Même si le brevet européen en litige a été délivré en langue anglaise, la société demanderesse, de

Or, ni la nationalité du représentant d’une des parties, ni la nationalité de la société intervenante, ne constituent des motifs sérieux, qui justifieraient pour des raisons de commodité ou d’équité, de proposer un changement de la langue de la procédure.

PROCEDURE ET DEMANDES
Le 05 décembre 2023, SEOUL VIOSYS a introduit une action en contrefaçon devant la Division Locale de Paris, à l’encontre de LASER COMPONENTS, relative au brevet européen EP3404726.
Suivant ordonnance du 12 février 2024, le Juge-rapporteur a déclaré recevable la demande d’intervention, formée par LASER COMPONENTS, à l’égard de son fournisseur PHOTON WAVE.
LASER COMPONENTS a déposé son mémoire en défense, le 18 mars 2024, contestant entre autres
mesures, la matérialité de la contrefaçon.
PHOTON WAVE a déposé le 18 mars 2024, un mémoire aux fins de voir déclarer recevable son intervention, et un mémoire en intervention, formant les demandes suivantes :
1. rejeter l'action en contrefaçon,
2. ordonner à la demanderesse de payer les frais de la procédure dans une décision de frais selon l'art. 69 AJUB, R. 118.5 RdP,
3. déclarer provisoirement exécutoire le jugement sur les frais, le cas échéant, contre constitution d'une sécurité,
4. statuer que, dans le cadre de l’intervention, l’intervenante peut soulever indépendamment de la défenderesse des requêtes de la défenderesse, tous les moyens d’attaque et de défense en soutien de la défenderesse que la défenderesse elle-même pourrait ou aurait pu soulever, en particulier que l’intervenante peut introduire de manière autonome une demande reconventionnelle en nullité,
5. dans le cas où elle serait autorisée à introduire une demande reconventionnelle en nullité
indépendamment de la défenderesse, d’accorder à l’intervenante un délai de deux mois pour
introduire une demande reconventionnelle en nullité,
6. dans le cas où l’intervenante ne serait pas autorisée à introduire une demande reconventionnelle en nullité indépendamment de la défenderesse, de statuer que :
(i) l’intervenante est considérée comme une partie avec tous les droits d’une partie,
(ii) l’intervenante est pour cela autorisée à introduire une demande reconventionnelle en nullité conformément à l’art. 33(4) 2e phrase de l’Accord relatif à une juridiction unifiée du brevet 2013/C
175/01 devant la Division locale de Paris de la Juridiction unifiée du brevet,
7. accorder une prolongation du délai pour le mémoire d’intervention de deux mois,
8. déterminer l’anglais comme langue de la procédure.
L’intervenante sollicite également, sur le fondement des règles R. 24(h) et R. 104 RdP, de :
-fixer la valeur de l’action en contrefaçon, à la somme de 250.000 euros,
-ordonner à TESCAN LAB d’expliquer sur quels faits elle fonde son interprétation des caractéristiques de la revendication, au vu des mesures,
-changer la langue de procédure.
En réponse, SEOUL VIOSYS, invitée à produire ses observations écrites, au plus tard le 23 avril 2024,
suivant ordonnance préliminaire du 09 avril 2024, sollicite dans ses observations écrites du 22 avril
2024 le rejet des demandes relatives à :
- la contestation de la valeur de l’action au motif qu’aucune preuve n’est fournie à l’appui de cette
contestation,
- au laboratoire TESCAN, pour défaut d’explication et de fondement juridique,
- au changement de langue, en faisant valoir que le français et l’anglais sont des langues étrangères
pour la société coréenne intervenante, que les parties peuvent se référer au fascicule du brevet
en anglais et que le maintien de la langue française n’étant pas significativement défavorable, que
ce changement de langue entrainerait pour le demandeur des coûts pour traduire son mémoire
en demande et toutes les pièces déjà déposées à l’appui, que n’est donc pas justifié le changement
de langue sollicité.
En outre, SEOUL VIOSYS sollicite du Juge-rapporteur que ce dernier enjoigne la production de
l’attestation d’un témoin à laquelle LASER COMPONENTS et l’intervenante se réfèrent dans leurs
mémoires respectifs et que la date de la production de cette pièce constitue le point de départ du
délai pour produire son mémoire en réponse aux mémoires en défense et en intervention.

