LEITSÄTZE:
1. Gemäß R. 262A.6 VerfO darf die Zahl der Personen, denen Zugang zu geheimhaltungs-
bedürftigen Informationen gewährt wird, nicht größer sein als für die Einhaltung des Rechts
der Verfahrensparteien auf einen wirksamen Rechtsbehelf und ein faires Verfahren
erforderlich, wobei der Kreis der Zugangsberechtigten mindestens eine natürliche Person
jeder Partei sowie die jeweiligen Anwälte oder Vertreter umfassen muss.
2. Grundsätzlich obliegt es der jeweiligen Partei, die Personen zu benennen, für die sie Zugang
begehrt. Kommt sie dem nach, kann der Ausschluss einer Person nicht allein damit begrün-
det werden, die benannte Person sei auf dem technischen Gebiet tätig, das mit dem
betreffenden Patent zusammenhängt. Gerade deshalb ist die betreffende Person häufig erst
in der Lage, ihrem Unternehmen und dessen Vertretern die für eine wirksame Rechtsverfol-
gung erforderlichen Informationen zu liefern. Die als vertraulich eingestuften Informationen
sind trotz eines solchen Zugangs nicht ungeschützt. Auch wenn die betroffenen Personen
Zugang zu den betreffenden Informationen haben, müssen sie die ihnen auferlegten Ge-
heimhaltungspflichten beachten, die falls notwendig über die Verhängung von Zwangsgel-
dern durchgesetzt oder nach nationalem Recht vollstreckt werden können.
4. Nachdem der Personenkreis, welchem Zugang zu den (vermeintlich) geheimhaltungsbedürf-
tigen Informationen gewährt wird, den für die Einhaltung des Rechts der Verfahrensbeteilig-
ten auf einen wirksamen Rechtsbehelf und ein faires Verfahren notwendigen Umfang nicht
überschreiten darf, ist der Kreis der zugangsberechtigten Personen stets einer Einzelfallprü-
fung zu unterziehen und, falls notwendig und geboten, an die Anforderungen des jeweiligen
Verfahrens anzupassen.

