Anordnung einstweiliger Maßnahmen - Antrag auf Berichtigung der Anordnung
KURZE DARSTELLUNG DES SACHVERHALTS
Am 22. Juni 2023 (Einstellungsdatum in das CMS: 23. Juni 2023) hat die Lokalkammer Düsseldorf der Antragsgegnerin im Wege der Anordnung einstweiliger Maßnahmen unter anderem aufgegeben, im Tenor der Anordnung näher bezeichnete Kombinationsstrukturen aus Fahrradrahmen und Motornabe in Deutschland, den Niederlanden, Frankreich und/oder Italien anzubieten, in Verkehr zu bringen oder zu gebrauchen oder zu den genannten Zwecken einzuführen oder zu besitzen. Das dieser Anordnung zugrundeliegende Verfügungspatent EP 2 456 134 B1 ist in Österreich, der Schweiz, Deutschland, Frankreich, Italien, Liechtenstein und den Niederlanden in Kraft. Aufgrund eines Versehens fand Österreich in der Antragsschrift weder in der Auflistung der Mitgliedsstaaten noch in den Anträgen explizit Erwähnung. Allerdings war das Begehren der Antragstellerin in ihrem Hauptantrag dahingehend formuliert, der Antragsgegnerin das Angebot und den Vertrieb der angegriffenen Ausführungsform in den Vertragsmitgliedsstaaten des Einheitlichen Patentgerichts, sofern das Verfügungspatent dort in Kraft steht, zu verbieten.
ANTRÄGE DER PARTEIEN
Die Antragstellerin beantragt,
I. die Anordnung (Tenor, S. 6 f., Ziffer I.) wie folgt abzuändern (ersuchte Änderung durch Unterstreichung kenntlich gemacht):
Der Antragsgegnerin wird aufgegeben, es zu unterlassen, Kombinationsstrukturen aus Fahrradrahmen und Motornabe,
in Deutschland, den Niederlanden, Frankreich, Österreich und/oder Italien anzubieten, in Verkehr zu bringen oder zu gebrauchen oder zu den genannten Zwecken einzuführen oder zu besitzen, wobei die Kombinationsstruktur umfasst:
einen Fahrradrahmen, beinhaltend eine erste Gabel und eine zweite Gabel, die gegenüberliegend angeordnet sind, wobei die erste Gabel mit einem Durchgangsloch bereitgestellt ist, während die zweite Gabel eine Vertiefung mit einem Innengewindeloch aufweist, das axial dem Durchgangsloch entspricht, und die erste Gabel an ihrer Innenseite, angrenzend an das Durchgangsloch, mit einer Positioniernut bereitgestellt ist; eine Motornabe, die in ihrer Mitte mit einer Muffe bereitgestellt ist, die in Bezug auf ein Positionierende ein Ende aufweist, das dergestalt ist, dass das Positionierende mit der Positioniernut der ersten Gabel eingreifbar und an ihr anschlagbar ist; und eine längliche Welle, die ein vorderes Ende und ein hinteres Ende aufweist, wobei das hintere Ende ein Außengewinde aufweist; die längliche Welle durch das Durchgangsloch der ersten Gabel und die Muffe der Motornabe hierdurch gelangen kann, und wobei das Außengewinde des hinteren Endes entsprechend im Innengewindeloch der zweiten Gabel im Eingriff steht und an ihm befestigt ist.
II. Ferner die Anordnung (Sachverhaltsdarstellung, S. 2) wie folgt abzuändern (ersuchte Änderung durch Unterstreichung kenntlich gemacht):
Das Verfügungspatent steht zum aktuellen Zeitpunkt in Österreich, Deutschland, der Schweiz, Italien, Lichtenstein und den Niederlanden in Kraft.
TATSÄCHLICHE UND RECHTLICHE STREITPUNKTE
Die Antragstellerin ist der Auffassung, bei der fehlenden Nennung von Österreich im Tenor der Anordnung handele es sich um eine offenbare Unrichtigkeit im Sinne von R. 353 VerfO, welche wie beantragt berichtigt werden könne.
GRÜNDE DER ANORDNUNG:
Der zulässige Antrag auf Berichtigung der Anordnung hat in der Sache keinen Erfolg.
I.
Gegen die Zulässigkeit des Berichtigungsantrages bestehen keine Bedenken. Insbesondere wurde dieser, wie von R. 353 VerfO gefordert, binnen eines Monats nach Zustellung der beanstandeten Anordnung gestellt.
Darüber hinaus konnte der Spruchkörper auch in der aus dieser Anordnung ersichtlichen Zusammensetzung entscheiden. Die Entscheidung über einen Berichtigungsantrag nach R. 353 VerfO obliegt dem Gericht, welches die zu korrigierende Anordnung erlassen hat. Die vorgenannte Norm lässt eine Berichtigung nur bei Schreib- und Rechenfehlern sowie offenbaren Unrichtigkeiten in der Entscheidung oder Anordnung zu. Da es sich hierbei um rein formale Korrekturen ohne inhaltliche Prüfung in der Sache handelt, ist es nicht erforderlich, dass der Spruchkörper in derselben Besetzung wie bei Erlass der Anordnung entscheidet.
II.
Jedoch ist der Antrag auf Berichtigung der Anordnung unbegründet.

