Faits et procédure
Une action en contrefaçon a été initiée par HEWLETT-PACKARD DEVELOPMENT COMPANY (ci-après
« HPDC ») à l’encontre de LAMA FRANCE (ci-après « LAMA») devant la Division locale de
Paris en date du 11 octobre 2023.
Le 2 août 2024, LAMA a déposé une demande d’irrecevabilité enregistrée dans le CMS sous le n°
44722/2024 concernant le mémoire déposé par HPDC le 15 juillet 2024 intitulé « mémoire en du-plique
au mémoire en réplique, mémoire en réplique au mémoire en défense à une demande de
modification du brevet ».
Le juge-rapporteur a invité HPDC à produire ses observations écrites sur cette demande dans un
délai de 14 jours, soit au 16 août 2024, ce qui a été fait par email du 15 août 2024 avec toutes les
parties en copie, du fait de difficultés techniques pour l’enregistrer à cette date dans le CMS.
LAMA sollicite dans sa requête procédurale de déclarer irrecevable dans le mémoire en duplique
au mémoire en réplique d’HPDC déposé le 15 juillet 2024 devant la JUB l’intégralité du contenu
des sections suivantes :

- et d’écarter purement et simplement des débats tous les développements d’HPDC relatifs aux
sections ci-avant exposées, ainsi que toutes les pièces d’HPDC n°85 à 99 et 101 à 101bis, et les
jurisprudences JP19 à JP23 afférentes à ces développements.
Au soutien de sa demande, LAMA fait valoir qu’en appliquant les règles 12 et 29 e) du Règlement
de procédure (RdP), et en respectant les grandes phases de la procédure écrite de première ins-tance
prévues par les textes devant la JUB, HPDC ne pouvait pas répondre sur les points ayant trait
à l’action en contrefaçon, ni produire, sans justification, des pièces et jurisprudences relatives aux
actes de contrefaçon.
En réponse, HPDC sollicite le rejet de la demande de LAMA, et subsidiairement demande au juge
rapporteur de rejeter la pièce n°49 de LAMA et l’ensemble des arguments qui s’appuient sur cette
preuve pour retenir que LAMA n’aurait pas la qualité de fabricant.
Au soutien de sa demande de rejet, HPDC fait valoir qu’elle n’a répondu qu’aux nouveaux argu-ments
soulevés par LAMA dans son dernier mémoire du 15 juin 2024 pour y apporter les clarifica-tions
nécessaires à la bonne compréhension du litige par la JUB mais n’a formulé aucun argument
nouveau. HPDC ajoute que dans son mémoire du 15 juin 2024 LAMA n’a pas fait que répondre aux
éléments présents dans la réponse de HPDC, que LAMA n’a pas hésité à apporter des éléments
nouveaux et des preuves qui auraient pu être communiquées plus tôt ayant des répercussions sur
plusieurs de ses arguments. HDPC en conclut que si le juge rapporteur venait à écarter les éléments
de réponse requis par LAMA, alors certains éléments et en particulier la pièce n°49 de LAMA, de-vraient
eux aussi être écartés, à défaut cela priverait HPDC de l’opportunité de répondre et de se
défendre.
HPDC fait également valoir qu’une interprétation plus souple de la procédure devrait être adoptée
par le juge rapporteur pour une décision de qualité comme le requièrent les textes et notamment
les principes du préambule du Règlement de procédure aux points 2, 4 et 5 et conformément à
l’AJUB dans ses articles 41, 42, 52 et 76.2 qui doivent prévaloir sur les règles de procédure, notam-ment
sur la règle 29 e).
Cadre légal
R 12 RdP – Échange de mémoires (action en contrefaçon) :
« 1. La procédure écrite comprend :
a) le dépôt d’un mémoire en demande (par le demandeur) [règle 13] ;
b) le dépôt d’un mémoire en défense (par le défendeur) [règles 23 et 24] ; et, facultativement
c) le dépôt d’un mémoire en réplique au mémoire en défense (par le demandeur) [règle 29, point
b)] ;
et d) le dépôt d’un mémoire en duplique au mémoire en réplique (par le défendeur) [règle 29, point
c)].
2. Le mémoire en défense peut inclure une demande reconventionnelle en nullité [règle 25, § 1].
3. Si une demande reconventionnelle en nullité est formée :
a) le demandeur et tout titulaire qui devient partie en vertu de la règle 25, § 2 (ci-après dans cette
règle 12 et les règles 29 à 32, « le titulaire ») dépose un mémoire en défense à la demande recon-ventionnelle
en nullité [règle 29, point a)], qui peut inclure une demande de modification du brevet
par le titulaire [règle 30] ;
b) le défendeur peut déposer un mémoire en réplique au mémoire en défense à la demande recon-ventionnelle
[règle 29, point d)] ; et
c) le demandeur et le titulaire peuvent déposer un mémoire en duplique au mémoire en réplique
au mémoire en défense à la demande reconventionnelle [règle 29, point e)].
4. Si une demande de modification du brevet est déposée par le titulaire, le défendeur dépose un
