LEITSÄTZE:
1. Gemäß R. 262A.4 VerfO ist der Vertreter der anderen Parteien vor dem Erlass einer Geheimnisschutzanordnung zu einer schriftlichen Stellungnahme aufzufordern. Im Interesse eines effektiven Geheimnisschutzes betrifft das Erfordernis der Anhörung vor Erlass indes nur die finale Geheimhaltungsanordnung und Zugangsbeschränkung. Im Interesse eines effektiven Geheimnisschutzes nach der Richtlinie (EU) 2016/943 kann dagegen bis zum Erlass einer endgültigen Anordnung der Zugang noch weiter eingegrenzt werden, namentlich auf die Person des Klägervertreters. Die Erörterung des Geheimhaltungsantrags mit der Partei ist mit den geschwärzten Versionen der betroffenen Dokumente möglich (Anschluss an UPC_CFI_22/2023 (Lokalkammer Hamburg), Anordnung v. 2. Dezember 2023).
2. Um den Besonderheiten von Eilverfahren Rechnung zu tragen, muss der für ein faires Verfahren erforderliche Personenkreis (R. 262A.6 VerfO) dort so gewählt werden, dass die von der vorläufigen Geheimnisschutzanordnung betroffene Partei unter Berücksichtigung des Geheimhaltungsinteresses der Gegenseite vollumfänglich arbeitsfähig und in der Lage ist, in der Sache zu jedem durch die Gegenseite aufgeworfenen Punkt Stellung zu nehmen. Daher erscheint im Regelfall eine vorläufige Beschränkung auf vier rechtsanwaltliche Vertreter (zwei Partner und zwei Associates zu deren Unterstützung), zwei patentanwaltliche Vertreter sowie drei Vertreter der Mandantin angemessen (UPC_CFI_463/2023 (LK Düsseldorf), Anordnung v. 14. Februar 2024), wobei dieser Personenkreis bei Bedarf um zwei Rechtsanwaltsfachangestellte erweitert werden kann.
3. Nachdem der Personenkreis, welchem Zugang zu den (vermeintlich) geheimhaltungsbedürftigen Informationen gewährt wird, gemäß R. 262.6 S. 1 VerfO den für die Einhaltung des Rechts der Verfahrensbeteiligten auf einen wirksamen Rechtsbehelf und ein faires Verfahren notwendigen Umfang nicht überschreiten darf, ist der Kreis der zugangsberechtigten Personen unter Berücksichtigung der vorstehenden Erwägungen stets einer Einzelfallprüfung zu unterziehen und, falls notwendig und geboten, an die Anforderungen des jeweiligen Verfahrens anzupassen.

KURZE DARSTELLUNG DES SACHVERHALTS:
Die Parteien stehen sich derzeit in einem Verfahren auf Anordnung einstweiliger Maßnahmen gegenüber. Mit Schriftsatz vom 15. Februar 2024 hat die Antragsgegnerin einen Antrag auf Schutz vertraulicher, in der Einspruchsschrift nebst Anlagen enthaltener Informationen gestellt.
Nach Auffassung der Antragsgegnerin ist der Zugang zu den durch sie als vertraulich eingestuften Informationen zu beschränken. Diese seien rein kommerzieller und nichttechnischer Natur, so dass Patentanwälte keinen Zugang zu diesen Informationen benötigten. Der Umfang der von der Antragsgegnerin als vertraulich eingestuften Informationen sei gering. Auch seien diese Informationen begrenzt, spezifisch, geschäftlich hochsensibel und so beschaffen, dass Mitarbeiter der Antragstellerin keinen Zugang benötigten. Falls ein Mitarbeiter der Antragstellerin Zugang erhalte, müsse dieser der Rechtsabteilung angehören und dürfe nicht an kommerziellen Entschei-dungen beteiligt sein. Darüber hinaus müsse die Antragstellerin das Gericht davon überzeugen, dass sie über Verfahren verfüge, die sicherstellen, dass der Zugang zu den von der Antragsgegnerin als vertraulich eingestuften Informationen auf die namentlich benannten Personen beschränkt sei. Um sicherzustellen, dass die betreffenden Informationen nicht außerhalb des vorliegenden Verfahrens verwendet werden, dürften die weiteren Rechtsvertreter, die zusätzlich zu den im bisherigen Verfahren benannten rechtsanwaltlichen Vertretern Zugang zu den betreffenden Informationen erhalten, nicht an anhängigen EPG-Verfahren beteiligt sein, die von der Antragstel-lerin auf demselben Gebiet geführt werden.