Gemäß R. 353 VerfO kann das Gericht im Wege der Anordnung nach Anhörung der Parteien Schreib- und Rechenfehler sowie offenbare Unrichtigkeiten in der Entscheidung oder Anordnung berichtigen. Unter Letzteres fallen alle unrichtigen oder unvollständigen Verlautbarungen des vom Gericht eigentlich Gewollten in der Anordnung oder Entscheidung. Die Erklärung des richterlichen Willens in der Entscheidung oder Anordnung muss von der bei der Entscheidungsfindung vorhandenen Willensbildung abweichen.

Diese Voraussetzungen sind vorliegend nicht erfüllt.
a)
Die Anordnung vorläufiger Maßnahmen ist auf der Grundlage der Antragsschrift ergangen. Dort findet Österreich weder in den Anträgen noch in der Begründung explizit Erwähnung. Vielmehr begehrte die Antragstellerin im Rahmen ihres Hilfsantrages den Erlass einer Anordnung einstweiliger Maßnahmen in Bezug auf Deutschland, die Niederlande, Frankreich und Italien. Dem hat das Gericht entsprochen. Es besteht somit offensichtlich keine Abweichung zwischen der tatsächlich getroffenen Anordnung und der bei der Entscheidungsfindung vorhandenen Willensbildung.

b)
Dass die Antragstellerin in ihrem allgemeiner gehaltenen Hauptantrag den Erlass einer einstweiligen Anordnung in Bezug auf alle Mitgliedsstaaten des Einheitlichen Patentgerichts begehrt, in denen das Verfügungspatent in Kraft steht, gibt unter Berücksichtigung des Gesamtinhalts der Antragsschrift zu keiner abweichenden Bewertung Anlass. Eine Gesamtbetrachtung des Vorbringens der Antragstellerin in ihrer Antragsschrift bestätigt vielmehr den vorstehenden Befund. Selbst wenn zu Gunsten der Antragstellerin unterstellt werden kann, dass Österreich auch bei der Nennung der Vertragsmitgliedsstaaten lediglich versehentlich unerwähnt geblieben ist, befasst sich die Antragstellerin auch im Zusammenhang mit der Begründung einer Verletzungshandlung nur mit Deutschland, den Niederlanden, Frankreich und Italien (vgl. Antragsschrift, Rz. 63). Dies lässt keinen anderen Schluss zu, als dass es sich bei der fehlenden Nennung von Österreich in dem der Anordnung zugrundeliegenden Hilfsantrag nicht um ein Schreibversehen handelt, sondern dass sich das in der Antragsschrift zum Ausdruck kommende Begehren trotz des allgemein gehaltenen Hauptantrages ausschließlich auf Deutschland, die Niederlande, Italien und Frankreich bezieht. Eine diese Länder betreffende Anordnung hat das Gericht erlassen, weshalb die Anordnung nicht wie von R. 353 VerfO gefordert offenbar unrichtig ist.

Soweit die Antragstellerin zur Begründung ihres Begehrens auf Art. 34 EPGÜ rekurriert, wirft sie damit letztlich die Frage nach der Reichweite der bereits getroffenen Anordnung ausgehend von den Regelungen des Übereinkommens auf. Die für eine Berichtigung nach R. 353 VerfO erforderliche offenbare Unrichtigkeit der Anordnung im vorgenannten Sinne lässt sich auf dieser Grundlage von vornherein nicht begründen.
ANORDNUNG:
Der Antrag der Antragstellerin, die Anordnung vom 22. Juni 2023 (Einstellung in das CMS: 23. Juni 2023) dahingehend zu berichtigen, dass auch Österreich vom Tenor der Anordnung erfasst ist, wird zurückgewiesen.