mémoire en défense à la demande de modification du brevet dans le mémoire en réplique au mé-moire
en défense à la demande reconventionnelle, le titulaire peut déposer un mémoire en réplique
au mémoire en défense à la demande de modification et le défendeur peut déposer un mémoire en
duplique à ce mémoire en réplique [règle 32].
5. Le juge-rapporteur peut autoriser l’échange d’autres mémoires dans des délais qu’il précise
[règle 36] ».
R 29 RdP – Dépôt d’un mémoire en défense à la demande reconventionnelle en nullité, d’un mé-moire
en réplique au mémoire en défense et d’un mémoire en duplique au mémoire en réplique :
e) Dans un délai d’un mois à compter de la signification du mémoire en réplique au mémoire en
défense à la demande reconventionnelle, le demandeur peut déposer un mémoire en duplique au
mémoire en réplique avec tout mémoire en réplique au mémoire en défense à une demande de
modification du brevet, en vertu de la règle 32, si elle s’applique. Le mémoire en duplique au mé-moire
en réplique au mémoire en défense se limite à une réponse aux questions soulevées dans le
mémoire en réplique au mémoire en défense.
R 32 RdP : Dépôt du mémoire en défense à la demande de modification du brevet, du mémoire en
réplique au mémoire en défense et du mémoire en duplique au mémoire en réplique :
3. Le titulaire peut déposer un mémoire en réplique au mémoire en défense à la demande de mo-dification
du brevet dans un délai d’un mois à compter de la signification du mémoire en défense
et le défendeur peut déposer un mémoire en duplique au mémoire en réplique dans un délai d’un
mois à compter de la signification du mémoire en réplique. Le mémoire en duplique se limite aux
questions soulevées dans le mémoire en réplique. »
Motifs de l’ordonnance
Il ressort de R 12 RdP que le règlement de procédure a divisé la procédure écrite en plusieurs
étapes successives :
- une étape 1 ou flux 1 (« workflow » 1 en anglais) relative à la demande en contrefaçon elle-même
comprenant un jeu de 4 écritures,
- puis, un flux 2 d’écritures dédié à la validité du brevet en cas de demande reconventionnelle en
nullité du brevet en cause,
- enfin, un flux 3 particulièrement dédié à la modification du brevet en cause si elle est demandée.
Dans le flux 1, le défendeur à la demande en contrefaçon a le dernier mot, en l’espèce LAMA.
Dans le flux 2, le défendeur à l’attaque sur la validité du brevet en question a le dernier mot, en
l’espèce HPDC.
Enfin, pour le flux 3 en cas de demande de modification du brevet en cause, le défendeur à cette
demande a le dernier mot, soit en l’espèce LAMA.
Ces flux, assortis de délais stricts, ont été prévus pour assurer une procédure la plus efficace et la
plus économique qui soit devant la JUB, conformément au point 4 du préambule.
Afin que les principes de flexibilité et de souplesse ainsi que le principe général de justice et
d’équité prévus au point 2 du préambule soient respectés, R 36 RdP permet aux parties de deman-der
des écritures supplémentaires au juge rapporteur sur demande motivée.
En outre, R 29 (e) indique expressément que le « mémoire en duplique au mémoire en réplique au
mémoire en défense se limite à une réponse aux questions soulevées dans le mémoire en réplique
au mémoire en défense ».
En l’espèce, dans son mémoire du 15 juillet 2024 qui intervient dans le cadre des flux 2 et 3 de la
procédure écrite, HPDC devait se limiter à répondre aux points 3 et 4 dédiés à la validité du brevet
(y compris la modification proposée) développés dans le mémoire du 15 juin 2024 par LAMA, et si
HPDC considérait que des moyens nouveaux sur la demande en contrefaçon justifiaient un
échange supplémentaire, il lui appartenait de le demander au juge rapporteur par une requête
motivée sur R 36 RdP.
La Cour relève que seul le point 3 du mémoire de HPDC du 15 juillet 2024 traite de la validité des
brevets en cause (pages 25 à 41) c’est à dire le sujet concerné par les flux 2 et 3.
En effet, le point 1 du mémoire en question est dédié à la préparation de la conférence de mise en
état, or, ce sujet fera l’objet d’une information préalable aux parties par le juge rapporteur après
le 30 août prochain, date annoncée de la clôture de la procédure écrite et la question de l’audition
de témoin à l’audience orale va être traitée dans les jours qui suivent en parallèle, dans le cadre
de la demande procédurale distincte soumise au juge rapporteur le 15 juillet 2024 par HPDC.
Le point 2 concerne les questions de compétence qui ont déjà été exposées dans les mémoires
précédents du demandeur.
Le point 4 relève de la contrefaçon elle-même, c’est-à-dire devant être traité dans les échanges du
flux 1, sauf requête motivée sur R 36 RdP.
