I. Procedure
1. Op 8 juli 2024 werd een Definitieve Beslissing (Order) (ORD_37783/2024) uitgevaardigd door de Judge-Rapporteur waarbij het Procedureel Verzoek ingediend door Verweerders op 24 juni 2024 (“Generic Procedural Application”) (“Objection against Equivalence”) werd afgewezen doch een bij-komende termijn voor het indienen van de Dupliek (“Statement of Rejoinder”)(R. 29 (c) RoP) werd toegestaan en dit tot uiterlijk 1 augustus 2024.
2. Tegen de vermelde Definitieve Beslissing (ORD_37783/2024) werd door Verweersters op 16 juli 2024 een Verzoek tot Herbeoordeling (“Application for Review of case management order”) inge-diend (in toepassing van R. 333.1 RoP en R. 334 RoP).
3. Bij Voorlopige Beslissing van 17 juli 2024 werd Eiser verzocht standpunt in te nemen uiterlijk op 18 juli 2024. Eiser heeft tijdig stelling ingenomen.
4. Onderhavige beslissing uitgevaardigd als een Definitieve Beslissing Rule 9 RoP (ORD_42533/2024) wordt beschouwd als een Definitieve Beslissing in toepassing van Rule 333.4. RoP (in APP_41533/2024) na uitvaardiging van de Voorlopige Beslissing (ORD_42232/2024).
II. Probleemstelling en Verzoek
5. Zoals aangegeven in de Definitieve Beslissing (ORD_37783/2024) betrof de probleemstelling de geoorloofdheid in hoofde van Eiser om, in reactie op de Verklaring van Verweer (“Statement of Defence”)(R. 24 RoP) van Verweerders, in zijn Repliek (“Reply to Statement of Defence”)(R. 29 (b) RoP) (i) het feitelijk kader aan te vullen, (ii) de inbreukargumentatie aan te vullen met een equivalentie-argumentatie en (iii) het petitum aan te passen en dit in het licht van de toepassing van in Order ORD_37783/2024 weergegeven Rules:
• R. 13.1.(l) t/m (o) RoP: “Content of Statement of Claim”
• R. 24 (b) t/m (g) RoP: “Contents of Statement of Defence”
• R. 29 (b) en (c) RoP: “Lodging of Defence to the Counterclaim for revocation, Reply to the Statement of defence and Rejoinder to the Reply”
• R. 263 RoP: “Leave to Change claim or amend case”
6. In hoofdorde verzochten Verweerders in hun Procedureel Verzoek van 24 juni 2024 om in de Repliek:
(i) De uitbreiding op basis van equivalentie te weigeren
(ii) De nieuwe aangebrachte feiten te weigeren
(iii) Het nieuw (aangepast) petitum te weigeren
Ondergeschikt verzochten Verweerders in hun Procedureel Verzoek van 24 juni 2024 een verlenging van de termijn voor hun Dupliek en dit tot 18 augustus 2024.
7. Bij Definitieve Beslissing van de Judge-Rapporteur van 8 juli 2024 (ORD_37783/2024) werd het Procedureel Verzoek van 24 juni 2024 in hoofdorde afgewezen doch werd wel ingegaan op het verzoek in ondergeschikte orde en werd Verweerders een bijkomende termijn verstrekt tot 1 augustus 2024 ter indiening van hun Dupliek.
8. Gesynthetiseerd weergegeven motiveerde de Judge-Rapporteur zijn beslissing als volgt:
Intern gebruik
8.1. In hoofdorde
R. 13 RoP (concreet R. 13.1. (l) tot (o) RoP) voert een zogenaamd “front loaded” procedure-systeem in waarbij een eisende partij wordt verplicht zijn argumentatie en bewijsmiddelen concreet uit werken in zijn Verklaring van Eis.
Bij het interpreteren en toepassen van bovenstaande regel dient rekening te worden met (i) het normdoel van R. 13 RoP en (ii) het procedureel-evolutief verloop van een gerechtelijk geschil en (iii) hoor en wederhoor, in het bijzonder in dit geval de mogelijkheden van verweer voor een partij geconfronteerd met nieuwe argumenten, feiten en een aangepast petitum op basis hiervan.
