Verfahrensanordnung des Gerichts erster Instanz des Einheitlichen Patentgerichts

LEITSÄTZE :
1) Gem. Regel 4.2 VerfO sind die Parteien gehalten, online bereitgestellte amtliche Formulare zu
verwenden. Hierzu zählen auch die unterschiedlichen Workflows. Innerhalb dieser Workflows
sind keine weiteren Anträge zu stellen, die anderen Workflows zugeordnet sind und/oder eine
abweichende Handhabung erfordern.
2) Im Workflow nach Regel 262.2 VerfO kann eine Partei Schutz vor der Kenntnisnahme durch
Dritte beantragen. Mit Eingang des Antrages wird automatisch vorläufiger Schutz bereitgestellt.
Soweit eine dritte Partei Zugang begehrt, wird der Antrag gerichtlich überprüft werden. Dies gilt
auch für den Fall, dass diese Informationen in einer Anordnung oder Entscheidung des Gerichts
enthalten sind. Verfahrensbeteiligt sind die antragstellende Partei sowie der Dritte. Andere
Prozessparteien sind nicht am Verfahren beteiligt.
3) Im Workflow nach Regel 262A VerfO kann eine Partei Schutz für vertrauliche Informationen
gegenüber einer anderen Prozesspartei beantragen. Vor Erlass der Anordnung ist diese andere
Prozesspartei zu hören (Regel 262A.4 VerfO).
4) Der Ausschluss der Öffentlichkeit von der Zwischenanhörung und der mündlichen
Verhandlung ist in Regeln 105.2 und 115 VerfO geregelt. Gesonderte Workflows stehen insoweit
nicht bereit. Mithin sind darauf gerichtete Anträge im Workflow des Hauptverfahrens (hier:
Verletzungsverfahrens) zu stellen.

ANTRÄGE DER KLAGEPARTEI
I. Zum Schutz von Geschäftsgeheimnissen werden die in der Klage vom 1. Juni 2023 grau hinterlegten Informationen sowie die hierzu überreichten und mit dem Hinweis "CONFIDENTIAL" oder geheimhaltungsbedürftig" versehenen Anlagen, Abbildungen und Übersichten, die insgesamt tabellarisch wie folgt zusammengefasst sind, als geheimhaltungsbedürftig eingestuft:

II. Die vorstehend genannten Informationen sind von jedermann, der von ihnen aufgrund seiner Beteiligung an dem vorliegenden Verfahren Kenntnis erhält, streng vertraulich zu behandeln und dürfen nicht außerhalb dieses Verfahrens genutzt oder offengelegt werden, es sei denn, dass von ihnen außerhalb dieses Verfah-
rens Kenntnis erlangt wurde.

III. Die Verpflichtung nach Ziffer II gilt auch nach Abschluss dieses Verfahrens fort, wobei dies nicht gilt, wenn das Gericht der Hauptsache das Vorliegen des streitgegenständlichen Geschäftsgeheimnisses durch rechtskräftiges Urteil verneint hat oder sobald die streitgegenständlichen Informationen für Personen in den Kreisen, die üblicherweise mit solchen Informationen umgehen, bekannt oder ohne Weiteres zugänglich werden.

IV. Der Zugang Dritter zu dem Akteninhalt dieses Verfahrens darf nur derart erfolgen, dass die unter Ziffer I genannten Geschäftsgeheimnisse enthaltenden Ausführungen unkenntlich gemacht werden.

V. Der Abschnitt D. und insbesondere die grau hervorgehobenen Abschnitte der Klage vom 1. Juni 2023 sowie die durch ein "geheimhaltungsbedürftig" oder "CONFIDENTIAL" gekennzeichneten Anlagen, Abbildungen oder Übersichten sind von der Veröffentlichung im Register und jedweder Akteneinsicht durch
Dritte auszuschließen.