Order for interim measures – Application for correction of the order
BRIEF STATEMENT OF THE FACTS
On 22 June 2023 (date of entry into the CMS: 23 June 2023), the Local Chamber of Düsseldorf ordered the respondent, by way of interim measures, inter alia, to refrain from offering, placing on the market or using combination structures consisting of bicycle frames and motor hubs as specified in the operative part of the order in Germany, the Netherlands, France and/or Italy, to place them on the market or to use them or to import or possess them for the aforementioned purposes. The patent underlying this order, EP 2 456 134 B1, is in force in Austria, Switzerland, Germany, France, Italy, Liechtenstein and the Netherlands. Due to an oversight, Austria was not explicitly mentioned in the application, either in the list of Member States or in the claims. However, the applicant's main request was formulated to the effect that the respondent be prohibited from offering and distributing the contested embodiment in the member states of the Unified Patent Court where the patent is in force.
PLAINTIFFS' CLAIMS
The plaintiff requests that
I. the order (operative part, p. 6 et seq., point I) be amended as follows (amendment requested indicated by underlining):
The respondent is ordered to refrain from offering, placing on the market or using combination structures consisting of bicycle frames and motor hubs,
in Germany, the Netherlands, France, Austria and/or Italy, or from importing or possessing them for the aforementioned purposes, whereby the combination structure comprises:
a bicycle frame comprising a first fork and a second fork arranged opposite each other, wherein the first fork is provided with a through hole, while the second fork has a recess with an internal threaded hole axially corresponding to the through hole, and the first fork is provided on its inner side, adjacent to the through hole, with a positioning groove; a motor hub, which is provided in its centre with a sleeve which, with respect to a positioning member, has one end which is such that the positioning member can engage with and abut against the positioning groove of the first fork; and an elongated shaft which has a front end and a rear end, the rear end having a male thread; the elongated shaft being able to pass through the through hole of the first fork and the sleeve of the motor hub, and the male thread of the rear end being correspondingly engaged in the female thread hole of the second fork and fixed thereto.

II. Furthermore, the order (statement of facts, p. 2) is to be amended as follows (requested amendment indicated by underlining):
The patent in suit is currently in force in Austria, Germany, Switzerland, Italy, Liechtenstein and the Netherlands.
FACTUAL AND LEGAL ISSUES
The applicant is of the opinion that the failure to mention Austria in the operative part of the order constitutes an obvious error within the meaning of R. 353 VerfO, which can be corrected as requested.
REASONS FOR THE ORDER:
The admissible application for correction of the order is unsuccessful on the merits.
I.
There are no objections to the admissibility of the application for correction. In particular, it was filed within one month of service of the contested order, as required by R. 353 VerfO.
Furthermore, the panel was able to decide in the composition apparent from this order. The decision on an application for correction pursuant to R. 353 VerfO is incumbent upon the court which issued the order to be corrected. The aforementioned provision only allows corrections in the event of clerical and calculation errors or obvious inaccuracies in the decision or order. As these are purely formal corrections without any review of the substance of the matter, it is not necessary for the panel to decide in the same composition as when the order was issued.
II.
However, the application for correction of the order is unfounded.

Pursuant to R. 353 VerfO, the court may, after hearing the parties, correct clerical and arithmetic errors as well as obvious inaccuracies in the decision or order by way of an order. The latter includes all incorrect or incomplete statements of the court's actual intention in the order or decision.
The statement of the court's intention in the decision or order must differ from the intention formed during the decision-making process.

These requirements are not met in the present case.
a)
The order for provisional measures was issued on the basis of the application. Austria is not explicitly mentioned there, either in the applications or in the grounds. Rather, the applicant sought, in its alternative application, the issuance of an order for provisional measures in relation to Germany, the Netherlands, France and Italy. The court complied with this request. There is therefore clearly no deviation between the order actually issued and the decision-making process.

b)
The fact that the applicant, in its more general main application, seeks the adoption of a provisional measure in relation to all Member States of the Unified Patent Court in which the patent subject to the injunction is in force does not give rise to a different assessment, taking into account the overall content of the application. Rather, an overall assessment of the applicant's submissions in its application confirms the above finding. Even if it can be assumed in favour of the applicant that Austria was merely omitted by mistake when the contracting Member States were listed, the applicant only refers to Germany, the Netherlands, France and Italy in connection with the grounds for infringement (see application, para. 63). This leads to no other conclusion than that the failure to mention Austria in the auxiliary application on which the order is based is not a clerical error, but that the request expressed in the application, despite the general nature of the main application, relates exclusively to Germany, the Netherlands, Italy and France. The court issued an order concerning these countries, which is why the order is not manifestly incorrect as required by Rule 353 of the Rules of Procedure.

Insofar as the applicant refers to Art. 34 EPGÜ in support of its request, it ultimately raises the question of the scope of the order already issued on the basis of the provisions of the Convention. The obvious incorrectness of the order within the meaning of R. 353 VerfO, which is required for a correction, cannot be justified on this basis from the outset.
ORDER:
The applicant's request to correct the order of 22 June 2023 (entered into the CMS on 23 June 2023) to the effect that Austria is also covered by the operative part of the order is rejected.