MOTIFS DE LA DECISION
A titre préliminaire, le panel considère que les points 1 à 3, mentionnés par PHOTON WAVE dans
son mémoire en intervention, concernant le rejet de la contrefaçon, le paiement des frais de
procédure et le prononcé de l’exécution provisoire, devront être examinés ultérieurement dans le
cadre de la décision rendue au fond.
1- Sur l’intervention forcée et la demande en nullité du brevet à titre reconventionnel (points 4, 5,
6, 7)
Selon la règle 315.4 RdP, « la partie intervenante est considérée comme une partie, sauf décision
contraire de la juridiction ». A ce titre la partie intervenante dispose des droits attachés à la qualité
de partie et participe à la procédure, sous réserve néanmoins, conformément à la règle 313.2 RdP,
que l’intervention soit « faite au soutien en tout ou partie d’une demande », ce qui signifie que
l’intervenant ne peut développer des prétentions contraires à la partie qu’il soutient et ne peut développer de manière autonome des demandes et selon des modalités procédurales distinctes
de celles offertes à la partie qu’il soutient.
Selon les règles 23 RdP et 25.1 Rdp, le défendeur dispose d’un délai de trois mois pour déposer un
mémoire en défense et pour déposer une demande reconventionnelle en nullité.
En application de la règle 9.2 RdP, la juridiction peut ne tenir aucun compte de toute diligence, fait
preuve ou argument qui n’a pas été accompli ou soumis dans un délai fixé par le règlement de
procédure.
Conformément à la règle 9.3(a) RdP, la juridiction peut sur requête motivée d’une partie, proroger
même rétroactivement un délai visé au règlement de procédure.
En l’occurrence, PHOTON WAVE intervient au soutien de la société LASER COMPONENTS, laquelle
disposait d’un délai de trois mois, pour conclure en défense et le cas échéant, pour déposer une
demande reconventionnelle en nullité du brevet. L’intervenant ne peut adopter une position
procédurale différente de celle du défendeur au principal.
LASER COMPONENTS a déposé un mémoire en défense, dans le délai précité, le 18 mars 2024,
sans former de demande reconventionnelle en nullité du brevet.
PHOTON WAVE n’a pas, dans ce même délai expirant le 18 mars 2024 et auquel elle se trouvait
soumise, comme indiqué précédemment, déposé une demande reconventionnelle en nullité. La
société PHOTON WAVE ne peut dès lors prétendre à être autorisée à former une telle demande,
alors qu’elle n’a pas fait diligence dans le délai imparti et qu’elle n’invoque aucun motif sérieux
justifiant l’octroi de délais supplémentaires.
La demande subséquente tendant à obtenir une prorogation de deux mois, du délai pour déposer
une demande reconventionnelle en nullité, doit être rejetée.

2-Sur la demande de changement de langue (point 8)
PHOTON WAVE sollicite le changement de langue, afin que la procédure se déroule désormais en
langue anglaise, sans préciser néanmoins la règle de procédure applicable, exposant que la
défenderesse, entreprise française, a elle-même formé une telle demande et soutenant que ses
collaborateurs comprennent les documents en anglais, tandis que ceux en français doivent être
traduits, avec des risques d’erreur, de perte d’information et de perte de temps et d’argent.
Compte tenu des motifs de commodité et d’équité invoqués par PHOTON WAVE dans son
mémoire en intervention, la demande doit être considérée comme fondée sur l’article 49(4) de
l’AJUB et la règle 322 RdP.
La demanderesse qui a choisi d’agir en langue française devant la Division Locale de Paris dans une
des deux langues possibles devant cette division, a indiqué s’opposer à la proposition de
changement de la langue de la procédure pour la langue anglaise, comme sollicité par l’intervenant
dans son mémoire.
Il n’y a donc pas en l’espèce d’accord des parties sur le changement de langue demandé.
Le juge rapporteur, après consultation de la chambre, a déjà indiqué par ordonnance du 27 février
2024, sur la demande de LASER COMPONENTS, les motifs de son rejet d’une proposition aux
parties d’un changement de la langue de procédure. En effet, même si le brevet européen en litige
a été délivré en langue anglaise, la société demanderesse, de nationalité coréenne, a fait le choix
procédural d’introduire son action en langue française, ce qui est respectueux des droits du
défendeur, société française implantée en France.
Or, ni la nationalité du représentant d’une des parties, ni la nationalité de la société intervenante,
ne constituent des motifs sérieux, qui justifieraient pour des raisons de commodité ou d’équité,
de proposer un changement de la langue de la procédure.
Par conséquent, les conditions posées par la règle 322 RdP, ne sont pas remplies en l’espèce pour
qu’un changement de la langue choisie par le demandeur soit décidé.