VI. Für den Fall der Erörterung dieses Sachvortrages in der Zwischenanhörung und/oder in der mündlichen Verhandlung wird angeordnet

1. die Öffentlichkeit wegen Gefährdung schutzwürdiger Interessen der Parteien für diesen Teil der Zwischenanhörung und/oder der mündlichen Verhandlung auszuschließen;

2. die bei der Zwischenanhörung und/oder mündlichen Verhandlung anwesenden Personen einschließlich der Parteivertreter, der Prozessbevollmächtigten und der zur Mitwirkung an dem Rechtsstreit bestellten Patentanwälte zu verpflichten, Tatsachen, welche die grau hervorgehobenen Ausführungen oder die durch "geheimhaltungsbedürftig" oder "CONFIDENTIAL" gekennzeichneten Anlagen betreffen und die durch die im Verfahren gewechselten Schriftsätze oder die Ausführungen in der mündlichen Verhandlung erstmals zu ihrer Kenntnis gelangen, gegenüber Dritten geheim zu halten, und nur zum Zwecke der Prozessführung im vorliegenden Verfahren zu verwenden

KURZE DARSTELLUNG DES SACHVERHALTS
Die Klagepartei hat am 01.06.2023 eine Verletzungsklage (ACT_459771/2023 UPC_CFI_9/2023) eingereicht. In der Klageschrift stellte sie die oben wiedergegebenen Geheimhaltungsanträge. Mit Schriftsatz vom 27.07.2023 stellte sie im Rahmen eines Workflows betreffend einen Antrag nach Regel 262.2 VerfO (App_556724/2023 UPC_CFI_9/2023) dieselben Anträge.

Mit Verfügung vom 28.09.2023 (ORD_577400/2023 UPC_CFI_9/2023) wurde die Klägerin aufgefordert, den Schriftsatz vom 27.07.2023 erneut hochzuladen, weil er neben Anträgen nach Regel 262.2 VerfO auch Anträge nach Regel 262A VerfO enthält, und für letztere eine vorherige Anhörung der Gegenseite durchzuführen ist. Diese Anhörung ist im Workflow betreffend einen Antrag nach Regel 262.2 nicht möglich, weil dieser Workflow bis zum Vorliegen eines Antrags eines Dritten einseitig geführt wird. Die anderen Prozessparteien sind hieran nicht beteiligt.

Die Klagepartei ist der Anordnung am 29.09.2023 nachgekommen.

Die beklagte Partei hat sich trotz Gelegenheit zur Stellungnahme nicht geäußert. Innerhalb des CMS können Schutzmaßnahmen nur dann zuverlässig bereitgestellt werden, wenn die jeweiligen Workflows gem. Regel 262 bzw. 262A vom Antragsteller eröffnet werden. Innerhalb allgemeiner Anträge oder Anordnungen ist dies nicht gewährleistet.

BEGRÜNDUNG DER ANORDNUNG
1.
Zunächst ist festzustellen, dass die von der Klagepartei gewählte Vorgehensweise nicht vollständig mit Regel 4.2 VerfO vereinbar ist. Hiernach sind die Parteien gehalten, online bereitgestellte amtliche Formulare zu verwenden. Hierzu zählen auch die unterschiedlichen Workflows. Innerhalb dieser Workflows sind keine weiteren Anträge zu stellen, die anderen Workflows zugeordnet sind und/oder eine abweichende Handhabung erfordern. Weiter ist festzustellen, dass sich der Antrag an der nationalen deutschen Praxis des Geheimnisschutzes orientiert, ohne sich mit den abweichenden Rechtsgrundlagen der Verfahrensordnung des Einheitlichen Patentgerichts auseinanderzusetzen.

Im Workflow nach Regel 262.2 VerfO kann eine Partei Schutz vor der Kenntnisnahme durch Dritte beantragen. Mit Eingang des Antrages wird automatisch vorläufiger Schutz bereitgestellt. Soweit eine dritte Partei Zugang begehrt, wird der Antrag gerichtlich überprüft werden. Dies gilt auch für den Fall, dass diese Informationen in einer Anordnung oder Entscheidung des Gerichts enthalten sind. Verfahrensbeteiligt sind die antragstellende Partei sowie der Dritte. Andere Prozessparteien sind nicht am Verfahren beteiligt.

Im Workflow nach Regel 262A VerfO kann eine Partei Schutz für vertrauliche Informationen gegenüber einer anderen Prozesspartei beantragen. Vor Erlass der Anordnung ist diese andere Prozesspartei zu hören (Regel 262A.4 VerfO).