Le point 5 sur la demande d’information a été traité en parallèle dans le cadre d’une demande
procédurale distincte sur R 191 RdP par une ordonnance du juge rapporteur du 2 août 2024.
Quant aux points 6 et 7 concernant la confirmation des demandes et la liste des documents, ce
n’est qu’un rappel des développements déjà exposés dans les mémoires antérieurs déposés par
HPDC.
Concernant l’argument de HPDC faisant valoir que ses développements sur l’action en contrefaçon
permettent seulement une clarification de ses arguments pour aider la Cour à rendre une décision
de meilleure qualité :
En l’espèce, même si les écritures des deux parties sont présentées clairement grâce à une table
des matières précise et une présentation ordonnée des arguments, la répétition intégrale des ar-guments
est superflue (un renvoi explicite en désignant les parties pertinentes dans les mémoires
précédents suffirait) et cette répétition tend à un surplus du nombre de pages des écritures (à ce
jour plus de 1760 pages pour l’ensemble des seuls mémoires au fond déposés dans cette affaire)
qui n’aide pas les juges à rendre une décision de meilleure qualité telle que prévue au point 6 du
préambule du Règlement de procédure, contrairement à ce que prétend HPDC dans sa réponse
du 16 août 2024.
Concernant l’argumentation de HPDC relative à la réponse à un argument nouveau présenté par
LAMA dans son mémoire du 15 juin 2024 :
Tout d’abord, il est logique que LAMA réponde à l’allégation de HPDC concernant son rôle de fa-bricant
des produits allégués de contrefaçon car il est défendeur à l’action en contrefaçon. En
outre, la critique consistant à dire que la pièce 49 (attestation de son expert-comptable sur l’acti-
vité de LAMA) a été produite tardivement et que cela est contraire au principe de la contradiction
n’est pas pertinente en ce que ladite pièce et les explications afférentes ont amené HPDC à sou-mettre
une demande procédurale d’information sur R 191 RdP le 2 août 2024. Dans le cadre de
cette demande procédurale, LAMA a produit dans sa réponse de nouvelles pièces informant sur
l’activité et le statut de ses deux filiales et la question de leur rôle respectif dans la fabrication des
cartouches alléguées de contrefaçon, et la demande de HPDC sur R 191 RdP a été partiellement
accueillie par le juge rapporteur en enjoignant LAMA à produire certaines pièces demandées par
HDPC concernant le rôle de LAMA dans les actes de contrefaçon qui lui sont reprochés. Il n’y a
donc pas lieu d’écarter la pièce 49 de LAMA et les explications concernant cette pièce, le principe
de la contradiction ayant été respecté à l’égard de HPDC.
Au vu de ces éléments, il convient de faire droit à la demande tendant à la mise hors des débats
des éléments suivants comme inadmissibles sur le fondement de R 29 e) dans le mémoire soumis
par HPDC le 15 juillet 2024, soit :
- tous les développements hors ceux du point 3 et les pièces 85 à 101 bis de HPDC afférentes au
point 3.
Subséquemment, comme cela a été admis par LAMA (page 19 de son mémoire du 16 août 2024
qui indique avoir répondu « à titre conservatoire » à l’ensemble du mémoire du 15 juillet 2024), il
est logique, du fait de la mise hors des débats d’une partie du mémoire de HPDC du 15 juillet 2024,
que ne soient admises aux débats dans le mémoire du 16 août 2024 soumis par LAMA que les
réponses au point 3 du mémoire de HPDC.
Par conséquent, pour les mêmes raisons d’inadmissibilité sur le fondement de R 32.3 RdP qui in-dique
que « le mémoire en duplique se limite aux questions soulevées dans le mémoire en ré-plique
», LAMA devait limiter sa réponse dans son mémoire du 16 août 2024 à la question de la
validité de la forme modifiée du brevet telle que proposée par HPDC. Seront donc mis hors dé-bats
tous les développements autres que ceux des points 3 et 4 ainsi que les pièces relatives à ces
points, soit les nouvelles pièces 59 à 64 de LAMA.
Par ces motifs,
Le Juge-rapporteur ordonne la mise hors des débats, en les disant inadmissibles sur le fondement
des règles 12, 29 (e) et 32.3 du RdP, des éléments suivants :
-dans le mémoire soumis par HEWLETT-PACKARD DEVELOPMENT COMPANY le 15 juillet 2024 :
- tous les développements hormis ceux du point 3, ainsi que les pièces d’HPDC n°85 à 99 et 101 à
101bis et les jurisprudences JP19 à JP23 afférentes au point 3 ;
-dans le mémoire soumis par LAMA France le 16 août 2024 :
- tous les développements hormis ceux des points 3 et 4, ainsi que les pièces afférentes à ces
points, soit les nouvelles pièces 59 à 64 de LAMA.
Cette ordonnance est susceptible d’une révision par la chambre selon les conditions de la règle
333 du RdP.