KURZE DARSTELLUNG DES SACHVERHALTS:
Die Parteien stehen sich derzeit in einem Verfahren auf Anordnung einstweiliger Maßnahmen ge-
genüber. Mit Schriftsatz vom 15. Februar 2024 hat die Antragsgegnerin einen Antrag auf Schutz
vertraulicher, in der Einspruchsschrift nebst Anlagen enthaltener Informationen gestellt.
Nach Auffassung der Antragsgegnerin ist der Zugang zu den durch sie als vertraulich eingestuften
Informationen zu beschränken. Diese seien rein kommerzieller und nichttechnischer Natur, so dass
Patentanwälte keinen Zugang zu diesen Informationen benötigten. Der Umfang der von der
Antragsgegnerin als vertraulich eingestuften Informationen sei gering. Auch seien diese Informa-
tionen begrenzt, spezifisch, geschäftlich hochsensibel und so beschaffen, dass Mitarbeiter der
Antragstellerin keinen Zugang benötigten. Falls ein Mitarbeiter der Antragstellerin Zugang erhalte,
müsse dieser der Rechtsabteilung angehören und dürfe nicht an kommerziellen Entscheidungen
beteiligt sein. Darüber hinaus müsse die Antragstellerin das Gericht davon überzeugen, dass sie
über Verfahren verfüge, die sicherstellen, dass der Zugang zu den von der Antragsgegnerin als
vertraulich eingestuften Informationen auf die namentlich benannten Personen beschränkt sei.
Um sicherzustellen, dass die betreffenden Informationen nicht außerhalb des vorliegenden Ver-
fahrens verwendet werden, dürften die weiteren Rechtsvertreter, die zusätzlich zu den im bisheri-
gen Verfahren benannten rechtsanwaltlichen Vertretern Zugang zu den betreffenden Informa-
tionen erhalten, nicht an anhängigen EPG-Verfahren beteiligt sein, die von der Antragstellerin auf
demselben Gebiet geführt werden.
Mit einer Verfahrensanordnung vom 16. Februar 2024 hat die Lokalkammer Düsseldorf zunächst
den bisher im Verfahren benannten Verfahrensbevollmächtigten Zugang zur ungeschwärzten
Fassung der vorgelegten Dokumente gewährt und diese unter Androhung von Zwangsgeldern zur
Geheimhaltung – auch gegenüber der Antragstellerin – verpflichtet. Zugleich hat die Lokalkammer
den Parteien Gelegenheit dazu gegeben, ergänzend zu dem Personenkreis vorzutragen, dem bis
zur endgültigen Entscheidung über den Geheimhaltungsantrag Zugang gewährt werden soll. Mit
Anordnung vom 23. Februar 2024 hat die Lokalkammer Düsseldorf den Kreis der Zugangsberech-
tigten nach Anhörung der Parteien auf insgesamt vier rechtsanwaltliche Vertreter, zwei Rechtsan-
waltsfachangestellte und einen Mitarbeiter der Antragstellerin erweitert und der Antragstellerin
zugleich Gelegenheit gegeben, zum Geheimhaltungsantrag der Antragsgegnerin Stellung zu
nehmen.
ANTRÄGE DER PARTEIEN:
Die Antragsgegnerin beantragt,
1. anzuordnen, dass der Zugang zu dem in roter Schriftfarbe gehaltenen Text in der
vertraulichen Einspruchsschrift gegen den Antrag auf vorläufige Maßnahmen und in
der vertraulichen eidesstattlichen Erklärung von Herrn … (siehe vertrauliche Anlage CR-
3) auf insgesamt höchstens vier namentlich bekannte Rechtsvertreter von 10x
persönlich beschränkt wird, die sich verpflichten, 5 Jahre lang an keinen
Lizenzverhandlungen im Bereich der räumlichen Transkriptomatik teilzunehmen; oder
2. hilfsweise anzuordnen, dass der Zugang zu dem in roter Schriftfarbe gehaltenen Text
in der vertraulichen Einspruchsschrift gegen den Antrag auf vorläufige Maßnahmen
und in der vertraulichen eidesstattlichen Erklärung von Herrn … (siehe vertrauliche
Anlage CR-3) beschränkt ist auf:
i. insgesamt höchstens vier namentlich genannte Rechtsvertreter von 10x
persönlich; und
ii. einen namentlich genannten Mitarbeiter von 10x aus der Rechtsabteilung, der
ebenfalls an keinen geschäftlichen Entscheidungen beteiligt ist; und
iii. in beiden vorgenannten Fällen auf Personen, die sich verpflichten, 5 Jahre lang
an keinen Lizenzvertragsverhandlungen in der Branche der räumlichen
Transkriptomatik teilzunehmen.
Die Antragstellerin beantragt,
Zugang zu den von der Antragsgegnerin als vertraulich bezeichneten Informationen
zumindest für den Personenkreis gemäß Anordnung zu Ziffer 1. der Verfahrensanordnung vom 23. Februar 2024 zu gewähren.
Darüber hinaus stellt es die Antragstellerin in das Ermessen des Gerichts zusätzlich in den Kreis der
bereits gemäß Verfahrensanordnung vom 23. Februar 2024 zugangsberechtigten Personen
folgende Personen aufzunehmen:
RAin und Vertreterin vor dem EPG Dr. …,
PA, European Patent Attorney und Vertreter vor dem EPG Dr. …,
European Patent Attorney Dr. …,
sowie zwei weitere zuverlässige Personen bei der Antragstellerin, namentlich
Herrn …, Chief Legal Officer der Antragstellerin,
…, Senior Director Intellectual Property der Antragstellerin.
GRÜNDE DER ANORDNUNG:
Der auf den Schutz von Geschäftsgeheimnissen und sonstiger vertraulicher Informationen gerich-
tete Antrag ist zulässig und hat im tenorierten Umfang Erfolg.
I.
Gegen die Zulässigkeit des Antrages bestehen keine Bedenken.
1.
Nach Art. 9 Abs. 1 und 2 lit. a) der Richtlinie (EU) 2016/943 ist vorgesehen, dass in einem gericht-
lichen Verfahren auf Antrag der Zugang zu von den Parteien oder Dritten vorgelegten Dokumen-
ten, die Geschäftsgeheimnisse oder angebliche Geschäftsgeheimnisse enthalten, ganz oder teil-
weise auf eine begrenzte Anzahl von Personen beschränkt werden kann. Der Schutz vertraulicher
Informationen ist im EPGÜ in Artikel 58 vorgesehen und in der Verfahrensordnung des Einheit-
lichen Patentgerichts in Regel 262A implementiert (vgl. UPC_CFI_54/2023 (LK Hamburg), Anord-
nung v. 3. November 2023).
2.
Die durch R. 262A.2 und .3 VerfO normierten formellen Anforderungen sind gewahrt. Auch wurden
die Vertreter der Antragstellerin, wie von R. 262A.4 VerfO gefordert, vor dem Erlass der Schutzan-
ordnung gehört. Sie haben von der ihnen eingeräumten Möglichkeit zur Stellungnahme Gebrauch
gemacht.
II.
Dass es sich bei den durch die Antragsgegnerin als geheimhaltungsbedürftig eingestuften Informa-
tionen um Geschäftsgeheimnisse oder zumindest sonstige vertrauliche Informationen handelt, hat
die Antragstellerin nicht im Einzelnen in Abrede gestellt. Von einer Schutzbedürftigkeit der in Rede
stehenden Informationen ist daher auszugehen. Der Zugang zu den betroffenen Informationen
war daher gemäß R. 262A.6 VerfO auf bestimmte Personen zu beschränken.