Der Ausschluss der Öffentlichkeit von der Zwischenanhörung und der mündlichen Verhandlung ist in Regeln 105.2 und 115 VerfO geregelt. Gesonderte Workflows stehen insoweit nicht bereit. Mithin sind darauf gerichtete Anträge im Workflow des Hauptverfahrens (hier: Verletzungsverfahrens) zu stellen.

Soweit das Begehren der Klagepartei auf einen Schutz gem. Regel 262.2 VerfO gerichtet ist, ist derzeit nichts weiter veranlasst. Der Schutz wird seit Eingang des Antrages automatisch gewährt.
Sobald ein Dritter Zugang zu den vom Antrag erfassten Informationen begehrt, wird über die
dann gegenläufigen Anträge zu entscheiden sein.

Soweit die Klagepartei gegenüber der beklagten Partei Schutz gem. Regel 262A VerfO begehrt, kann dem Antrag entsprochen werden, sobald ein Workflow nach Regel 262A VerfO von der Klagepartei eröffnet worden ist.

Insoweit ist das Begehren der Klagepartei „sind von jedermann, …, streng vertraulich zu behandeln und dürfen nicht außerhalb dieses Verfahrens genutzt oder offengelegt werden“ dahingehend zu verstehen, dass dies – gerade auch - gegenüber der beklagten Partei angeordnet werden soll.

Regel 262A.1 sieht vor, dass … eine Partei beim Gericht einen Antrag auf Erlass einer Anordnung stellen kann, den Zugriff auf bestimmte in ihren Schriftsätzen enthaltene Informationen oder die Erhebung und Verwendung von Beweisen im Verfahren einzuschränken oder für unzulässig zu erklären. Das o.g. Begehren der Klagepartei stellt demgegenüber insoweit ein Minus dar, als der Zugriff der beklagten Partei physisch ohne weiteres möglich sein soll, soweit dieser Zugriff unter Wahrung der Vertraulichkeit geschieht und die Nutzung auf das hiesige Verfahren beschränkt bleibt.

Das Gericht kann dem Antrag nach Regel 262A.5 VerfO insbesondere dann stattgeben, wenn die von dem Antragsteller angeführten Gründe für die Anordnung das Interesse der anderen Partei an einem uneingeschränkten Zugang zu den betreffenden Informationen oder Beweismitteln beträchtlich überwiegen. Da die beklagte Partei keinerlei Einwände erhoben hat und die Klagepartei den Antrag damit begründet hat, dass antragsgegenständlich Informationen sind, die bereits Gegenstand außergerichtlicher Geheimhaltungsvereinbarungen mit der beklagten Partei bzw. mit Dritten sind, wird dem Antrag, sobald er im richtigen Workflow gestellt worden ist, stattzugeben sein.

Nur wenn der Antrag im richtigen Workflow gestellt wird, kann auch sichergestellt werden, dass innerhalb des CMS die notwendigen Schutzvorkehrungen ergriffen werden.

4. Soweit die Klagepartei den Ausschluss der Öffentlichkeit von der Zwischenanhörung und der
mündlichen Verhandlung beantragt hat, wird hierüber durch den dann handelnden Spruchkörper
befunden werden.

5. Soweit die Anträge auf in einem Urteil enthaltende geheimhaltungsbedürftige Informationen
gerichtet sind, ist zunächst der Erlass des Urteils abzuwarten. Sodann ist - innerhalb einer Karenzfrist von 14 Tagen - ein (weiterer) Antrag gem. Regel 262.2 VerfO unter Beifügung einer geschwärzten Fassung des Urteils zu stellen.

6. Soweit der Antrag darauf gerichtet ist, neben der der beklagten Partei zuzuordnenden Personen weiteren Personen Geheimhaltungsverpflichtungen aufzuerlegen, ist er abzuweisen. Hierzu fehlt die Rechtsgrundlage.

ANORDNUNG
1. Sobald die Klagepartei den Antrag in dem Workflow für 262A stellt, wird angeordnet werden, dass die in der Klage vom 1. Juni 2023 grau hinterlegten Informationen sowie die überreichten und mit dem Hinweis "CONFIDENTIAL" oder "geheimhaltungsbedürftig" versehenen Anlagen, Abbildungen und Übersichten, die insgesamt tabellarisch wie folgt zusammengefasst sind,

von der beklagten Partei streng vertraulich zu behandeln sind und von ihr nicht außerhalb dieses Verfahrens genutzt oder offengelegt werden dürfen, es sei denn, dass von diesen Informationen außerhalb dieses Verfahrens Kenntnis erlangt wurde.