3- Sur la fixation de la valeur du litige et sur les explications relatives au rapport établi par TESCAN
ANALYTICS
Ces questions relèvent non pas de la procédure écrite, mais de la procédure de mise en état, dans
le cadre de laquelle elles seront traitées, le cas échéant, conformément à la règle 104(b) et (i).

4- Sur le report du point de départ du délai pour répliquer
Par application de la règle 24(j) RdP, à laquelle renvoie la règle 13.2 RdP, le défendeur à l’action en
contrefaçon doit fournir, simultanément au dépôt de son mémoire en défense, une copie de
chacun des documents visés au mémoire en défense et ce, afin de « permettre au défendeur de
préparer une défense sur la base de tous les arguments avancés dans la requête et de toutes les
annexes à l'appui de ses arguments » et de garantir « que les principes fondamentaux de justice
et d'équité, qui doivent être assurés en tenant compte des intérêts légitimes des deux parties (voir
le préambule 5 des Règles de procédure), sont correctement respectés ». (Cour d’appel de la JUB,
13 octobre 2023, UPC_CoA_320/2023).
Par ailleurs, les demandes en vue de produire un élément de preuve sont régies par les règles 190
et suivantes RdP. Or, en l’espèce, l’attestation objet de la demande a été établie pour démontrer
des faits, la force probatoire de cette attestation sera évaluée par la suite et dès lors que les
défenderesses n’ont communiqué qu’un extrait de l’attestation de témoin, lors de la notification
de leur mémoire, il n’y a pas lieu d’enjoindre à celle-ci de communiquer désormais le document
en son intégralité. En conséquence, il n’y pas lieu de reporter le délai pour la réplique de SEOUL
VIOSYS.

DECISION
Dit que PHOTON WAVE n’a pas déposé dans le délai imparti, un mémoire en nullité du brevet,
Rejette la demande d’allongement du délai pour la production par PHOTON WAVE, d’un mémoire
en nullité du brevet,
Rejette la demande de changement de langue formée par PHOTON WAVE,
Rejette la demande de report du délai pour répliquer de SEOUL VIOSYS,
Dit que la fixation de la valeur du litige et les explications relatives au rapport établi par TESCAN
ANALYTICS, seront traitées dans le cadre de la mise en état,
Dit que les demandes relatives au rejet de la contrefaçon, au paiement des frais de procédure et
au prononcé de l’exécution provisoire seront traitées dans le cadre du jugement au fond.
Dit que la présente ordonnance est susceptible d’un appel dans les conditions prévues par les
dispositions de la règle 220.2 RdP.

Headnotes: An intervener cannot raise claims contrary to the party it supports and cannot independently raise claims and proceed in a manner different from that available to the party it supports. Therefore, since the intervener did not file a counterclaim for invalidity within the time limit allowed to the person it supports, it cannot claim an extension of the time limit for filing an independent claim.
Even though the European patent at issue was granted in English, the applicant company, which is of

Korean nationality, chose to bring its action in French, which respects the rights of the defendant, a French company established in France. However, neither the nationality of the representative of one of the parties nor the nationality of the intervening company constitute serious grounds which would justify, for reasons of convenience or fairness, proposing a change in the language of the proceedings.

PROCEEDINGS AND APPLICATIONS
On 5 December 2023, SEOUL VIOSYS brought an infringement action before the Paris Local Division against LASER COMPONENTS in relation to European patent EP3404726.