Grundsätzlich obliegt es der jeweiligen Partei, die Personen zu benennen, deren Zugang sie be-
gehrt. Um den Besonderheiten des Eilverfahrens Rechnung zu tragen, ist im Regelfall eine Be-
schränkung auf vier rechtsanwaltliche Vertreter (zwei Partner und zwei Associates zu deren Unterstützung), zwei patentanwaltliche Vertreter sowie drei Vertreter der Mandantin gestattungs-
fähig (UPC_CFI_463/2023 (LK Düsseldorf), Verfahrensanordnung v. 14. Februar 2024), wobei die-
ser Personenkreis bei Bedarf um zwei Rechtsanwaltsfachangestellte erweitert werden kann
(UPC_CFI_463/2024 (LK Düsseldorf), Verfahrensanordnung v. 23.02.2024).

Hat eine Partei von ihrem Vorschlagsrecht Gebrauch gemacht, kann der Ausschluss einer Person
nicht allein damit begründet werden, diese sei auf dem technischen Gebiet tätig, das mit dem
betreffenden Patent zusammenhängt. Gerade wegen dieser Sachnähe ist die betreffende Person
häufig erst in der Lage, ihrem Unternehmen und dessen Vertretern die für eine wirksame Rechts-
verfolgung erforderlichen Informationen zu liefern. Dies bedeutet nicht, dass die als vertraulich
eingestuften Informationen ungeschützt wären. Auch wenn die betroffene Person Zugang zu den
betreffenden Informationen hat, muss sie die ihr auferlegten Geheimhaltungspflichten beachten,
die falls notwendig über die Verhängung von Zwangsgeldern durchgesetzt oder nach nationalem
Recht vollstreckt werden können (UPC_CFI_355/2023 (LK Düsseldorf), Verfahrensanordnung v. 26.
Februar 2024; vgl. auch Tilmann/Plassmann/v. Falck/Stoll, EPGVerfO R. 262A, Rz. 19 f.).