Mit einer Verfahrensanordnung vom 16. Februar 2024 hat die Lokalkammer Düsseldorf zunächst den bisher im Verfahren benannten Verfahrensbevollmächtigten Zugang zur ungeschwärzten Fassung der vorgelegten Dokumente gewährt und diese unter Androhung von Zwangsgeldern zur Geheimhaltung – auch gegenüber der Antragstellerin – verpflichtet. Zugleich hat die Lokalkammer den Parteien Gelegenheit dazu gegeben, ergänzend zu dem Personenkreis vorzutragen, dem bis zur endgültigen Entscheidung über den Geheimhaltungsantrag Zugang gewährt werden soll.
Unter Berücksichtigung dieser Stellungnahmen hat die Lokalkammer die nunmehr ergangene Verfahrensanordnung im Wege einer vorläufigen Verfahrensanordnung vom 20. Februar 2024 angekündigt und der Antragsgegnerin Gelegenheit gegeben, hierzu innerhalb kurzer Frist abschließend Stellung zu nehmen. Davon hat die Antragsgegnerin Gebrauch gemacht.
ANTRÄGE DER PARTEIEN:
Die Antragsgegnerin beantragt, gemäß Artikel 58 EPGÜ
1. anzuordnen, dass der Zugang zu dem in roter Schriftfarbe gehaltenen Text in der vertraulichen Einspruchsschrift gegen den Antrag auf vorläufige Maßnahmen und in der vertraulichen eidesstattlichen Erklärung von Herrn … (siehe vertrauliche Anlage CR-3) auf insgesamt höchstens vier namentlich bekannte Rechtsvertreter von 10x persönlich beschränkt wird, die sich verpflichten, 5 Jahre lang an keinen Lizenzverhandlungen im Bereich der räumlichen Transkriptomatik teilzunehmen; oder
2. hilfsweise anzuordnen, dass der Zugang zu dem in roter Schriftfarbe gehaltenen Text in der vertraulichen Einspruchsschrift gegen den Antrag auf vorläufige Maßnahmen und in der vertraulichen eidesstattlichen Erklärung von Herrn … (siehe vertrauliche Anlage CR-3) beschränkt ist auf:
i. insgesamt höchstens vier namentlich genannte Rechtsvertreter von 10x persönlich; und
ii. einen namentlich genannten Mitarbeiter von 10x aus der Rechtsabteilung, der ebenfalls an keinen geschäftlichen Entscheidungen beteiligt ist; und
iii. in beiden vorgenannten Fällen auf Personen, die sich verpflichten, 5 Jahre lang an keinen Lizenzvertragsverhandlungen in der Branche der räumlichen Transkriptomatik teilzunehmen.
Die Antragstellerin beantragt,
1. bis zum Erlass einer endgültigen Entscheidung über den Antrag zum Schutz vertraulicher Informationen vorläufigen Zugang zu den von der Antragsgegnerin noch zu bezeichnenden vermeintlichen vertraulichen Informationen für die Rechtsanwälte der BARDEHLE PAGENBERG Partnerschaft mbB sowie für zwei zuverlässige Personen bei der Antragstellerin, namentlich Herrn …, Chief Legal Officer der Antragstellerin und Herrn …, Vice President Intellectual Property der Antragstellerin, anzuordnen.
2. bis zum Erlass einer endgültigen Entscheidung über den Antrag zum Schutz vertraulicher Informationen der Antragsgegnerin vorläufigen Zugang zu den von der Antragsgegnerin noch zu bezeichnenden vermeintlichen vertraulichen Informationen den mit dem Verfahren betrauten Rechtsanwälten der BARDEHLE PAGENBERG Partnerschaft mbB, namentlich

GRÜNDE DER ANORDNUNG:
Nach Art. 9 Abs. 1 und 2 lit. a) der Richtlinie (EU) 2016/943 ist vorgesehen, dass in einem gerichtlichen Verfahren auf Antrag der Zugang zu von den Parteien oder Dritten vorgelegten Dokumenten, die Geschäftsgeheimnisse oder angebliche Geschäftsgeheimnisse enthalten, ganz oder teilweise auf eine begrenzte Anzahl von Personen beschränkt werden kann. Der Schutz vertraulicher Informationen ist im EPGÜ in Artikel 58 vorgesehen und in der Verfahrensordnung des Einheitlichen Patentgerichts in Regel 262A implementiert.