ORDER
Facts and proceedings
An infringement action was brought by HEWLETT-PACKARD DEVELOPMENT COMPANY (hereinafter

‘HPDC’) against LAMA FRANCE (hereinafter ‘LAMA’) before the Local Division of
Paris on 11 October 2023.
On 2 August 2024, LAMA filed a motion to dismiss registered in the CMS under No.

44722/2024 concerning the statement filed by HPDC on 15 July 2024 entitled ‘reply to the rejoinder, rejoinder to the defence to a request for
modification of the patent’.
The judge-rapporteur invited HPDC to submit its written observations on this request within

period of 14 days, i.e. by 16 August 2024, which was done by email on 15 August 2024 with all
parties in copy, due to technical difficulties in registering it on that date in the CMS.
In its procedural request, LAMA asks the court to declare inadmissible in the rejoinder

in the reply to the HPDC's reply filed on 15 July 2024 before the JUB, the entire content
of the following sections:

- and to dismiss outright from the proceedings all of HPDC's arguments relating to

the sections set out above, as well as all HPDC documents nos. 85 to 99 and 101 to 101bis, and
case law JP19 to JP23 relating to these developments.
In support of its request, LAMA argues that by applying rules 12 and 29(e) of the Rules of Procedure

(RdP) and by complying with the main stages of the written procedure at first instance
provided for by the texts before the JUB, HPDC could not respond to the points relating
to the infringement action, nor could it produce, without justification, documents and case law relating to the
acts of infringement.
In response, HPDC requests that LAMA's application be dismissed and, in the alternative, asks the judge
rapporteur to reject LAMA's exhibit No. 49 and all the arguments based on this
evidence to find that LAMA does not have the status of manufacturer.

In support of its request for dismissal, HPDC argues that it only responded to the new arguments
raised by LAMA in its latest statement of 15 June 2024 in order to provide the clarifications
necessary for the JUB to properly understand the dispute, but did not put forward any new arguments

. HPDC adds that in its statement of 15 June 2024, LAMA did not merely respond to the
points made in HPDC's response, but that LAMA did not hesitate to provide
new information and evidence that could have been communicated earlier and that had an impact on

several of its arguments. HDPC concludes that if the judge rapporteur were to dismiss the elements
of LAMA's response, then certain elements, and in particular LAMA's exhibit No. 49, would
also have to be dismissed, failing which HPDC would be deprived of the opportunity to respond and defend itself
.

HPDC also argues that a more flexible interpretation of the procedure should be adopted
by the judge-rapporteur for a high-quality decision, as required by the texts and in particular
the principles of the preamble to the Rules of Procedure in points 2, 4 and 5 and in accordance with

the AJUB in Articles 41, 42, 52 and 76.2, which must prevail over the rules of procedure, in particular
rule 29 e).
Legal framework
R 12 RdP – Exchange of statements (infringement proceedings):
"1. The written procedure shall comprise:

a) the filing of a statement of claim (by the claimant) [rule 13];
b) the filing of a statement of defence (by the defendant) [rules 23 and 24]; and, optionally
c) the filing of a reply to the statement of defence (by the claimant) [rule 29, point

b)]; and
d) the filing of a rejoinder to the reply (by the respondent) [Rule 29(
c)].
2. The statement of defence may include a counterclaim for invalidity [Rule 25(1)].
3. If a counterclaim for invalidity is made:

(a) the claimant and any proprietor who becomes a party under Rule 25, § 2 (hereinafter in this
Rule 12 and Rules 29 to 32, ‘the proprietor’) shall file a statement of defence to the counterclaim
for revocation [Rule 29(a)], which may include a request for amendment of the patent

by the proprietor [Rule 30];
(b) the defendant may file a reply to the defence to the counterclaim
[Rule 29(d)]; and
(c) the claimant and the proprietor may file a rejoinder to the reply

to the statement of defence to the counterclaim [Rule 29(e)].
4. If a request for amendment of the patent is filed by the proprietor, the defendant shall file a
statement of defence to the request for amendment of the patent in the reply to the statement of defence to the counterclaim

to the defence to the counterclaim, the proprietor may file a rejoinder
to the defence to the request for amendment and the defendant may file a
reply to that rejoinder [Rule 32].
5. The judge-rapporteur may authorise the exchange of further pleadings within a time limit which he shall specify

[Rule 36].
R 29 RdP – Filing of a statement of defence to the counterclaim for nullity, a reply to the statement of defence and a rejoinder to the reply:
e) Within one month of service of the reply to the statement of defence, the claimant may file a rejoinder to the reply with any reply to the statement of defence to a claim for amendment, and the defendant may file a rejoinder to this reply.

to the defence to the counterclaim, the claimant may file a rejoinder to the
reply brief with any reply brief to the defence brief to a request for
amendment of the patent, pursuant to Rule 32, if applicable. The rejoinder to the reply brief

reply to the statement of defence shall be limited to a response to the issues raised in the
reply to the statement of defence.
R 32 RdP: Filing of the statement of defence to the request for amendment of the patent, the
reply to the statement of defence and the rejoinder to the reply:

3. The proprietor may file a reply to the defence in response to the request for amendment of the patent
within one month of service of the defence,
and the defendant may file a rejoinder to the reply within one month
of service of the reply. The rejoinder shall be limited to

issues raised in the reply.
Reasons for the order
It follows from R 12 RdP that the Rules of Procedure divided the written procedure into several
successive stages:
- a stage 1 or workflow 1 relating to the infringement claim itself
comprising a set of four written submissions,

- then, a workflow 2 dedicated to the validity of the patent in the event of a counterclaim for
invalidity of the patent in question,
- finally, a workflow 3 specifically dedicated to the modification of the patent in question if requested.
In workflow 1, the defendant in the infringement claim has the last word, in this case LAMA.

In flow 2, the defendant in the attack on the validity of the patent in question has the final say, in
this case HPDC.
Finally, for flow 3, in the event of a request for modification of the patent in question, the defendant in that
request has the final say, i.e. in this case LAMA.
These flows, accompanied by strict time limits, have been designed to ensure the most efficient and economical procedure possible before the JUB, in accordance with point 4 of the preamble.
In order to ensure that the principles of flexibility and adaptability, as well as the general principle of justice and fairness provided for in point 2 of the preamble, are respected, R 36 RdP allows the parties to request additional written submissions from the reporting judge upon reasoned request. In addition, in the event of a request for amendment of the patent in question, the defendant in the request for amendment has the final say, i.e. in this case LAMA.
In flow 3, in the event of a request for amendment
equity provided for in point 2 of the preamble are respected, R 36 RdP allows the parties to request
additional written submissions from the judge-rapporteur on a reasoned request.
Furthermore, R 29 (e) expressly states that the "rejoinder to the reply

reply brief to the defence brief shall be limited to a response to the issues raised in the reply brief
to the defence brief".
In the present case, in its brief of 15 July 2024, which was filed in connection with flows 2 and 3 of the
written procedure, HPDC was required to limit itself to responding to points 3 and 4 concerning the validity of the patent

(including the proposed amendment) developed in LAMA's statement of 15 June 2024, and if
HPDC considered that new arguments on the claim for infringement justified an
additional exchange, it was for it to request this from the reporting judge by means of a
reasoned application under R 36 RdP.

The Court notes that only point 3 of HPDC's statement of 15 July 2024 deals with the validity of the
patents in question (pages 25 to 41), i.e. the subject matter of flows 2 and 3.
In fact, point 1 of the statement in question is dedicated to the preparation of the pre-trial conference

, whereas this subject will be the subject of prior information to the parties by the judge-rapporteur after
30 August, the date announced for the closure of the written procedure, and the question of the hearing
of witnesses at the oral hearing will be dealt with in the days following, in parallel, in the context of

the separate procedural request submitted to the judge-rapporteur on 15 July 2024 by HPDC.
Point 2 concerns the questions of jurisdiction that have already been set out in the applicant's previous statements.

