GRÜNDE DER ANORDNUNG:
Die Anordnung einstweiliger Maßnahmen kommt grundsätzlich nur in Betracht, wenn der Rechtsbestand des Streitpatents ausreichend gesichert ist, Art. 62 Abs. 4 EPGÜ i.V.m. R. 211.2 VerfO. Es obliegt daher dem Spruchkörper, sich auf der Grundlage des Vorbringens der Parteien ein hinreichendes Bild über den Rechtsbestand zu verschaffen und insbesondere zu prüfen, ob die gegebenenfalls gegen die Rechtsbeständigkeit des Streitpatents vorgebrachten Einwände geeignet sind, begründete Zweifel an der Rechtsbeständigkeit des Streitpatents hervorzurufen (UPC_CFI_452/2023 (LK Düsseldorf), Anordnung v. 11. Dezember 2023).
Obwohl die Hinzuziehung eines technisch qualifizierten Richters von Amts wegen in der Verfah-rensordnung lediglich in R. 34 VerfO und damit in den Regelungen zum Hauptsacheverfahren Erwähnung findet, räumt Art. 8(5) S. 2 EPGÜ dem Spruchkörper allgemein und damit auch im Eilverfahren das Recht ein, nach Anhörung der Parteien auf eigene Initiative einen solchen Richter hinzuziehen, wenn er dies für angezeigt hält (so auch UPC_CFI_2/2023 (LK München), UPC_CFI_214/2023 (LK Helsinki).
Dies ist vorliegend der Fall.
Das Streitpatent stellt ein „Verfahren zum lokalisierten Nachweis von Nukleinsäuren in einer Zellen umfassenden Gewebeprobe“ sowie einen „Array zur Anwendung in einem solchen Verfahren“ unter Schutz. Es betrifft demnach den Bereich der Gentechnik und damit ein von vornherein technisch anspruchsvolles Gebiet. Die Hinzuziehung eines technisch qualifizierten Richters ist auch bereits zum jetzigen Zeitpunkt sinnvoll und geboten. Eine solche Ergänzung der Richterbank um einen technisch qualifizierten Richter gewährleistet zum einen, dass sich auch dieser Richter bereits frühzeitig in den Fall einarbeiten und dem Berichterstatter dadurch falls erforderlich jederzeit beratend zur Seite stehen kann. Zum anderen bietet sich dadurch die Möglichkeit, einen möglichen Verhandlungstermin im Fall eines Einspruchs bereits im Vorfeld mit dem technisch qualifizierten Richter abzustimmen und so das Verfahren insgesamt erheblich zu beschleunigen.

ANORDNUNG:
Die Präsidentin des Gerichts erster Instanz wird mit Zustimmung der Parteien ersucht, dem Spruchkörper gemäß Art. 18(3) EPGÜ einen zusätzlichen technisch qualifizierten Richter zuzuweisen, der über eine entsprechende Qualifikation und Erfahrung auf dem das Streitpatent betreffenden Gebiet der Technik (Klassifizierung IPC: C12Q) verfügt.

REASONS FOR THE ORDER:
The ordering of provisional measures is generally only possible if the legal status of the contested patent is sufficiently secure, Art. 62(4) EPGÜ in conjunction with R. 211.2 VerfO. It is therefore incumbent upon the decision-making body to form a sufficient picture of the legal status on the basis of the parties' submissions and, in particular, to examine whether the objections raised against the legal validity of the contested patent are capable of giving rise to justified doubts as to the legal validity of the contested patent (UPC_CFI_452/2023 (LK Düsseldorf), order of 11 December 2023).
Although the involvement of a technically qualified judge ex officio is only mentioned in Rule 34 of the Rules of Procedure and thus in the provisions governing the main proceedings, Article 8(5) sentence 2 EPGÜ grants the panel of judges in general, and thus also in summary proceedings, the right to involve such a judge on its own initiative after hearing the parties if it considers this appropriate (see also UPC_CFI_2/2023 (LK Munich), UPC_CFI_214/2023 (LK Helsinki).
This is the case here.
The contested patent protects a ‘method for the localised detection of nucleic acids in a tissue sample comprising cells’ and an ‘array for use in such a method’. It therefore relates to the field of genetic engineering, which is a technically demanding area from the outset. The involvement of a technically qualified judge is also appropriate and necessary at this stage. Adding a technically qualified judge to the bench would ensure that this judge could familiarise themselves with the case at an early stage and thus be available to advise the rapporteur at any time if necessary. It would also make it possible to coordinate a possible hearing date with the technically qualified judge in advance in the event of an appeal, thereby significantly speeding up the proceedings as a whole.

ORDER:
The President of the Court of First Instance is requested, with the consent of the parties, to assign an additional technically qualified judge to the panel in accordance with Article 18(3) EPGÜ who has the relevant qualifications and experience in the field of technology (IPC classification: C12Q) to which the patent in dispute relates.