Gemäß R. 262A.4 VerfO ist vor dem Erlass einer Anordnung der Vertreter der anderen Parteien zu einer schriftlichen Stellungnahme aufzufordern. Im Interesse eines effektiven Geheimnisschutzes betrifft das Erfordernis der Anhörung vor Erlass indes nur die finale Geheimhaltungsanordnung und Zugangsbeschränkung. Im Interesse eines effektiven Geheimnisschutzes nach der Richtlinie (EU) 2016/943 kann dagegen bis zum Erlass einer endgültigen Anordnung der Zugang noch weiter eingegrenzt werden, namentlich auf die Person des Klägervertreters. Die Erörterung des Geheimhaltungsantrags mit der Partei ist mit den geschwärzten Versionen der betroffenen Dokumente möglich (UPC_CFI_22/2023 (Lokalkammer Hamburg), Anordnung v. 2. Dezember 2023).
Auch wenn diese Überlegungen im Grundsatz auch in Verfahren auf Anordnung einstweiliger Maßnahmen gelten, dürfen die Besonderheiten derartiger Verfahren nicht unberücksichtigt bleiben. Wie auch im Hauptsacheverfahren werden die für die Parteien bestehenden Stellungnah-mefristen durch einen Geheimnisschutzantrag nicht berührt. Jedoch scheiden Fristverlängerungen aufgrund des Eilcharakters derartiger Verfahren im Regelfall aus. Zudem steht der Termin zur mündlichen Verhandlung häufig kurzfristig an. Vor diesem Hintergrund ist die von einer vorläufi-gen Geheimnisschutzanordnung betroffene Partei gezwungen, trotz der mit einer solchen Anord-nung naturgemäß verbundenen Einschränkungen ihre Einlassungen in der Sache vorzubereiten und ggf. auf den (vermeintlich) geheimhaltungsbedürftige Informationen enthaltenden Schriftsatz zu erwidern. Da Stellungnahmen in derartigen Verfahren in der Regel innerhalb kurzer Fristen im Rahmen eines strengen Fristenregimes einzureichen sind und auch die mündliche Verhandlung kurzfristig vorzubereiten ist, muss der für ein faires Verfahren erforderliche Personenkreis (R. 262A.6 VerfO) so gewählt werden, dass die von der vorläufigen Geheimnisschutzanordnung betroffene Partei unter Berücksichtigung des Geheimhaltungsinteresses der Gegenseite vollumfänglich arbeitsfähig und in der Lage ist, in der Sache zu jedem durch die Gegenseite aufgeworfenen Punkt Stellung zu nehmen. Um den Besonderheiten des Eilverfahrens Rechnung zu tragen, erscheint daher im Regelfall eine vorläufige Beschränkung auf vier rechtsanwaltliche Vertreter (zwei Partner und zwei Associates zu deren Unterstützung), zwei patentanwaltliche Vertreter sowie drei Vertreter der Mandantin angemessen (UPC_CFI_463/2023 (LK Düsseldorf), Anordnung v. 14. Februar 2024), wobei dieser Personenkreis bei Bedarf um zwei Rechtsanwaltsfachangestellte erweitert werden kann.
Nachdem der Personenkreis, welchem Zugang zu den (vermeintlich) geheimhaltungsbedürftigen Informationen gewährt wird, gemäß R. 262.6 S. 1 VerfO den für die Einhaltung des Rechts der Verfahrensbeteiligten auf einen wirksamen Rechtsbehelf und ein faires Verfahren notwendigen Umfang nicht überschreiten darf, ist der Kreis der zugangsberechtigten Personen unter Berücksichtigung der vorstehenden Erwägungen stets einer Einzelfallprüfung zu unterziehen und, falls notwendig und geboten, an die Anforderungen des jeweiligen Verfahrens anzupassen.
