RESUME DES FAITS ET DE LA PROCEDURE
Une action en contrefaçon a été initiée par SEOUL VIOSYS à l’encontre de LASER COMPONENTS
devant la Division locale de Paris en date du 5 décembre 2023.
La notification du mémoire en demande est datée du 18 décembre 2023.
LASER COMPONENTS a sollicité que son fournisseur PHOTON WAVE Co intervienne à la procédure
et une ordonnance rendue en date du 12 février 2024 a dit recevable la demande en intervention
et a invité PHOTON WAVE à se positionner sur cette demande en intervention dans un délai d’un
mois, tel que prévu par R. 316.2 RdP.
Ladite ordonnance a été notifiée à PHOTON WAVE à l’adresse électronique de son représentant
en date du 19 février 2024, ce dernier ayant accepté la notification.
Toutes les pièces du dossier ont été adressées par email au représentant de PHOTON WAVE en
date du 20 février 2024 via un lien de transfert.
Par requête du 8 mars 2024, LASER COMPONENTS a sollicité une extension des délais légaux sur
le fondement de R.9.3 RdP. Cette requête a été communiquée par email au représentant de PHO-TON
WAVE par le greffe de la Division locale de Paris.
ARGUMENTS DU REQUERANT
Le requérant sollicite le report de la date de signification de son mémoire en défense, arguant du
fait que l’intervenant a connu des difficultés techniques pour enregistrer son mémoire d’interven-
tion dans le CMS et du fait qu’il est probable que l’intervenant déposera une demande reconven-tionnelle
indépendante en vue d’une déclaration de nullité conformément à R25 RdP, qu’une coor-dination
avec le défendeur est nécessaire en vue d’une défense commune.
MOTIFS de l’ordonnance
La Règle (R.) 9.3 a) du Règlement de procédure de la Juridiction unifiée du brevet (RdP) prévoit
que sur requête motivée d’une partie, la Juridiction peut proroger (sous réserve du §4), même
rétroactivement un délai visé au présent règlement ou imposé par la Juridiction.
En l’espèce, la Juridiction relève tout d’abord que le tiers appelé en intervention n’a pas subi de
préjudice du fait des difficultés techniques du CMS car il lui a été communiqué le mémoire en
demande d’intervention, l’ordonnance statuant sur l’admissibilité de la demande en intervention
du 12 février 2024 et toutes les pièces du dossier dès les 19 et 20 février par e-mail à son repré-sentant.
Le délai pour que le tiers se positionne et éventuellement dépose son mémoire d’inter-
vention a été fixé dans l’ordonnance à un mois. Par conséquent, si PHOTON WAVE souhaite inter-venir,
il devra déposer son mémoire d’intervention au plus tard dans le mois suivant la notification
de la demande d’intervention et des pièces à l’appui, soit le 20 mars 2024 conformément à R.
316.2 RdP.
En outre, le défendeur n’a pas démontré avoir lui-même connu des difficultés techniques pour
enregistrer son mémoire en défense qui est prévu au 18 mars prochain. Le défendeur est donc en
état pour développer ses propres arguments en parallèle à l’intervention en cours. En effet, la
réponse en réplique du défendeur n'est pas conditionnée par la position du tiers appelé en inter-vention.
Enfin, la demanderesse ne doit pas pâtir des choix processuels opérés par la partie défenderesse
qui a décidé de mettre en cause l'intervenant.
Les parties devant la Juridiction unifiée du brevet savent que les délais sont strictement limités et
se doivent d’être diligents dans leurs démarches afin que le fonctionnement de la Juridiction soit
à la fois juste et efficace, conformément aux principes du préambule des RdP, dans ses articles 2
et 4. Aussi, le défendeur ne peut légitimement invoquer le fait qu’une intervention est en cours,
celle-ci est menée en parallèle de l’action au principal et il n’est pas justifié qu’elle retarde le pro-cès.
Il en résulte que la demande en allongement des délais sur le fondement de R. 9.3 a) RdP ne sera
pas accueillie.
Le mémoire en demande ayant été notifié le 18 décembre 2023, le défendeur devra donc sou-mettre
son mémoire en défense dans le délai de 3 mois conformément aux dispositions de R. 23
RdP, soit avant le 18 mars 2024.