Following an order dated 12 February 2024, the Judge-Rapporteur declared admissible the application for intervention filed by LASER COMPONENTS against its supplier PHOTON WAVE.
LASER COMPONENTS filed its statement of defence on 18 March 2024, contesting, among other things,

measures, the materiality of the infringement.
On 18 March 2024, PHOTON WAVE filed a statement of defence seeking to have its intervention declared admissible, and a statement of intervention, making the following claims:
1. dismiss the infringement action,
2. order the plaintiff to pay the costs of the proceedings in a decision on costs pursuant to Art. 69 AJUB, R. 118.5 RdP,
3. declare the judgment on costs provisionally enforceable, if applicable, against the provision of security,

4. rule that, in the context of the intervention, the intervener may, independently of the defendant, raise the defendant's claims, all grounds of attack and defence in support of the defendant that the defendant itself could or could have raised, in particular that the intervener may independently bring a counterclaim for annulment,

5. in the event that it is authorised to bring a counterclaim for annulment
independently of the defendant, grant the intervener a period of two months to
bring a counterclaim for annulment,

6. in the event that the intervener is not authorised to bring a counterclaim for invalidity independently of the defendant, to rule that:
(i) the intervener is considered a party with all the rights of a party,

(ii) the intervener is therefore authorised to bring a counterclaim for invalidity in accordance with Article 33(4), second sentence, of the Agreement on a Unified Patent Court 2013/C
175/01 before the Local Division of Paris of the Unified Patent Court,

7. grant an extension of two months for the statement of intervention,
8. determine English as the language of the proceedings.
The intervener also requests, on the basis of Rules R. 24(h) and R. 104 RdP, that:

-set the value of the infringement action at EUR 250,000,
-order TESCAN LAB to explain on what facts it bases its interpretation of the characteristics of the claim, in view of the measures,
-change the language of the proceedings.

In response, SEOUL VIOSYS, invited to submit its written observations by 23 April 2024 at the latest,
pursuant to the preliminary order of 9 April 2024, requested in its written observations of 22 April
2024 that the claims relating to the following be dismissed:

- the challenge to the value of the action on the grounds that no evidence was provided in support of this
challenge,
- TESCAN, for failure to provide an explanation and legal basis,
- the change of language, arguing that French and English are foreign languages

for the Korean intervening company, that the parties may refer to the patent file
in English and that maintaining the French language is not significantly disadvantageous, that
this change of language would entail costs for the applicant to translate its statement of claim
and all the documents already filed in support thereof, and that the requested change of language is therefore not justified.

In addition, SEOUL VIOSYS requests that the Judge-Rapporteur order the production of
the witness statement referred to by LASER COMPONENTS and the intervener in their
respective statements and that the date of production of this document constitute the starting point for the
time limit for producing its statement in response to the statements of defence and intervention.

GROUNDS FOR THE DECISION
As a preliminary point, the panel considers that points 1 to 3, mentioned by PHOTON WAVE in
its intervention statement, concerning the rejection of the infringement claim, the payment of the costs of the proceedings
and the order for provisional enforcement, should be examined at a later stage in the
context of the decision on the merits.

1- On the compulsory intervention and the counterclaim for invalidity of the patent (points 4, 5,
6, 7)
According to Rule 315.4 of the Rules of Procedure, ‘the intervening party shall be considered a party, unless the court decides otherwise
’. As such, the intervening party has the rights attached to the status of

and participates in the proceedings, subject, however, in accordance with Rule 313.2 RdP,
to the intervention being ‘made in support of all or part of a claim’, which means that
the intervener may not raise claims contrary to the party it supports and may not independently raise claims and follow procedural steps distinct

from those available to the party it supports.
According to Rules 23 RdP and 25.1 Rdp, the defendant has three months to file a
statement of defence and to file a counterclaim for annulment.
Pursuant to Rule 9.2 RdP, the court may disregard any diligence, fact

or argument that has not been completed or submitted within a time limit set by the Rules of Procedure.

In accordance with Rule 9.3(a) RdP, the court may, upon a reasoned request from a party, extend
even retroactively, a time limit referred to in the Rules of Procedure.

In the present case, PHOTON WAVE is intervening in support of LASER COMPONENTS, which
had a period of three months to conclude its defence and, if necessary, to file a
counterclaim for invalidity of the patent. The intervener cannot adopt a procedural position
different from that of the defendant in the main proceedings.