Auf den vorliegenden Fall gewendet bedeutet dies, dass Patentanwälte keinen Zugang zur ungeschwärzten Version der Einspruchsschrift nebst Anlagen benötigen. Sämtliche von der Antragstellerin als geheimhaltungsbedürftig eingestuften Informationen sind kommerzieller und nichttechnischer Natur. Gegen das Begehren der Antragstellerin, auf Rechtsanwaltsseite den Zugang auf drei Partner und zum Ausgleich lediglich auf einen Associate zu erstrecken, bestehen keine Bedenken. Darüber hinaus erscheint es unter Berücksichtigung des Vorbringens beider Parteien angemessen und geboten, die Zahl der zugangsberechtigten Mitarbeiter bis zur endgültigen Entscheidung über den Geheimnisschutzantrag auf die sowohl in der Richtlinie (EU) 2016/943 als auch in R. 262A.6 VerfO vorgesehene Mindestzahl und damit auf eine natürliche Person zu beschränken. Die Lokalkammer hat sich dazu entschieden, der Person Zugang zu gewähren, die nach Auskunft der Antragstellerin ihre patentrechtlichen Streitigkeiten maßgeblich koordiniert, in die Abstimmung der Schriftsätze des vorliegenden Verfahrens sowie die rechtliche wie geschäftliche Strategie maßgeblich involviert ist und bei welcher es sich um die zentrale interne Person in der täglichen Bearbeitung der Prozessführung der Antragstellerin handelt. Allein die abstrakte Möglichkeit, dass diese Person möglicherweise an kommerziellen Entscheidungen der Antragstellerin beteiligt ist, rechtfertigt es nicht, ihr den Zugang zu den in Rede stehenden Informationen zu verwehren. Dem Geheimhaltungsinteresse der Antragsgegnerin trägt die mit der Androhung von Zwangsgeldern verbundene Geheimhaltungsanordnung hinreichend Rechnung. Aus diesem Grund sieht die Lokalkammer auch keine Veranlassung, von der Antragstellerin den Nachweis eines von ihr implementierten internen Geheimnisschutzregimes zu fordern. Die von der Antragsgegnerin geforderte Verpflichtung des betreffenden Mitarbeiters, fünf Jahre lang an keinen Lizenzverhandlungen in der Branche der räumlichen Transkriptomatik teilzunehmen, greift unverhältnismäßig in dessen Recht auf Berufsausübung ein und kommt daher nicht in Betracht.
Soweit die Antragsgegnerin sämtlichen Mitarbeitern der Antragstellerin den Zugang zu den (vermeintlich) geheimhaltungsbedürftigen Informationen verwehren will, lässt sich dieses Begehren weder mit Art. 9 der Richtlinie (EU) 2016/943 noch mit R. 262A.6 VerfO in Einklang bringen. Auch wenn die Anzahl der zugangsberechtigten Personen auf das notwendige Maß beschränkt werden soll, bringen beide Normen klar zum Ausdruck, dass der Kreis zugangsberechtigter Personen mindestens eine natürliche Person jeder Partei umfassen muss. Damit soll dem Anspruch auf rechtliches Gehör Rechnung getragen werden (vgl. Münchner Kommentar zum Lauterkeitsrecht, 3. Aufl. 2020, Geheimnisschutz-RL Art. 9, Rz. 18). Dass Art. 58 EPGÜ eine solche Mindestzahl natürlicher Personen nicht kennt, vermag an diesem Befund nichts zu ändern. Wie jedes nationale Gericht hat das Einheitliche Patentgericht den unbedingten Vorrang des Unionsrechts zu beachten (Art. 20 EPGÜ). Daher sind die Normen des EPGÜ richtlinienkonform auszulegen (Kircher in Bopp/Kircher, Handbuch Europäischer Patentprozess, 2. Auflage, § 1 Rz. 23). Im Rahmen der Auslegung von Art. 58 EPGÜ hat deshalb Art. 9 Abs. 2 der Richtlinie (EU) 2016/943 Berücksichtigung zu finden. Auch danach muss der Kreis zugangsberechtigter Personen mindestens eine natürliche Person jeder Partei umfassen. Sieht Art. 58 EPGÜ daher die Möglichkeit der Beschränkung des Zugangs zu Beweismitteln auf bestimmte Personen vor, ist dies richtlinienkonform im Sinne der Notwendigkeit der Gewährung des Zugangs für mindestens eine natürliche Person jeder Partei auszulegen. Im Einklang damit ist auch in dem Art. 58 EPGÜ konkretisierenden R. 262A.6 VerfO eine solche Mindestzahl vorgesehen.
