LEITSÄTZE:
1. Gemäß Art. 51 Abs. 2 EPGÜ sehen alle Kammern des Gerichts erster Instanz, soweit dies
angemessen erscheint, auf Verlangen einer Partei eine Verdolmetschung vor, um die Partei
bei der mündlichen Verhandlung zu unterstützen. Dieser allgemeine Grundsatz wird in
R. 109 VerfO näher konkretisiert.
2. Ziel der Simultanverdolmetschung ist es, den Beteiligten, welche der Verfahrenssprache
nicht oder nicht in ausreichendem Maße mächtig sind, eine aktive Teilnahme an der mündli-
chen Verhandlung zu ermöglichen. Dabei kann die Verdolmetschung sowohl in als auch aus
der Verfahrenssprache erfolgen (vgl. R. 109.1 VerfO).
3. Eine Verdolmetschung ist nach Art. 51 Abs. 2 EPGÜ allerdings nur in dem Umfang vorgese-
hen, wie diese angemessen erscheint, um eine Partei in der mündlichen Verhandlung zu un-
terstützen. Im Übrigen verbleibt es bei der Notwendigkeit, in der Verfahrenssprache zu ver-
handeln. Sind einzelne Parteivertreter der Verfahrenssprache mächtig, besteht weder Grund
noch Veranlassung, ihnen die Verhandlung in einer anderen Sprache als der Verfahrensspra-
che unter Einsatz einer Simultanverdolmetschung zu gestatten.