Point 4 relates to the infringement itself, i.e. it must be dealt with in the exchanges in

flow 1, unless a reasoned request is made on R 36 RdP.
Point 5 on the request for information was dealt with in parallel in a separate procedural request
on R 191 RdP by order of the reporting judge on 2 August 2024.
As for points 6 and 7 concerning the confirmation of the requests and the list of documents, this

are merely a reminder of the developments already set out in the previous submissions filed by
HPDC.
With regard to HPDC's argument that its submissions on the infringement action
merely clarify its arguments in order to assist the Court in rendering a
better decision:
In the present case, even though the pleadings of both parties are clearly presented thanks to a precise table of contents and an orderly presentation of arguments, the full repetition of the arguments is superfluous (an explicit reference to the relevant parts of the previous pleadings would suffice) and this repetition tends to increase the number of pages of the pleadings (at present, more than 1,760 pages for all the pleadings on the merits filed in this case alone), which does not help the judges to render a better decision as provided for in point 6 of the
more than 1,760 pages for all the substantive submissions filed in this case alone)
which does not help the judges to deliver a better decision as provided for in point 6 of the
preamble to the Rules of Procedure, contrary to what HPDC claims in its response
of 16 August 2024.
Regarding HPDC's argument concerning the response to a new argument presented by
LAMA in its statement of 15 June 2024:
Firstly, it is logical that LAMA should respond to HPDC's allegation concerning its role as manufacturer
of the allegedly infringing products, as it is the defendant in the infringement proceedings.

Furthermore, the criticism that Exhibit 49 (its chartered accountant's statement on LAMA's activity)
was produced late and that this is contrary to the principle of adversarial proceedings
is irrelevant in that the said exhibit and the accompanying explanations led HPDC to submit

a procedural request for information on R 191 RdP on 2 August 2024. In response to
this procedural request, LAMA produced new documents in its response providing information on
the activity and status of its two subsidiaries and the question of their respective roles in the manufacture of the

allegedly infringing cartridges, and HPDC's request on R 191 RdP was partially
granted by the reporting judge, ordering LAMA to produce certain documents requested by
HDPC concerning LAMA's role in the acts of infringement alleged against it. There is

there is therefore no reason to dismiss LAMA's exhibit 49 and the explanations concerning that exhibit, as the principle
of adversarial proceedings has been respected with regard to HPDC.
In view of these factors, the request to exclude the following elements from the proceedings as inadmissible on the basis of R 29 e) in the statement submitted
by HPDC on 15 July 2024 should be granted:
by HPDC on 15 July 2024, namely:
- all developments other than those in point 3 and exhibits 85 to 101 bis of HPDC relating to
point 3.
Subsequently, as admitted by LAMA (page 19 of its statement of 16 August 2024

which states that it responded ‘as a precautionary measure’ to the entire statement of 15 July 2024), it
is logical, given that part of HPDC's statement of 15 July 2024 has been excluded from the proceedings,
that only the

responses to point 3 of HPDC's statement of case.
Consequently, for the same reasons of inadmissibility on the basis of R 32.3 RdP, which states
that "the statement of case in duplicate shall be limited to the issues raised in the statement of case in reply

", LAMA had to limit its response in its statement of 16 August 2024 to the question of the
validity of the amended form of the patent as proposed by HPDC. All arguments other than those in points 3 and 4, as well as the documents relating to these
points, i.e. the new documents 59 to 64 submitted by LAMA, will therefore be excluded from the proceedings.

For these reasons,
the Judge-Rapporteur orders the following to be excluded from the proceedings as inadmissible on the basis of
rules 12, 29(e) and 32.3 of the Rules of Procedure:
-in the statement submitted by HEWLETT-PACKARD DEVELOPMENT COMPANY on 15 July 2024:

- all developments except those in point 3, as well as HPDC exhibits 85 to 99 and 101 to
101bis and case law JP19 to JP23 relating to point 3;
-in the statement submitted by LAMA France on 16 August 2024:

- all developments except those in points 3 and 4, as well as the documents relating to these
points, i.e. the new documents 59 to 64 from LAMA.
This order is subject to review by the chamber in accordance with the conditions of rule
333 of the Rules of Procedure.