Nachdem der Personenkreis, welchem Zugang zu den (vermeintlich) geheimhaltungsbedürftigen
Informationen gewährt wird, gemäß R. 262.6 S. 1 VerfO den für die Einhaltung des Rechts der
Verfahrensbeteiligten auf einen wirksamen Rechtsbehelf und ein faires Verfahren notwendigen
Umfang nicht überschreiten darf, ist der Kreis der zugangsberechtigten Personen gleichwohl stets
einer Einzelfallprüfung zu unterziehen und, falls notwendig und geboten, an die Anforderungen
des jeweiligen Verfahrens anzupassen (UPC_CFI_463/2023 (LK Düsseldorf), Anordnung v. 23.
Februar 2024).
a)
Auf den vorliegenden Fall gewendet bedeutet dies, dass Patentanwälte keinen Zugang zur unge-
schwärzten Version der Einspruchsschrift nebst Anlagen benötigen. Sämtliche von der Antrags-
gegnerin als geheimhaltungsbedürftig eingestuften Informationen sind kommerzieller und nicht-
technischer Natur. Darüber hinaus erscheint es unter Berücksichtigung des weiteren Vorbringens
beider Parteien angemessen und geboten, die Zahl der zugangsberechtigten Mitarbeiter auch
weiterhin auf die sowohl in der Richtlinie (EU) 2016/943 als auch in R. 262A.6 VerfO vorgesehene
Mindestzahl und damit auf eine natürliche Person zu beschränken.
b)
Soweit die Antragstellerin angeregt hat, den Zugang auf zwei weitere Mitarbeiter der Antragstel-
lerin zu erstrecken, hat sie sich mit den durch die Antragsgegnerin im Hinblick auf diese Mitarbei-
terin geäußerten Bedenken nicht auseinandergesetzt. Ebenso wenig hat sie im Einzelnen dazu vor-
getragen, weshalb diesen Mitarbeitern trotz dieser Bedenken Zugang gewährt werden soll. Vor
diesem Hintergrund besteht kein Anlass, den Kreis der Zugangsberechtigten zu erweitern.
ANORDNUNG:
1. Der Zugang zur ungeschwärzten Fassung des Einspruchsschriftsatzes vom 15. Februar
2024 sowie zur ungeschwärzten Fassung der Anlage CR-3 wird auf Seiten der
Antragstellerin auf folgende Personen beschränkt:
Rechtsanwalt und Vertreter vor dem EPG Prof. Dr. …;
Rechtsanwalt und Vertreter vor dem EPG Dr. …;
Rechtsanwalt und Vertreter vor dem EPG Dr. …;
Rechtanwältin und Vertreterin vor dem EPG … LL.M.;
Rechtsanwaltsfachangestellte …;
Rechtsanwaltsfachangestellte …;
Herr …, Vice President Intellectual Property der Antragstellerin.
Die vorgenannten Personen sind auch gegenüber der Antragstellerin zur Geheim-
haltung der in den ungeschwärzten Fassungen der vorgenannten Unterlagen enthalte-
nen Informationen verpflichtet.
2. Die von der Antragsgegnerin als vertraulich bezeichneten Informationen sind von den
unter Ziffer 1. namentlich genannten Personen als geheimhaltungsbedürftig zu behan-
deln. Sie dürfen nicht außerhalb dieses Gerichtsverfahrens verwendet oder offengelegt
werden, es sei denn, sie sind der empfangenden Partei außerhalb dieses Verfahrens
zur Kenntnis gelangt. Diese Ausnahme greift allerdings nur dann, wenn diese Informa-
tionen von der empfangenden Partei auf nicht vertraulicher Basis aus anderer Quelle
als von der Antragsgegnerin oder den mit ihr verbundenen Unternehmen erlangt
wurden, vorausgesetzt, diese Quelle ist ihrerseits nicht durch eine Vertraulichkeitsver-
einbarung mit der Antragsgegnerin oder den mit ihr verbundenen Unternehmen oder
durch eine sonstige Geheimhaltungspflicht gegenüber dieser gebunden.
3. Der Antragstellerin wird aufgegeben, durch geeignete Maßnahmen sicherzustellen,
dass die von Herrn … erlangten, dieser Vertraulichkeitsanordnung unterliegenden
Informationen vertraulich bleiben und nicht außerhalb dieses Verfahrens verwendet
werden. Insbesondere hat die Antragstellerin sicherzustellen, dass die der Geheimhal-
tungspflicht unterliegenden Informationen bei der Antragstellerin ausschließlich in ge-
sicherten elektronischen Dateien enthalten sind, auf die nur Herr … Zugriff hat. Soweit
die der Geheimhaltungspflicht unterliegenden Informationen in den Geschäftsräumen
der Antragsgegnerin durch Herrn … gedruckt werden, ist durch geeignete Maßnahmen
sicherzustellen, dass ausschließlich Herr … auf diese Ausdrucke Zugriff hat.
4. Bei schuldhafter Zuwiderhandlung gegen diese Anordnung kann das Gericht für jeden
Fall der Zuwiderhandlung ein nach den Umständen des Einzelfalls zu bemessendes
Zwangsgeld verhängen.
5. Im Übrigen wird der auf den Schutz vertraulicher Informationen gerichtete Antrag der
Antragsgegnerin vom 15. Februar 2024 zurückgewiesen.