VERFAHRENSSPRACHE: Deutsch
GEGENSTAND: R. 109.1 VerfO – Simultanverdolmetschung der mündlichen Verhandlung
KURZE DARSTELLUNG DES SACHVERHALTS:
Die Parteien stehen sich derzeit in einem Verfahren auf Anordnung einstweiliger Maßnahmen ge-
genüber, wobei sich die Antragstellerin für Deutsch als Verfahrenssprache entschieden hat. Einem
von Antragsgegnerseite gestellten Antrag auf Änderung der Verfahrenssprache zu Englisch ist die
Antragstellerin entgegengetreten, woraufhin die Präsidentin des Gerichts erster Instanz einen
solchen Wechsel abgelehnt hat. Eine Entscheidung des Berufungsgerichts über die durch die An-
tragsgegnerin hiergegen eingelegte Berufung steht noch aus. Das Eilverfahren wird daher weiter-
hin auf Deutsch geführt. Versuche einer vergleichsweisen Beilegung der Sprachenfrage sind ge-
scheitert.
Mit Anordnung vom 1. März 2024 hat die Lokalkammer Düsseldorf einen Antrag der Antragstel-
lerin auf Anordnung der Simultanverdolmetschung vom Deutschen ins Englische abgelehnt. Den
für diesen Fall durch die Antragstellerin gestellten Hilfsantrag, Vorkehrungen für eine Simultanver-
dolmetschung der mündlichen Verhandlung zu treffen, hat die Lokalkammer zurückgewiesen. Zu-
gleich hat die Lokalkammer den Parteien in dieser Anordnung gestattet, für die mündliche Ver-
handlung für die Übersetzung von der deutschen in die englische Sprache auf ihre Kosten eine
Simultanverdolmetschung zu beauftragen und der Sub-Registry der Lokalkammer Düsseldorf bis
zum 12. März 2024 mitzuteilen, ob sie von dieser Möglichkeit Gebrauch machen. Eine entspre-
chende Mitteilung der Antragsgegnerin ist bei der Lokalkammer Düsseldorf fristgerecht einge-
gangen. Zugleich teilte die Antragsgegnerin der Lokalkammer Düsseldorf mit, sie werde die Option
nutzen und zwei (weitere) Dolmetscher für eine Übersetzung vom Englischen ins Deutsche beauf-
tragen.
ANTRÄGE DER PARTEIEN:
Die Antragstellerin beantragt,
festzustellen, dass die Parteien, insbesondere die Beklagtenseite, in der mündlichen Ver-
handlung nicht auf Englisch mit Simultanverdolmetschung ins Deutsche verhandeln dürfen,
sondern jeglicher mündliche Vortrag von den jeweils bestellten Vertretern in der deutschen
Verfahrenssprache zu leisten ist.
Die Antragsgegnerin beantragt,
den Antrag der Antragstellerin zurückzuweisen;
festzustellen, dass die Parteivertreter in der mündlichen Verhandlung am 26. (und 27.) März
2024 auf Englisch mit Simultanverdolmetschung ins Deutsche verhandeln dürfen.
GRÜNDE DER ANORDNUNG:
Gemäß Art. 51 Abs. 2 EPGÜ sehen alle Kammern des Gerichts erster Instanz, soweit dies angemes-
sen erscheint, auf Verlangen einer Partei eine Verdolmetschung vor, um die Partei bei der mündli-
chen Verhandlung zu unterstützen. Dieser allgemeine Grundsatz wird in R. 109 VerfO näher kon-
kretisiert. Fehlt es davon ausgehend – wie hier auf Antragsgegnerseite – an einem fristgerechten
Antrag auf Simultanverdolmetschung im Sinne von R. 109.1 VerfO oder wurde ein solcher Antrag
durch den Berichterstatter zurückgewiesen, ist es der Partei für den Fall, dass der Berichterstatter
nicht von Amts wegen eine Verdolmetschung anordnet (R. 109.3 VerfO), unbenommen, selbst auf
eigene Kosten einen Dolmetscher zu bestellen (R. 109.4 VerfO). In diesem Fall muss sie die Kanzlei
zwei Wochen vor der mündlichen Verhandlung über eine solche Intention unterrichten.
Von dieser Möglichkeit hat die Antragsgegnerin vorliegend Gebrauch gemacht. Eine entsprechen-
de Mitteilung ging am 12. März 2024 und damit fristgerecht bei der Sub-Registry der Lokalkammer
Düsseldorf ein.
Ziel der Simultanverdolmetschung ist es, den Beteiligten, welche der Verfahrenssprache nicht oder
nicht in ausreichendem Maße mächtig sind, eine aktive Teilnahme an der mündlichen Verhandlung
zu ermöglichen. Dabei kann die Verdolmetschung sowohl in als auch aus der Verfahrenssprache
erfolgen (vgl. R. 109.1 VerfO). Dass dem so sein muss, liegt auf der Hand. Nur durch eine solche
Simultanverdolmetschung in beide Richtungen ist gewährleistet, dass der Betroffene einerseits die
Ausführungen in der Verfahrenssprache versteht (Übersetzung aus der Verfahrenssprache) und
sich zugleich auch bei Bedarf artikulieren kann (Übersetzung in die Verfahrenssprache). Soweit die
Antragstellerin gleichwohl sämtliche Beteiligten auf Antragsgegnerseite zu einer Verhandlung in
deutscher Sprache zwingen will, würde eine solche Anordnung daher dem Sinn der Simultanver-
dolmetschung und damit letztlich auch Art. 51 Abs. 2 EPGÜ zuwiderlaufen.
Dass es Dolmetschern, wie von der Antragstellerin ausgeführt, im Regelfall an der Postulations-
fähigkeit im Sinne von Art. 48 EPGÜ fehlt, ist unerheblich. Dolmetscher sind keine Parteivertreter,
sondern bloßes Werkzeug, um der Partei bzw. den Parteivertretern dazu zu verhelfen, sich trotz
fehlender oder zumindest mangelhafter Kenntnisse der Verfahrenssprache an der mündlichen
Verhandlung zu beteiligen.
Die durch R. 112.6 VerfO für Zeugen eröffnete Möglichkeit, in einer anderen Verfahrenssprache
auszusagen, rechtfertigt keine andere Bewertung. Es handelt sich dabei um eine eng begrenzte
Möglichkeit eines Abweichens von der Verfahrenssprache. Ist ein Zeuge der Verfahrenssprache
nicht mächtig, kann ihm das Gericht erlauben, in einer anderen Sprache auszusagen, ohne dass es
der Hinzuziehung eines Dolmetschers bedarf. Die Möglichkeiten der Simultanverdolmetschung
werden dadurch nicht berührt.
Eine Verdolmetschung ist nach Art. 51 Abs. 2 EPGÜ allerdings nur in dem Umfang vorgesehen, wie
dies angemessen erscheint, um eine Partei in der mündlichen Verhandlung zu unterstützen. Im
Übrigen verbleibt es bei der Notwendigkeit, in der Verfahrenssprache und damit im vorliegenden
Fall gemäß Art. 49 Abs. 1 EPGÜ auf Deutsch zu verhandeln. Die Antragsgegnerin hat der Kanzlei
mitgeteilt, Eingaben würden in der mündlichen Verhandlung durch Agathe Michel-de Cazotte und
Cameron Marshall erfolgen. Nachdem die Antragsgegnerin dem Vortrag der Antragstellerin zu den
Deutschkenntnissen der Erstgenannten einschließlich deren mehrjähriger Tätigkeit für eine deut-
sche Praxis (vgl. Schriftsatz v. 12.02.2024, S. 4 Rz. 9) nicht entgegengetreten ist, ist davon auszu-
gehen, dass diese in der mündlichen Verhandlung auf Deutsch verhandeln kann und wird. Es be-
steht weder Grund noch Veranlassung, ihr die Verwendung der englischen Sprache unter Einsatz
eines Simultandolmetschers zu gestatten. Die Verhandlung auf Englisch unter Einsatz einer Simul-
tanverdolmetschung ist daher nur dem Patentanwalt der Antragsgegnerin zu gestatten.
ANORDNUNG:
1. Dem Patentanwalt der Antragsgegnerin, Herrn …, wird unter Zurückweisung des
weitergehenden Antrages gestattet, in der mündlichen Verhandlung am 26. (und 27.)
März 2024 auf Englisch mit einer Simultanverdolmetschung ins Deutsche zu
verhandeln.
2. Den dafür erforderlichen Simultandolmetscher hat die Antragsgegnerin auf eigene Ko-
sten zu stellen. Der Antragsgegnerin wird gestattet, für die Simultanverdolmetschung
die im Sitzungssaal für diesen Zweck vorhandene Anlage zu nutzen.
3. Der Antrag der Antragstellerin, festzustellen, dass die Parteien, insbesondere die Be-
klagtenseite, in der mündlichen Verhandlung nicht auf Englisch mit Simultanverdol-
metschung ins Deutsche verhandeln dürfen, sondern jeglicher mündliche Vortrag von
den jeweils bestellten Vertretern in der deutschen Verfahrenssprache zu leisten ist,
wird zurückgewiesen.

