LEITSATZ:
Ein Antrag der Berufungskläger auf Beschleunigung des Berufungsverfahrens und Verkürzung der Frist für die Einreichung der Berufungserwiderung gemäß R.9.3 (b) VerfO wird abgelehnt. Die von dem Berufungskläger geltend gemachten Interessen an der Beschleunigung überwiegen nicht die Interessen des Berufungsbeklagten an einem ordnungsgemäßen Verfahren.

ZUSAMMENFASSUNG DES SACHVERHALTS UND DER PROZESSGESCHICHTE
1. Mit der am 14. März 2024 eingereichten Klageschrift erhob Ona eine Verletzungsklage gegen Apple auf der Grundlage des Streitpatents betreffend eine „Positionsbestimmung von mobilen Objekten auf der Basis von gegenseitig gesendeten Signalen“ vor der Lokalkammer Düsseldorf (LKD).
2. Am 10. Mai 2024 beantragte Apple die Änderung der Verfahrenssprache von Deutsch in die Sprache des Patents, d. h. Englisch, gemäß R.323 VerfO.
3. Auf Aufforderung mit Anordnung der Präsidentin des Gerichts erster Instanz vom 14. Mai 2024 gemäß R.323.2 VerfO, reichte Ona seine schriftliche Stellungnahme am 24. Mai 2024 ein.
4. Die Präsidentin hat den Antrag mit Anordnung vom 18. Juni 2024 zurückgewiesen.
5. Mit Antrag vom 14. Juni 2024 (App_35890/2024, App_35891/2024, App_35892/2024) hat Apple beantragt, zur Eingabe von Ona Stellung nehmen zu dürfen (dieser Antrag enthielt bereits eine Erwiderung). Die LKD hat dies mit Anordnung vom 20. Juni 2024 abgelehnt und hat den Workflow in Anbetracht der bereits von der Präsidentin getroffenen Entscheidung geschlossen.

ANTRÄGE DER PARTEIEN
Im vorliegenden Berufungsverfahren beantragt Apple die Aufhebung der Anordnung der Präsidentin und die Anordnung durch das Berufungsgericht, dass die Verfahrenssprache Englisch sein soll.

VERFAHRENSGEGENSTAND
Antrag auf Beschleunigung des Berufungsverfahrens, R.225 (e), R.9.3 (b) VerfO

ENTSCHEIDUNGSGRÜNDE
1. Der Antrag auf Beschleunigung ist zulässig.
2. In Anbetracht des Ergebnisses dieses Antrags ist es nicht erforderlich, Ona Gelegenheit zur Stellungnahme zu geben.
3. Gemäß R.235.2 und R.224.2(b) VerfO kann ein Berufungsbeklagter innerhalb von 15 Tage nach Zustellung der Berufungsbegründung eine Berufungserwiderung einreichen. Nach R.9.3(b) VerfO ist das Gericht befugt, auf begründeten Antrag einer Partei eine Frist zu verkürzen.
4. In seinem am 1. Juli 2024 eingereichten Antrag beantragt Apple eine Beschleunigung des Berufungsverfahrens dahingehend, dass die Frist für die Einreichung der Berufungserwiderung am 5. Juli 2024 enden soll. Dies ist schon deshalb nicht möglich, weil die (am Samstag, dem 29. Juni 2024, eingereichte) Berufungsschrift und Berufungsbegründung an Ona erst am 9. Juli 2024 zugestellt wurden. Das Berufungsgericht legt daher den Antrag von Apple dahin aus, dass Ona nur 4 Tage für die Einreichung der Berufungserwiderung eingeräumt werden sollen.
5. Die von Apple vorgebrachten Gründe überwiegen die Interessen des Berufungsbeklagten und des ordnungsgemäßen Verfahrens nicht, und rechtfertigen nicht die von Apple beantragte Beschleunigung des Berufungsverfahrens.
6. Apple macht geltend, dass die beantragte Beschleunigung des Berufungsverfahrens gerechtfertigt sei, da Ona die Argumente von Apple angesichts der von Apple am 14. Juni 2024 eingereichten Erwiderung auf die Stellungnahme von Ona bereits bekannt gewesen seien. Dem kann schon aus folgendem Grund nicht gefolgt werden: In dem Verfahren nach R.323 VerfO ist eine Erwiderung auf eine Stellungnahme des Berufungsbeklagten nach R.323.2 VerfO nicht vorgesehen. Apples Antrag, weitere Schriftsätze zuzulassen, wurde von der LKD abgelehnt. Die Erwiderung wurde von der Präsidentin nicht berücksichtigt, wie aus der Anordnung vom 18. Juni 2024 hervorgeht, die auf diese Erwiderung keinen Bezug nimmt. Es gab daher keinen Grund für Ona diese Erwiderung vor der Zustellung der Berufungsschrift und der Berufungsbegründung zur Kenntnis zu nehmen.
7. Apple hat nicht dargelegt, warum ein besonderes Interesse daran besteht, dass die Berufungserwiderung vor einem bestimmten Datum vor Ablauf der in R.224.2(b) VerfO vorgesehenen Frist von 15 Tagen eingereicht werden sollte.
8. In Anbetracht der Interessen von Ona und der Grundsätze der Verhältnismäßigkeit, der Fairness und der Billigkeit sowie unter Berücksichtigung der obergenannten Gründe und der Zeit, die Apple sich für die Einreichung seiner Berufungsbegründung genommen hat – die wesentlich länger ist als die Frist, die Ona für die Einreichung der Berufungserwiderung eingeräumt werden soll – vermag das Berufungsgericht keinen Grund für die von Apple beantragte Verkürzung der Frist für die Einreichung der Berufungserwiderung durch Ona zu erkennen. Der Antrag ist abzulehnen.

ANORDNUNG
Der Antrag auf Beschleunigung des Berufungsverfahrens wird abgelehnt.

SUMMARY OF THE FACTS AND THE PROCEEDINGS
1. By statement of claim filed on 14 March 2024, Ona brought an infringement action against Apple on the basis of the contested patent relating to the ‘positioning of mobile objects based on mutually transmitted signals’ before the Local Chamber of Düsseldorf (LKD).

2. On 10 May 2024, Apple requested that the language of the proceedings be changed from German to the language of the patent, i.e. English, pursuant to R.323 VerfO.

3. Upon request by order of the President of the Court of First Instance dated 14 May 2024 pursuant to R.323.2 VerfO, Ona submitted its written statement on 24 May 2024.
4. The President rejected the request by order dated 18 June 2024.

5. By application dated 14 June 2024 (App_35890/2024, App_35891/2024, App_35892/2024), Apple requested to be allowed to comment on Ona's submission (this application already contained a response). The LKD rejected this request in its order of 20 June 2024 and closed the workflow in view of the decision already taken by the President.

PLAINTIFFS' MOTIONS
In the present appeal proceedings, Apple requests that the President's order be set aside and that the Court of Appeal order that the language of the proceedings be English.


SUBJECT MATTER OF THE PROCEEDINGS

REASONS FOR THE DECISION
1. The request for acceleration is admissible.
2. In view of the outcome of this request, it is not necessary to give Ona the opportunity to comment.

3. Pursuant to R.235.2 and R.224.2(b) of the Rules of Procedure, an respondent may file a response to the appeal within 15 days of service of the appeal statement. Pursuant to R.9.3(b) of the Rules of Procedure, the court has the power to shorten a time limit upon a reasoned request by a party.

4. In its application filed on 1 July 2024, Apple requests that the appeal proceedings be expedited so that the deadline for filing the response to the appeal expires on 5 July 2024. This is not possible because the notice of appeal (filed on Saturday, 29 June 2024) and the grounds of appeal were not served on Ona until 9 July 2024. The Court of Appeal therefore interprets Apple's application as meaning that Ona should be given only four days to file its response to the appeal.

5. The reasons put forward by Apple do not outweigh the interests of the respondent and of due process, and do not justify the acceleration of the appeal proceedings requested by Apple.

6. Apple argues that the requested acceleration of the appeal proceedings is justified because Ona was already aware of Apple's arguments in view of Apple's response to Ona's statement submitted on 14 June 2024. This cannot be accepted for the following reason: In proceedings under R.323 VerfO, a reply to a statement by the respondent is not provided for under R.323.2 VerfO. Apple's request to allow further written submissions was rejected by the LKD. The response was not taken into account by the President, as can be seen from the order of 18 June 2024, which makes no reference to this response. There was therefore no reason for Ona to take note of this response before the appeal and the grounds of appeal were served.

7. Apple has not explained why there is a particular interest in the appeal response being filed before a specific date before the expiry of the 15-day period provided for in R.224.2(b) VerfO.

8. In view of Ona's interests and the principles of proportionality, fairness and equity, and taking into account the above reasons and the time Apple took to file its statement of grounds for appeal – which is significantly longer than the time to be granted to Ona for filing its response to the appeal – the Court of Appeal sees no reason to grant Apple's request to shorten the time limit for Ona to file its response to the appeal. The request is denied.

ORDER
The request to expedite the appeal proceedings is denied.

INSTRUCTIONS TO THE PARTIES AND THE LAW FIRM REGARDING THE NEXT STEPS IN THE PROCEEDINGS
