LEITSATZ:
1. Für den Schutz vertraulicher Informationen sieht das Case Management System (CMS) im Rahmen des R. 262A-Workflows ein abgestuftes Verfahren vor, in welchem den Geheimhaltungsinteressen beider Parteien umfassend Rechnung getragen werden kann.
2. Bevor die mit einem Geheimnisschutzantrag eingereichte ungeschwärzte Fassung („unredacted version“) eines Dokuments für die Gegenseite freigegeben wird, eröffnet das CMS dem Berichterstatter innerhalb des vorgenannten Workflows die Möglichkeit, Anordnungen zum vorläufigen Schutz der (vermeintlich) geheimhaltungsbedürftigen Informationen zu treffen.
3. Im Regelfall wird eine solche Anordnung zunächst den Kreis der zugangsberechtigten Personen der Gegenseite bis zur abschließenden Entscheidung über den Geheimnisschutzantrag beschränken. Hält der Berichterstatter ausgehend vom Inhalt eines solchen Antrages ausnahmsweise eine vorläufige Geheimnisschutzanordnung für entbehrlich, hat er die den Geheimnisschutz begehrende Partei vor einer Freigabe der ungeschwärzten Version über seine Auffassung zu informieren. Die zugleich einzuräumende Gelegenheit zur Stellungnahme bietet der betreffenden Partei die Gelegenheit, auf die drohende schutzlose Freigabe der aus ihrer Sicht geheimhaltungsbedürftigen Informationen zu reagieren und sich bei Bedarf auch dahingehend zu erklären, dass die betreffenden Dokumente nicht oder nicht in vollem Umfang zum Gegenstand des Verfahrens gemacht werden sollen.
4. Um dem Gericht eine Entscheidung in Kenntnis des angeblich geheimhaltungsbedürftigen Vortrags zu ermöglichen, sind ihm zusammen mit einem Geheimnisschutzantrag nach R. 262A VerfO stets vollständig ungeschwärzte Fassungen des betreffenden Dokuments vorzulegen. Sämtliche eingereichten Dokumente stehen unter einem vorläufigen Geheimnisschutz.

DARSTELLUNG DES SACHVERHALTS:
Mit Schriftsatz vom 4. Dezember 2023 hat die Antragstellerin einen Antrag auf Anordnung einstweiliger Maßnahmen gegen die Antragsgegnerin gestellt.
Unmittelbar vor Ablauf der Einspruchsfrist (R. 209.1 (a) VerfO) und vor Einreichung der Einspruchsschrift begehrt die Antragsgegnerin die Anordnung von Maßnahmen zum vorläufigen Schutz vertraulicher Informationen.
ANTRÄGE DER PARTEIEN:
Die Antragsgegnerin beantragt,
1. den Zugang zum Text in roter Farbe in der vertraulichen Fassung des Einspruchs gegen den Antrag auf einstweilige Maßnahmen einschließlich der beigefügten Anlagen (zusammen als „die Einspruchsschrift“ bezeichnet), der vertrauliche Geschäftsinformationen der Antragsgegnerin darstellt (die „Vertraulichen Informationen“), bis zum Erlass einer endgültigen Geheimhaltungsanordnung auf die persönlichen Vertreter der Antragstellerin, d.h. Prof. Dr. jur. T.-Müller-Stoy und Dr. jur. M. Drews, zu begrenzen
und
2. die beiden Vertreter der Antragstellerin bis zu diesem Zeitpunkt auch gegenüber ihrer Mandantin, d.h. der Antragstellerin, zur Verschwiegenheit in Bezug auf die vertrauliche Fassung der in der Einspruchsschrift enthaltenen Angaben zu verpflichten.
GRÜNDE DER ANORDNUNG:
Für den Schutz vertraulicher Informationen nach R. 262A VerfO ist im Case Management System (CMS) ein abgestuftes Verfahren implementiert.
Hält die Antragsgegnerin bezüglich bestimmter, in der Einspruchsschrift oder deren Anlagen enthaltener Informationen eine Geheimnisschutzanordnung für geboten, ist es an ihr, zusammen mit der ungeschwärzten Fassung („unredacted version“) auch eine geschwärzte Version („redacted version“) der betreffenden Dokumente im CMS hochzuladen und zugleich über den dafür vorgesehenen Workflow einen Geheimnisschutzantrag nach R. 262A VerfO bezüglich dieser Dokumente zu stellen. Macht sie von dieser Möglichkeit Gebrauch, ist für die Gegenseite zunächst ausschließlich die geschwärzte Version sichtbar, bis die ungeschwärzte Fassung durch die Sub-Registry der Lokalkammer auf explizite Anweisung des Richters hin freigegeben wird.