Die von der Antragsgegnerin weiterhin geforderte Beschränkung der Rechtsvertreter der Antragstellerin auf solche, die nicht an anhängigen und dasselbe Rechtsgebiet betreffenden Verfahren vor dem Einheitlichen Patentgericht beteiligt sind, schränkt die Antragstellerin unangemessen in der Wahl ihrer Rechtsvertreter ein. Hinzu kommt, dass auch die anwaltlichen Vertreter der Antragstellerin durch eine solche Anordnung massiv in der Ausübung ihrer beruflichen Tätigkeit behindert würden, ohne dass dies durch überwiegende Interessen auf Antragsgegnerseite gerechtfertigt wäre. Die Antragsgegnerin ist durch die in der Anordnung enthaltene und mit der Androhung von Zwangsmitteln unterlegte Verschwiegenheitsanordnung hinreichend geschützt.
ANORDNUNG:
1. Der Zugang zur ungeschwärzten Fassung des Einspruchsschriftsatzes vom 15. Februar 2024 sowie zur ungeschwärzten Fassung der Anlage CR-3 wird bis zu einer abschließenden Entscheidung über den auf den Schutz vertraulicher Informationen gerichteten Antrag der Antragsgegnerin auf Seiten der Antragstellerin auf folgende Personen beschränkt:

Bis zu einer abschließenden Entscheidung über den Geheimnisschutzantrag der Antragsgegnerin sind die vorgenannten Personen auch gegenüber der Antragstellerin zur Geheimhaltung der in den ungeschwärzten Fassungen der vorgenannten Unterla-gen enthaltenen Informationen verpflichtet.
2. Die von der Antragsgegnerin als vertraulich bezeichneten Informationen sind von den unter Ziffer 1. namentlich genannten Personen bis auf weiteres als geheimhaltungsbedürftig zu behandeln. Sie dürfen nicht außerhalb dieses Gerichtsverfahrens verwendet oder offengelegt werden, es sei denn, sie sind der empfangenden Partei außerhalb dieses Verfahrens zur Kenntnis gelangt. Diese Ausnahme greift allerdings nur dann, wenn diese Informationen von der empfangenden Partei auf nicht vertraulicher Basis aus anderer Quelle als von der Antragsgegnerin oder den mit ihr verbundenen Unternehmen erlangt wurden, vorausgesetzt, diese Quelle ist ihrerseits nicht durch eine Vertraulichkeitsvereinbarung mit der Antragsgegnerin oder den mit ihr verbundenen Unternehmen oder durch eine sonstige Geheimhaltungspflicht gegenüber dieser gebunden.
3. Der Antragstellerin wird aufgegeben, durch geeignete Maßnahmen sicherzustellen, dass die von Herrn … erlangten, dieser Vertraulichkeitsanordnung unterliegenden Informationen vertraulich bleiben und nicht außerhalb dieses Verfahrens verwendet werden. Insbesondere hat die Antragstellerin sicherzustellen, dass die der Geheimhaltungspflicht unterliegenden Informationen bei der Antragstellerin ausschließlich in gesicherten elektronischen Dateien enthalten sind, auf die nur Herr … Zugriff hat. Soweit die der Geheimhaltungspflicht unterliegenden Informationen in den Geschäftsräumen der Antragsgegnerin durch Herrn … gedruckt werden, ist durch geeignete Maßnahmen sicherzustellen, dass ausschließlich Herr … auf diese Ausdrucke Zugriff hat.
4. Bei schuldhafter Zuwiderhandlung gegen diese Anordnung kann das Gericht für jeden Fall der Zuwiderhandlung ein nach den Umständen des Einzelfalls zu bemessendes Zwangsgeld verhängen.