Bij het concreet beoordelen van het Procedureel Verzoek van 24 juni 2024 en in toepassing van het bovenstaande oordeelde de Judge-Rapporteur dat Eiser had gehandeld binnen de grenzen van het normdoel van R. 13 RoP (handelend als een redelijk en voorzichtig persoon (eisende partij) geplaatst in dezelfde omstandigheden) en dat de aangereikte nieuwe feiten, argumenten en aangepast petitum pasten binnen het procedureel-evolutief verloop van een gerechtelijk geschil.
In het verlengde hiervan oordeelde de Judge-Rapporteur dat een verzoek in toepassing van R. 263.2. RoP niet aan de orde was.
8.2. In ondergeschikte (subsidiaire) orde
De Judge-Rapporteur achtte het wel proportioneel, redelijk en billijk om in toepassing van R. 9.3. (a) RoP een bijkomende termijn toe te staan ter indiening van de Dupliek en dit tot uiterlijk 1 au-gustus 2024. Daarmee is naar zijn oordeel voldoende voorzien in de mogelijkheid van verweer (in toepassing van de hiervoor onder (iii) aangegeven interpretatieregel).
9. Op 16 juli 2024 verzochten Verweerders een Herbeoordeling van bovenstaande Definitieve Beslissing (ORD_37783/2024) door het panel (hierna aangeduid als “UPC (Lokale Divisie Brussel)”) en dit in toepassing van R. 333.1 RoP en R. 334 RoP. In het Verzoek tot Herbeoordeling wordt volgend beschikkend gedeelte weergegeven:
“OrthoApnea verzoekt uw panel haar prealabele procedurele verzoek toe te wijzen en de termijn voor het indienen van een Statement of rejoinder op te schorten vanaf 24 juni tot aan het moment dat een definitieve materiële beslissing is gegeven met één dan wel twee maanden als genoemd onder randnummer 6.
OrthoApnea handhaaft onderdeel (i) van haar primaire verzoek van 24 juni onverkort en verzoekt uw panel de inbreuk op basis van equivalentie te weigeren.
OrthoApnea verzoekt de termijn voor het indienen van een Statement of rejoinder, bij wei-gering van het prealabele procedurele verzoek, te verlengen tot 30 augustus althans een door uw panel in goede justitie te bepalen termijn.
OrthoApnea verzoekt toestemming te verkrijgen om beroep in te stellen tegen de Order, dan wel tegen een afwijzende beslissing van uw panel in de reviewprocedure.
Nelissen te veroordelen in de kosten van deze application procedure dan wel de beslissing omtrent de kosten van deze application procedure aan te houden tot een beslissing in de hoofdzaak.

III. Beoordeling
10. De toetsing door de UPC (Lokale Divisie Brussel) van de Definitieve Beslissing (ORD_37783/2024) is marginaal van aard in de zin dat deze zich beperkt tot het nagaan of de Judge-Rapporteur is uitgegaan van de juiste feiten, of hij deze correct heeft beoordeeld en of hij zijn beslissing heeft genomen binnen de grenzen van de redelijkheid.
III.A. Prealabel verzoek tot het schorsen van de termijn met één dan wel twee maanden voor het indienen van de Dupliek vanaf 24 juni 2024 tot aan het moment dat een definitieve materiële beslissing is gegeven
11. Het betreffende verzoek wordt afgewezen als ongegrond. De UPC (Lokale Divisie Brussel) motiveert als volgt:
• De RoP voorzien m.b.t. de vooropgestelde termijnen tijdens de schriftelijke fase niet in een schorsing noch na het indien van een Procedureel Verzoek, noch na het indien van een Verzoek tot Herbeoordeling door het panel noch na het inleiden van een hoger beroep tegen een dergelijke herbeoordeling door het panel. Dat de RoP evenmin in een schorsing voorzien van de termijnen na een Voorafgaandelijke Bezwaar (“Preliminary Objection”) (R. 19.6. RoP) dan wel een Verzoek tot Taalwijziging (“Application for Change of Procedural Language”)(R. 323 RoP) versterkt de overtuiging dat deze regels principieel geen schorsing beogen op grond van procedurele overwegingen/verzoeken.