Vor dieser Freigabe eröffnet das CMS dem Berichterstatter innerhalb des R. 262A-Workflows die Möglichkeit, Anordnungen zum vorläufigen Schutz der (vermeintlich) geheimhaltungsbedürftigen Dokumente zu treffen. In diesem Rahmen hat dieser sowohl den Inhalt der betreffenden Informationen als auch die Begründung des Geheimnisschutzantrages in seine Erwägungen einzubeziehen. Daher muss dem Gericht für seine Entscheidung zwingend eine vollständig ungeschwärzte Fassung und nicht etwa eine redigierte oder teilredigierte Version vorgelegt werden. Im Regelfall wird der Berichterstatter der zunächst einseitigen Einschätzung des Antragstellers zum Geheimnischarakter folgend im Wege einer solchen Anordnung den Kreis der zugangsberechtigten Personen der Gegenseite bis zur abschließenden Entscheidung über den Geheimnisschutzantrag beschränken. In einem ersten Schritt wird das Dokument zunächst nur dem Parteivertreter der Gegenseite freigegeben, soweit der Antragsteller nicht selbst etwa die Freigabe auch an weitere, noch vom gegnerischen Vertreter zu benennende Personen gestattet. Hält der Berichterstatter ausgehend vom Inhalt des Antrages auf Schutz vertraulicher Informationen ausnahmsweise eine solche vorläufige Geheimnisschutzanordnung für entbehrlich, gebieten es bereits die nach Ziffer 5. der Präambel der Verfahrensordnung stets zu wahrenden Grundsätze der Billigkeit und Fairness, die Geheimnisschutz begehrende Partei vor einer Freigabe der ungeschwärzten Fassung zu informieren. Die zugleich einzuräumende Gelegenheit der Stellungnahme bietet der betreffenden Partei die Möglichkeit, auf die drohende schutzlose Freigabe der aus ihrer Sicht geheimhaltungsbedürftigen Informationen zu reagieren und sich bei Bedarf auch dahingehend zu erklären, dass die betreffenden Dokumente nicht oder nicht in vollem Umfang zum Gegenstand des Verfahrens gemacht werden sollen.
Dadurch stehen sämtliche, zusammen mit einem Geheimnisschutzantrag nach R. 262A VerfO eingereichten Dokumente unter einem vorläufigen Geheimnisschutz. Für Geheimnisschutzanordnungen im Vorfeld der Einreichung derartiger vollständig ungeschwärzter Dokumente besteht daher kein Bedürfnis.
ANORDNUNG:
Die Entscheidung über die mit Schriftsatz vom 13. Februar 2024 gestellten Anträge wird zurückge-stellt, bis die Antragsgegnerin ihren Einspruchsschriftsatz eingereicht und einen Antrag auf den Schutz vertraulicher Informationen gestellt hat.
Um das Verfahren nach Eingang der Einspruchsschrift sowie – falls zutreffend – eines entsprechenden Geheimnisschutzantrages zu beschleunigen, wird der Antragsgegnerin aufgegeben, sich in einem eventuellen Geheimnisschutzantrag auch zu dem im Schriftsatz der Antragstellerin vom 14. Februar 2024 (App_8029/2024) genannten Personenkreis zu äußern.
Eine Beschränkung des Personenkreises auf lediglich zwei rechtsanwaltliche Vertreter, wie sie die Antragsgegnerin fordert, dürfte mit dem Interesse der Antragstellerin an einer effektiven Verfahrensführung schon allein vor dem Hintergrund der im Eilverfahren zu wahrenden knappen Fristen und des zeitnahen Termins zur mündlichen Verhandlung nicht zu vereinbaren sein. Um den Besonderheiten des Eilverfahrens Rechnung zu tragen, erscheint bei vorläufiger Bewertung eine Beschränkung auf vier rechtsanwaltliche Vertreter (zwei Partner und zwei Associates zu deren Unterstützung), zwei patentanwaltliche Vertreter sowie drei Vertreter der Mandantin gestattungsfähig zu sein.

LEADING PRINCIPLE:
1. For the protection of confidential information, the Case Management System (CMS) provides for a tiered procedure within the framework of the R. 262A workflow, in which the confidentiality interests of both parties can be fully taken into account.
2. Before the unredacted version of a document submitted with a request for protection of confidential information is disclosed to the other party, the CMS gives the rapporteur the opportunity, within the aforementioned workflow, to issue orders for the provisional protection of the (allegedly) confidential information.
