ORDONNANCE
février 2024 à 16h ;
316A.2 RdP ;

PATENT SUBJECT OF THE DISPUTE
Patent no. Owner
EP3404726 Seoul Viosys Co., Ltd

LANGUAGE OF THE PROCEEDINGS: French
ORDER
Having regard to the statement of claim filed on 5 December 2023 by the Korean company SEOUL
VIOSYS Co. Ltd against the French company SAS LASER COMPONENTS,
Having regard to the statement of SAS LASER COMPONENTS dated 17 January 2024, for the purpose of compulsory intervention
by the Korean company PHOTON WAVE Co. Ltd,
Having regard to the observations of SEOUL VIOSYS Co. Ltd made on 29 January 2024.
SAS LASER COMPONENTS is seeking the compulsory intervention of the Korean company PHOTON
WAVE Co. Ltd, which it designates as the supplier of the UV LED chips alleged to be counterfeit,
arguing that if it is found guilty of counterfeiting, it will be entitled to a guarantee from its supplier and will be able to seek recourse against the latter for the damages and costs awarded.
SEOUL VIOSYS Co. Ltd responds that granting the request would be likely to harm
its legitimate interests, in that it would have the effect of prolonging the proceedings,
preventing it from obtaining a judgment within one year and allowing the defendant
to continue selling the products alleged to be counterfeit. Furthermore, the compulsory intervention
is not useful for resolving the counterfeiting and will not enable LASER
COMPONENTS to escape its liability, nor is it necessary, as the Unified Patent Court
does not rule on the liability of third parties brought into the proceedings and the legal guarantee
does not require the seller to be a party to the main proceedings, but only that
the latter be notified within a reasonable time.
Reasons for the decision
Having regard to Rule (R.) 316A of the Rules of Procedure of the Unified Patent Court (Rp) governing
compulsory intervention before the Unified Patent Court,
SAS LASER COMPONENTS, the defendant in the original proceedings, has a right of recourse
against its supplier under Article 43 of the United Nations Convention
on Contracts for the International Sale of Goods (CISG). It has a direct interest in
bring an action against PHOTON WAVE Co. Ltd in the context of the decision to be made in
the infringement proceedings brought against it by SEOUL VIOSYS Co. Ltd, as PHOTON WAVE Co. Ltd is likely to indemnify it for any damages
that may be awarded against it.
It is therefore justified, in accordance with R.316A.1 RdP, that PHOTON WAVE Co. Ltd,
supplier of the allegedly infringing product, even if it refuses to intervene in the case, be bound
by the decision rendered in the infringement action brought against
LASER COMPONENTS.
The argument put forward by SEOUL VIOSYS Co. Ltd to the effect that
compulsory intervention would inevitably have the effect of prolonging the proceedings is not
decisive in that the time limits for the intervener to file a statement of case are
strictly governed by the provisions of R.316A.2 RdP. SEOUL VIOSYS Co. Ltd
cannot invoke the risk of continuation of the alleged acts of infringement, since it
has not requested any provisional measures. Finally, even if the Unified Patent Court
has no jurisdiction over the dispute between the defendant and its supplier, it appears useful and necessary
for the latter to be a party to the proceedings, so that it is bound by the decision to be taken.
The request for the compulsory intervention of PHOTON WAVE Co. Ltd should therefore be granted.
On these grounds,
declare the application for the compulsory intervention of PHOTON WAVE Co. Ltd admissible,
invite the applicant for compulsory intervention to provide the registry with a valid email address
for notification to PHOTON WAVE Co. Ltd, no later than Friday 16 February 2024 at 4 p.m.;
We state that the registry shall notify PHOTON WAVE Co. Ltd as soon as possible of the
application for compulsory intervention against it,
We state that, in the absence of a statement by the party subject to compulsory intervention within the one-month period provided for in R. 316.2 RdP, to oppose the compulsory intervention, or failing its intervention, PHOTON
WAVE Co. Ltd shall be bound by the decision rendered between the original parties in accordance with R.
316A.2 RdP;
Recall that this decision is not subject to appeal in accordance with R. 317 RdP.
Rendered in Paris on 12 February 2024.