• De verwijzing naar Court of Appeal (UPC_CoA_301/2024 d.d. 19 juni 2024 (ICPillar LLC/ ARM Limited r.o. 6 en 7) kan onvoldoende overtuigen om de schorsing toe te staan. In tegendeel, in deze beslissing wordt aangegeven dat slechts in “uitzonderlijke omstandigheden” een schorsing van een (eerste instantie) procedure kan worden toegestaan om de procedure zo min mogelijk te onderbreken met procedurele beroepen (punt 6 van de CoA beslissing). Hieruit kan worden afgeleid dat hetzelfde mutatis mutandis opgaat voor de procedure in eerste aanleg. Ook die dient zo min mogelijk onderbroken te worden door (de behandeling van) procedurele verzoeken. Daarmee wordt ook voorkomen dat een procedure met dergelijke verzoeken oneigenlijk wordt vertraagd. In lijn met deze uitspraak wordt bovendien geoordeeld dat het niet-toestaan van een schorsing allerminst het hoger beroep onwerkzaam zou maken. Ook in de onderhavige zaak beschikken Verweerders nog over voldoende tijd om een eventueel hoger beroep in te stellen tegen onderhavige beslissing.
• Een verzoek tot schorsing kan verder enkel worden toegewezen wanneer dit proportioneel is en de afweging van belangen van partijen daartoe aanleiding geeft. Dat kan bijvoorbeeld aan de orde zijn indien Verweerders zich ernstig geschaad zien in hun rechten van verdediging en dit afgewogen tegen de belangen van Eiser, in het bijzonder diens belang bij het voortvarend doorprocederen. Dat Verweerders in de periode noodzakelijk ter beoordeling van (i) het initiële Procedureel Verzoek van 24 juni 2024, (ii) het Verzoek tot Herbeoordeling van 16 juli 2024 en (iii) het (eventueel) hoger beroep tegen deze beoordeling, geen verdere argumentatie meer wensen te ontwikkelen in hun Dupliek in het licht van de equivalentie-argumentatie, kan niet als gevolg hebben dat dient te worden ingegaan op het verzoek tot schorsing. Bij een eventueel gegrond verklaren van het hoger beroep, staat het ten andere Verweerders vrij om de eventuele meerkosten die dit heeft teweeggebracht bij het indienen van hun Dupliek van Eiser te vorderen. In die zin lijkt het dan ook proportioneel dat de belangen van Eiser ter handhaving van de vooropgestelde (en reeds verlengde) termijnen doorwegen op de mogelijke nadelige financieel gevolgen voor Verweerders ter handhaving van de vooropgestelde (en reeds verlengde) termijn.

III.B. Herbeoordeling van de Definitieve Beslissing van de Judge-Rapporteur van 8 juli 2024 (ORD_37783/2024) door de UPC (Lokale Divisie Brussel)
12. Inleidend wordt reeds aangegeven dat Verweerders hun Verzoek tot Herbeoordeling van 16 juli 2024 beperken tot het afgewezen Procedureel Verzoek (van 24 juni 2024) om in de Repliek de uitbreiding van de grondslag van de eis door een beroep op equivalentie te weigeren.
Concreet verzetten Verweerders zich niet meer tegen het “het aanvoeren van nieuwe feiten die reeds bekend waren of bekend hadden moeten zijn bij Nelissen ten tijde van het uitbrengen van de Statement of claim”, en “het wijzigen van een aantal van zijn vorderingen”. Alleszins dient de Definitieve Beslissing (ORD_37783/2024) hieromtrent reeds te worden bevestigd.
13. Dit beperkte Verzoek tot Herbeoordeling wordt afgewezen als ongegrond. De UPC (Lokale Divisie Brussel) motiveert als volgt:
• In het Verzoek tot Herbeoordeling zijn door Verweerders (in wezen) geen nieuwe gronden of bewijzen aangevoerd dan deze die ten grondslag lagen aan de Definitieve Beslissing (ORD_37783/2024).
• Waar, naar de mening van Verweerders, het aanvoeren van een inbreuk-vordering op grond van equivalentie als een “fundamentele nieuwe grondslag” dient te worden beschouwd waaromtrent toestemming dient gevraagd (R. 263.1. RoP), heeft de Judge-Rapporteur terecht geoordeeld dat de (ondergeschikte) argumentatie-lijn op grond van equivalentie niet het voorwerp van de procedure aantast.
• Eiser heeft in lijn met het procedureel-evolutief verloop van een gerechtelijk geschil en na ontvangst van het eerste verweer van Verweerders zich bijkomend (en ondergeschikt) gesteund op een inbreuk op grond van equivalentie. Niet aangenomen kan worden dat Eiser reeds in zijn Verklaring van Eis alle mogelijke verweren van Verweerders in rekening dienen te nemen zonder dat deze concreet werden uitgewerkt door Verweerders. In dit concrete geval is gesteld noch gebleken dat Eiser wist dat Verweerders de verwezenlijking van kenmerk 1.2.4 zouden betwisten en zo ja, met welke argumenten.