LASER COMPONENTS filed a defence within the aforementioned time limit on 18 March 2024,
without filing a counterclaim for invalidity of the patent.
PHOTON WAVE did not, within the same time limit expiring on 18 March 2024 and within which it was

, as previously indicated, file a counterclaim for invalidity. The
company PHOTON WAVE cannot therefore claim to be authorised to file such a claim,
since it did not act diligently within the time limit and does not invoke any serious grounds
justifying the granting of additional time.

The subsequent request for a two-month extension of the time limit for filing
a counterclaim for invalidity must be rejected.

2-On the request for a change of language (point 8)
PHOTON WAVE requests a change of language so that the proceedings may now be conducted in
English, without specifying the applicable procedural rule, stating that the

defendant, a French company, had itself made such a request and arguing that its
employees understand documents in English, whereas those in French must be
translated, with the risk of errors, loss of information and loss of time and money.
In view of the reasons of convenience and fairness invoked by PHOTON WAVE in its

intervention brief, the request must be considered well founded under Article 49(4) of the
AJUB and Rule 322 of the Rules of Procedure.
The claimant, who chose to proceed in French before the Paris Local Division in one
of the two languages available before that division, indicated that it opposed the proposal to

change the language of the proceedings to English, as requested by the intervener
in its statement.
There is therefore no agreement between the parties on the requested change of language in this case.
The judge-rapporteur, after consulting the chamber, has already indicated by order of 27 February

2024, at the request of LASER COMPONENTS, the reasons for rejecting a proposal to the parties to change the language of the proceedings.
Even though the European patent in dispute
was granted in English, the applicant company, which is Korean, chose

to bring its action in French, which respects the rights of the
defendant, a French company established in France.
However, neither the nationality of the representative of one of the parties nor the nationality of the intervening company
constitute serious grounds which would justify, for reasons of convenience or fairness,
a proposal to change the language of the proceedings.

Consequently, the conditions laid down in Rule 322 of the Rules of Procedure are not met in this case for
a change in the language chosen by the claimant to be decided.

3- On the determination of the value of the dispute and on the explanations relating to the report prepared by TESCAN
ANALYTICS

These issues do not fall within the written procedure, but within the pre-proceedings,
during which they will be dealt with, if necessary, in accordance with Rule 104(b) and (i).

4- On the postponement of the starting point of the time limit for reply
Pursuant to Rule 24(j) of the Rules of Procedure, to which Rule 13.2 of the Rules of Procedure refers, the defendant in an infringement action
must provide, at the same time as filing its statement of defence, a copy of
each of the documents referred to in the statement of defence in order to "enable the defendant to

prepare a defence on the basis of all the arguments put forward in the application and all the
annexes in support of its arguments‘ and to ensure ’that the fundamental principles of justice
and fairness, which must be ensured taking into account the legitimate interests of both parties (see

preamble 5 of the Rules of Procedure), are correctly respected". (Court of Appeal of the JUB,
13 October 2023, UPC_CoA_320/2023).
Furthermore, requests for the production of evidence are governed by Rules 190

et seq. of the Rules of Procedure. However, in the present case, the certificate that is the subject of the request was drawn up to prove
facts, the probative value of that certificate will be assessed at a later stage and, since the
defendants only provided an extract from the witness statement when serving

of their statement of defence, there is no need to order them to now provide the document
in its entirety. Consequently, there is no need to extend the deadline for SEOUL
VIOSYS's reply.

DECISION
Declares that PHOTON WAVE did not file a statement of invalidity of the patent within the time limit,

Rejects the request for an extension of the time limit for PHOTON WAVE to file a statement
of invalidity of the patent,
Rejects the request for a change of language made by PHOTON WAVE,
Rejects SEOUL VIOSYS' request for an extension of the time limit for its reply,

Declares that the determination of the value of the dispute and the explanations relating to the report prepared by TESCAN
ANALYTICS will be dealt with in the context of the pre-trial proceedings,
Declares that the claims relating to the rejection of the infringement, the payment of the costs of the proceedings and
the pronouncement of provisional enforcement will be dealt with in the judgment on the merits.