5. Die Sub-Registry der Lokalkammer Düsseldorf wird angewiesen, den unter Ziffer 1. genannten und der Geheimhaltungspflicht unterliegenden Vertretern der Antrag-stellerin die ungeschwärzte Fassung der durch die Antragsgegnerin als geheimhal-tungsbedürftig bezeichneten Dokumente im Case Management System (CMS) freizugeben.
6. Die Antragstellerin erhält Gelegenheit, zum Geheimhaltungsantrag der Antragsgegnerin bis zum 1. März 2024 Stellung zu nehmen. Im Anschluss wird die Antragsgegnerin Gelegenheit erhalten, auf die Stellungnahme der Antragstellerin zu erwidern.

LEADING PRINCIPLES:
1. Pursuant to Rule 262A.4 PTR, the representative of the other parties must be invited to submit written observations before a confidentiality order is issued. However, in the interests of effective protection of confidential information, the requirement to hear the parties before issuing an order only applies to the final confidentiality order and restriction of access. In the interests of effective protection of confidential information in accordance with Directive (EU) 2016/943, access may be further restricted until a final order is issued, namely to the person of the applicant's representative. 2. Therefore, as a rule, a provisional restriction to four legal representatives (two partners and two associates to support them), two patent attorneys and three representatives of the client appears appropriate (UPC_CFI_463/2023 (LK Düsseldorf), order of 14 February 2024), whereby this group of persons may be expanded by two paralegals if necessary.
3. After the group of persons to whom access to the (allegedly) confidential information is granted has been determined in accordance with R. 262.6 sentence 1 VerfO, the group of persons authorised to access the information must not exceed the scope necessary to ensure the rights of the parties to the proceedings to an effective remedy and a fair trial, the group of persons authorised to access the information must always be subject to a case-by-case assessment, taking into account the above considerations, and, if necessary and appropriate, adapted to the requirements of the respective proceedings.

BRIEF STATEMENT OF THE FACTS:
The parties are currently involved in proceedings for interim measures. In a written submission dated 15 February 2024, the respondent filed an application for protection of confidential information contained in the statement of opposition and its annexes.
In the respondent's view, access to the information it has classified as confidential must be restricted. This information is purely commercial and non-technical in nature, meaning that patent attorneys do not need access to it. The scope of the information classified as confidential by the respondent is limited. Furthermore, this information is limited, specific, highly sensitive from a business perspective and of such a nature that the applicant's employees do not need access to it. If an employee of the applicant were to be granted access, they must belong to the legal department and not be involved in commercial decisions. In addition, the applicant must convince the court that it has procedures in place to ensure that access to the information classified as confidential by the respondent is restricted to the persons named. In order to ensure that the information in question is not used outside the present proceedings, the other legal representatives who, in addition to the legal representatives named in the previous proceedings, are granted access to the information in question must not be involved in pending EPG proceedings brought by the applicant in the same field.
In a procedural order dated 16 February 2024, the Düsseldorf Local Chamber initially granted the representative appointed in the proceedings access to the unredacted version of the documents submitted and imposed an obligation of confidentiality, including vis-à-vis the applicant, under threat of a penalty payment. At the same time, the Local Chamber gave the parties the opportunity to submit additional information on the group of persons to whom access should be granted until a final decision on the confidentiality request has been made.
Taking these comments into account, the Local Chamber announced the procedural order now issued by way of a provisional procedural order dated 20 February 2024 and gave the respondent the opportunity to make a final statement on this within a short period of time. The respondent made use of this opportunity.
PLAINTIFFS' CLAIMS:
The defendant requests, pursuant to Article 58 EPGÜ
1. that access to the text in red font in the confidential statement of opposition to the application for provisional measures and in the confidential affidavit of Mr ... (see confidential Annex CR-3) be restricted to a total of no more than four named legal representatives of 10x personally, who undertake not to participate in any licence negotiations in the field of spatial transcription for a period of five years; or
2. alternatively, order that access to the text in red font in the confidential statement of opposition to the application for interim measures and in the confidential affidavit of Mr ... (see confidential Annex CR-3) be restricted to:
i. a maximum of four named legal representatives of 10x personally; and
ii. one named employee of 10x from the legal department who is also not involved in any business decisions; and
iii. in both of the above cases, to persons who undertake not to participate in any licence agreement negotiations in the spatial transcriptomics industry for a period of five years.