• Verweerders hebben overigens niet (gemotiveerd) aangevoerd dat ze in hun verdediging zijn geschaad door het (ondergeschikte) beroep op equivalentie bij Repliek waarop zij nog bij Dupliek (met inachtneming van de reeds door de Judge-Rapporteur verlengde termijn voor indiening) in de schriftelijke fase kunnen reageren. Verweerders hebben in wezen slechts aangevoerd dat het beroep op equivalentie bij repliek niet verenigbaar is met het front-loaded karakter van de procedure bij de UPC, zonder daarbij duidelijk te maken waarom dit hun procesbelangen in het onderhavige geval concreet schaadt. De UPC (Lokale Divisie Brussel) gaat er daarom vanuit dat hiervan geen sprake is en ziet ook hierin geen aanleiding om de beslissing van de Judge-Rapporteur aan te passen.
• Dat het leerstuk van de equivalentie binnen de UPC nog niet werd uitgewerkt en dat dit “ook in nationale procedures leidt tot omvangrijke discussies”, kan onvoldoende overtuigen om aan te nemen dat Verweerders te zeer in hun belangen zijn geschaad, althans anderszins in het onderhavige geval de equivalentie-argumentatie uit te sluiten in de Repliek. De equivalentie-beoordeling betreft een beoordeling omtrent een rechtsvraag die door de UPC (Lokale Divisie Brussel) zal worden beoordeeld in het kader van zijn eindbeoordeling in deze zaak. Het gegeven dat de equivalentie-argumentatie binnen de UPC nog niet werd uitgewerkt en ook in nationale procedures leidt tot discussies overtuigt dan ook onvoldoende om dergelijke argumentatie in casu te beschouwen als een “nieuwe grondslag” of anderszins ontoelaatbaar.

III.C. Verzoek tot het verlengen van de termijn voor het indienen van de Dupliek tot 30 augustus 2024 bij afwijzing van het prealabele procedure verzoek
14. Dit verzoek wordt afgewezen als ongegrond. De UPC (Lokale Divisie Brussel) motiveert als volgt:
• Rekening houdend met de oorspronkelijke termijn voor de Dupliek met uiterlijke datum 18 juli 2024 alsmede met de beoordeling van de Judge-Rapporteur van het op 24 juni 2024 ingeleide verzoek door Verweerders binnen een termijn van 14 dagen (na stellingname door partijen), heeft de Judge-Rapporteur een bijkomende termijn toegestaan voor de Dupliek en dit tot 1 augustus 2024. De UPC (Lokale Divisie Brussel) acht deze termijn heden nog steeds voldoende ter indiening van een Dupliek. Verweerders hebben ook onvoldoende concreet en onderbouwd toegelicht waarom zij een langere termijn nodig menen te hebben voor het opstellen van de Dupliek, waarvoor zij reeds sinds 18 juni 2024 tijd hebben.
• Bijkomend kan echter eveneens worden aangegeven dat aangezien Eiser pas in zijn Repliek de equivalentie-argumentatie heeft ontwikkeld, Verweerders alleszins als laatste een schriftelijk verweer zullen kunnen ontwikkelen in hun Dupliek.
III.D. Verzoek tot het mogen inleiden van een hoger beroep tegen onderhavige beslissing van de UPC (Lokale Divisie Brussel)
15. Het verzoek van Verweerders tot het mogen inleiden van een (tussentijds) beroep tegen onderhavige beslissing (“Order”) wordt toegestaan in toepassing van R. 333 (5) RoP (cf. UPC_CoA_486/2023 APL_595643/2023 Beslissing (Order) van het Hof van Beroep van de UPC van 21 maart 2024).
III.E. Verzoek tot het aanhouden van de beslissing omtrent de veroordeling tot betaling van de kosten voor onderhavig verzoek
16. Het verzoek tot het aanhouden van de beslissing van de veroordeling in de kosten voor onderhavige verzoek-procedure tot eindbeslissing in de hoofdzaak, wordt toegewezen.
IV. Beslissing
1. Het prealabele verzoek tot het schorsen van de termijn met één dan wel twee maanden voor het indienen van de Dupliek vanaf 24 juni 2024 tot aan het moment dat een definitieve materiële beslissing over het Procedureel Verzoek is gegeven, wordt afgewezen.