The parties are currently involved in proceedings for interim measures,

applicant nevertheless wishes to compel all parties on the respondent's side to attend a hearing in
German, such an order would therefore run counter to the purpose of simultaneous interpretation
and thus ultimately also to Article 51(2) EPGÜ.
The fact that interpreters, as stated by the applicant, generally lack the ability to act as legal representatives
within the meaning of Article 48 EPGÜ is irrelevant. Interpreters are not representatives of the parties,
but merely tools to help the parties or their representatives to participate in the oral proceedings despite
their lack of or at least insufficient knowledge of the language of the proceedings
.
The possibility opened up by Rule 112.6 of the Rules of Procedure for witnesses to testify in another language of the proceedings
does not justify a different assessment. This is a narrowly limited
possibility of deviating from the language of the proceedings. If a witness does not speak the language of the proceedings,
the court may allow him to testify in another language without
the need to call in an interpreter. This does not affect the possibilities of simultaneous interpretation.
However, according to Art. 51(2) EPGÜ, interpretation is only provided to the extent that
this appears appropriate to assist a party in the oral proceedings.

that submissions will be made at the oral hearing by Agathe Michel-de Cazotte and

German language skills of the former, including her several years of work for a German law firm
(see written submission of 12 February 2024, p. 4, para. 9), it must be assumed
that she can and will be able to conduct the oral proceedings in German. There is
neither reason nor cause to allow her to use the English language with the assistance of
a simultaneous interpreter. The proceedings in English with simultaneous interpretation
are therefore only to be permitted for the respondent's patent attorney.
ORDER:
1. The respondent's patent attorney, Mr ..., is granted leave, with the rejection of the
further application, to conduct the oral proceedings on 26 (and 27)
March 2024 in English with simultaneous interpretation into German.
2. The respondent shall provide the necessary simultaneous interpreter at its own expense.
