ANTRÄGE DER PARTEIEN
Die Klägerin beantragt die Anordnung der Urkundenvorlage gegen sich selbst und stellt einen flankierenden Antrag auf Geheimnisschutz nach Regel 262A VerfO: I. gemäß R. 262A VerfO
1. die folgenden Informationen als vertraulich einzustufen:
Informationen betreffend … [geschwärzt] …;
Solche Informationen sind in dem Antrag auf Anordnung der Beweisvorlage sowie
den darauf bezogenen Geheimhaltungsanträgen nach R. 262.2 und R.262A enthalten.
2. anzuordnen, dass die Informationen unter Ziffer I.1 auf Seiten der Beklagten nur
- den Prozessbevollmächtigten, deren Hilfspersonen (einschließlich Experten sowie
ihrer Teammitglieder) und
- folgender zuverlässigen Person, nämlich:
- … [geschwärzt] …;
zur Kenntnis gebracht werden dürfen;
3. anzuordnen, dass nach endgültiger Beendigung des Verfahrens jede Partei und die
unter Ziffer I.2 genannten Personen die vertraulichen Informationen nach Ziffer I.1 herausgibt oder vernichtet;
4. die Anordnung mit einer verhältnismäßigen Zwangsgeldandrohung in Höhe von mindestens EUR 100.000,00 für jeden Fall der Zuwiderhandlung zu versehen;
5. die Parteien und die unter Ziffer I.2 genannten Personen zu verpflichten, die vertraulichen Informationen nach Ziffer I.1 über das Verfahren hinaus streng vertraulich zu behandeln und die vertraulichen Informationen ausschließlich für die Zwecke dieses Verfahrens zu verwenden;
Hilfsweise für den Fall, dass der Spruchkörper den Anträgen zu Ziffer I nicht vollumfänglich stattgibt beantra gen wir, dass
II. die Information und/oder die vorgelegten Unterlagen, die Gegenstand der vorstehen den Anträge nach Ziffer I sind, nicht als zur Akte gereicht gelten sollen und im Verfahren vom Gegner und vom Gericht nicht verwendet werden dürfen, wenn nicht die Klägerin innerhalb von 14 Tagen nach Zugang der endgültigen Entscheidung ausdrücklich erklärt, dass die Information und/oder die vorgelegten Unterlagen trotzdem als zur Akte gereicht gelten sollen und im Verfahren vom Gegner und vom Gericht verwendet werden dürfen. Mit vorläufiger Anordnung vom 09/05/2024 wurde vorläufiger Geheimnisschutz wie beantragt gewährt und die Beklagten aufgefordert Stellung zu nehmen. Die Beklagten beantragen den Erlass einer modifizierten Geheimhaltungsanordnung: 1. Ziffer I.2 der vorläufig angeordneten Geheimhaltungsregelung wie folgt abzuändern:
2. anzuordnen, dass die Informationen unter Ziffer I.1 auf Seiten der Beklagten nur
- den Prozessbevollmächtigten im vorliegenden Verfahren (ACT_545619/2023) sowie in den Parallelverfahren zwischen der Klägerin und den jeweiligen Beklagten in den Verfahren vor
dem Landgericht München I (Az. 21 O 9854/23, 21 O 9855/23, 21 O 9856/23 und 21 O 9429/23), vor dem Landgericht Mannheim (Az. 14 O 67/23, 14 O 90/23, 14 O 91/23 und 14 O 92/23), vor der Lokalkammer München des Einheitlichen Patentgerichts (ACT_545562/2023 und ACT_546092/2023), der Lokalkammer Mannheim des Einheitlichen Patentgerichts
(ACT_245615/2023, ACT_545817/2023 und ACT_545606/2023) sowie vor dem High Court of Justice of England & Wales (Verfahrensnummer HP-2023-000025), deren Hilfspersonen (einschließlich Experten sowie ihrer Teammitglieder) und
- folgender folgenden zuverlässigen Personen, nämlich:

zur Kenntnis gebracht werden dürfen;
2. Ziffer I.3 der vorläufig angeordneten Geheimhaltungsregelung zu streichen
oder – hilfsweise – wie folgt abzuändern:
„3. anzuordnen, dass nach endgültiger Beendigung des Verfahrens jede Partei und die unter Ziffer I.2 genannten Personen die vertraulichen Informationen nach Ziffer I.1 herausgibt oder vernichtet, soweit sich die vorbezeichneten Informationen im Besitz der jeweiligen Partei bzw. Person befinden und die Herausgabe oder Vernichtung nicht mit gesetzlichen Aufbewahrungspflichten für die Partei oder die unter Ziffer I.2 genannten Personen kollidiert;“
3. Ziffer I. 4 der vorläufig angeordneten Geheimhaltungsregelung wie folgt abzuändern:
„4. die Anordnung mit einer verhältnismäßigen Zwangsgeldandrohung in Höhe von mindestens EUR 100.000,00 für jeden schuldhaften Fall der Zuwiderhandlung zu versehen;
In Bezug auf den Schriftsatz vom 15/04/2024 beantragen sie Geheimnisschutz gem. Regel 262.2 VerfO und tragen vor, dass das CMS insoweit keine eigenständige Einreichung zulasse. Insoweit wurde bereits Geheimnisschutz angeordnet. BEGRÜNDUNG DER ANORDNUNG
Die Anordnung des vorläufigen Geheimnisschutz vom 09/05/2024 ist im von den Beklagten beantragten Umfang aufzuheben und im Übrigen zu bestätigen. Im Übrigen ist der Antrag zurückzuweisen. 1. Geheimhaltungsanordnungen für noch vorzulegende Unterlagen, die – so der Antrag – vor der Vorlage noch geschwärzt werden, kommen nicht in Betracht. Insoweit ist im Zeitpunkt der Vorlage ein paralleler Antrag nach Regeln 262, 262A VerfO zu stellen. Es wird dann überprüft werden, ob und in welchem Umfang die ungeschwärzten Inhalte Schutz genießen. 2. In ihrer Stellungnahme stellen die Beklagte die Schutzbedürftigkeit der übrigen vom Antrag betroffenen Informationen nicht in Abrede. Mithin ist von der Schutzbedürftigkeit auszugehen. 3. Die Beklagten haben die nachfolgenden formellen Einwände vorgetragen: a. Es bestehe die Möglichkeit, den Begriff der "Prozessbevollmächtigten" in Ziffer I.2 der vorläufig angeordneten Geheimhaltungsregelung in verschiedener Weise zu verstehen. Insofern sei eine Klarstellung zur Vermeidung von Missverständnissen zumindest sinnvoll. Diese Klarstellung ist zur Vermeidung von Missverständnissen sinnvoll. Die vorläufige Anordnung ist daher insoweit zu modifizieren. b. Es bestehe ein Bedürfnis, mehr als nur eine Person die Kenntnisnahme zu gestatten. Die Klägerin hat keine Zweifel an der Zuverlässigkeit der drei genannten Personen vorgetragen. Sie meint, dass die Beschränkung auf nur eine Person besser sei, als der Zugang für drei Personen. Dies reicht vorliegend nicht aus, weil die Anordnung eines Geheimnisschutzes nur den Vorlageantrag betrifft und nicht schon die vorzulegenden Unterlagen.
c. Für die Herausgabe- und Vernichtungsverpflichtung (Ziffer I.3 der vorläufig angeordneten Geheimhaltungsregelung) biete die Verfahrensordnung keinerlei Grundlage. Darüber hinaus habe die Klägerin entgegen R. 262A.2 VerfO die beantrage Herausgabe- bzw. Vernichtungsverpflichtung auch nicht begründet, sodass diese nicht gewährbar ist. In jedem Fall müsste gewährleistet sein, dass eine solche Verpflichtung nicht mit entgegenstehenden gesetzlichen Verpflichtungen kollidiere. Für die Herausgabe- Vernichtungsverpflichtung bietet die Verfahrensordnung keinerlei Grundlage. Die vorläufige Anordnung ist daher insoweit aufzuheben. d. Ferner sei auch die beantragte Mindesthöhe für die Zwangsgeldandrohung nach Ziffer I.4 der vorläufig angeordneten Geheimhaltungsregelung weder hinreichend begründet (entgegen R. 262A.2 VerfO) noch verhältnismäßig. Ein Verschuldenserfordernis fehle.
Die Zwangsgeldandrohung ist aus den angeführten Gründen dahingehend abzuändern, dass ein
Zwangsgeld in Höhe von bis zu 100.000,00 € bei einem schuldhaften Verstoß verhängt werden
kann. Diese Summe wurde auch in den deutschen Verfahren so festgesetzt und als ausreichend
betrachtet. Die Formulierung bietet die Möglichkeit, kleinste Verstöße mit einem geringeren
Betrag zu ahnden. Das Verschuldenserfordernis ist einem Verstoß immanent, aber auf Antrag
aufzunehmen.
e. Schließlich sei der Inhalt der Verpflichtung in Ziffer I.5 der vorläufig angeordneten
Geheimhaltungsregelung in Bezug auf die Beklagten bereits im zweiten Spiegelstrich der Ziffer I.2
der vorläufig angeordneten Geheimhaltungsregelung enthalten, sodass eine unnötige Dopplung
der Anordnungen bestehe.
Die Doppelung ist zu bereinigen.
ANORDNUNG
1. Die Anordnung des vorläufigen Geheimnisschutz vom 09/05/2024 wird im von den Beklagten
beantragten Umfang aufgehoben und im Übrigen bestätigt. Im Übrigen wird der Antrag
zurückgewiesen.
2. Die endgültige Anordnung zum Geheimnisschutz lautet nunmehr konsolidiert wie folgt:
a. Die folgenden Informationen werden als vertraulich eingestuft:
- Die in den Anträgen gelb oder grau hinterlegten Ausführungen
- Die als „Personenbeschränkt streng vertraulich“ gekennzeichneten Anlagen FRAND BV,
namentlich die Anlage FRAND BV 1 – Personenbeschränkt streng vertraulich, Anlage FRAND BV 2
– Personenbeschränkt streng vertraulich und Anlage FRAND BV 3 – Personenbeschränkt streng
vertraulich.
b. Es wird angeordnet, dass
- die Beklagten die Informationen unter Ziffer 2.a nur den Prozessbevollmächtigten im
vorliegenden Verfahren (ACT_545619/2023) sowie in den Parallelverfahren zwischen der
Klägerin und den jeweiligen Beklagten in den Verfahren vor dem Landgericht München I (Az. 21
O 9854/23, 21 O 9855/23, 21 O 9856/23 und 21 O 9429/23), vor dem Landgericht Mannheim (Az.
14 O 67/23, 14 O 90/23, 14 O 91/23 und 14 O 92/23), vor der Lokalkammer München des
Einheitlichen Patentgerichts (ACT_545562/2023 und ACT_546092/2023), der Lokalkammer
Mannheim des Einheitlichen Patentgerichts (ACT_245615/2023, ACT_545817/2023 und
ACT_545606/2023) sowie vor dem High Court of Justice of England & Wales (Verfahrensnummer
HP-2023-000025), deren Hilfspersonen (einschließlich Experten sowie ihrer Teammitglieder) und
folgender zuverlässigen Personen, nämlich:

- - Legal Counsel, und
- - Licensing Director,
zur Kenntnis bringen dürfen.
- und dass die genannten Personen die vertraulichen Informationen nach Ziffer 2.a über das Verfahren hinaus streng vertraulich zu behandeln haben und die vertraulichen Informationen ausschließlich für die Zwecke dieses Verfahrens verwenden dürfen. c. Für jeden schuldhaften Verstoß gegen diese Geheimhaltungsanordnung wird die Verhängung eines Zwangsgeldes in Höhe von bis zu 100.000,00 € für jeden Fall der Zuwiderhandlung angedroht.

PLAINTIFF'S CLAIMS
The plaintiff requests that the order to produce documents be issued against itself and submits an accompanying request for protection of secrets pursuant to Rule 262A VerfO: I. pursuant to R. 262A VerfO
1. to classify the following information as confidential:

Such information is contained in the request for an order to produce evidence and
the related confidentiality requests pursuant to R. 262.2 and R.262A.
2. to order that the information under item I.1 on the part of the defendant may only

2. Delete section I.3 of the provisional confidentiality order
or, in the alternative, amend it as follows:
‘3. order that, upon final conclusion of the proceedings, each party and the persons named in Section I.2 shall disclose or destroy the confidential information referred to in Section I.1, insofar as the aforementioned information is in the possession of the respective party or person and the disclosure or destruction does not conflict with statutory retention obligations for the party or the persons named in Section I.2;’
3. Amend Section I.4 of the provisionally ordered confidentiality agreement as follows:
"4. to impose a proportionate penalty payment of at least EUR 100,000.00 for each culpable case of non-compliance;
With regard to the written statement of 15 April 2024, they request confidentiality protection pursuant to Rule 262.2 VerfO and argue that the CMS does not allow independent submission in this respect. Confidentiality protection has already been ordered in this respect. REASONS FOR THE ORDER
The order for provisional confidentiality protection dated 9 May 2024 is to be lifted to the extent requested by the defendants and confirmed in all other respects. In all other respects, the application is to be dismissed. 1. Confidentiality orders for documents still to be submitted which, according to the application, are to be redacted before submission, are not possible. In this respect, a parallel application must be filed at the time of submission in accordance with Rules 262 and 262A of the Rules of Procedure. It will then be examined whether and to what extent the unredacted content is protected. 2. In their statement, the defendants do not dispute the need for protection of the remaining information affected by the application. It can therefore be assumed that they are in need of protection. 3. The defendants have raised the following formal objections: a. The term ‘legal representative’ in section I.2 of the provisional confidentiality order can be understood in different ways. In this respect, clarification is at least advisable in order to avoid misunderstandings. This clarification is advisable in order to avoid misunderstandings. The provisional order must therefore be modified in this respect. b. There is a need to allow more than one person to take note of the information. The plaintiff has not raised any doubts as to the reliability of the three persons named. It believes that restricting access to only one person is better than granting access to three persons. This is not sufficient in the present case because the order to protect confidential information only concerns the request for a preliminary ruling and not the documents to be submitted.
c. The Rules of Procedure do not provide any basis for the obligation to surrender and destroy documents (section I.3 of the provisional confidentiality order). Furthermore, contrary to R. 262A.2 VerfO, the plaintiff did not justify the requested obligation to surrender or destroy the documents, so that this cannot be granted. In any case, it must be ensured that such an obligation does not conflict with conflicting legal obligations. The Rules of Procedure do not provide any basis for the obligation to surrender or destroy the documents. The provisional order must therefore be set aside in this respect. d. Furthermore, the minimum amount requested for the penalty payment under Section I.4 of the provisionally ordered confidentiality regulation is neither sufficiently justified (contrary to Rule 262A.2 VerfO) nor proportionate. There is no requirement for fault.
For the reasons stated, the penalty payment threat must be amended to the effect that a
penalty payment of up to €100,000.00 may be imposed in the event of a culpable breach.
This amount was also set in the German proceedings and considered sufficient
. The wording makes it possible to penalise minor infringements with a lower
amount. The requirement of fault is inherent in a breach, but must be included upon request.
e. Finally, the content of the obligation in Section I.5 of the provisionally ordered
confidentiality provision with regard to the defendants is already contained in the second indent of Section I.2
of the provisionally ordered confidentiality rule, so that there is an unnecessary duplication
of the orders.
The duplication is to be removed.
ORDER
1. The order for provisional confidentiality protection dated 09/05/2024 is lifted to the extent requested by the defendants
and confirmed in all other respects. In all other respects, the application is
dismissed.
2. The final order for confidentiality is now consolidated as follows:
a. The following information is classified as confidential:
- The statements highlighted in yellow or grey in the applications
- The annexes FRAND BV marked as ‘strictly confidential for specific persons’,
namely Annex FRAND BV 1 – Strictly confidential for specific persons, Annex FRAND BV 2
– Strictly confidential for specific persons and Annex FRAND BV 3 – Strictly confidential for specific persons

b. It is ordered that
- the defendants disclose the information under point 2.a only to the legal representatives in the
present proceedings (ACT_545619/2023) and in the parallel proceedings between the
plaintiff and the respective defendants in the proceedings before the Munich I Regional Court (Ref. 21
O 9854/23, 21 O 9855/23, 21 O 9856/23 and 21 O 9429/23), before the Regional Court of Mannheim (Ref.
14 O 67/23, 14 O 90/23, 14 O 91/23 and 14 O 92/23), before the Munich Local Chamber of the
Unified Patent Court (ACT_545562/2023 and ACT_546092/2023), the Mannheim Local Chamber
of the Unified Patent Court (ACT_245615/2023, ACT_545817/2023 and
ACT_545606/2023) and before the High Court of Justice of England & Wales (case number
HP-2023-000025), their assistants (including experts and their team members) and
the following trusted persons, namely:
- - Legal Counsel,
- - Legal Counsel, and
- - Licensing Director,

- and that the aforementioned persons shall treat the confidential information in accordance with section 2.a as strictly confidential beyond the proceedings and shall use the confidential information exclusively for the purposes of these proceedings. c. For each culpable breach of this confidentiality order, a penalty payment of up to €100,000.00 shall be imposed for each case of infringement.