2. Het verzoek tot gedeeltelijke herbeoordeling van de Definitieve Beslissing van 8 juli 2024 van de Judge-Rapporteur (ORD_37783/2024) wordt afgewezen als ongegrond. De UPC (Lokale Divisie Brussel) bevestigt de beslissing van de Judge-Rapporteur in al zijn onderdelen.
3. Het verzoek tot het toekennen van een bijkomende termijn voor het indienen van de Dupliek wordt afgewezen en de datum van 1 augustus 2024 voor de Dupliek blijft gehandhaafd.
4. Het verzoek tot het mogen indienen van hoger beroep tegen onderhavige definitieve beslissing wordt toegestaan. Hoger beroep kan worden ingesteld binnen de 15 dagen na betekening (“ser-vice”) van onderhavige beslissing (R. 224.1 (b) RoP juncto R. 220.2. RoP).
5. De beslissing aangaande de veroordeling tot betaling van de kosten van het oorspronkelijk Pro-cedureel Verzoek van 24 juni 2024 en het Verzoek tot Herbeoordeling van 16 juli 2024 wordt aangehouden tot de eindbeslissing in de hoofdzaak.

1. II. Problem and Request

As indicated in the Final Decision (ORD_37783/2024), the problem concerned the admissibility on the part of the Claimant, in response to the Statement of Defence (R. 24 RoP) of the Respondents, in its Reply to Statement of Defence (R. 29 (b) RoP) (i) supplement the factual framework, (ii) supplement the infringement argument with an equivalence argument and (iii) amend the relief sought and do so in light of the application of the Rules set out in Order ORD_37783/2024:
• R. 13.1.(l) to (o) RoP: ‘Content of Statement of Claim’
• R. 24 (b) to (g) RoP: ‘Contents of Statement of Defence’
• R. 29 (b) and (c) RoP: ‘Lodging of Defence to the Counterclaim for revocation, Reply to the Statement of defence and Rejoinder to the Reply’
• R. 263 RoP: ‘Leave to Change claim or amend case’
6. In their Procedural Request of 24 June 2024, the Defendants primarily requested that the Court, in its Reply:
(i) Reject the extension on the basis of equivalence
(ii) Reject the new facts presented
(iii) Reject the new (amended) relief sought
In the alternative, the Defendants requested in their Procedural Request of 24 June 2024 an extension of the time limit for their Rejoinder until 18 August 2024.
7. In the Final Decision of the Judge-Rapporteur of 8 July 2024 (ORD_37783/2024), the Procedural Request of 24 June 2024 was rejected in the main order, but the request in the subordinate order was granted and the Defendants were granted an additional period until 1 August 2024 to submittheir rejoinder.
8. In summary, the Judge-Rapporteur gave the following reasons for his decision:

8.1. In the main order
R. 13 RoP (specifically R. 13.1. (l) to (o) RoP) introduces a so-called “front loaded” procedural system whereby a claimant is required to set out its arguments and evidence in concrete terms in its Statement of Claim.
When interpreting and applying the above rule, account must be taken of (i) the normative purpose of R. 13 RoP and (ii) the procedural evolution of a legal dispute and (iii) the right to be heard, in particular in this case the possibilities of defence for a party confronted with new arguments, facts and an amended claim based on these.
In its specific assessment of the Procedural Request of 24 June 2024 and in application of the above, the Judge-Rapporteur ruled that the Claimant had acted within the limits of the normative objective of R. 13 RoP (acting as a reasonable and prudent person (claimant) placed in the same circumstances) and that the new facts, arguments and amended claim submitted were consistent with the procedural development of a legal dispute.
In line with this, the Judge-Rapporteur ruled that a request pursuant to R. 263.2. RoP was not applicable.
8.2. In the alternative (subsidiary) order
The Judge-Rapporteur considered it proportionate, reasonable and fair, pursuant to R. 9.3. (a) RoP, to grant an additional period for the submission of the Rejoinder, until 1 August 2024 at the latest. In his opinion, this sufficiently provides for the possibility of a defence (in application of the rule of interpretation indicated above under (iii)).