PAR CES MOTIFS, LA JURIDICTION ORDONNE :
-Que soit rejetée la requête de LASER COMPONENTS tendant à l’allongement du délai légal
pour déposer son mémoire en défense,
-Enjoint à LASER COMPONENTS de soumettre son mémoire en défense au plus tard le 18 mars
2024.
Il est rappelé que la présente ordonnance est susceptible d’un appel dans les conditions pré-vues
par les dispositions de R. 220.2 RdP.

SUMMARY OF THE FACTS AND PROCEEDINGS
An infringement action was brought by SEOUL VIOSYS against LASER COMPONENTS
before the Local Division of Paris on 5 December 2023.
The notification of the statement of claim is dated 18 December 2023.
LASER COMPONENTS requested that its supplier PHOTON WAVE Co intervene in the proceedings,
and an order issued on 12 February 2024 declared the request for intervention admissible
and invited PHOTON WAVE to respond to this request for intervention within one month,
as provided for in R. 316.2 RdP.
The order was notified to PHOTON WAVE at the email address of its representative
on 19 February 2024, and the latter accepted the notification.
All documents in the file were sent by email to PHOTON WAVE's representative
on 20 February 2024 via a transfer link.
By application dated 8 March 2024, LASER COMPONENTS requested an extension of the legal time limits on
the basis of R.9.3 RdP. This application was communicated by email to the representative of PHO-TON
WAVE by the registry of the Local Division of Paris.
ARGUMENTS OF THE APPLICANT
The applicant requests a postponement of the date of service of its statement of defence, arguing that
the intervener experienced technical difficulties in registering its statement of intervention
in the CMS and that it is likely that the intervener will file a counterclaim
for a declaration of invalidity in accordance with R25 RdP, that coordination
with the defendant is necessary with a view to a joint defence.
GROUNDS for the order
Rule (R.) 9.3(a) of the Rules of Procedure of the Unified Patent Court (RdP) provides
that, on a reasoned request by a party, the Court may extend (subject to §4), even
retroactively, a time limit referred to in these Rules or imposed by the Court.
In the present case, the Court notes first of all that the third party called to intervene did not suffer any
any prejudice as a result of the technical difficulties experienced by CMS, since it was sent the statement of
intervention, the order ruling on the admissibility of the application for intervention
of 12 February 2024 and all the documents in the file on 19 and 20 February by email to its representative.
The time limit for the third party to state its position and, if necessary, file its statement of intervention
was set in the order at one month. Consequently, if PHOTON WAVE wishes to intervene,
it must file its statement of intervention no later than one month after notification
of the application to intervene and the supporting documents, i.e. 20 March 2024 in accordance with R.
316.2 RdP.
Furthermore, the defendant has not demonstrated that it itself encountered technical difficulties in
filing its statement of defence, which is due on 18 March. The defendant is therefore in a position
in a position to develop its own arguments in parallel with the intervention in progress. Indeed, the
defendant's reply is not conditional on the position of the third party called upon to intervene.
Finally, the claimant should not suffer from the procedural choices made by the defendant
who decided to involve the intervener.
The parties before the Unified Patent Court are aware that the time limits are strictly limited and
must be diligent in their proceedings so that the Court can function
fairly and efficiently, in accordance with the principles set out in the preamble to the Rules of Procedure, in Articles 2
and 4. Therefore, the defendant cannot legitimately invoke the fact that an intervention is pending,
as it is being conducted in parallel with the main proceedings and there is no justification for it to delay the proceedings.
As a result, the request for an extension of time on the basis of Rule 9.3(a) of the Rules of Procedure will not be
not granted.
As the statement of claim was served on 18 December 2023, the defendant must therefore submit
its statement of defence within three months in accordance with the provisions of R. 23
RdP, i.e. before 18 March 2024.
ON THESE GROUNDS, THE COURT ORDERS:
-That the application by LASER COMPONENTS for an extension of the legal time limit for filing its statement of defence be dismissed,
-That LASER COMPONENTS be ordered to submit its statement of defence by 18 March 2024 at the latest.
It is noted that this order is subject to appeal under the conditions set out by the provisions of R. 220.2 of the Rules of Procedure.