2. Die Verpflichtung nach Ziffer 1 gilt auch nach Abschluss dieses Verfahrens fort, wobei dies nicht gilt, wenn das Gericht die Geheimhaltungsbedürftigkeit dieser Informationen durch rechtskräftige Entscheidung oder Anordnung verneint hat oder sobald die streitgegenständlichen Informationen für Personen in den Kreisen, die üblicherweise mit solchen Informationen umgehen, bekannt oder ohne Weiteres zugänglich werden.

3. Im Übrigen werden die Anträge zurückgewiesen. Eine erneute Befassung zu einem späteren Zeitpunkt bleibt vorbehalten.

4. Die Berufung wird zugelassen.

ANWEISUNGEN AN DIE PARTEIEN UND DIE KANZLEI
1- Die Klagepartei ist gehalten, ihren Antrag betreffend einen Schutz gem. Regel 262A in
dem dafür vorgesehenen Workflow zu stellen.
2- Die Klagepartei ist ferner gehalten, im weiteren Verlauf des Verfahrens die derzeit
verfrüht gestellten Anträge erneut zu stellen.
3- Die Kanzlei hat sicherzustellen, dass Dritten nur im Rahmen einer gerichtlichen
Anordnung nach Regel 262.6 VerfO Zugang zu den antragsgegenständlichen
Informationen gewährt wird.

INFORMATIONEN ÜBER DIE BERUFUNG
Gegen die vorliegende Anordnung kann entweder - durch jede Partei, die ganz oder teilweise in
ihren Anträgen erfolglos war, zusammen mit der Berufung gegen die Endentscheidung des
Gerichts erster Instanz in der Hauptsache Berufung eingelegt werden, oder - nach Zulassung der
Berufung durch das Gericht erster Instanz binnen 15 Tagen nach Zustellung der entsprechenden
Entscheidung Berufung durch jede Partei, die ganz oder teilweise in ihren Anträgen erfolglos war,
eingelegt werden (Art. 73 (2) (b) EPGÜ, Regel 220.2, 224.1 (b) VerfO).

If a third party requests access, the request will be reviewed by the court. This also applies

BRIEF STATEMENT OF THE FACTS

On 1 June 2023, the plaintiff filed an infringement action (ACT_459771/2023 UPC_CFI_9/2023). In the statement of claim, it made the confidentiality requests reproduced above. In a written submission dated 27 July 2023, it made the same requests in the context of a workflow concerning a request under Rule 262.2 of the Rules of Procedure (App_556724/2023 UPC_CFI_9/2023).


By order of 28 September 2023 (ORD_577400/2023 UPC_CFI_9/2023), the plaintiff was requested to re-upload the written submission of 27 July 2023 because it contained requests under Rule 262.2 VerfO as well as requests under Rule 262A VerfO, and for the latter, a prior hearing of the opposing party must be held. This hearing is not possible in the workflow concerning a request under Rule 262.2 because this workflow is conducted unilaterally until a request from a third party is submitted. The other parties to the proceedings are not involved in this.

The plaintiff complied with the order on 29 September 2023.


The defendant did not comment despite being given the opportunity to do so. Within the CMS, protective measures can only be reliably provided if the respective workflows are initiated by the applicant in accordance with Rules 262 and 262A. This is not guaranteed within general applications or orders.
REASONS FOR THE ORDER
1.

Firstly, it should be noted that the approach chosen by the applicant is not entirely compatible with Rule 4.2 of the Rules of Procedure. According to this rule, the parties are required to use official forms provided online. This also includes the various workflows. No further requests that are assigned to other workflows and/or require different handling may be submitted within these workflows. It should also be noted that the application is based on national German practice regarding the protection of secrets, without addressing the different legal bases of the Rules of Procedure of the Unified Patent Court.


In the workflow under Rule 262.2 VerfO, a party may request protection against disclosure to third parties. Upon receipt of the request, provisional protection is automatically granted. If a third party requests access, the request will be reviewed by a court. This also applies if this information is contained in an order or decision of the court. The parties to the proceedings are the requesting party and the third party. Other parties to the proceedings are not involved in the proceedings.