3. As a rule, such an order will initially restrict access to the opposing party's authorised persons until a final decision on the confidentiality request has been made. If, based on the content of such a request, the rapporteur considers a provisional confidentiality order to be unnecessary in exceptional cases, he must inform the party seeking confidentiality of his opinion before releasing the unredacted version. The opportunity to comment, which must be granted at the same time, gives the party concerned the opportunity to respond to the imminent release of information which it considers to be confidential and, if necessary, to state that the documents in question should not be made the subject of the proceedings, or at least not in their entirety.
4. In order to enable the court to make a decision in full knowledge of the allegedly confidential submissions, fully unredacted versions of the relevant document must always be submitted to it together with an application for protection of confidential information pursuant to R. 262A VerfO. All documents submitted are subject to provisional protection of confidential information.

STATEMENT OF THE FACTS:
In a written submission dated 4 December 2023, the applicant filed an application for interim measures against the respondent.
Immediately before the expiry of the objection period (R. 209.1 (a) VerfO) and before filing the statement of objection, the respondent seeks an order for measures to provisionally protect confidential information.
PLAIDS OF THE PARTIES:
The respondent requests
1. to restrict access to the text in red in the confidential version of the opposition to the application for interim measures, including the attached annexes (together referred to as ‘the statement of opposition’), which constitutes confidential business information of the respondent (the ‘Confidential Information’), to the personal representatives of the applicant, i.e. Prof. Dr. jur. T.-Müller-Stoy and Dr. jur. M. Drews,
and
2. to oblige the two representatives of the applicant until that time to maintain confidentiality vis-à-vis their client, i.e. the applicant, with regard to the confidential version of the information contained in the statement of opposition.
REASONS FOR THE ORDER:
A graduated procedure has been implemented in the Case Management System (CMS) for the protection of confidential information pursuant to R. 262A VerfO.
If the respondent considers that certain information contained in the statement of opposition or its annexes requires protection as confidential, it is incumbent upon it to upload a redacted version of the relevant documents to the CMS together with the unredacted version and, at the same time, to submit a request for protection of confidential information pursuant to R. 262A VerfO with regard to these documents. If it makes use of this option, only the redacted version will be visible to the other party until the unredacted version is released by the sub-registry of the local chamber on the explicit instruction of the judge.
Prior to this release, the CMS gives the rapporteur the option within the R. 262A workflow to issue orders for the provisional protection of the (allegedly) confidential documents. In this context, the rapporteur must include both the content of the information in question and the reasons for the confidentiality request in his considerations. Therefore, a completely unredacted version must be submitted to the court for its decision, and not an edited or partially edited version. As a rule, the rapporteur will, following the applicant's initial one-sided assessment of the confidential nature of the information, restrict the circle of persons authorised to access the information on the opposing side by means of such an order until a final decision on the application for protection of confidential information has been made. In a first step, the document will initially only be released to the opposing party's representative, unless the applicant himself permits its release to other persons to be named by the opposing party's representative. If, based on the content of the application for protection of confidential information, the rapporteur exceptionally considers such a provisional confidentiality order to be unnecessary, the principles of fairness and equity, which must always be observed in accordance with section 5 of the preamble to the Rules of Procedure, require that the party seeking confidentiality be informed before the unredacted version is released. The opportunity to comment, which must be granted at the same time, allows the party concerned to respond to the imminent release of information which it considers to be confidential and, if necessary, to state that the documents in question should not be made the subject of the proceedings, or at least not in their entirety.
This means that all documents submitted together with an application for protection of confidential information pursuant to R. 262A VerfO are subject to provisional protection of confidential information. There is therefore no need for orders for protection of confidential information prior to the submission of such completely unredacted documents.
ORDER:
The decision on the applications filed in the written submission of 13 February 2024 is postponed until the respondent has filed its statement of opposition and an application for the protection of confidential information.
In order to expedite the proceedings after receipt of the statement of opposition and, if applicable, a corresponding application for protection of confidential information, the respondent is ordered to comment in any application for protection of confidential information on the group of persons named in the applicant's written submission of 14 February 2024 (App_8029/2024).
A restriction of the group of persons to only two legal representatives, as requested by the respondent, is unlikely to be compatible with the applicant's interest in effective proceedings, particularly in view of the tight deadlines to be observed in the summary proceedings and the short notice given for the oral hearing. In order to take account of the special features of the summary proceedings, a preliminary assessment suggests that a restriction to four legal representatives (two partners and two associates to assist them), two patent attorneys and three representatives of the client appears to be permissible.
