaintiff.
The modalities of the hearing and the subject of the questions to be put to the witness will be
specified in the order issued by the judge-rapporteur following the status conference on 6
September, in accordance with rule 104 (e) of the Rules of Procedure.
On the need for simultaneous interpretation under rule 109 of the Rules of Procedure
As the language of the proceedings is French, LAMA requests that the hearing in English be held with
the assistance of a sworn interpreter, who would provide simultaneous interpretation from French
into English and vice versa, at the hearing on 2 October 2024.
This request was lawful under rule 109 of the Rules of Procedure because it was submitted at least
one month before the hearing.
However, the Court considers, on the one hand, that as English is one of the two possible languages
of proceedings before the Paris Local Division, it is a language used and understood by all the
members of the panel; and on the other hand, that as English is the common working language before
all the divisions of the JUB, it is supposed to be understood by all the representatives before the JUB.
Consequently, LAMA's request that the Court organise simultaneous interpretation at the oral hearing
will be rejected as unnecessary in view of the principle of economy of means set out in the preamble
(point 4) to the Rules of Procedure of the Unified Patent Jurisdiction. LAMA still has the option
provided for in rule 109.4 of the Rules of Procedure of the Unified Patent Court of engaging an
interpreter at its own expense, in which case it must inform the Registry at least two weeks before
the hearing.
For these Reasons, the Judge-Rapporteur:
-Ordered that Mr. be heard in English as a witness (on his written statements made in exhibits
AD 20 and 40 of HPDC) at the oral hearing according to the terms specified in an order to be made
following the status conference,
-states that, in the present case, simultaneous interpretation from English into French is not
necessary for the hearing of this witness,
-recalls that this order may be reviewed in accordance with rule 333 of the Rules of Procedure.