9. On 16 July 2024, the Respondents requested a Review of the above Final Decision (ORD_37783/2024) by the panel (hereinafter referred to as ‘UPC (Local Division Brussels)’) pursuant to R. 333.1 RoP and R. 334 RoP. The Request for Review contains the following operative part:
"OrthoApnea requests your panel to grant its pre-appeal procedural request and to suspend the time limit for submitting a Statement of rejoinder from 24 June until a final substantive decision has been taken, with one or two months as specified in paragraph 6.
OrthoApnea maintains part (i) of its primary request of 24 June in full and requests your panel to reject the infringement on the basis of equivalence.
OrthoApnea requests that the deadline for submitting a Statement of rejoinder, in the event that the preliminary procedural request is rejected, be extended to 30 August or to a date to be determined by your panel in accordance with the principles of justice.
OrthoApnea requests permission to appeal against the Order or against a negative decision by your panel in the review proceedings.
Nelissen to be ordered to pay the costs of this application procedure or to reserve the decision on the costs of this application procedure until a decision has been made in the main proceedings.

III. Assessment
10. The review by the UPC (Local Division Brussels) of the Final Decision (ORD_37783/2024) is marginal in nature in that it is limited to verifying whether the Judge-Rapporteur based his decision on the correct facts, whether he assessed them correctly and whether he took his decision within the bounds of reasonableness.
III.A. Preliminary request to suspend the time limit by one or two months for the submission of the rejoinder from 24 June 2024 until a final substantive decision has been taken
11. The request in question is rejected as unfounded. The UPC (Local Division Brussels) gives the following reasons:
• The Rules of Procedure do not provide for a suspension of the time limits set during the written phase, either after the filing of a Procedural Request, after the filing of a Request for Review by the panel, or after the initiation of an appeal against such a review by the panel. The fact that the RoP also does not provide for a suspension of the time limits after a Preliminary Objection (R. 19.6. RoP) or an Application for Change of Procedural Language (R. 323 RoP) reinforces the conviction that these rules do not, in principle, provide for suspension on procedural grounds/requests.
• The reference to the Court of Appeal (UPC_CoA_301/2024 dated 19 June 2024 (ICPillar LLC/ ARM Limited, paragraphs 6 and 7) is not sufficient to justify the suspension. On the contrary, this decision states that only in “exceptional circumstances” may a suspension of (first instance) proceedings be granted in order to minimise the interruption of the proceedings by procedural appeals (point 6 of the CoA decision). It can be inferred from this that the same applies mutatis mutandis to the proceedings at first instance. These too should be interrupted as little as possible by (the handling of) procedural requests. This also prevents proceedings involving such requests from being unduly delayed. In line with this ruling, it is also considered that not granting a suspension would in no way render the appeal ineffective. In the present case, too, the Respondents still have sufficient time to lodge an appeal against the present decision.
• A request for suspension can only be granted if it is proportionate and if the weighing of the interests of the parties gives cause to do so. This may be the case, for example, if the Defendants consider that their rights of defence are seriously prejudiced and this is weighed against the interests of the Claimant, in particular its interest in the expeditious continuation of the proceedings. The fact that the Defendants do not wish to develop any further arguments in their Rejoinder in the light of the equivalence argument during the period necessary for the assessment of (i) the initial Procedural Request of 24 June 2024, (ii) the Request for Reassessment of 16 July 2024 and (iii) the (possible) appeal against this assessment, in light of the equivalence argument, cannot result in the request for suspension being granted. If the appeal is upheld, the Defendants are free to claim any additional costs incurred by them in submitting their Reply to the Claimant. In that sense, it therefore seems proportionate that the interests of the Claimant in maintaining the set (and already extended) deadlines outweigh the possible adverse financial consequences for the Defendants in maintaining the set (and already extended) deadline.

III.B. Review of the Final Decision of the Judge-Rapporteur of 8 July 2024 (ORD_37783/2024) by the UPC (Brussels Local Division)
12. It is stated at the outset that the Defendants limit their Request for Review of 16 July 2024 to the rejected Procedural Request (of 24 June 2024) to refuse, in the Reply, the extension of the basis of the claim by invoking equivalence.
Specifically, the Defendants no longer object to “the introduction of new facts that were already known or should have been known to Nelissen at the time of the Statement of Claim” and “the amendment of a number of its claims”. In any event, the Final Decision (ORD_37783/2024) on this point must already be confirmed.
13. This limited Request for Review is rejected as unfounded. The UPC (Brussels Local Division) gives the following reasons:
• In the Request for Review, the Respondents have not (in essence) put forward any new grounds or evidence other than those on which the Final Decision (ORD_37783/2024) was based.