BRIEF STATEMENT OF THE FACTS:
The parties are currently involved in proceedings for interim measures.
In a written submission dated 15 February 2024, the respondent filed an application for protection of confidential information contained in the statement of opposition and its annexes.
In its response, the respondent requested that access to the information classified as confidential by the respondent be restricted.

patent attorneys do not need access to it. The scope of the information classified as confidential by the

REASONS FOR THE ORDER:
The application for the protection of trade secrets and other confidential information
is admissible and successful to the extent stated in the operative part.
I.
There are no objections to the admissibility of the application.

According to Article 9(1) and (2)(a) of Directive (EU) 2016/943, it is provided that, in court proceedings,
upon request, access to documents submitted by the parties or third parties
containing trade secrets or alleged trade secrets may be restricted in whole or in part
or to a limited number of persons. The protection of confidential
information is provided for in Article 58 of the EPGÜ and implemented in Rule 262A of the Rules of Procedure of the Unified Patent Court
(see UPC_CFI_54/2023 (LK Hamburg), order of 3 November 2023).

The formal requirements laid down in Rules 262A(2) and (3) of the Rules of Procedure have been complied with. Furthermore,
the applicant's representatives were heard before the protective order was issued, as required by Rule 262A(4) of the Rules of Procedure.
They made use of the opportunity granted to them to submit their observations.
II.
The applicant has not disputed in detail that the information classified as confidential by the respondent
constitutes trade secrets or at least other confidential information.
It must therefore be assumed that the information in question is in need of protection. Access to the information concerned
must therefore be restricted to certain persons in accordance with Rule 262A(6) VerfO. 1. In principle, it is for the respective party to designate the persons whose access it seeks to restrict.

If a party has exercised its right of nomination, the exclusion of a person
cannot be justified solely on the grounds that they are active in the technical field related to the
the patent in question. It is precisely because of this proximity to the subject matter that the person concerned is
often in a position to provide their company and its representatives with the information necessary for effective legal
proceedings. This does not mean that the information classified as confidential
is unprotected. Even if the person concerned has access to the
relevant information, they must comply with the confidentiality obligations imposed on them,
which, if necessary, can be enforced by the imposition of penalty payments or enforced under national
law (UPC_CFI_355/2023 (LK Düsseldorf), procedural order of 26 February 2024; see also Tilmann/Plassmann/v. Falck/Stoll, EPGVerfO R. 262A, para. 19 et seq.).

After the group of persons to whom access to the (allegedly) confidential information is granted

Applied to the present case, this means that patent attorneys do not need access to the unredacted
version of the notice of opposition and its annexes. All information classified by the respondent as confidential

Furthermore, taking into account the further submissions of both parties, it appears appropriate and necessary to limit the number of employees with access to the documents to those who are necessary for the proper performance of their duties.

Insofar as the applicant suggested extending access to two further employees of the applicant

this background, there is no reason to extend the circle of persons entitled to access.
ORDER:
1. Access to the unredacted version of the statement of objection dated 15 February
2024 and to the unredacted version of Annex CR-3 is restricted on the part of the
applicant to the following persons:
