Verfahrenssprache: Deutsch
Gegenstand des Verfahrens:
Nichtigkeitsklage betreffend EP 2 681 034 B1
Hier: Antrag auf Simultanverdolmetschung gemäß Art. 51 Abs. 2 EPGÜ, Regel 109
VerfO
Sachverhalt
sei.
17. Die Antragstellerinnen haben angegeben, dass diese deutschsprachigen
Prozessvertreter in der Zwischenanhörung bzw. in der mündlichen
Verhandlung Eingaben machen werden. Dies ist auch naheliegend, da die
Schriftsätze von deutschsprachigen Prozessvertretern unterschrieben worden
sind. Ein ordnungsgemäßer und effizienter Prozessverlauf ist somit
gewährleistet.
In
Prozessvertretern an.
In diesem Fall

Language of the proceedings: German
Subject matter of the proceedings:
Action for annulment concerning EP 2 681 034 B1

Here: Request for simultaneous interpretation pursuant to Art. 51(2) EPGÜ, Rule 109
VerfO
Facts
1. The parties are currently involved in proceedings for a declaration of invalidity
concerning EP 2 681 034 B1, whereby the applicants

are the applicants for annulment and the language of the proceedings is German (Art. 49
(6) EPGÜ).
2. The parties were summoned to an interim hearing on 29 May 2024 at 10:00 a.m.
and to oral proceedings on 23 August 2024 at 9:30 a.m.

3. The applicants request simultaneous interpretation into Dutch,
or alternatively into English, for both the interim hearing and the oral proceedings.
4. In support of their application, the applicants submit the following
• The managing directors and the persons responsible for the proceedings
do not speak German. Furthermore, both the authorised representative, Dr Wim Maas, and the participating patent attorney from the Netherlands

authorised representative, Dr Wim Maas, and the patent attorney involved
are from the Netherlands.
• As an expression of the right to a fair hearing, these
persons must not only be able to follow the proceedings,
but also be able to fully understand what is being said by a
representative and the other party. This is not

by the fact that their (legal) representative is proficient in the
language of the proceedings. The necessity of
interpretation arises from the fact that it must be possible to follow
the proceedings.
• In accordance with Art. 51(2) EPGÜ, interpretation is only requested

be requested for the representative who is unable to conduct the proceedings in German due to a lack of
appropriate language skills, namely Dr Maas.
• As medium-sized companies, the applicants cannot be expected to provide multilingual support for a case.
• In addition to the authorised representative Dr Wim Maas, for whom interpretation has been requested,

interpretation has been requested, also make submissions (in German).
Furthermore, the patent attorneys involved are also expected to make contributions (in German),
at least in the main hearing.
• The working language between the parties' representatives is English.
• Since Mr. Rubusch will plead in German,

translation is also required for the coordination of the legal representatives,
who must be able to understand each other's contributions.
• The applicants were not able to choose the language of the proceedings,
so that appropriate interpretation is necessary.
Insofar as several representatives would make submissions in the hearing
, this was due to the scope of the dispute, which

, in addition to the present proceedings, a parallel
infringement action before the Munich Local Chamber.
• The applicants had unsuccessfully approached the respondent with the
question of whether it would be willing to propose to the court
that at least the interim hearing be held in English
. The respondent had refused to do so.

5. The respondent requests that the applicants' application be dismissed
and submits the following grounds:
• All of the respondent's representatives are proficient in the
language of the proceedings, so that simultaneous interpretation into either Dutch or English is not necessary for the respondent
.

• The applicants are represented by authorised representatives of the law firm
Cohausz&Florack, who are native speakers of the language of the proceedings
and have submitted extensive written submissions in the
language of the proceedings. It is not apparent why
party representatives who are not sufficiently proficient in the language of the proceedings

.
• The language skills of persons who are not authorised to appear in court did not justify
ordering simultaneous interpretation in accordance with Rule 109
VerfO.
Application for simultaneous interpretation in accordance with Rule 109(1) and (2) sentence 1
VerfO

6. Pursuant to Article 51(2) EPGÜ, all chambers of the Court of First Instance shall,
where appropriate, provide interpretation at the request of a party
in order to assist that party in the oral proceedings
.
7. The aim of interpretation is to enable parties who do not have a sufficient command of the language of the proceedings

the language of the proceedings or do not have sufficient knowledge of that language, to
enable them to participate actively in the oral proceedings.
8. However, according to Art. 51(2) EPGÜ, interpretation is only provided to the
extent that this appears appropriate to assist a party in the
oral proceedings. In all other respects, the

necessity of conducting the proceedings in the language of the proceedings, which in the present case
is German pursuant to Article 49(1) EPGÜ. Accordingly,
the rapporteur must decide on the appropriateness of
simultaneous interpretation.

9. This general principle from Article 51(2) EPGÜ is specified in more detail in Rule 109 VerfO.
If the rapporteur orders simultaneous interpretation pursuant to Rule 109(2) sentence
1 VerfO upon a reasoned request within the meaning of

Rule 109(1) of the Rules of Procedure, the costs of simultaneous interpretation shall be
procedural costs pursuant to Rule 150 of the Rules of Procedure.
10. If such a request pursuant to Rule 109(1) of the Rules of Procedure is not granted,
the parties may request simultaneous interpretation at their own expense pursuant to Rule 109(2) sentence 2 of the Rules of Procedure.
the parties may, in accordance with Rule 109(2) sentence 2 of the Rules of Procedure, request
simultaneous interpretation at their own expense.
11. In the context of the decision to be taken by the rapporteur on the appropriateness of
simultaneous interpretation in response to a request pursuant to Rule 109(1)
, consideration shall be given to

recital 6 of the preamble to the EPGÜ, according to which an appropriate
balance must be struck between the interests of the right holders and other parties,
taking into account the necessary proportionality and flexibility.
This principle is also relevant in connection with the
costs of the proceedings.

12. Pursuant to Article 49(6) EPGÜ, the language of proceedings before the Central Chamber is
the language in which the patent concerned was granted. It follows that the
applicant for a declaration of invalidity cannot choose the language himself and cannot
gain any strategic advantage by choosing a language he prefers
.

13. It can also be taken into account in favour of the applicants that
they are undisputedly small and medium-sized enterprises
.
14. However, these circumstances do not mean that the applicants are entitled
to simultaneous interpretation, the costs of which would be procedural costs.
Rather, the weighing of interests leads to the conclusion that
ordering simultaneous interpretation would be disproportionate and must therefore
be rejected.
15. The applicants are not challenged by the language of the proceedings in their pursuit of their legal rights to a greater extent than is usually the case in a
multilingual international court.
16. The interests of the applicants are represented by three German-speaking

legal representatives. In the course of the proceedings to date, they have
presented their case extensively in German without the court
being aware of any communication problems.
17. The applicants have stated that these German-speaking
legal representatives will make submissions in the interim hearing and in the oral
proceedings. This is also obvious, as the

written pleadings have been signed by German-speaking legal representatives.
A proper and efficient course of proceedings is therefore
guaranteed.
18. The fact that the fourth legal representative, Dr Wim Maas, does not speak German
does not alter this assessment. As the Court of Appeal stated in paragraph 26 of its

decision of 17 April 2024, UPC_CoA_101/2024 ApL_ 12116/2024, in
connection with the balancing of interests in the case of a change of language,
it is irrelevant what language skills a
specific legal representative from an international team has. In

international disputes, a representative is typically chosen not only for the sake of his or her own abilities, but also for the sake of the international,
multidisciplinary and multilingual environment in which he or she works and in
which a team of several representatives with different abilities is usually involved.
What applies to the decision on the appropriateness of a change of language also applies to the ordering of simultaneous interpretation.
The legal representatives complement each other and the language skills of one of several legal representatives are not decisive for the assessment of the appropriateness of simultaneous interpretation.

simultaneous translation: the legal representatives complement each other and
the language skills of one of several legal representatives are not decisive for assessing the appropriateness of
simultaneous interpretation.
19. The conclusion that the lack of German language skills of one of several legal representatives
does not justify simultaneous interpretation to be ordered by the court within the meaning of

Rule 109(2) sentence 1 VerfO, is also based on the fact that
otherwise the party that chooses an international team as its legal representative
with correspondingly diverse language skills would have the power to
significantly increase the costs of the proceedings.
20. This result is in line with the procedural order of the court of first instance

instance of the Unified Patent Court, Local Chamber Düsseldorf, issued
on 22 March 2024 App_14943/2024 under the main file number
ACT_590953/2023, UPC number: UPC_CFI_463/2023. There, the

Local Chamber in Düsseldorf stated that interpretation pursuant to Article 51(2)
of the EPGÜ is only provided for to the extent that it appears appropriate
to assist a party in the oral proceedings.
In all other respects, the requirement to conduct the proceedings in the language of the proceedings remains unchanged.

. If individual representatives of the parties are proficient in the language of the proceedings,
there is neither reason nor cause to allow them to conduct the proceedings in a
language other than the language of the proceedings with the use of
simultaneous interpretation.
21. The interest of the managing directors of the applicants in following the proceedings in
English or Dutch also does not justify

simultaneous interpretation ordered by the court. It is in the nature of an international
court that not all representatives of the parties are able to follow the
legal proceedings directly during the oral hearing.
If, in such cases, consideration were given to the
language skills of the parties, who are not themselves authorised to appear in court, and
interpretation were ordered, this would have a significant and unreasonable

impact on the costs of the proceedings. This would be contrary to the
principle of proportionality.
22. The parties' right to a fair hearing has not been violated. Insofar as the
applicants refer to the decision of the Court of Appeal in paragraph 23
of its decision of 17 April 2024 UPC_CoA_101/2024 ApL_
12116/2024, this is not convincing. It may be, and is not
the subject of the present proceedings, that a change of language in
infringement proceedings before the EPG may be necessary if the defendant

party itself does not have a command of the language of the proceedings. However, this is not the case here.
No change of language is required, but rather simultaneous translation,
and this request was not made by the defendant, but by the
plaintiffs. Unlike the defendant in the infringement proceedings
, the plaintiff in nullity proceedings is not under comparable time pressure, as it is possible for it, at least during the preparation of the action, to consult its legal representatives in detail and plan its litigation strategies.

comparable time pressure, as it is possible for it, at least during the preparation of the action,
to consult extensively with its legal representatives and to plan its
litigation strategy.
23. In view of the above, the request for simultaneous interpretation pursuant to Rule 109
(1) VerfO must be rejected.

Request for simultaneous interpretation pursuant to Rule 109(2) sentence 2 of the Rules of Procedure
24. Pursuant to Rule 109(2) sentence 2 of the Rules of Procedure, the parties may request that,
as far as practicable, arrangements be made for
simultaneous interpretation at their expense. In this case

the applicants must inform the court two weeks before the oral hearing
of their intention to do so.
25. The court interprets the applicants' request in their written submission of 29 April
2024 as meaning that, in the alternative, such a request is also being made in order to
enable a translation to be provided in favour of Mr. Dr. Wim Maas, lawyer

. This application is granted.
26. The court also has no objection to the patent attorney
and the managing directors of the applicants also following the proceedings
by means of simultaneous interpretation at their own expense.
27. It is left to the applicants to decide whether the simultaneous interpretation
should be into Dutch or English.

Order
1. The applicants' legal representative, Dr Wim Maas, is granted,
rejecting the further application, permission to conduct the interim hearing on 29 May 2024 and the oral hearing on
23 August 2024 in English, or optionally in Dutch, with simultaneous interpretation into German.

simultaneous interpretation into German.
2. The applicants shall provide the necessary simultaneous interpreters at their own expense.
The applicants are permitted to use the equipment available in the courtroom for this purpose for the simultaneous interpretation.