• Where, in the opinion of the Respondents, the submission of an infringement claim on the basis of equivalence as a “fundamental new ground” for which permission must be sought (R. 263.1. RoP), the Judge-Rapporteur rightly ruled that the (subordinate) line of argument based on equivalence does not affect the subject matter of the proceedings.
• In line with the procedural development of a legal dispute and after receiving the first defence from the Defendants, the Claimant additionally (and subordinately) relied on an infringement on the basis of equivalence. It cannot be assumed that the claimant must already take into account all possible defences of the defendants in its statement of claim without these having been specifically elaborated by the defendants. In this specific case, it has not been argued or shown that the claimant knew that the defendants would contest the fulfilment of feature 1.2.4 and, if so, with what arguments.
• Moreover, the Defendants have not (with reasons) argued that they have been prejudiced in their defence by the (subordinate) reliance on equivalence in the Reply, to which they can still respond in the written phase in the Dupliek (taking into account the deadline for submission already extended by the Judge-Rapporteur). The defendants have essentially only argued that the reliance on equivalence in the reply is incompatible with the front-loaded nature of the proceedings before the UPC, without clarifying why this specifically prejudices their interests in the present case. The UPC (Local Division Brussels) therefore assumes that this is not the case and sees no reason to amend the decision of the Judge-Rapporteur.
• The fact that the doctrine of equivalence has not yet been developed within the UPC and that this “also leads to extensive discussions in national proceedings” is not sufficient to conclude that the Defendants' interests have been prejudiced to such an extent that the equivalence argument should be excluded from the Reply in the present case. The equivalence assessment concerns an assessment of a legal question that will be assessed by the UPC (Local Division Brussels) in the context of its final assessment in this case. The fact that the equivalence argument has not yet been developed within the UPC and also leads to discussions in national proceedings is therefore insufficient to consider such an argument in this case as a “new ground” or otherwise inadmissible.

III.C. Request to extend the deadline for submitting the rejoinder until 30 August 2024 if the request for a preliminary ruling is rejected
14. This request is rejected as unfounded. The UPC (Brussels Local Division) gives the following reasons:
• Taking into account the original deadline for the Rejoinder of 18 July 2024 and the assessment of the Judge-Rapporteur of the request submitted by the Defendants on 24 June 2024 within a period of 14 days (after the parties had stated their positions), the Judge-Rapporteur has granted an additional period for the Rejoinder until 1 August 2024. The UPC (Brussels Local Division) still considers this period sufficient for the submission of a Rejoinder. The Defendants have also failed to explain in a sufficiently concrete and substantiated manner why they consider that they need a longer period to prepare the Rejoinder, for which they have already had time since 18 June 2024.
• In addition, it can also be pointed out that, since the Claimant only developed the equivalence argument in its Reply, the Defendants will in any case be able to develop a written defence in their Duplique.
III.D. Request to be allowed to lodge an appeal against the present decision of the UPC (Brussels Local Division)
15. The Defendants' request to lodge an (interim) appeal against the present decision (‘Order’) is granted pursuant to R. 333 (5) RoP (cf. UPC_CoA_486/2023 APL_595643/2023 Decision (Order) of the Court of Appeal of the UPC of 21 March 2024).
III.E. Request to stay the decision on the order to pay the costs of the present request
16. The request to stay the decision on the order to pay the costs of the present request procedure until the final decision in the main proceedings is granted.
IV. Decision
1. The preliminary request to suspend the time limit by one or two months for the submission of the Rejoinder from 24 June 2024 until a final substantive decision on the Procedural Request has been given is rejected.
2. The request for partial reassessment of the Final Decision of 8 July 2024 of the Judge-Rapporteur (ORD_37783/2024) is rejected as unfounded. The UPC (Local Division Brussels) confirms the decision of the Judge-Rapporteur in all its parts.
3. The request for an additional period to submit the Rejoinder is rejected and the date of 1 August 2024 for the Rejoinder is maintained.
4. The request to lodge an appeal against this final decision is granted. An appeal may be lodged within 15 days of service of this decision (R. 224.1 (b) RoP in conjunction with R. 220.2. RoP).
5. The decision regarding the order to pay the costs of the original Procedural Request of 24 June 2024 and the Request for Review of 16 July 2024 is reserved until the final decision in the main proceedings.