In the workflow under Rule 262A VerfO, a party may request protection for confidential information vis-à-vis another party to the proceedings. Before the order is issued, the other party to the proceedings must be heard (Rule 262A.4 VerfO).


The exclusion of the public from the interim hearing and the oral hearing is governed by Rules 105.2 and 115 VerfO. No separate workflows are available in this respect. Applications to this effect must therefore be made in the workflow for the main proceedings (in this case: infringement proceedings).

Insofar as the plaintiff's request is for protection pursuant to Rule 262.2 VerfO, no further action is currently required. Protection is automatically granted upon receipt of the application.
As soon as a third party requests access to the information covered by the application, a decision must be made on the

contrary applications will then have to be decided upon.

Insofar as the plaintiff seeks protection vis-à-vis the defendant pursuant to Rule 262A VerfO, the application can be granted as soon as a workflow pursuant to Rule 262A VerfO has been initiated by the plaintiff.


In this respect, the plaintiff's request that ‘shall be treated as strictly confidential by everyone ... and may not be used or disclosed outside these proceedings’ is to be understood as meaning that this is to be ordered – in particular – vis-à-vis the defendant.


Rule 262A.1 provides that ... a party may apply to the court for an order restricting access to certain information contained in its pleadings or restricting or prohibiting the taking and use of evidence in the proceedings. The above request of the plaintiff, on the other hand, constitutes a reduction insofar as the defendant should have physical access without further ado, provided that such access is subject to confidentiality and use is restricted to the present proceedings.

The court may grant the request under Rule 262A.5 VerfO in particular if the reasons given by the applicant for the order significantly outweigh the other party's interest in unrestricted access to the information or evidence in question. Since the defendant has not raised any objections and the plaintiff has justified the application on the grounds that the information in question is already subject to out-of-court confidentiality agreements with the defendant or with third parties, the application will be granted as soon as it has been submitted in the correct workflow.


Only if the application is submitted in the correct workflow can it be ensured that the necessary protective measures are taken within the CMS.
4. Insofar as the plaintiff has requested that the public be excluded from the interim hearing and the
oral proceedings, this will be decided by the panel then acting.

5. Insofar as the applications relate to information contained in a judgment that is subject to confidentiality,
the judgment must first be issued. Then, within a grace period of 14 days, a (further) application must be submitted in accordance with Rule 262.2 VerfO, enclosing a redacted version of the judgment.


6. Insofar as the application is directed at imposing confidentiality obligations on persons other than those assigned to the defendant, it must be rejected. There is no legal basis for this.
ORDER

1. As soon as the plaintiff submits the application in the workflow for 262A, it will be ordered that the information highlighted in grey in the statement of claim dated 1 June 2023, as well as the attachments, illustrations and overviews submitted and marked ‘CONFIDENTIAL’ or ‘subject to confidentiality’ , which are summarised in tabular form as follows,

2. The obligation under point 1 shall continue to apply after the conclusion of these proceedings, unless the court has denied the confidentiality of this information by a final decision or order, or as soon as the information in dispute becomes known or readily accessible to persons within the circles that normally deal with such information.


3. In all other respects, the applications are dismissed. The right to refer the matter to the court at a later date is reserved.

4. The right of appeal is reserved.

INSTRUCTIONS TO THE PARTIES AND THE LAW FIRM
1- The plaintiff is required to submit its application for protection pursuant to Rule 262A in
the workflow provided for this purpose.

2- The applicant is also required to resubmit the applications that are currently
premature in the further course of the proceedings.
3- The law firm must ensure that third parties are only granted access to the information that is the subject of the application within the scope of a court order
pursuant to Rule 262.6 VerfO.

INFORMATION ABOUT THE APPEAL
An appeal may be lodged against this order either - by any party that has been unsuccessful in whole or in part in
its claims, together with the appeal against the final decision of the
court of first instance on the main issue, or - after the
appeal has been admitted by the court of first instance, within 15 days of service of the relevant

decision, by any party that has been unsuccessful in whole or in part in its claims
(Art. 73 (2) (b) EPGÜ, Rule 220.2, 224.1 (b) VerfO).