The applicant requests
1. until a final decision is made on the application for protection of confidential information, to grant provisional access to the alleged confidential information yet to be identified by the respondent to the lawyers of BARDEHLE PAGENBERG Partnerschaft mbB and to two reliable persons at the applicant, namely Mr ... Vice President Intellectual Property of the applicant, be granted.

REASONS FOR THE ORDER:
According to Article 9(1) and (2)(a) of Directive (EU) 2016/943, in court proceedings, access to documents submitted by the parties or third parties that contain trade secrets or alleged trade secrets may be restricted in whole or in part to a limited number of persons upon request. The protection of confidential information is provided for in Article 58 of the EPGÜ and implemented in Rule 262A of the Rules of Procedure of the Unified Patent Court.
Pursuant to R. 262A.4 VerfO, the representatives of the other parties must be invited to submit written observations before an order is issued. In the interests of effective protection of secrecy, however, the requirement to hear the parties before issuing an order only applies to the final confidentiality order and restriction of access. In the interests of effective protection of secrecy under Directive (EU) 2016/943, however, access may be further restricted until a final order is issued, namely to the person of the claimant's representative. The confidentiality request can be discussed with the party using redacted versions of the documents concerned (UPC_CFI_22/2023 (Local Chamber Hamburg), order of 2 December 2023).
Even if these considerations also apply in principle to proceedings for interim measures, the special features of such proceedings must not be disregarded. As in the main proceedings, the time limits for the parties to submit their observations are not affected by an application for confidentiality. However, extensions of time limits are generally ruled out due to the urgent nature of such proceedings. In addition, the date of the oral hearing is often set at short notice. Against this background, the party affected by a preliminary order for the protection of secrets is forced, despite the restrictions naturally associated with such an order, to prepare its submissions on the merits of the case and, if necessary, to respond to the written pleading containing the (allegedly) confidential information. Since statements in such proceedings must generally be submitted within short deadlines under a strict deadline regime and the oral hearing must also be prepared at short notice, the group of persons required for a fair hearing (R. 262A.6 VerfO) must be selected in such a way that the party affected by the preliminary order for confidentiality is fully able to work and is in a position to comment on every point raised by the opposing party, taking into account the opposing party's interest in confidentiality. In order to take account of the special features of summary proceedings, a provisional restriction to four legal representatives (two partners and two associates to support them), two patent attorneys and three representatives of the client appears appropriate in the normal case (UPC_CFI_463/2023 (LK Düsseldorf), order of 14 February 2024), whereby this group of persons may be expanded by two paralegals if necessary.
Since the group of persons granted access to the (allegedly) confidential information must not exceed the scope necessary to ensure that the parties to the proceedings have an effective legal remedy and a fair trial, the group of persons authorised to access the information must be limited to the persons specified in R. 262.6 sentence 1 VerfO, the group of persons authorised to access the information must not exceed the scope necessary to ensure the rights of the parties to the proceedings to an effective remedy and a fair trial, the group of persons authorised to access the information must always be reviewed on a case-by-case basis, taking into account the above considerations, and, if necessary and appropriate, adapted to the requirements of the respective proceedings.
Applied to the present case, this means that patent attorneys do not need access to the unredacted version of the notice of opposition and its annexes. All information classified by the applicant as confidential is of a commercial and non-technical nature. There are no objections to the applicant's request to extend access on the legal side to three partners and, as compensation, to only one associate. Furthermore, taking into account the submissions of both parties, it appears appropriate and necessary to limit the number of employees with access to the minimum number provided for in both Directive (EU) 2016/943 and R. 262A.6 VerfO, i.e. to one natural person, until a final decision on the request for protection of confidential information has been made. The Local Chamber has decided to grant access to the person who, according to the applicant, is responsible for coordinating its patent disputes, is significantly involved in the coordination of the pleadings in the present proceedings and in the legal and commercial strategy, and is the central internal person responsible for the day-to-day management of the applicant's litigation. The abstract possibility that this person may be involved in commercial decisions of the applicant does not justify denying her access to the information in question. The confidentiality order, which is subject to a penalty payment, takes sufficient account of the respondent's interest in confidentiality. For this reason, the Local Chamber also sees no reason to require the applicant to provide evidence of an internal confidentiality regime implemented by it. The obligation imposed by the respondent on the employee concerned not to participate in any licence negotiations in the spatial transcription industry for a period of five years disproportionately interferes with his right to pursue his profession and is therefore out of the question.
Insofar as the respondent wishes to deny all of the applicant's employees access to the (allegedly) confidential information, this request cannot be reconciled with either Article 9 of Directive (EU) 2016/943 or Rule 262A.6 VerfO. Even if the number of persons authorised to access the information is to be limited to the necessary minimum, both standards clearly state that the group of persons authorised to access the information must include at least one natural person from each party. This is to ensure that the right to a fair hearing is respected (see Munich Commentary on Fair Trading Law, 3rd edition 2020, Trade Secrets Directive, Art. 9, margin note 18). The fact that Art. 58 EPGÜ does not specify such a minimum number of natural persons does not alter this finding. Like any national court, the Unified Patent Court must observe the absolute primacy of Union law (Art. 20 EPGÜ). Therefore, the provisions of the EPGÜ must be interpreted in accordance with the Directive (Kircher in Bopp/Kircher, Handbuch Europäischer Patentprozess, 2nd edition, § 1 margin no. 23). In interpreting Article 58 EPGÜ, Article 9(2) of Directive (EU) 2016/943 must therefore be taken into account. According to this provision, the group of persons entitled to access must also include at least one natural person from each party. If Article 58 EPGÜ therefore provides for the possibility of restricting access to evidence to certain persons, this must be interpreted in accordance with the Directive in the sense that access must be granted to at least one natural person from each party. In line with this, Rule 262A.6 of the Rules of Procedure, which specifies Article 58 EPGÜ, also provides for such a minimum number.
The restriction sought by the respondent, limiting the applicant's legal representatives to those who are not involved in pending proceedings before the Unified Patent Court concerning the same subject matter, unreasonably restricts the applicant's choice of legal representatives. In addition, such an order would also seriously impede the applicant's legal representatives in the exercise of their professional activities without this being justified by overriding interests on the part of the respondent. The respondent is sufficiently protected by the confidentiality order contained in the order and backed by the threat of coercive measures.
ORDER:
1. Access to the unredacted version of the statement of opposition dated 15 February 2024 and to the unredacted version of Annex CR-3 shall be restricted to the following persons on the applicant's side until a final decision has been made on the respondent's application for the protection of confidential information:

Until a final decision has been made on the respondent's application for protection of confidential information, the above-mentioned persons are also obliged to maintain confidentiality towards the applicant with regard to the information contained in the unredacted versions of the above-mentioned documents.
2. The information designated as confidential by the respondent shall be treated as confidential by the persons named in paragraph 1 until further notice. It may not be used or disclosed outside these court proceedings unless it has come to the knowledge of the receiving party outside these proceedings. However, this exception shall only apply if this information has been obtained by the receiving party on a non-confidential basis from a source other than the respondent or its affiliated companies, provided that this source is not itself bound by a confidentiality agreement with the respondent or its affiliated companies or by any other obligation of confidentiality towards them.
3. The applicant is ordered to take appropriate measures to ensure that the information obtained by Mr ... and subject to this confidentiality order remains confidential and is not used outside these proceedings. In particular, the applicant shall ensure that the information subject to the confidentiality obligation is stored at the applicant's premises exclusively in secure electronic files to which only Mr ... has access. Insofar as the information subject to the confidentiality obligation is printed by Mr ... at the respondent's business premises, appropriate measures shall be taken to ensure that only Mr ... has access to these printouts.
4. In the event of a culpable breach of this order, the court may impose a penalty payment to be determined in accordance with the circumstances of the individual case for each instance of the breach.
5. The sub-registry of the Düsseldorf Local Chamber is instructed to release the unredacted version of the documents designated by the respondent as confidential in the Case Management System (CMS) to the representatives of the applicant named in point 1 and subject to the confidentiality obligation.
6. The applicant shall be given the opportunity to comment on the respondent's application for confidentiality by 1 March 2024. The respondent shall then be given the opportunity to respond to the applicant's comments.
